Business owners who choose to deliberately underpay workers will face criminal charges from the first of January 2025. The new criminal measures are the latest to take effect, after the Federal Government's “Closing the Loopholes” legislation passed at the end of 2023. But businesses shouldn't be afraid, according to Fair Work Ombudsman Anna Booth. In this episode, the Ombudsman reassures business owners that it must be proven that the underpayment was deliberate. Anna also says that compliance can be straightforward, by following a voluntary code designed to protect those who make honest mistakes. Some of the other resources being made available include an advisory service, self-audit tools, and webinars to help businesses stay on track, avoid penalties, and foster better workplace practices. Wage theft is a big problem in Denver, and it's getting worse. The Denver Auditor's Office recovered more than $2 million in stolen wages last year, but according to today's guest, that is just a drop in the bucket. Matthew Fritz-Mauer is the executive director of Denver Labor, the division of the auditor's office that investigates and remediates wage theft, which recently deployed its new subpoena power in an investigation into three local strip clubs. He's on today with producer Paul Karolyi to talk about how pervasive wage theft is across a variety of industries, what you should do if you suspect you're a victim, and break down the strip club investigation. 100 home care workers were in Albany on Tuesday for a Supreme Court hearing on their case against the Department of Labor. The NYSDOL, despite admitting that the Chinese-American Planning Council has engaged in massive wage theft against workers, has decided to drop the case after years of investigation, citing a new rule related to arbitration. The workers are asking the Attorney General to investigate possible collusion, since the former head of the CPC recently took a high level position with Gov. Hochul. Early Monday, Minnesota Attorney General Keith Ellison announced one of the largest wage theft lawsuits in Minnesota history against a large dairy producer with Facilities in Stearns and Redwood counties. Ellison alleges that Evergreen Acres Dairy failed to pay an estimated three million dollars in wages to its workers, most of who are immigrants from Mexico.The Attorney General also alleged that the company-provided substandard housing for the workers. The lawsuit comes after Ellison created a new wage theft unit in 2019 to protect Minnesota worker's pay. He joined the show to talk about the lawsuit.
