West Virginia's coal industry has out-sized influence in the state's politics, and in Washington. But the industry's power has come at a cost to West Virginians. --- The state of West Virginia has made headlines over the past year on the high profile of its senior senator, Joe Manchin, who has been the swing vote in the Senate on major energy legislation. Most dramatically, Manchin's last-minute deal with Senate Democratic leadership in July allowed for the passage of the Inflation Reduction Act that provides billions of dollars in tax incentives for wind and solar power. Kimberly A. Reed just finished up a 2-year term as President and Chairman of the Board of Directors of the Export- Import Bank of the United States (EXIM - https://www.exim.gov). She was the first woman to lead EXIM in the agency's 87-year history, was the first recipient of EXIM's highest honor, the Franklin D. Roosevelt Award, and was confirmed by the U.S. Senate in 2019 on a strong bi-partisan basis. EXIM provides loans, guarantees, and export credit insurance for the export of U.S. goods and services from enterprises ranging from Fortune 100 companies to small businesses in a multitude of sectors including infrastructure, power, agriculture, transportation/aviation, health care, commodities, industrial, and technology. Ms. Reed was recognized for successfully navigating Congress to re-open EXIM after four years of dormancy and transforming the mission and impact of the 515-person independent federal agency. Ms. Reed also spearheaded EXIM's historic, longest-ever Congressional re-authorization of seven years and a significant new mandate, the Program on China and Transformational Exports, which focuses on industries including biomedical sciences, biotechnology, wireless communication (5G), renewable energy, financial technologies, artificial intelligence, and the space industry. Prior to EXIM, Ms. Reed spent her career working at senior levels in both the public and private sectors. Ms. Reed served as President of the International Food Information Council (IFIC) Foundation where she worked with multi-national food, agriculture, and nutrition companies to understand consumer insights, communicate the science, and increase U.S. sales and exports. At the U.S. Department of the Treasury, Ms. Reed headed the Community Development Financial Institutions Fund, where she oversaw the award of $4 billion in tax credits, loans, and grants to financial institutions and economic development groups investing in distressed communities across the nation. Ms. Reed also served as Senior Advisor to U.S. Treasury Secretaries John Snow and Henry Paulson, as well as counsel to three committees in the U.S. House of Representatives—Ways and Means, Government Reform and Oversight, and Education and the Workforce Committees, where she focused on Congressional investigations, oversight, and reform of federal agencies. She was also Vice President for Financial Markets Policy at Lehman Brothers in New York. Recognized as one of the “100 Women Leaders in STEM,” Washingtonian's “Most Powerful Women in Washington,” and West Virginia Executive's “Lawyers and Leaders,“ Ms. Reed previously served on the Boards of the Alzheimer's Association, Alzheimer's Impact Movement, American Swiss Foundation, National Coalition for Food and Agriculture Research, Tax Coalition, and West Virginia Wesleyan College. She was the first woman elected as Chair of the Republican National Lawyers Association and is a life member of the Council on Foreign Relations. In this episode, Amy Cyphert, Lecturer in Law and Director of the ASPIRE Office at the West Virginia University College of Law, discusses her article "Reprogramming Recidivism: The First Step Act and Algorithmic Prediction of Risk," which is published in the Seton Hall Law Review. Cyphert begins by explaining how the First Step Act changed the way the Department of Justice makes decisions about when to release particular people from federal prison, including in response to the COVID pandemic. Specifically, she discusses the new PATTERN system, which provides a framework for placing people in different risk categories, based on both static and dynamic features. She observes that it may be an improvement on previous, more subjective methods, but still lacks the transparency necessary to evaluate it for accuracy and bias. Dr. E. Gordon Gee is one of America’s most prominent higher education leaders, having helmed universities for more than three decades. In 2009, Time magazine named him one of the top 10 university presidents in the United States. Recently, the website Great Value Colleges named him the nation’s top university president. In 2014, Gee returned to West Virginia University, where his career as a university president began. His leadership goals include putting students first, advancing the university’s research agenda, partnering with West Virginia communities and making sure that 1.8 million West Virginians know in their hearts and minds that West Virginia University is their university. Born in Vernal, Utah, Gee graduated from the University of Utah with an honors degree in history and earned his J.D. and Ed.D. degrees from Columbia University. He clerked under Chief Justice David T. Lewis of the U.S. 10th Circuit Court of Appeals before being named a judicial fellow and staff assistant to the U.S. Supreme Court. In this role, he worked for Chief Justice Warren Burger on administrative and legal problems of the Court and federal judiciary. Gee returned to Utah as an associate professor and associate dean in the J. Reuben Clark Law School at Brigham Young University and was granted full professorship in 1978. One year later, he became dean of the West Virginia University College of Law, and, in 1980, was named West Virginia University president. He served in that role until 1985. He went on to lead the University of Colorado (1985-1990), Brown University (1998-2000) and Vanderbilt University (2001-2007). He served as president of The Ohio State University from 1990 to 1997 and again from 2007 to 2013.

Matthew Titolo is a Professor of Law at West Virginia University College of Law. In this episode, Joshua Fershee, Professor of Law at the West Virginia University College of Law and Head of the Economic and Community Development Group in the West Virginia University Center for Innovation in Gas Research and Utilization, discusses his article "The End of Responsible Growth and Governance?: The Risks Posed by Social Enterprise Enabling Statutes and the Demise of Director Primacy," which was published in Transactions: The Tennessee Journal of Business Law. Fershee begins by observing the expansion of social enterprise enabling statutes and the decline of director primacy under law. He explains that these create perverse incentives to prioritize short-term financial gains for stockholders as the only function of the for-profit corporate form, rather than allow corporate directors to make the best long-term decisions from a variety of factors. He also reflects that these incentives would lead to unsustainable business practices and distort the normal market performance of corporations. He concludes by providing his insights and recommendations to address this concerning trend. Anoa Changa is an attorney in the Greater Atlanta Metropolitan area. She holds a Master in City and Regional Planning from The Ohio State University as well as a Juris Doctorate from West Virginia University College of Law where she was a W.E.B Dubois fellowship recipient.  Anoa serves on the board of the National Conference of Black Lawyers (NCBL). A growing presence in the world of independent progressive media, Anoa hosts The Way with Anoa, a weekly talk show and podcast, focusing on politics, news, and community engagement. John Temple teaches reporting and writing courses at West Virginia University. His specialty area is narrative nonfiction writing. His new book 2016 Edgar Award nominee “American Pain” chronicles how two young felons built the largest painkiller distribution ring in the United States. The book, published by Rowman & Littlefield, also explores the massive rise in the use and abuse of narcotic painkillers over the past two decades. Temple is the author of two previous nonfiction books: “The Last Lawyer: The Fight to Save Death Row Inmates” (2009) and “Deadhouse: Life in a Coroner’s Office” (2005).
