FTX/Alameda US bankruptcy court hearing January 31, 2024, #crypto #cryptocurrency #cryptonews #sbfThis is an exceptionally interesting bankruptcy court hearing in the complex international bankruptcy proceedings of FTX/Alameda.It opens with the bankruptcy court's bench ruling with respect to certain issues concerning the estimation of the IRS claim against FTX/Alameda.Does anyone knows... if the IRS wins that it has a multi billion dollar claim then couldn't that lead to the arguably statutorily mandated and arguably optimal result in the chapter 11 cases? In other words could an IRS win lead to return to customers of their stakes, then the rest of the cash, crypto etc. goes to the government/taxpayers, and what is left over would go to creditors with lower priority.Possibly, optimally, the chapter 11 cases could be wrapped up from there without a lot of litigation hanging out on the back end like clawback litigation. But the various litigants and counsel representing them would know better what suits their interests and concerns etc.

This is: "Going Infinite" - New book on FTX/SBF released today + my TL;DR, published by Nicky Pochinkov on October 4, 2023 on The Effective Altruism Forum. Just finished new book about FTX and Sam Bankman-Fried, launched today: "Going Infinite: The Rise and Fall of a New Tycoon" by Michael Lewis. The book itself is quite engaging and interesting, so I recommend it as a read.The book talks about: Early life and general personality Working at Jane Steet Capital Early days at Alameda and the falling out A refreshed alameda The early FTX days and actions of Sam Post-FTX days, and where did the money go? The book talks a decent bit about effective altruists in both good and bad light. Some particularly interesting anecdotes and information according to the book (contains "spoilers"): In early Alameda days, they apparently lost track of (as in, didn't know where it went) $ millions of XRP tokens, and Sam was just like "ehh, who cares, there is like 80% chance will show up eventually, so we can just count it as 80% of the value". This + general disorganisation + risk taking really pissed off many of the first wave of EAs working there, and a bunch of people left. Eventually, they actually "found" the XRP: it was in some crypto exchange they were using, and some software bug meant it was not labelled correctly, so they had to email them about it. Where did all the lost FTX money go? At FTX the lack of organisation was similar, but much larger in scale. Last chapter has napkin calculations with in-goings vs out-goings for FTX. (Edit: See this below). While they clearly spent and lost lots of money, some of the assets were just lost track of because didn't care to keep track because other assets were so large that these were not that important/urgent. So far "the debtors have recovered approximately 7 billion dollars in assets, and they anticipate further recoveries", which could be an additional approx $7.2Billion to still be found (which might be sold for less as much of it non-cash, but at least $2Billion?), not even including potential clawbacks like investment into Anthropic. A naive reading suggests there could have been enough to repay all the affected customers? EDIT: here is the "napkin math" given in the book of combined FTX+Alameda ingoings and outgoings over the course of a few years. So the question in the final chapters of the book is accounting for the $6 Billion discrepancy. Clearly the customer funds were misused by Sam and Alameda, and the numbers are not to be taken at face value (for example, the profits at Alameda could be questioned), but possibly worth viewing at as a possible reference point for those interested in them but not willing to read the whole book:Money In: Customer Deposits: $15 billion Investment from Venture Capitalists: $2.3 billion Alameda Training Profits: $2.5 billion FTX Exchange Revenues: $2 billion Net Outstanding Loans from Crypto Lenders (mainly Genesis and BlockFi): $1.5 billion Original Sale of FTT: $35 million Total Money In: $23 billion Money Out: Return to Customers During the November Run: $5 billion Amount Paid Out to CZ: $1.4 billion (excluding $500 million worth of FTT and $80 million worth of BNB tokens) Sam's Private Investments: $4.4 billion (with at least $300 million paid for using shares and FTX) Loans to Sam: $1 billion (used for political and EA donations to avoid stock dividends) Loans to Nishad: $543 million (for similar purposes) Endorsement Deals: $500 million (potentially more, including cases where FTX paid endorsers with FTX stock) Buying and Burning Their Exchange Token FTT: $600 million Out Expenses (Salaries, Lunch, Bahamas Real Estate): $1 billion Total Money Out: $14.443 Billion After the Crash: $3 billion on hand. $450 million stolen in hack Here are the largest manifold markets on FTX repayment I could find f...

What's up everyone! This is Thomas Bahamas and you are here for Solana Weekly episode 26! Solana Price - $19.10, down 7.7% from last week and looking like it wants lower. I'm going to get deep into why this is and why the sell pressure won't stop anytime soon.SolEth - Sitting at .01069, down 7.5% from last week. Eth not looking strong, but Sol looking weaker.SolBTC - .0007293 - which is a decrease of 5.5%, Sol is not performing well and holding up to the rest of the market.Why is Sol dumping you're probably asking? Well we have major bagholders dumping.https://twitter.com/solanobahn/status/1660465899995025408 Here's a thread worth reading by SolanoBahn.But in summary we have a super old wallet somewhat connected to FTX/Alameda that is dumping the f out of Sol. They had 17 million Sol and have dumped 7 million Sol of it so far. This is likely the “Wintermute Dumper” that has been TWAPing out of their position for months. They are the reason we haven't had breakouts and it looks like the buyers at 20 have exhausted their willingness to defend it. Now we break down below support and they still have 10 million Sol to fire at us. Not great.So short term it's not looking great, my guess is we hit 17, bounce, then hit 13 in the short term. But all is not lost!We've got a long term massive bull case for Solana thread, one that I haven't really seen.https://twitter.com/solbeachbum/status/1660604668332896258Sol Beach Bum coming out with that fire. On it's current path this puts Solana price up 100x in 10 years, moving to a deflationary currency, a store of value, and TPS over 200k. Rarely do we see predictions like this backed up by data, and I feel like he did a good job of putting those projections together. What this means for us, is to watch out with leverage, stack your Sol's while you can, be in it for the long term, and that Sol's price will be stunted in the short term. Once you know this, it will set you free.Metaplex drama - starting to tax NFT mint's at .01 Sol per. Community up in arms.MadLads catching a pump and I'm here for it.Asset Dash's Vanta NFT just dropped and sold out in minutes, good sign that there is still demand for good mints, I just haven't seen that many.Chat GPT coming to Solana.NFT Fi is still exploding, people are stacking that Sol this way, still think it's generally useless and a net negative.FTX 2.0 gaining some steam.Ledger - everyone is pissed at it for adding an OPTIONAL social recovery plan. Good idea and probably needed if we want secure storage for normies, but pissing off us cypherpunks.BTC NFT's are pumping and HGE is moving ABC over.Drift is killing it, added mSOL as a collateral option and have 6400 mSol deposited currently.What it all means: I don't think we are out of the weeds with sol and sol NFT's just yet. The plan is to dca during dips for the next few months. If we get under 15 we stack hard. We are in an era where the protocol of Solana has immense value and is hitting its stride while the value of its token will be suppressed for the short term. I don't think Solana summer will be the Solana token mooning. I think it will be opening up access to all markets on Solana. I think NFT's get sorted out with Metaplex capitulating or a new standard being introduced. All this leads to more transactions, more users, better use cases and strengthens Solana's value proposition.While beach bum's 10 year outlook seems pretty high, I can see it happening. That's a 100x from now. That's $2000 Solana and 500 Solana makes you a millionaire.We must simply look at the big picture, not waste our time playing games we can't win. A fee examiner is hired in some chapter 11 bankruptcy cases to review fee applications submitted by some of the professionals billing the bankruptcy estate. A fee examiner does not typically investigate events leading up to the bankruptcy filing. It feels like Season One of FTX: Trouble in Paradise has drawn to a close. SBF narrowly avoided jail thanks to a last-minute $250 million bond and is now chilling at home with his parents. Season Two will see him fighting for his freedom in court as his former friends, colleagues and lovers queue up to spill the beans. Everyone just wants to get the lightest sentence possible.   SBF's next court appearance is scheduled for the 3rd of January, so it won't be long before Season Two is up and running. In the meantime however, it feels like a good opportunity to pause and try to make sense of what has happened in the last few weeks. How on earth was it possible for this disaster to happen? When did everything start going wrong? And, how did a bunch of maths geeks who clearly weren't very good traders manage to mislead the whole industry for so long?   To answer these questions and many others, I got together with Ram Ahluwalia, the co-founder and CEO of Lumida - an investment advisory firm that focuses on digital assets. Ram has worked in finance for most of his career and has a level of knowledge and experience that few can match. He recently published some intriguing threads on Twitter that delved into the FTX/Alameda debacle and, having read them, I knew I had to talk with him in depth.    In our discussion we drilled down into Ram's thoughts on the disaster and why he believes it was a long time coming - longer perhaps than many people believe. He also talked through some of the mysteries of high finance that seem to have helped thwart SBF and his cronies and explained how those who were able to play the game better were able to profit at FTX and Alameda's expense.    This was a fascinating conversation to have and I'm grateful to Ram for taking the time to talk to me. SBF at SDNY Triggers Crypto Cooperator Qs As Ex Ellison Pleads Out Amid Bahamas Flight By Matthew Russell Lee, Patreon Maxwell book NY Mag LITERARY SDNY, Dec 21 – In the week after the SDNY press conference about Sam Bankman-Fried, in the courthouse and its Press Room the tension built. Court artists came, since photography is prohibited in the courthouse. Reporters staked out the courtroom of District Judge Ronnie Abrams, to whom the case had been assigned, and the small Magistrates Court where on most days Kurt Wheelock was the only member of the media, or even member of the public. It was all different now. "Crypto Man" was coming, as one non-techie reporter put it. Kurt tried to get ready. Since one of Kurt's beats before he came to the courthouse was banking, or anti-banking more precisely, he submitted Freedom of Information requests to the agencies which had allowed FTX / Alameda to buy a stake in Farmington State Bank (subsequently renamed Moonstone Bank), and put customers' money into Silvergate Bank. And then, as always, a break in the case. As Kurt Wheelock tried to re-index his website while uploading stories about the day's more obscure criminal cases, including a woman from Columbia seeking asylum after her husband was murdered - and, yes, selling fentanyl - two plea agreements and a video came in, from the prosecutors. Caroline Ellison and Gary Wang had pleaded guilty, it said, with the agreements signed on December 19. Apparently they withheld them until SBF was in the air and couldn't turn back. Or could he? Also, a recorded video from US Attorney Damian Williams, that SBF "will be transported directly to the Southern District of New York." That seemed to preclude an overnight in Essex County Correctional Facility in New Jersey, or the MDC in Brooklyn - in the EDNY. So was SBF in the same courthouse where Kurt sat typing, and shaking his fist at censorship, and looking out the window at Chinatown below? It emerged overnight that SBF had been flown into the Westchester airport in White Plains - yes, in the SDNY - and would from there be taken to the courthouse in the morning. Update It's been a while since our last update, but, suffice to say, we are still here! During 2021 we gradually increased our numbers again, from a low of 4 grantees mid-pandemic, to 15 by the end of the year (our full capacity, with no room sharing and 2 staff living on site). We lifted all Covid restrictions in March 2022, and things started to again feel like they were pre-pandemic. However, our building and its contents are old, and in mid-May this year we closed to new grantees for building repairs and maintenance. We reopened bookings again at the end of July, by which time we had once again got down to very low numbers - we are now up and running again and starting to fill up with new grantees, but we still have plenty of spare capacity. Please apply if you are interested in doing EA work at the hotel. We are offering (up to full) subsidies on accommodation and board for those wishing to learn or work on research or charitable projects (in fitting with our charitable objects). See our Grant Making Policy for more details. Along with the ups and downs in numbers, we've had ups and downs in other ways. We were delighted to receive our largest grant to date, from the FTX Future Fund, in May ($125k or ~ a year of runway), but this is now bittersweet given recent events. We condemn the actions of SBF and the FTX/Alameda inner circle, and are ashamed of the association. It's possible the grant will be subject to clawbacks as a result of the commenced bankruptcy proceedings. As with many FTX grantees in the EA Community, we are following and discussing the situation as it unfolds. We intend to follow the consensus that emerges around any voluntary returning of unspent funds. Despite the significant funding, with the ongoing energy crisis, inflation in general, and increased spending on building maintenance and salaries, our costs have risen rapidly, and we were recently down to ~4 months of runway again. Enter the Survival & Flourishing Fund (SFF). We are extremely grateful to have been awarded a grant of $224,000(!) by Jaan Tallinn as per their most recent announcement. In order to attract and retain talent, with the last grant we upped our management salaries to ~the UK median salary (£31,286), plus accommodation and food (worth about £6k). It's now 4.5 years since we first opened. Since then we have supported ~100 EAs aspiring to do direct work with their career development, and hosted another ~200 visitors from the EA community participating in events, networking and community building. We've established an EA community hub in a relatively low cost location. We believe there is plenty of potential demand for it to scale, but we still need to get the word out (which we are doing in part with this blog post). Our impact Grantee work There are two main aspects to our potential impact: the direct work and career building of our grantees, and the community building and networking we facilitate. We are open to people working on all cause areas of EA, with the caveat that the work we facilitate is desk-based and mostly remote. In practice, this has meant that longtermist topics, especially x-risks, and in particular AI Alignment, have been foremost amongst the work of the grantees we have hosted. But we have also had grantees interested in animal welfare, global health, wellbeing, development and progress, and meta topics related to EA community building. This is: Why didn't the FTX Foundation secure its bag?, published by Greg Colbourn on November 15, 2022 on The Effective Altruism Forum. “Asked whether he had set up any kind of endowment for his giving, Mr. Bankman-Fried said in the Times interview last month: “It's more of a pay-as-we-go thing, and the reason for that, frankly, is I'm not liquid enough for it to make sense to do an endowment right now.”” (Source (a)) Quite apart from the fact that in hindsight, the above quote should've been ringing alarm bells, I think a big lesson here is that foundations should "secure their bags" – aka secure assets/their endowment – early. The fact that the FTX Foundation didn't do this is a massive loss - for the world, EA, and FTX creditors. It's not even just about fraud or bankruptcy risk. Basic risk management would suggest that it should be done to hedge against the possibility of the major donors' wealth diminishing for any reason. This is a massive risk management failure from the high level EA community point of view of doing good with the money. Equity, or crypto, should've been donated to the foundation, and sold for cash by it. And the foundation should've been controlled by people who weren't FTX/Alameda! As a community, we put way too much faith and trust in those who owned/controlled FTX/Alameda, and insufficient effort into pressing for commitments to be secured. Trust, but verify. As I understand it, OpenPhil has a few $B that is theirs, under independent legal control (i.e. separate from Moskovitz and Tuna, who, whilst being board members, do not have unilateral control of the funds; they make up ⅖ of the board). The point I'm making here is bigger than just the loss of current promised grants. It's about making sure that money is secured when pledges are made, to minimise the risks of losing it. Otherwise the pledges don't count for much (as we can see here). If Moskovitz and Tuna went down now, OpenPhil would still have $Bs at its disposal. Sure, funds might be frozen for some amount of time (if the donors went bankrupt), but it is very unlikely that they would be lost. For a much smaller example, I can attest that with CEEALAR (the org I founded), we set up a charity, for which I only control ⅓ (i.e. the other two Trustees could out vote me), and I have donated the building to the charity. It can go on without me. Regarding any moral/PR risks of the FTX Foundation spending money now were it to have it; suppose the FTX Foundation was set-up like OpenPhil so it had at least $1B in assets that weren't under the control of SBF and his cronies. And suppose that money was made in a non-fraudulent way (which seems likely if it were to have been given last year, significantly before all the financial trouble started at FTX/Alameda). We would be in a much better position now even from the point of view of wanting (or being compelled) to use the money to pay back FTX creditors (i.e. there would be significantly more money for the creditors). In practice, maybe securing significant assets wasn't really possible with the FTX Foundation, given the likely illiquid nature of any sizable assets that FTX/Alameda could've donated (e.g. FTT or FTX stock), which have now collapsed in value. But it still would've been a step in the right direction. Did anyone at the FTX Foundation or Future Fund, or others in advisory roles, press for this? A side benefit might've also been uncovering the fraud earlier and perhaps mitigating it somewhat. Although note that I can't seem to find any public reference to the original source of the quote from “last month”. To use a phrase that is popular in crypto. See penultimate paragraph. I can imagine SBF saying something like the max-EV thing to do is keeping all the funds in the for-profit companies to maximise their growth, and the FTX Foundation / F...

Bankman-Fried seems to have generously funded a lot of effective altruism charities, artificial-intelligence and pandemic research, Democratic political candidates, etc. One $500 million entry on the desperation balance sheet is “Anthropic,” a venture investment in an AI safety company. [...] That seems consistent with the following excerpts from this page on Anthropic's website: Anthropic, an AI safety and research company, has raised $580 million in a Series B. The Series B follows the company raising $124 million in a Series A round in 2021. The Series B round was led by Sam Bankman-Fried, CEO of FTX. The round also included participation from Caroline Ellison, Jim McClave, Nishad Singh, Jaan Tallinn, and the Center for Emerging Risk Research (CERR). There remains a large amount of uncertainty about what exactly happened inside FTX and Alameda. I do not offer any new takes on what occurred. However, there are the inklings of some "lessons" from the situation that are incorrect regardless of how the details flesh out. Pointing these out now may seem in poor taste while many are still coming to terms with what happened, but it important to do so before they become the canonical lessons. 1. Ambition was a mistake There have been a number of calls for EA to "go back to bed nets." It is notable that this refrain conflates the alleged illegal and unethical behavior from FTX/Alameda with the philosophical position of longtermism. Rather than evaluating the two issues as distinct, the call seems to assume both were born out of the same runaway ambition. Logically, this is obviously not the case. Longtermism grew in popularity during SBFs rise, and Future Fund did focus on longtermist projects, but FTX/Alameda situation has no bearing on the truth of longtermism and associated project's prioritization. To the extent that both becoming incredibly rich and affecting the longterm trajectory of humanity are "ambitious" goals, ambition is not the problem. Committing financial crimes is a problem. Longtermism has problems, like knowing how to act given uncertainty about the future. But an enlightened understanding of ambition accommodates these problems: We should be ambitious in our goals while understanding our limitations in solving them. There is an uncomfortable reality that SBF symbolized a new level of ambition for EA. That sense of ambition should be retained. His malfeasance should not be. This is not to say that there may be lessons to learn about transparency, overconfidence, centralized power, trusting leaders, etc from these events. But all of these are distinct from a lesson about ambition, which depends more on vague allusions to Icarus than argument. 2. No more earning to give I am not sure that this is being learned as a "lesson" or if this situation simply "leaves a bad taste" in EA's mouths about earning to give. The alleged actions of the FTX/Alameda team in no way suggest that earning money to donate to effective causes is a poor career path. Certain employees of FTX/Alameda seem to have been doing distinctly unethical work, such as grossly mismanaging client funds. One of the only arguments for why one might be open to working a possibly unethical job like trading crypto currency is because an ethically motivated actor would do that job in a more ethical way than the next person would (from Todd and MacAskill). Earning to give never asked EAs to pursue unethical work, and encouraged them to pursue any line of work in an ethically upstanding way. (I emphasize Todd and MacAskill conclude in their 2017 post: "We believe that in the vast majority of cases, it's a mistake to pursue a career in which the direct effects of the work are seriously harmful"). Earning to give in the way it has always been advised-by doing work that is basically ethical-continues to be a highly promising route to impact. This is especially true when total EA assets have significantly depreciated. There is a risk that EAs do not continue to pursue earning to give, thinking either that it is icky post-FTX or that someone else has it covered. This is a poor strategy. It is imperative that some EAs who are well suited for founding companies shift their careers into entrepreneurship as soon as possible. 3. General FUD from nefarious actors As the EA community reals from the FTX/Alameda blow up, a number of actors with histories of hating EA have chimed in with threads about how this catastrophe is in line with X thing they alre...
