On April 16, the UK Supreme Court handed down a judgement determining that the terms “man," “woman,” and “sex” in the Equality Act 2010 refer to biological sex (not gender identity). After years of fighting for the return of women's sex-based rights, the group For Women Scotland succeeded in winning their case brought against the Scottish Ministers. Going forward, a man identifying as a “woman” or a “transwoman,” even with a gender recognition certificate (GRC), will not be considered female under UK law, and therefore will not be permitted into women-only spaces such as bathrooms, prisons, change rooms, and shelters.Meghan Murphy speaks with Susan Smith, a founder of For Women Scotland, about the group, their fight, and what this win means for women in the UK.The Same Drugs is on X @thesamedrugs_. Trans women should use toilets according to their biological sex, according to the equalities minister Bridget Phillipson, this is in response to the UK Supreme Court's ruling a week ago on the legal definition of a woman. The Prime Minister Keir Starmer has welcomed the decision, saying it provides much needed clarity, and his office has confirmed that the Prime Minister no longer believes trans women are women. There have been protests against the decision, with critics saying it is incredibly worrying for the trans community. The ruling followed a long-running legal battle between the Scottish Government and the campaign group For Women Scotland. Susan Smith, one of the directors, gives her reflections on the outcome, a week on. The historian Tiffany Watt Smith traces the evolution and messy realities of female friendship across the past century in her new book Bad Friend. Tiffany talks to Clare about bad friends through history: the romantic school girls of the 1900s; office gossips; mum cliques; angry activists; and the coven – women who choose to live together in old age – to the present day. The former lioness Eni Aluko had a hugely successful career as a player making over 100 appearances for England. Since then she's gone on to have an equally successful career as a pundit, becoming the first woman to appear on Match of the Day in 2014. Earlier this month her name was in the headlines following the outcome of a civil court hearing involving the ex-footballer Joey Barton. In the first stage of a High Court libel case the Judge found that online posts made by Joey Barton about Eni and her family were "defamatory". Mr Barton is yet to respond, and can appeal, or defend the statements if the case proceeds to trial. In a separate criminal case involving both parties Joey Barton has pleaded not guilty to allegedly posting offensive comments on social media. An Army of Women is a documentary that follows a group of women in Austin, Texas who took on the legal systems that they feel let their rapists walk free – specifically by filing lawsuits against the police department in Austin and the district attorney's office in Travis County, which prosecutes cases for the county. Those suits were settled in 2021 and 2022. The documentary debuted at the South by Southwest Festival last year, and is being released here in the UK from this Friday. Clare speaks to documentary director Julie Lunde Lillesæter and Hanna Senko, who was the lead plaintiff in one of those lawsuits.Presented by Clare McDonnell Producer: Louise Corley

David Smith Recalls Susan Smith's Chilling Confession: ‘She Just Said I'm Sorry' Susan Smith's ex-husband, David Smith, vividly remembers the moment she admitted to killing their two young sons in 1994. Speaking with NBC's Craig Melvin for an upcoming Dateline episode, David reflected on the cold nature of her confession. “She just casually, like you and I sitting here, said ‘I'm sorry.' And that was about as far as it went,” David recalled. For David, the lack of emotion in her words has lingered for three decades. “I asked her ‘Why did you do this? Why?' And she said, ‘I don't know why, but I'm sorry,'” he continued. The case, which shocked the nation, began on October 25, 1994, when Susan, then 23, told authorities that a Black man had carjacked her vehicle with her two sons, Michael, 3, and Alex, 14 months, inside. She pleaded on national television for their safe return, igniting a massive search effort. Nine days later, her story fell apart. Susan ultimately admitted that there was no carjacker. Instead, she had let her car roll into a lake in Union, South Carolina, with her children still strapped into their car seats. Investigators determined that Susan's motive stemmed from a relationship with a man who did not want children. The case captivated the world and landed on the cover of PEOPLE magazine. Susan was convicted of two counts of murder and sentenced to life in prison. Three decades later, Susan remains incarcerated at Leath Correctional Institution in Greenwood, South Carolina. In November 2024, she was denied parole after serving 30 years. “I know that what I did was horrible,” Susan told the parole board, according to CNN. “I am a Christian, and God is a big part of my life, and I know he has forgiven me… And I just ask that you show that same kind of mercy as well.” David, however, made it clear before the hearing that he did not support her release. “I don't think she'll ever be rehabilitated,” he said on the Today show. “I don't think she's, even to me, she's never been really sorry for what she did.” Looking back, David wishes the jury had sentenced Susan to death instead of life in prison. “For myself, yes, because I wouldn't have to be dealing with what's coming up now,” he told Dateline. “I know that they said she had a tough life growing up, and I've never tried to make light of that, but you don't kill your children for what happened to you. I wanted an eye for an eye, but the jury saw different.” Despite his anger, David has found a way to forgive Susan. Speaking with Court TV in September 2024, he explained that his faith led him to that decision. “Yes, I have forgiven her, but again, that goes to my faith in God and that's the way I was raised. That we have to forgive,” he said. “But it sure doesn't take away the act of what she did. It doesn't make it any less, it doesn't make it any easier. But I have forgiven her for what she did.” David's pain, however, remains as sharp as ever. Susan Smith, the South Carolina mother convicted of murdering her two sons in 1994, was denied parole on Wednesday, Nov. 20, after appearing before the South Carolina parole board. The denial comes nearly three decades after Smith drove her car into a lake with her children, Michael (3) and Alex (14 months), strapped inside, a crime that shocked the nation.   Smith, now 53, appeared via videoconference and addressed the board with remorse. “I know that what I did was horrible,” she said, according to CNN. She added, “I am a Christian and God is a big part of my life and I know he has forgiven me and I know that is by his grace and mercy … And I just ask that you show that same kind of mercy as well.”   The board rejected her request, citing the severity of her crime.   On October 25, 1994, Susan, then 23, claimed that a Black man had carjacked her vehicle with her sons still inside, prompting a national search. For nine days, she made tearful public pleas for their safe return. However, the truth unraveled when Susan confessed to letting her car roll into John D. Long Lake, killing her children.   Prosecutors revealed that Susan's motive stemmed from her affair with a wealthy man who had ended their relationship because she had children. In 1995, she was convicted of two counts of murder and sentenced to life in prison.   Her ex-husband, David Smith, reflected on her actions during an interview with the *Today* show, stating, “I don't think Susan should ever be granted parole. It wasn't an accident; she deliberately killed our boys.”   David also described the lingering anger he felt during the trial. “I used to sit there and look at the back of her head and then look at where the bailiffs were and think about killing her,” he admitted.   Smith's time in prison at Leath Correctional Institution in Greenwood, South Carolina, has been marked by disciplinary infractions. She has been punished for self-mutilation, drug use, and unauthorized interviews, among other violations. She was also disciplined for having sexual relationships with two prison staff members, both of whom faced criminal charges.   In 2015, Smith wrote to a local newspaper in an attempt to defend her character. “I am not the monster society thinks I am. I am far from it,” she claimed.   Despite these statements, critics, including her ex-husband, believe she has not demonstrated genuine remorse. “I don't think she'll ever be rehabilitated,” David told the *Today* show.   Though he opposes her release, David has spoken about his journey to forgiveness. “Yes, I have forgiven her, but that doesn't take away what she did. It doesn't make it easier,” he told Court TV in September.   David continues to grieve the loss of his sons, holding on to memories of Michael and Alex. A photograph of him holding their picture outside the courthouse after the verdict in 1995 remains a poignant reminder of the tragedy.   The South Carolina parole board hears dozens of cases each day, but Smith's high-profile application garnered widespread attention. To secure parole, she needed a two-thirds majority vote from the seven-member panel, which she did not achieve.   Parole for violent offenders in South Carolina is rare, with only 8% of applicants granted release. If Susan Smith chooses, she may reapply in two years.   The board's decision ensures that, for now, Susan Smith will remain behind bars, continuing to serve her life sentence for the murder of her two sons—a crime that still haunts the nation decades later.   #SusanSmith #TrueCrime #ParoleDenied #ChildMurder #JusticeForMichaelAndAlex #ParoleBoard #CrimeNews Want to listen to ALL of our podcasts AD-FREE?
