As most of you probably already know, over the past few years we've seen a sharp increase in the number of people experiencing homelessness across south east queensland as the housing crisis has intensified. This has led, unsurprisingly, to more people living in public spaces. This week on the podcast, Marissa catches up with Sam Tracy, Practice Director at Basic Rights Queensland, a community legal centre that works on human rights, discrimination and poverty-related laws. Marissa and Sam discuss a recent win on behalf of homeless clients in the Supreme Court in the case of Bobeldyk and Anor v Moreton Bay City Council; Eichin & Ors v Moreton Bay City Council [2026] QSC 27. In response to complaints from other residents, city council employees and the police have been directed to enforce evictions, removing people and their property from public parks. In 2025, this led to a number of people (including the claimants in the matter we're discussing in this week's show) being forcibly evicted from Eddie Hyland Park in Moreton Bay. These evictions were incredibly cruel, and led to significant distress and the destruction of priceless belongings (including in one horrific case, the destruction of the claimant's deceased daughter's ashes). This case was brought on behalf of some of the people evicted from Eddie Hyland Park. While the decision sadly does not stop Council's from enforcing laws to move people on and destroy their belongings, it does set some limits on the way that these evictions can happen. The Supreme Court determined that the way the council "evicted and disposed of property belonging to people experiencing homelessness breached the human rights (and other legal protections) of those affected and was therefore unlawful." While this is not a resounding victory against evictions from public parks, it's a starting point for thinking about the role of lawyers and the legal system in this moment. For people sleeping rough, and for the people organising in solidarity with them, these kinds of legal processes offer a site of potential leverage. Forcing council's to slow down processes like evictions gives people more time to advocate for their own needs; more time to call in support; and importantly, more time for their neighbours and comrades to organise effective anti-eviction actions.

The Department of Justice has historically been largely independent from the White House, despite the fact that the Attorney General is appointed by the President and approved by the Senate. However, Donald Trump's DOJ has been different. Recently fired AG Pam Bondi sought to prosecute the President's political opponents and the Department has gone to great lengths to protect the President amid the revelations of the Epstein Files. On today's show, we will discuss the legacy of Pam Bondi as Attorney General and what this means for the future of the Justice Department. A Turning Point in Irish History50 years ago on Sunday past I was in Cage 11 in Long Kesh prison camp. It was a Monday. It was also 1 March 1976, the date on which the British Labour government's decision to end political status took effect.Political status had been introduced in June 1972 after a hunger strike by republican prisoners and as part of the context for negotiations that were to take place between republicans and the British.In March 1974 a Labour government, led by Harold Wilson, came to power and embarked on a new strategy to defeat Irish republicans. Ending political status was only one part of it. Laws were changed to allow for ease of convictions in the non-jury Diplock Courts, particularly using beatings and forced confessions. New cellular special control units called H-Blocks were constructed in 1975 in another part of Long Kesh, to house the expected new influx of those who were now to be designated ‘criminals.'Merlyn Rees was the British Secretary of State with responsibility for the new ‘Ulsterisation, Criminalisation, Normalisation' strategy. Its aim was simple; reduce the number of British soldiers getting killed, and replace them with the locally recruited RUC and UDR. In the British mindset local forces were expendable and their deaths less likely to cause a political fuss In Britain and internationally.Criminalisation was about trying to convince people, especially the nationalist section of our people, that republicans were motivated by greed. That we were ‘gangsters' involved in a ‘criminal conspiracy. We were, in the new language of the 70s, – godfathers – mafiosi – out for what we could make personally. The British hoped that this new spin on an old propaganda theme would reduce support in Ireland and the international community. International Women's DayThis Sunday is International Women's Day. For over one hundred years the 8 March has been set aside to specifically celebrate women who are active in society; in their communities, trade unions, voluntary organisations, in their families and the political institutions.It is also an occasion when the inequalities, injustices and violence still suffered by many women are highlighted. According to one UN report nearly 70 per cent of countries surveyed revealed that women continue to face more barriers than men to accessing justice. And for the 676 million women who live within 50 kilometres of an active conflict zone “justice systems are largely absent and perpetrators act with impunity.”The reality is that millions of women and girls around the world are confronted by violence, discrimination, and abuse. The United Nations defines violence against women and girls as: “Any act of gender-based violence that results in, or is likely to result in, physical, sexual or psychological harm or suffering to women, including threats of such acts, coercion, or arbitrary deprivation of liberty, whether occurring in public or private life.” War of Aggression in the GulfAs I write this, the war declared by President Trump last Saturday against Iran, and his avowed aim of regime change, is continuing as the death toll rises. The US and Israel had clearly been planning this attack for some time. The USA did this as negotiations involving it and Iran were, according to the Oman mediators, making progress.This war must be condemned. Diplomatic efforts had not ended. There was still hope. President Trump and Benjamin Netanyahu broke international law, ignored Iran's sovereignty, and destroyed that hope with bombs.Under the UN Charter, states are prohibited from using unilateral force, except in two cases: (1) when authorized by the UN Security Council or (2) in self-defence. The US and Israel did not go to the UN Security Council ahead of Saturday's strikes. That only leaves self-defence

The Insight: Protest or Punishment? Cambridge students speak out against ‘Criminalisation' of Gaza Solidarity by Radio Islam
En Tunisie, la situation des migrants subsahariens se précarise de plus en plus depuis les campagnes sécuritaires qui ont commencé en 2023. Le contrôle sur le travail non régulé s'est accentué et beaucoup de migrants présents dans la capitale travaillent au noir ou ont recours à la mendicité, une situation qui alerte les ONG des droits humains. À Tunis, dans un quartier de la banlieue nord, plusieurs migrants subsahariens attendent sur le trottoir au bord de la route. Selon les besoins en petits boulots, les clients viennent à ce rond-point et embauchent à la journée les premiers à se présenter, comme l'explique Sami, un migrant malien de 16 ans. « On attend du travail ici. Travail de chantier, travail de jardin, etc », énumère-t-il.Ce phénomène est visible dans plusieurs endroits de la capitale de la Tunisie, les migrants n'étant plus embauchés dans des emplois stables à cause des contrôles à répétition des autorités. Une situation de plus en plus difficile pour Abdallah, 25 ans et Ivoirien. « Il y a beaucoup de problèmes, même pour aller travailler, ça fait peur, parce qu'on n'a pas de papiers. Il y a la police qui peut nous arrêter pour aller en prison », redoute-t-il.Sami, 27 ans, migrant camerounais, est venu il y a sept mois à Tunis, pensant trouver du travail, dans son domaine, la réparation d'objets électroniques. Il se retrouve à faire le « berbecha », le collecteur de plastique. Il fouille dans les poubelles pour trouver des bouteilles à vendre ensuite à des dépôts de recyclage « Quand je suis arrivé et que je suis allé dans des magasins d'électronique pour du travail, on m'a dit que ce n'était pas possible de m'embaucher. Du coup, je ne pouvais rien faire et rester à la maison, je devais payer le loyer, ma nourriture, donc je suis allé dans la rue et j'ai commencé ce travail », explique le jeune homme.Pour le Forum tunisien des droits économiques et sociaux, une organisation non gouvernementale (ONG) tunisienne, la précarité des migrants est de plus en plus visible dans l'espace public. « Maintenant, c'est remarquable le nombre de mamans accompagnées de leurs enfants dans l'espace public parce que ces mamans-là n'ont pas la possibilité de travailler et sont obligées de sortir dans l'espace public pour chercher quelques moyens à vivre ou d'aide de la part des gens », alerte Romdhane Ben Amor, porte-parole de l'ONG, pour qui la précarité a atteint un niveau alarmant.Il attribue cette mendicité de plus en plus visible à la criminalisation actuelle, par les autorités, des organisations de la société civile qui viennent en aide aux migrants. Beginning near the start of February this year, the government's new school lunch program has faced criticism after criticism since its introduction. From supply issues to quality and quantity concerns to dietary considerations and heating issues, the program has had its fair share of teething issues. Now the government claims these issues have been ironed out, others continue to arise. Libelle, one of the school lunch providers contracted by the School Lunch collective recently went into liquidation. Two weeks ago, Prime Minister Christopher Luxon also told parents concerned with the program to “go make a marmite sandwich.” Also in politics this past week we've seen Labour MP Camilla Belich's private members bill passed by all parties excluding National and ACT. The Crimes (Theft by employer) amendment bill would move wage theft from a civil issue to a criminal issue, which National says is unnecessary and time consuming. In our weekly catchup with National's Tom Rutherford, Wire host Castor asked about each of these issues, starting with school lunch program concerns.

In a recently published report, “Criminalisation and Repression of Climate and Environmental Protests”, Dr. Oscar Berglund and his colleagues identified four key mechanisms through which climate and environmental protests are repressed: the introduction of new anti-protest laws, the broadening use of existing legislation, excessive policing and killings and disappearances of activists. Alasdair and Oscar discuss the findings of the report and the ways in which the clampdown on climate protest represents a threat to both democracy and net zero targets. Chronic pain is a silent pandemic affecting somewhere between 8 and 28 million people in the UK alone. Recent headlines (https://www.bbc.co.uk/news/business-65596283) reveal it's contributing to 2.5 million Brits leaving work. But more alarming still, is our response.The UK prescribes more opioid pain killers per capita than any other country in the world. This is in spite of NHS guidelines warning against its use for chronic pain. It is also in spite of a US opioid crisis that has plagued the nation with half a million fatal overdoses.But opioids are not the only option. Medical cannabis has been legal in the UK for almost five years, yet fewer than five people have ever been prescribed it on the NHS for chronic pain. Private clinics, by contrast, have issued over 89,000 prescriptions for unlicensed cannabis medicines not available on the NHS.Those who cannot afford private healthcare are left with a difficult choice: legal opioids, or illegal cannabinoids. And over a million are choosing the latter. Isabel Vaughan-Spruce is the guest on this week's episode of Merely Catholic, the podcast series for the Catholic Herald. The pro-life counsellor was arrested and charged by police in December after she admitted to them that she “might be” praying silently in her head outside a closed abortion facility in Birmingham. The Crown Prosecution Services have since dropped the charges but Miss Vaughan-Spruce intends to apply for a court verdict on whether she was breaking any laws. She talks to Dr Gavin Ashenden about her experience and about the chilling implications for such human rights as freedom of speech, expression, conscience, association and religion under new regulations which brook no public dissent from the culture of death.

In May 2022, the Delhi High Court delivered a verdict on several petitions seeking to remove the marital rape exception in the rape law. Section 375 of the Indian Penal Code excludes sexual intercourse between a married couple. The verdict was split with Justice Rajiv Shakder ruling in favour of removing the exception, and Justice C Hari Shankar dismissing the petition. Many states have repealed tough laws that put sex workers at risk of prosecution. But so far, Queensland hasn't followed suit. Now, the state government is looking at introducing new safeguards to protect those in the industry. Reporter Mahmood Fazal investigates.

But sex work is not just stigmatised - it's criminalised. Laws that ban certain aspects of sex work force workers into unsafe, unregulated environments, where they become even more vulnerable. This week, Media Storm heads to Bristol, where strip clubs face being outlawed by the council - in similar scenes to Chester, Swansea, and Blackpool. Critics of strip clubs seem to blame sex workers for the systematic problems of gender-based violence, yet our data research showed otherwise. Media Storm meets workers in the sexual entertainment industry who feel unheard and stuck in a limbo, following them to the Sex/Work Strike in London's Leicester Square on International Women's Day. In this interview with French political scientist Laure Neumayer, we discuss how a particular form of anti-communist memory politics were mobilized and utilized by "memory entrepreneurs" in Europe following the Cold War. A particular interpretation of the socialist past was put up against official European memory of the 20th century as the EU enlarged into Eastern Europe. A mixture of anti-communist nationalists, former dissidents and liberals wanted a pan-European identity to be rewritten in a way that criminalized communism as it had after World War II criminalized Nazism. Here's a description of Laure Neumayer's 2019 book The Criminalisation of Communism in the European Political Space After The Cold War: Memory has taken centre stage in European-level policies after the Cold War, as the Western historical narrative based on the uniqueness of the Holocaust was being challenged by calls for an equal condemnation of Communism and Nazism. This book retraces the anti-communist mobilisations carried out by Central European representatives in the Parliamentary Assembly of the Council of Europe and in the European Parliament since the early 1990s. Based on archive consultation, interviews and ethnographic observation, it analyses the memory entrepreneurs' requests for collective remembrance and legal accountability of Communist crimes in European institutions, Pan-European political parties and transnational advocacy networks. The book argues that these newcomers managed to strengthen their positions and impose a totalitarian interpretation of Communism in the European assemblies, which directly shaped the EU's remembrance policy. However, the rules of the European political game and recurring ideological conflicts with left-wing opponents reduced the legal and judicial implications of this anti-communist grammar at the European level.
