**Today's Halacha is dedicated f or the refuah and haslacha of Ronnie, Sharon, Eli and all the children of CARE** During the spring and summer months, many people have the custom to accept Shabbat and recite Arbit before sundown on Friday afternoon. The question arises as to whether a person who follows this practice may count Friday's counting of Sefirat Ha'omer after he recited Arbit. Suppose the individual completed Arbit some 30 minutes or so before sundown, and then he remembered that he did not count the Omer on Thursday night or during the day on Friday. On the one hand, we might contend that since the sun has not set, the day has not ended and he may therefore still count Friday's counting. On the other hand, he had already prayed the Friday night Arbit service and accepted the onset of Shabbat, effectively declaring that Friday had ended and Shabbat has already begun. Perhaps, then, he can no longer count Friday's counting. The Zera Emet (work of responsa by Rabbi Yishmael Ha'kohen of Modona, Italy, 19th century) addressed this question and ruled that a person in such a case should count the Omer before sundown without reciting a Beracha. Then, that night, he may count as usual with a Beracha. He compares this case to the Halacha cited in the Shulhan Aruch from the Terumat Ha'deshen (work by Rabbi Yisrael Isserlin, 1390-1460) regarding a person who cannot remember whether or not he counted on one of the days of the Omer. The Shulhan Aruch rules that such a person may continue counting with a Beracha, despite the possibility that he had missed a day of counting. (If a person knows definitively that he missed a day of counting, he can no longer count with a Beracha.) The Zera Emet extends this ruling to the case described above. After a person recited Arbit before sundown on Friday, it is uncertain whether or not he may still count the Omer. Therefore, he should count without a Beracha, and then his situation is no different than that of a person who simply cannot remember whether or not he counted on a given day. As such, he may resume counting with a Beracha after dark on Friday night. This is the view accepted by Hacham Ovadia Yosef, in his work Yabia Omer (vol. 4). Summary: If a person recited Arbit before sundown on Friday, and then realized that he had not counted the Omer that day, he should count before sundown without reciting a Beracha. He may then resume counting with a Beracha, as usual, that night.

If three people ate together, and two of them forgot that they needed to conduct a Zimun, and recited the first three words of Birkat Ha'mazon – "Baruch Ata Hashem" – before realizing their mistake, it is questionable whether or not they should continue reciting Birkat Ha'mazon. Seemingly, they should be able to correct their mistake by reciting the words "Lamedeni Hukecha," such that they would have recited the complete verse in Tehillim, "Baruch Ata Hashem Lamedeni Hukecha." This strategy is used when a person begins reciting a Beracha which he is not supposed to recite, and realizes his mistake after reciting the words "Baruch Ata Hashem." In order to avoid reciting a "Beracha Le'batala" (Beracha in vain), he should recite the words "Lamedeni Hukecha" so that he will have recited a verse from Tehillim, and not an unwarranted Beracha. It would appear that this strategy can also be used by people who mistakenly began reciting Birkat Ha'mazon before a Zimun. They can, seemingly, correct their mistake by reciting "Lamedeni Hukecha" so that they will not be considered as having begun Birkat Ha'mazon, and thus a Zimun can still be recited. However, the validity of this course of action depends on a question raised – and left unresolved – by the Ben Ish Hai (Rav Yosef Haim of Baghdad, 1833-1909), in Parashat Vayakhel. He addresses the case of one who began reciting the Amida for Minha, and after reciting the first three words – "Baruch Ata Hashem" – he heard Kaddish being recited. The question becomes whether he should recite "Lamedeni Hukecha" so that he will be considered as having not yet begun the Amida and thus can respond to Kaddish. While at first there seems to be no reason not to allow this, the Ben Ish Hai is uncertain, as it is possible that the recitation of "Lamedeni Hukecha" was instituted as a solution only to avoid a "Beracha Le'batala." In a case where there is no "Beracha Le'batala" at stake, and one wants to discontinue the Beracha he had begun so that he can perform a different Misva – such as answering Kaddish – it is questionable whether it is proper to discontinue one's Beracha by reciting "Lamedeni Hukecha." (The Ben Ish Hai does say, however, that if one heard Kaddish after reciting "Adon-nai Sefatai Tiftah…" before beginning "Baruch Ata Hashem," then he can answer Kaddish and then begin the Amida anew afterward.) This question of the Ben Ish Hai is relevant also in the case of people who began reciting Birkat Ha'mazon and then realized that they need to recite a Zimun. It is uncertain whether they should recite "Lamedeni Hukecha" so a Zimun can be recited, or simply continue with Birkat Ha'mazon without a Zimun. Summary: If people began reciting Birkat Ha'mazon without conducting a Zimun, and they realized their mistake after reciting the words "Baruch Ata Hashem," it is uncertain whether they should discontinue Birkat Ha'mazon by reciting the words "Lamedeni Hukecha," or simply continue with Birkat Ha'mazon without a Zimun.

There is an obligation to recite the entire Hallel service on each of the eight days of Hanukah. This obligation applies regardless of whether one prays privately or with a Minyan; in either case, one is required to recite Hallel. Before reciting Hallel, one recites the Beracha, "…Asher Kideshanu Be'misvotav Ve'sivanu Li'gmor Et Ha'Hallel," and after the recitation, one recites the concluding Beracha of "Yehalelucha." If one mistakenly recited the "half-Hallel" on Hanukah – meaning, he omitted the sections of Hallel that are not recited during Hallel on Rosh Hodesh – then he must repeat the Hallel. However, he does not recite a Beracha before or after his repetition of Hallel. Women are exempt from the obligation of Hallel. Even though they are included in the obligation of the Hanukah candle lighting, they are nevertheless exempt from the Hallel obligation, just as they are not required to recite Hallel on the Yamim Tobim (Pesah, Shavuot and Sukkot). A woman who wishes to recite the complete Hallel on Hanukah may certainly do so, but she should not recite the Berachot before or after the Hallel. One may not make any interruptions during the recitation of Hallel. One should not speak at all during Hallel, or use any gadgets – such as cell phones or Tablets – during Hallel. (Of course, one should not be using these gadgets at any point during the prayer service, as this is very disrespectful to the service.) However, if a person hears somebody recite a Beracha while he recites Hallel, he should answer "Amen" to the Beracha. Likewise, one may respond to Kaddish, Kedusha or Barechu during the Hallel recitation. It occasionally happens that the congregation completes Hallel and the Hazzan begins Kaddish before some congregants completed Hallel. They may interrupt their recitation of Hallel in order to answer to Kaddish. It is interesting to note that there is a verse in the Torah which alludes to the twenty-one days when we recite the complete Hallel. The Torah writes that before the flood, "Shenayim Shenayim Ba'u El Noah" ("two of each [animal] came to Noah" – Bereshit 7:9). The first word, "Shenayim" ("two"), alludes to the first two days of Pesah, when Diaspora communities recite the complete Hallel (as opposed to the other days of Pesah, when the half-Hallel is recited). The second "Shenayim" alludes to the two days of Shabuot, and the word "Ba'u" ("they came") has the numerical value of nine, referring to the nine days of Sukkot, Shemini Aseret and Simhat Torah. Finally, Noah's name in the phrase "El Noah" may be read as an acronym for the phrase "Ner Hanukah," thus alluding to the eight days of Hanukah, when we recite the full Hallel. Summary: Men are obligated to recite the complete Hallel on each day of Hanukah; women who wish to recite Hallel may do so, but without the Berachot. One who mistakenly recited "half-Hallel" on Hanukah must recite the whole Hallel, but without the Berachot. One may not make any interruptions during the Hallel recitation, except to answer "Amen" to a Beracha, or to respond to Kaddish, Kedusha or Barechu.

Since fruits grow on trees which grow from the ground, the Beracha of "Ha'adama" is appropriate for fruits, even though of course one is supposed to recite "Ha'etz" over fruits. Therefore, after the fact, one has fulfilled his obligation if he recited "Ha'adama" over a product requiring "Ha'etz." It is unclear whether a person who recited "Ha'adama" in such a case and then immediately realized his mistake should correct himself, or just eat the fruit. Some contend that since the Beracha of "Ha'adama" suffices after the fact, there is no need for the person in this case to correct himself. Others, however, argue that the person should correct himself in order to recite the Beracha that is supposed to be recited. This question has not been definitively resolved one way or the other. In a case where one mistakenly recited "Ha'adama" over a fruit, the Beracha covers all foods on the table that require "Ha'adama." Thus, for example, if a person recited "Ha'adama" over an apple, and there are vegetables on the table, then he does not have to recite "Ha'adama" a second time over the vegetables. Although his Beracha of "Ha'adama" was recited by mistake, nevertheless, it covers all the vegetables in front of him. This applies also to one who mistakenly recited "She'ha'kol" over a food requiring a different Beracha. The Beracha of "She'ha'kol," after the fact, covers all foods. And so if one mistakenly recited "She'ha'kol" over a fruit, for example, his Beracha covers the fruit as well as any other foods in front of him, such as water. This is mentioned by Yalkut Yosef, citing his father, Hacham Ovadia Yosef. Finally, the Radbaz (Rav David Ben Zimra, Egypt, 1479-1573) ruled that if one mistakenly recited "Ha'adama" over a fruit, and other people at the table listened to his Beracha with the intention of fulfilling their obligation, they fulfill their obligation even though the Beracha was recited mistakenly. This can happen on the night of Rosh Hashanah, when the head of the household customarily recites "Ha'etz" over an apple or date for everyone at the table, who fulfill their obligation by listening to his Beracha. If he mistakenly recited "Ha'adama" over the fruit, both he and they have fulfilled the obligation. This is the Radbaz's ruling, and it was accepted by later Poskim. Summary: One who mistakenly recited "Ha'etz" over a food requiring "Ha'adama" has not fulfilled his obligation, and must then recite "Ha'adama." However, if a person mistakenly recited "Ha'adama" over a food requiring "Ha'etz," he has fulfilled his obligation. (If he realized his mistake immediately after reciting "Ha'adama," it is uncertain whether he should correct himself.) This recitation of "Ha'adama" covers all foods on the table requiring "Ha'adama," and if others intended to fulfill their obligation by listening to this Beracha, they, too, fulfill their requirement, even though the Beracha was not the proper Beracha.

The obligation to recite Habdala on Mosa'eh Shabbat applies to both men and women. Nevertheless, it is customary for the husband to recite Habdala for his wife. Even if a man had already recited Habdala in the synagogue, with the intention of fulfilling his obligation, the custom is that he repeats Habdala for his wife. Despite the fact that he had already fulfilled the Misva, he may nevertheless repeat the recitation on his wife's behalf, and this is the accepted practice. There is, however, a discussion among the Halachic authorities concerning the two middle Berachot of Habdala – the Beracha of "Besamim" (over spices) and the Beracha of "Ha'esh" (over fire). It is unclear whether the husband may repeat these Berachot for his wife after he had already fulfilled his obligation. Therefore, Hacham Ovadia Yosef rules that in such a case, the women herself should – if she is capable of doing so – recite the Berachot of "Besamim" and "Ha'esh." This means that the husband begins Habdala and recites the Beracha over the wine ("Ha'gefen"), at which point the wife recites the Berachot over the Besamim and the fire. The husband then recites the concluding Beracha of "Hamabdil" and drinks the wine. Hacham Ovadia adds that in such a case the husband should not answer "Amen" to the wife's Berachot of "Besamim" and "Ha'esh." It is forbidden for him to interrupt in between the recitation of the Beracha over the wine ("Ha'gefen") and his drinking the wine after reciting the Beracha of 'Ha'mabdil." Therefore, he may not answer "Amen" to his wife's Berachot over the spices and the fire, which do not pertain to his recitation. If the wife is unable to properly recite these Berachot, then, according to Hacham Ovadia, the husband can and should recite the entire Habdala on her behalf, including the Berachot of "Besamim" and "Ha'esh," even though he had already recited them in the synagogue. Hacham Ovadia takes this position in his work Yabia Omer (vol. 4). Summary: Both men and women are included in the obligation of Habdala, though it is customary for the husband to recite Habdala for his wife. If the husband recited Habdala in the synagogue with the intention of fulfilling his obligation, then when he returns home he recites the Berachot of "Ha'gefen" and "Ha'mabdil" for his wife, and the wife herself recites the Berachot of "Besamim" and "Ha'esh." The husband should not answer "Amen" to the wife's Berachot. If the wife is unable to recite these Berachot, then the husband recites the entire Habdala service for her.

Customarily, when somebody needs to recite Birkat Ha'gomel after emerging safely from a dangerous situation, he recites the Beracha in the synagogue, when the Sefer Torah is read. However, this is not strictly required, and the Beracha may also be recited at other times, as long as a Minyan is present. The Hatam Sofer (Rav Moshe Sofer of Pressburg, 1762-1839), in one of his responsa, ruled that this Beracha should not be recited during the nighttime. He reasoned that since it is customarily recited at the time of the Torah reading, the Beracha should not be recited at night, when the Torah us not read. The Ben Ish Hai (Rav Yosef Haim of Baghdad, 1833-1909) likewise ruled that Birkat Ha'gomel should not be recited at night, though for a different reason, namely, that this Beracha is recited in place of the Korban Toda (thanksgiving sacrifice) which one would offer in the Bet Ha'mikdash after a situation of danger. Since sacrifices are not brought at night, the Ben Ish Hai writes, Birkat Ha'gomel, which is recited in lieu of a sacrifice, should not be recited at night. Hacham Ovadia Yosef, however, disputes this position. He noted that we customarily recite Birkat Ha'gomel on Shabbat, even though private sacrifices – such as the Korban Toda – were not offered on Shabbat. Moreover, Rav Eliyahu Mani (Baghdad-Hebron, 1818-1899), in Zichronot Eliyahu, ruled that one who, for whatever reason, cannot recite Birkat Ha'gomel during the day may do so at night. Indeed, it is customary for women to recite Birkat Ha'gomel after childbirth on the night of the traditional Zohar reading, when a Minyan assembles in the home. Thus, one who cannot recite Birkat Ha'gomel during the Torah reading in the synagogue may do so anytime, even at night. Summary: Those who must recite Birkat Ha'gomel after emerging safely from a dangerous situation customarily recite the Beracha in the synagogue, during the Torah reading. However, this Beracha may be recited anytime in the presence of a Minyan, even during the nighttime.

The Ge'onim (Babylonian scholars in the post-Talmudic era) were of the opinion that when a person recites Kiddush on Shabbat, he does not fulfill the obligation unless he personally drinks the minimum required Shiur (quantity) of wine from the Kiddush cup. Even if somebody else at the table heard the Kiddush and then drank the Shiur, nobody fulfills the obligation if the Mekadesh (person who recited Kiddush) did not drink the minimum required amount. The Shulhan Aruch (Orah Haim 271:14), however, does not follow this opinion. He rules that although it is certainly preferable for the Mekadesh to drink the required Shiur, if this is not possible, then he may give the cup to somebody else to drink. Assuming that this individual had heard the Kiddush, and the Mekadesh had intended for his Kiddush recitation to fulfill the obligation for this person, that person may drink the Shiur of wine, and then everyone who heard Kiddush fulfills their obligation. How can a group fulfill the obligation of Kiddush if no one is able to drink the minimum required amount of wine? The Shulhan Aruch cites an opinion that a group can fulfill the obligation even if the Shiur is drunk collectively, meaning, if several people each drink a small amount, such that altogether they drink the minimum required amount. According to the accepted Halacha, however, this opinion may be relied upon only Be'di'abad (after the fact), meaning, if the Mekadesh recited Kiddush and no single individual drank a complete Shiur. In such a case, they do not need to repeat Kiddush, and may instead rely on the view that the collective consumption of the Shiur suffices to fulfill the Misva. However, they may not plan from the outset to have each person drink a small sip, without any individual drinking a complete Shiur. What, then, should a group of people do if they know from the outset that no member of the group is able to drink a complete Shiur of wine? Rav Moshe Halevi (Israel, 1961-2001), in his work Menuhat Ahaba, writes that in such a case, the group should recite Kiddush on bread, and not on wine. This option is Halachically preferable to having each person drink only a small sip of wine. Summary: When a person recites Kiddush on Shabbat for a group of people, he should preferably drink the Shiur (minimum required amount) of wine from the Kiddush cup. If he is unable to drink the Shiur, then he may have somebody else at the table drink the Shiur. If nobody at the table is able to drink the Shiur of wine, then they should recite Kiddush over bread, and not over wine. However, if they mistakenly recited Kiddush over wine, and each person drank a small sip of wine, such that they collectively drank the minimum required amount, they have fulfilled their obligation. Preferably, however, in such a case they should recite Kiddush over bread.

Is Hallel recited in a mourner's home on Rosh Hodesh? Of course, we recite Hallel as part of the Rosh Hodesh prayer service, but the question arises whether this festive recitation should be omitted in a house of mourning. The work Meir Or, which documents the customs of mourning practiced by the Syrian Jewish community, comments (on p. 62) that Hallel is recited in a house of mourning on both Rosh Hodesh and Hanukah, despite the festive nature of this recitation, for a number of reasons. First, the private mourning does not override the public festivity of Rosh Hodesh. Additionally, if Hallel was not recited in a house of mourning, people might not wish to pray there, and the mourner would thus not have a Minyan. However, as Rav Shemuel Pinhasi (contemporary) notes in his work Haim Va'hesed (p. 144), the mourners themselves do not recite Hallel on Rosh Hodesh, and should step out into a different room during the Hallel recitation. And thus although the people praying in the house of mourning recite Hallel, the mourners themselves do not. Summary: Hallel is recited in a house of mourning on Rosh Hodesh, but the mourners themselves do not recite Hallel.

Throughout the eight days of Hanukah, one is required to add the section of Al Ha'nisim in every Amida prayer. Al Ha'nisim is added in the Modim section of the Amida, before the words "Ve'al Kulam." There is some discussion as to whether one should recite "Al Ha'nisim" or "Ve'al Ha'nisim." According to Halacha, it is more proper to recite "Ve'al Ha'nisim," with the conjunction "Ve" ("and"), since this sentence continues the text of Modim. In the Modim section, we declare that we thank Hashem for all the wondrous acts of kindness which He performs for us, and we then add that we thank Him as well for the miracles He performed at the time of Hashmona'im. It is therefore proper to recite "Ve'al Ha'nisim," rather than "Al Ha'nisim." If a person forgot to recite Al Ha'nisim, and he realized his mistake before he said Hashem's Name in the concluding Beracha ("Baruch Ata Hashem Ha'tob Shimcha…"), then he should recite at that point, "Modim Anahnu Lach Al Ha'nisim…" and then continue as usual. If he did not realize his mistake until after he recited Hashem's Name, then he simply continues with the Amida. He should not recite Al Ha'nisim after the Beracha, before "Sim Shalom," as this would constitute an unwarranted interruption in the Amida. Preferably, one who forgot to add Al Ha'nisim should recite, "Modim Anahnu Lach Al Ha'nisim…" at the very end of the Amida, before reciting "Oseh Shalom." If a person forgot to recite Al Ha'nisim during the Amida, and then, mistakenly thinking that he must repeat the Amida, began reciting the Amida again until he realized that he should not repeat the Amida, he must stop immediately. Any subsequent Beracha that he recites is a Beracha Le'batala (Beracha recited in vain), and he must therefore stop wherever he is and not even complete the Beracha which he currently recites. If a person mistakenly recited Al Ha'nisim in the section of Reseh, in the place where Ya'aleh Ve'yabo is recited on Rosh Hodesh and festivals, and he realizes his mistake during the Modim section, then he should simply recite Al Ha'nisim as usual in Modim. His prayer is valid despite the fact that he made an unwarranted interruption by reciting Al Ha'nisim in Reseh. A person should not skip Al Ha'nisim for the purpose of completing the Amida in time to recite Nakdishach or Kaddish with the congregation. One might have thought that since the Amida is valid even if one forgot to add Al Ha'nisim, it is preferable to skip the prayer in order to be able to join the congregation for Nakdishach or Kaddish. In truth, however, one should recite Al Ha'nisim as the Sages enacted, even at the expense of joining in the recitation of Nakdishach or Kaddish. Summary: One must add Al Ha'nisim in the Modim section of every Amida prayer recited throughout the eight days of Hanukah. If one forgot to add Al Ha'nisim and realized his mistake only after reciting Hashem's Name in the concluding Beracha of Modim, he simply continues reciting the Amida, and does not repeat the prayer. Preferably, he should add Al Ha'nisim before "Oseh Shalom" at the very end of the Amida.

There is an obligation to recite the entire Hallel during the Shaharit service on each of the eight days of Hanukah. This obligation applies to both individuals praying privately, as well as to congregations praying together in the synagogue. Before one begins the actual recitation of Hallel he recites an introductory Beracha. The text of this Beracha, according to the practice of the Sepharadim, is "Baruch Ata Hashem Elokenu Melech Ha'olam Asher Kideshanu Be'misvotav Ve'sivanu Ligmor Et Ha'hallel." This text differs slightly from the text recited by the Ashkenazim, who conclude this Beracha with the words "Likro Et Ha'hallel" ("to read the Hallel"), rather than "Ligmor Et Ha'hallel" ("to complete the Hallel"). If one mistakenly recited "Likro Et Ha'hallel," must he repeat the Beracha? Hacham Ovadia Yosef addresses this question in his work Hazon Ovadia (Laws of Hanukah, p. 209), and rules that a person in such a case is not required to repeat the Beracha. He notes that the Maharam of Rotenberg (Rabbi Meir Ben Baruch, Germany, 1215-1293) held that it is actually preferable to recite the text of "Likro Et Ha'hallel." If one recites "Ligmor Et Ha'hallel," which means "to complete the Hallel," and he mistakenly omits a word from the Hallel recitation, then the Beracha that he recited would thus be rendered a "Beracha Le'vatala" (Beracha recited in vain). The Maharam therefore preferred reciting "Likro Et Ha'hallel" so that the Beracha would remain valid even in the event that somebody mistakenly omits a word. Hacham Ovadia contends that although Sephardic custom does not follow this view of the Maharam, nevertheless one who did recite "Likro" may, after the fact, rely on this position and thus is not required to repeat the Beracha. If a person began reciting Hallel without reciting a Beracha at all, and realized this mistake at some point during Hallel, should he recite the Beracha at that point? Hacham Ovadia (ibid.) rules that one should, in fact, recite the Beracha at the point where he realized his mistake. Even though the phrase "Ligmor Et Ha'hallel" is generally understood to mean "to complete the Hallel," and in this case the individual will not complete the entire Hallel after reciting the Beracha, he should nevertheless recite this text. As Hacham Ovadia cites, the Hida (Rabbi Haim Yosef David Azulai, 1724-1807), in his work Birke Yosef (683), claims that the word "Ligmor" can also mean "to read." In Masechet Berachot (9b), for example, the Gemara speaks of the custom to recite Shema immediately before sunrise, and refers to the Shema recitation with the term "Gomerim." Thus, the text of "Ligmor" is appropriate even if one recites the Beracha after having already recited part of the Hallel. After reciting the Hallel, one recites the Beracha of "Yehalelucha," which concludes with "Baruch Ata Hashem Melech Mehulal Ba'tishbahot." If one mistakenly recited Hallel on Hanukah "Be'dilug," meaning, omitting the sections that are omitted on Rosh Hodesh, he must repeat the Hallel but does not recite the introductory or concluding Beracha. Are women included in the obligation to recite Hallel on Hanukah? With regard to the obligation of the Hanukah candles, the Sages teach that since the Hanukah miracle affected both men and women alike ("Af Hen Hayu B'oto Ha'nes"), the obligation likewise includes men and women. As for Hallel, however, it appears that this recitation was instituted only for men. The Rambam (Rabbi Moshe Maimonides, Spain-Egypt, 1135-1204), in Hilchot Hanukah (3:12), writes that if a man is unable to recite the Hallel by himself, he can fulfill his obligation by listening to a woman reciting Hallel and repeating each word after her. Clearly, the Rambam felt that a man does not fulfill his obligation of Hallel by simply listening to a woman's recitation. Presumably, this is because women are not included in the obligation of Hallel. Hacham Ovadia Yosef (Hazon Ovadia – Laws of Hanukah, p. 213) thus rules that women are not required to recite Hallel on Hanukah. A woman who nevertheless wishes to recite Hallel may certainly do so, though without reciting a Beracha. Summary: Before reciting Hallel one recites the Beracha "Ligmor Et Ha'hallel." One who recited the text "Likro Et Ha'hallel" does not repeat the Beracha. If one remembered during Hallel that he had not recited a Beracha at all, he should recite the Beracha of "Ligmor Et Ha'hallel" at the point where he realized his mistake. If one recited Hallel on Hanukah and mistakenly omitted the sections that are omitted on Rosh Hodesh, he should repeat the Hallel without a Berachah. Women are not obligated to recite Hallel on Hanukah; a woman who wishes to recite Hallel may do so, but without a Beracha.
