Litigation has become the go-to weapon to fight unconstitutional laws, lack of service delivery, abuse of power. In this interview with BizNews, constitutional law expert Professor Koos Malan says: “…we have such large scale malfunctioning of the executive, such large scale malfunctioning of the administration, covering each and every aspect of South African society and also having an effect on each and every possible right, specifically constitutional rights, that one can conceive of, that people are actually forced to go to the courts in order to try to seek help.” However, he warns that a court order amounts to “something like a wish” because “the moment you deal with this systemic problem, the courts are actually not in position to give any remedies, to give any real help, any real proper interference that could steer the executive, steer the relevant organ of state, whatever, in a positive direction simply because of the fact that the state has to such an extent crumbled, to use that strong word, that eventually the court's order won't mean anything.” Instead, Professor Malan hails the private sector for “superbly standing in for the failure of the State - also within the justice system”. Professor Malan further describes how the judiciary is “always somehow in step with the dominant elite” - and says: “…let's say for a moment, the African National Congress becomes weaker and the Democratic Alliance becomes stronger. Then the political landscape changes and the changed landscape implies that the Constitutional Court has more leeway, more liberty, not to take into account those risks that might be involved…”

Let's put on a show! There is nothing more exciting than live theatre. One of the most historic and venerable ones in the Boston area is The Regent Theatre in Arlington. Longtime director Richard Stavros recently retired and a new leader has taken over. He is Harvard computer science professor David Malan. David and I discuss his innovative plans to revitalize the theatre through the introduction of what he calls “educational theatricality.” This will involve streaming community and educational programs adding to the theatrical experience. Instead of having one, two, or three friends, I have four with me today. First up is the outstanding Ross Steel. Ross was diagnosed with autism at the age of three after being born in 2003. He has been placed on the honor roll several times and was awarded a sizable college scholarship. He also runs his own Instagram program, Steel Reviewing. I also have a country guy named Caleb Creamens. Born in 2004, Caleb, who is from Washington, Indiana, has cerebral palsy. Like me, he studies broadcasting at Vincennes University. Caleb also likes wrestling, NASCAR, basketball, football, and country music. Next is my close companion, Andie Schroyer. Andie serves as a 21-year-old student studying medical lab science. She does drawings and games in her spare time. She grew up with her cousin, who was diagnosed with Malan syndrome and autism. And last, Maddie Jordan, who is amazing. Maddie was born in December 2001. She currently works as a teacher at Bloomfield Elementary. In addition to being the drummer in the Greene County Community Band, her younger sister is on the autism spectrum, and they are here to give their perspectives on having a friend with autism. IntegrityIQ, the business behind an AI-driven platform designed to address failings in ethics and compliance in large multinationals, is set to become the first campus company to officially spin out of Trinity Business School. It is hoped the move could be the first step in making Dublin a hub for ethics and corporate integrity in Europe. IntegrityIQ is supported by The Learnovate Centre, a global research and innovation centre in learning technologies in Trinity College Dublin. In 2023, with Learnovate's support, the environmental, social and governance (ESG) firm received €365,000 in funding under Enterprise Ireland's Commercialisation Fund to bring the platform to market - a process due to culminate this year. IntegrityIQ is attracting support from investors both in Ireland and internationally and was last week named a regional finalist in the InterTradeIreland Seedcorn Investor Readiness Competition - one of three Dublin-based finalists in the New Start category. The company's mission is to help large multinationals address failings in ethics and corporate governance that are leading to huge annual losses from fraud, corruption and unethical behaviour. The firm was founded in 2022 by Dr Daniel Malan and is co-owned by IntegrityIQ CEO Mark Shields. Dr Malan is an internationally renowned expert in the field of Organisational Integrity and Director of the Trinity Corporate Governance Lab at Trinity College Dublin. He has served as co-chair of the Integrity and Compliance Task Force for Business Twenty (B20), the official business dialogue with the G20. He has also been a member of the World Economic Forum's Global Future Council on Transparency and Anti-Corruption and an advisory committee member on the Future of Trust and Integrity Project. Mark Shields is an award-winning executive specialising in the development of ESG companies from start-up to SME level. Some 41% of fraud cases are uncovered following a tip-off. Ethics officers in large multinationals report challenges around the sourcing of relevant content for ethics and compliance training.
