Join us in this riveting episode of the Employee Survival Guide® as Mark Carey unravels the complex legal battle between Zoe Hollis, an exotic dancer, and the management of two notorious Portland dance clubs, Sassy's and Dante's. This episode dives deep into the intricacies of employee wage classification under the Fair Labor Standards Act (FLSA) and the often-overlooked implications of illegal retaliation in the workplace. Zoe Hollis alleges that Sassy's misclassified her as an independent contractor, subjecting her to extreme workplace control and wage theft. This misclassification is not just a bureaucratic error; it represents a significant threat to employee rights and workplace culture. After filing a lawsuit, Hollis faced retaliation when her scheduled performances at Dante's were abruptly canceled, a move that highlights the hostile work environment many employees endure when standing up for their rights. This episode sheds light on the legal arguments from both sides, the concept of economic realities in determining employment status, and how interconnected corporate entities complicate labor law. As we navigate through the legal labyrinth, we discuss the Ninth Circuit Court of Appeals' groundbreaking decision that redefined retaliation protections. This ruling serves as a clarion call for workers' rights in the gig economy, emphasizing that employers cannot retaliate against employees for asserting their rights, even across affiliated businesses. It's a powerful reminder that the fight for employee empowerment is far from over. Whether you're an employee, an employer, or someone navigating the murky waters of employment law, this episode is packed with insights that can help you understand your legal rights and the importance of advocacy in the workplace. From severance negotiations to understanding employment contracts, we equip you with vital knowledge to survive and thrive in today's challenging work environment. Tune in to the Employee Survival Guide® and arm yourself with the tools to combat discrimination, retaliation, and corporate overreach. Your career survival starts here! Imagine the scene: You work at your job all month but when payday rolls around there's no check, no deposit in your account. Your boss says it'll all be worked out next month… but when that pay period comes around there's still no money. That's called wage theft. And it hits low-wage workers especially hard and most frequently. That's one of the reasons why San Mateo County launched the office of Labor Standards and Enforcement last summer. Reporter Sebastian Miño-Bucheli wanted to find out: how is it working? How much wage theft is still happening?
Today, we hear how some San Mateo County farmworkers are speaking up about workplace injustice. Then, would you do stand-up comedy with your mom?... or your kid!? And, in the final days of Ramadan, we reflect on how the month can feel different, depending on where you are.

This episode goes somewhere we didn't plan, and we think that makes it one of our best yet.We sat down with Jarah Euston, co-founder and CEO of WorkWhile, a fast-growing app-based staffing platform connecting 80 million frontline workers with flexible shift opportunities. Jarah grew up in Fresno working retail, got burnt out building software for tech people, and decided to build technology for workers instead. It's a compelling vision and a genuinely interesting conversation about flexibility, AI, and what the future of work could look like for hourly employees. But after that conversation wrapped, we learned that WorkWhile had recently settled a second major lawsuit with the San Francisco City Attorney's office for misclassifying workers as independent contractors. So we spoke with David Chu, the San Francisco City Attorney, and asked for his side of the story. What you'll hear in this episode is both interviews back to back. First, Jarah's perspective on building worker-centered technology, and then David's perspective on what happens when "flexibility" becomes a cover for avoiding worker protections.Together, these two conversations raise a question that feels urgent right now: Is it possible to build a genuinely worker-centered future of work, one with flexibility, innovation, and fair treatment? Or are we just repackaging old inequities in new apps? Visit us at InclusionGeeks.com to stay up to date on all the ways you can make the workplace work for everyone! A newly published survey has revealed a concerning trend of widespread underpayment among young workers in Australia. Nearly one in three respondents—about 33 per cent—reported earning $15 an hour or less. The findings come from the final report of the Fair Day's Work Project, titled 'Underpaid and Overlooked: The Wage Crisis Facing Young Workers in Australia', which surveyed 2,814 workers under the age of 30. In this podcast, we discuss its key findings and recommendations.

In a fiery back-to-back exposé, Tara Servatius uncovers the hidden truth behind South Carolina's quiet transformation into a sanctuary state — not by Democrats, but by the GOP's own leadership. From sabotaged immigration enforcement bills to shielding illegal immigrant criminals from deportation, Tara reveals the shocking depth of Republican betrayal. She then pivots to powerful economic data showing how Donald Trump's policies have sparked historic blue-collar wage growth, as over a million illegal immigrants self-deport. Connecting illegal immigration to tax evasion, corporate greed, and working-class wage theft, Tara makes the case that border policy is economic justice — and the fight is far from over.
It looked like this year's big trans rights bill was going to sail through the state legislature, despite the usual conservative Christian opposition, but now the local LGBTQ community itself is divided. Plus, a beloved Mexican restaurant is paying out a massive settlement to former employees and we hear from listeners about “suspicious” bike riding, Tacos Rapidos, and a little hidden gem you might not have heard of — Wynkoop Brewing. Prime Minister Christopher Luxon is currently in New Delhi, meeting with government officials ahead of negotiating a trade deal with India. A free trade deal between New Zealand and India was part of the Prime Minister's election promises for his first term. School lunch provider Libelle Group, who were contracted to deliver 125,000 school lunches daily, has gone into liquidation. And Labour MP Camilla Belich's bill to make wage theft a crime has passed it's third reading in Parliament. For our weekly catch-up with the Labour Party, Wire Host Caeden spoke to Deputy Leader Carmel Sepuloni about all of these topics.
Beginning near the start of February this year, the government's new school lunch program has faced criticism after criticism since its introduction. From supply issues to quality and quantity concerns to dietary considerations and heating issues, the program has had its fair share of teething issues. Now the government claims these issues have been ironed out, others continue to arise. Libelle, one of the school lunch providers contracted by the School Lunch collective recently went into liquidation. Two weeks ago, Prime Minister Christopher Luxon also told parents concerned with the program to “go make a marmite sandwich.” Also in politics this past week we've seen Labour MP Camilla Belich's private members bill passed by all parties excluding National and ACT. The Crimes (Theft by employer) amendment bill would move wage theft from a civil issue to a criminal issue, which National says is unnecessary and time consuming. In our weekly catchup with National's Tom Rutherford, Wire host Castor asked about each of these issues, starting with school lunch program concerns.

The report says that over the last 20 years, employers — many times these are unregistered businesses or even homes where people work as cleaners or caretakers — the estimated theft from minimum wage workers amounts to more than $2 billion.

John and Craig look at how writers (and other humans) handle the anxiety of uncertainty, from election nights to green lights. We'll talk through strategies for navigating situations where your circle of concern doesn't match your circle of control. Then we travel back to the 1980s and 90s, when many studios were run by ambitious strivers in their late 20s and early 30s. As the decades have passed, the players in these positions have held onto their posts, leaving the next generation stuck mid-ladder. We discuss what impact the aging of Hollywood has had on its output, and where the new guard might find an opening. We also ask, is development wage theft? Denver's biggest strip club operator, RCI Holdings, sued Denver Labor last week in an attempt to block wage-theft investigators from looking at their internal company documents. The club owners allege that the investigators are using “overreaching and unjustified” subpoenas in an “alarming abuse of power.” But in fact, there are plenty of reasons to believe the workers at these clubs aren't getting a fair shake. Denver Post reporter Megan Ulu-Lani Boyanton joined host Bree Davies and producer Paul Karolyi last year to give us the inside scoop on Denver's precarious strip club industry. This episode originally aired on August 7, 2023. Join us live and in person TONIGHT! We are moderating a forum of candidates running in the most exciting and dramatic RTD Board election… maybe ever? Wage theft is a big problem in Denver, and it's getting worse. The Denver Auditor's Office recovered more than $2 million in stolen wages last year, but according to today's guest, that is just a drop in the bucket. Matthew Fritz-Mauer is the executive director of Denver Labor, the division of the auditor's office that investigates and remediates wage theft, which recently deployed its new subpoena power in an investigation into three local strip clubs. He's on today with producer Paul Karolyi to talk about how pervasive wage theft is across a variety of industries, what you should do if you suspect you're a victim, and break down the strip club investigation. Matthew referenced this Westword article on his office issuing its first subpoenas to three local strip clubs. Do you think you might be a victim of wage theft? Definitely get in touch with Matthew and Denver Labor, but we want to hear the story, too! Following our headlines, we discuss the recent firing of rail engineer, and popular commentator, Gareth Dennis, in response to (true) statements he made about safety concerns. Thousands of rideshare drivers and supporters rallied in NYC this week to demand the city stop Uber and Lyft from locking them out of the app to evade fair wage laws. Protests erupted across Australia in response to the government's recent takeover of one of the country's more militant unions on accusation of collusion with organized crime. 32,000 Boeing Machinists have won a tentative deal with the company after a credible strike threat. Finally, we discussion the longhaul strike by Boston University grad student workers. Federal labor enforcement authorities recover millions of dollars for workers each year from employers who break minimum wage, overtime pay and other laws. But a significant chunk of that money never makes it to wage-theft victims, many of whom are in California. A new survey shows that both the mayor and city council's approval ratings are well below 50%. But Denver's at-large council members, Serena Gonzales-Gutierrez and Sarah Parady, say there's some context missing in the media's presentation of the data. The council members join host Bree Davies to dig into the survey, plus talk about how the Denver Police Department handled the protester arrests at Auraria Campus, why city council approved a contentious shelter funding contract with the Salvation Army, and what the Governor's recent veto of a wage theft bill says about our state leader's priorities. Bree mentioned the Colorado Fiscal Institute's wage theft report. We're doing our annual survey to learn more about our listeners. Workers who are cheated on their paychecks often don't recover the wages they are owed -- even after state regulators rule in their favor. In San Diego County, a first-of-its-kind government program aims to change that. Reporter: Farida Jhabvala Romero, KQED Academic workers at UC Santa Cruz go on strike on Monday, becoming the first UC campus to do so following a union vote last week. The walkout is in response to what the union calls unfair labor practices at UCLA, UC San Diego, and UC Irvine, where campus leaders called for police to intervene during on-campus protests over the war in Gaza. Reporter: Elena Neale-Sacks, KAZU The California Supreme Court will hear a new challenge to Proposition 22 on Tuesday. That's the 2020 ballot initiative that classified gig workers as independent contractors. Reporter: Katherine Monahan, KQED Learn more about your ad choices. Visit megaphone.fm/adchoices
In the shadows of corporate greed and exploitation lies a sinister crime that is silently perpetrated, leaving countless victims in its wake—a crime that affects millions of hardworking Americans every year and sucks billions out of our economy —Wage Theft. No industry is immune to this insidious crime, from restaurant workers to construction laborers. On this episode of Pitchfork Economics, we are joined by Terri Gerstein, Director of the Labor Initiative at NYU Robert F. Wagner Graduate School of Public Service, to unpack the chilling truth behind these workplace crimes, learn who the perpetrators are, and uncover how they get away with it. Most importantly, what can be done to stop them? Terri Gerstein is the Director of the NYU Wagner Labor Initiative, at NYU's Robert F. Wagner Graduate School of Public Service, which explores and helps activate the often-untapped potential of government in safeguarding and advancing workers' rights. Previously, Terri enforced labor laws in New York for 17 years, including as Labor Bureau Chief in the New York State Attorney General's Office. Hi. In today's episode, we look at the offensive amount of money that employers steal from their workers, and how it's a much bigger problem than the "crisis" of retail theft.
