Pav Gill, ex-APAC Head of Legal at Wirecard, joins Jeremy Au to share how he uncovered one of the largest financial frauds in Europe. They discuss Pav's early career shift from traditional law to fintech, the moment red flags at Wirecard became undeniable, and how an internal whistleblower's plea led him to launch a covert investigation. Pav reveals how management retaliation escalated into threats, fake HR cases, and even potential physical harm. With support from his mother, he connected with investigative journalists, leading to Financial Times exposés and Wirecard's collapse. Pav reflects on the limits of legal privilege, the challenges of systemic fraud, and how founding his governance startup, Confide, helps companies act on misconduct before it spirals. 03:00 Pav joined Wirecard for Fintech exposure: He left a low-paid legal role at GoBear and was attracted by Wirecard's billion-dollar scale and regional autonomy. 07:00 Subsidiary financials didn't match reported earnings: Pav noticed Asia's books were consistently late, loss-making, and inconsistent with group-level EBITDA claims. 08:15 A junior employee blew the whistle to Pav: She feared for her life and refused to carry out forged transaction requests, trusting him as a neutral legal party. 13:00 Pav found fake invoices and logos in inboxes: Wirecard staff had blatantly doctored client documents—indicating round-tripping and money laundering. 17:30 Management shut down the investigation and targeted him: Pav faced office intimidation, HR setups, and was asked to travel to Jakarta under suspicious pretext. 33:35 Pav's mother connected him to journalists: She contacted Clare Rewcastle Brown, who referred them to the Financial Times and helped spark public investigations. Was fehlt solchen Menschen? Selbstreflexion.

How do we create systems that encourage whistleblowing without incentivizing malicious reporting? Should we reward whistleblowers financially? Why is closure important, both for whistleblowers and the organisations they are whistleblowing on? Episode SummaryOn this episode, I speak with Pav Gill, the whistleblower behind the Wirecard scandal and former General Counsel for Wirecard's Asia Pacific operations. But this conversation isn't about Wirecard. Instead, we explore the broader dynamics of whistleblowing—beyond high-profile scandals—focusing on the personal and organizational challenges of speaking up. Pav shares insights into what happens after a whistleblower comes forward, why some struggle to move on while others thrive, and how organizations can encourage reporting without creating perverse incentives. We discuss the psychological toll of whistleblowing, the role of incentives in encouraging disclosures, and the importance of closure—not just for individuals but for entire organizations. Pav also introduces the Confide Platform, his end-to-end whistleblowing platform designed to improve the process for both whistleblowers and companies. With experience as both a whistleblower and a compliance professional, he offers a unique perspective on making whistleblowing work for all stakeholders. Whether you work in compliance, risk, legal, or HR or are simply interested in ethical business practices, this episode will provide fresh insights into a complex topic. Guest BiographyPav Gill is the founder and CEO of The Confide Platform, a whistleblowing tool that streamlines the reporting and management of corporate misconduct. He gained prominence as the whistleblower behind the Wirecard scandal, exposing a multi-billion-dollar fraud that ultimately led to the company's collapse. At the time, Pav was General Counsel for Wirecard's Asia Pacific operations. His decision to speak out was instrumental in bringing the case to light. Beyond his whistleblowing experience, Pav is a legal and compliance expert with deep knowledge of corporate governance, risk management, and regulatory compliance. Before founding the Confide Platform, he held leadership roles, providing legal and strategic counsel in high-stakes corporate environments. His insights into whistleblowing—shaped by both personal experience and professional expertise—make him a leading voice on ethical corporate behaviour and whistleblower protections.

Dan McCrum investigated a story at Wirecard that had him fearing for his safety.British journalist Dan McCrum usually writes about businesses for the London-based newspaper, the Financial Times. In 2014 he got a tip off alleging there were so-called gangsters behind a much-feted German company called Wirecard. The company had started small, taking care of the technical part of processing online payments. But by the time Dan starting looking into it, it was entering the big league. And what he discovered took him into unchartered territory: of international spies, underworld deals and fraud on a massive scale. The chief executive Markus Braun was arrested in 2020 and is now on trial in Germany. He denies all charges against him and says he himself was deceived. At the request of Germany, Interpol issued a red notice for the arrest of Wirecard's former Chief Operating Officer, Jan Marsalek. He is believed to have fled to Russia.Dan's written a book about his investigation called Money Men: A Hot Startup, A Billion Dollar Fraud, A Fight for the Truth.Presenter: Jo Fidgen Producer: Jo Impey Editor: Munazza KhanGet in touch: liveslessordinary@bbc.co.uk or WhatsApp: 0044 330 678 2784

How does a respected financial institution turn into a criminal operation? In this episode of Corruption, Crime, and Compliance, host Michael Volkov dives into the record-breaking $3 billion settlement between TD Bank and the Department of Justice over pervasive violations of the Bank Secrecy Act (BSA) and Anti-Money Laundering (AML) laws. Highlighting TD Bank's systemic failures, Michael explores how the bank's compliance and oversight lapses led to criminal conduct within its operations, making it a case study on the dangers of prioritizing growth over legal compliance. From failed AML programs to enabling money laundering on a massive scale, this episode sheds light on the regulatory crackdown TD Bank now faces.Hear him discuss: TD Bank's $3 billion penalty sets a new high for banking compliance cases. In yet another reminder of the scope of Justice Department enforcement powers, and an important demonstration of the risks of non-compliance, the Justice Department and relevant banking agencies announced a $3 billion settlement with TD Bank companies to resolve systemic and pervasive Bank Secrecy Act ("BSA") and money laundering violations.TD Bank's internal culture sidelined AML compliance, leading to massive oversights, including unmonitored transactions worth $18.3 trillion from 2018 to 2024. TD Bank enforced a “flat-cost paradigm,” restricting the compliance budget, which prevented updates and adaptations needed to meet new risk levels.TDBUSH pleaded guilty to causing TDBNA to fail to maintain an AML program that complies with the BSA and to fail to file accurate Currency Transaction Reports ("CTRs").Despite multiple warnings from internal audits and third-party consultants, the bank maintained its flawed AML protocols without significant action.TD Bank earned the ignominious record: TD Bank is the largest bank in U.S. history to plead guilty to Bank Secrecy Act program failures, and the first US bank in history to plead guilty to conspiracy to commit money laundering. With this settlement, TD Bank joins a list of high-profile compliance failures alongside companies like Wells Fargo and Wirecard, furthering the call for financial institutions to prioritize ethical compliance in their growth models.ResourcesMichael Volkov on LinkedIn | TwitterThe Volkov Law Group

Lionel Barber is the former editor of the Financial Times and probably the only journalist on the planet to have interviewed Presidents Obama, Trump and Putin. Under his stewardship, the FT metamorphosed from a newspaper into a digital subscription business, and was sold to the Japanese company Nikkei for 44x earnings. And as editor, Barber fully backed up former guest Dan McCrum in his investigation of Wirecard. I was delighted when Lionel agreed to come on the show to talk about his new book, Gambling Man, a biography of Masa Son, founder of Softbank and creator of the $100bn Vision Fund. I have long been curious about Son, who for 3 days at the peak of the dot.com boom was the richest man in the world. Barber spent 3 years writing his meticulously researched book for which he interviewed 150 subjects, including Bill Gates and Warren Buffett, as he explains in our discussion. Some of his stories, including his description of Son's inner sanctum, are marvellous. If you enjoy this episode, head over to our Substack, (sign up button on https://behindthebalancesheet.com/), take the monthly paid option and get exclusive additional content, including Steve's interview with Alok Sama, former CFO of Softbank International.
Join us in this episode of Jimmy's Jobs of the Future as we delve into the experiences and insights of Lionel Barber, former editor of the Financial Times, and the intriguing life of Masayoshi Son, the visionary founder of SoftBank. Explore Barber's reflections on interviewing world leaders like Vladimir Putin, Barack Obama, and Angela Merkel, and his observations on the future of artificial intelligence and journalism.
Silicon Valley couldn't be farther from the confines of Langley or Fort Meade, let alone Beijing or Moscow. Yet, the verdant foothills of suburban sprawl that encompass the Bay Area have played host to some of the most technically sophisticated espionage missions the world has ever seen. As the home of pivotal technologies from semiconductors to databases, artificial intelligence and more, no place has a greater grip on the technological edge than California — and every nation and their intelligence services want access. It just so happens that almost no national security reporter sits on this beat. Nearly all cover the sector from Washington, or in rare cases New York. All except one that is: Zach Dorfman. Zach has been driving the coverage of the technical side of espionage operations for years, and his pathbreaking scoops about China's unraveling of the CIA's network of operatives in the early 2010s were widely read in DC officialdom. Now, he's published two blockbuster features, one in Politico Magazine on the FBI's attempts to intercede in the chip trade between the U.S. and the U.S.S.R. at the height of the Cold War in the 1980s, and the other in Rolling Stone on a deep-cover agent and the very human consequences of state-to-state skullduggery. Zach and host Danny Crichton talk about Silicon Valley's history in industrial espionage, the tricky mechanics of intercepting and disabling chip shipments to the Soviet Union, why the U.S.S.R. was so keen on learning the market dynamics of computing in America, the risks for today's companies around insider threats, Wirecard and Jan Marsalek and finally, some thoughts on Xi Jinping and how China's rollup of the CIA's mainland intelligence network affected his leadership of America's current greatest adversary. This summer break, we'll be taking a pause from uploading new episodes. However, Jules and Jonathan have handpicked some favorite past episodes for new listeners to enjoy and subscribers to revisit! There's a negative connotation associated with short selling – the act of betting against a stock to perform well. But is this trading practice truly a bad thing? In this episode of All Else Equal: Making Better Decisions, hosts and finance professors Jonathan Berk and Jules van Binsbergen build the case for short selling as a dynamic regulating force in the free market. And an incentive for individuals to investigate and expose fraud.Later in the episode, Jonathan and Jules speak with Marc Cohodes, whose notable short-selling decisions have landed him in hot water with powerful figures all over the world. Cohodes has exposed a series of fraudulent practices – from mortgage lender Novastar to digital finance giant Wirecard, and most recently the cryptocurrency exchange FDX – and shares his view on the role of short sellers to step in where government regulation fails.Submit your questions to the show here: https://bit.ly/AllElseEqualFind All Else Equal on the web: https://www.gsb.stanford.edu/business-podcasts/all-else-equal-making-better-decisionsAll Else Equal: Making Better Decisions Podcast is a production of Stanford Graduate School of Business and is produced by University FM.See Privacy Policy at https://art19.com/privacy and California Privacy Notice at https://art19.com/privacy#do-not-sell-my-info.
