(The Center Square) – The Illinois Freedom Caucus has filed articles of impeachment against Gov. J.B. Pritzker for what it says is his engaging in conduct that constitutes inciting violence. Part of the impeachment resolution in House Resolution 466 that the Illinois Freedom Caucus filed includes quotes from Pritzker's State of the State speech on Feb. 19 where he characterized the Trump administration as using an authoritarian playbook. “If you think I'm overreacting and sounding the alarm too soon, consider this: It took the Nazis one month, three weeks, two days, eight hours and 40 minutes to dismantle a constitutional republic,” Pritzker said earlier this year. Transcription / Notes FREE SPEECH OR INCITEMENT TO VIOLENCE Hello, this is Darrell Castle with today's Castle Report. This is Friday the 5th day of September in the year of our Lord 2025. I will be talking about the deterioration of freedom and the imposition of top-down control of speech and thought in the mother country that once believed in the concept of freedom. From at least the year 1215 when the Great Charter the Magna Charta was imposed on King John by the British nobles English people have had the proud belief that they were free. King John did not resist but accepted the concept in writing that the law applies equally to all Englishmen, King and commoner alike. When the American colonies rebelled it was at least in part because they wanted the rights of ordinary Englishmen which they believed they were. In a system that is euphemistically referred to as democracy, people are supposed to choose their own leaders so the government is the people. That is the belief that we accept as true even when we know it no longer is true if it ever was. I am talking about Great Britain right now rather than the United States because things are happening in Britain that would not be tolerated here or at least I hope it would not be. By way of disclaimer, I haven't been to England in many years to see firsthand for myself what is happening, but I read and follow the stories continually reported by others. Great Britain seems to be in the middle of a crises involving immigration and the rights of immigrants versus the rights of Englishmen. The English government and recently the courts have clearly taken the position that immigrant rights are preeminent and that has led to a crises that many believe is the precursor to civil war. Why would a government of the people choose to prosecute its own people for just talking about immigrants in a negative way. Unbelievable, yet we accept it as true because it is happening right now in Great Britain. For example, consider the case of British comedian Graham Linehan. I admit that I was completely unfamiliar with the man until I, like the rest of the world, read his words and followed his story. His story is all the more disturbing because it is not at all unusual in England today. Mr. Linehan was in America doing some type of project in Arizona. When he attempted to board his flight to London he was singled out and subjected to extra screening, etc. He chalked it up to the joys of air travel today but when he arrived in London he found it was a lot more than just inconvenience. “The moment I stepped off the plane at Heathrow, five armed police officers were waiting. Not one, not two—five. They escorted me to a private area and told me I was under arrest for three tweets. In a country where pedophiles escape sentencing, where knife crime is out of control, where women are assaulted and harassed every time they gather to speak, the state had mobilized five armed officers to arrest a comedy writer for this tweet (and no, I promise you, I am not making this up).” OK, here is the tweet, or printed statement, or expressed thought, however you want to say it that got him arrested. “If a trans-identified male is in a female-only space, he is committing a violent, abusive act. Make a scene, call the cops and if all else fails, punch him in the balls.” There were three tweets in total as the officers told him but I won't quote the others because there is profanity in them. This case is significant and we hear of it because the victim is a prominent man who apparently has a popular presence on British television. They confiscated his belt, carry- on bag, and electronic devices and put him in a holding cell. This case is common and is happening all the time but we know of this one for the reaso...

The Bill of Rights and subsequent amendments and judicial interpretations embody these rights. Dynamic and Evolving: This area of law is presented as dynamic, requiring an understanding of its historical development, the balance between liberty and governmental interests, and the precedent set by landmark Supreme Court decisions. Key Themes: The lecture focuses on three primary areas: First Amendment Freedoms (free speech, freedom of the press, and religious freedom); Due Process and Equal Protection (the 14th Amendment, procedural and substantive due process, and equal protection under the law); and Landmark Supreme Court Cases (pivotal decisions that have shaped the interpretation and application of individual rights). Practical Importance: Understanding these rights is deemed crucial for both bar exam success and effective legal practice, given their intersection with numerous aspects of society. II. Ohio. **Brandenburg Test (1969):**The speech must be "directed at inciting or producing imminent lawless action" and "likely to incite or produce such action." This test significantly expanded free speech protection, moving focus from abstract advocacy to concrete threats. Implications: The Brandenburg standard has influenced contemporary debates about online speech, protests, and incendiary rhetoric. It underscores the tension between free speech and the harms posed by speech. B. Freedom of Religion Dual Protection: The First Amendment protects religious freedom through two key provisions: Establishment Clause: Prohibits the government from establishing an official religion or favoring one religion over another. It promotes a separation of church and state and religious neutrality. **Lemon Test (Lemon v. Kurtzman):**The government action must have a secular purpose, its primary effect must neither advance nor inhibit religion, and it must not foster excessive government entanglement with religion. Free Exercise Clause: Protects individuals from government actions that substantially burden their religious practices. It guarantees the right to worship or abstain from religion freely.

(Adam@TheWorldview.com) By Jonathan Clark Iranian Christian released from prison 5 years early Church in Chains reports that authorities in Iran released a Christian convert from Evin Prison in Tehran last week. Mehdi Akbari had already spent nearly five years in prison out of his 10-year sentence. Thankfully, a court reduced his sentence.  Officials arrested him in 2019 on charges of “acting against national security by forming an illegal evangelical Christian group.”  Mansour Borji with Article 18, a non-profit religious liberty group, welcomed Mehdi's release. He said, “We call now for the immediate release of the other at least 20 Christians still in prison only on account of their beliefs and the peaceful outworking of these beliefs, such as Armenian citizen Hakop Gochumyan, who is also serving a ten-year sentence only because he visited some churches and was in possession of a handful of Bibles.” Irish legislature drops ambiguously worded “hate speech” bill The Irish legislature dropped “hate speech” elements from proposed legislation last month. The Incitement to Violence or Hatred and Hate Offences Bill 2022 is currently stuck in the Irish Senate. The bill originally would criminalize the possession of material considered “likely” to incite hatred with up to five years in jail. The bill did not clearly define “hate.” This left many concerned that Christians could face jail time for simply affirming a Biblical understanding of sexuality. Alliance Defending Freedom International noted, “With the world watching, the people of Ireland said ‘no' to state censorship, and it's working.” Colorado Supreme Court dismissed case again Christian baker Jack Phillips In the United States, the Colorado  Supreme Court sided with a Christian baker on Tuesday. Jack Phillips of Masterpiece Cakeshop has faced years of harassment for his biblical beliefs about marriage and sexuality.  The state's high court dismissed the latest case against him. The case started in 2017 when Phillips refused to bake a cake to celebrate someone pretending to be the opposite sex. Senior Counsel Jake Warner with Alliance Defending Freedom said, “Enough is enough. Jack has been dragged through courts for over a decade. It's time to leave him alone. Free speech is for everyone. As the U.S. Supreme Court held in 303 Creative, the government cannot force artists to express messages they don't believe.” Psalm 14:4 asks, “Have all the workers of iniquity no knowledge, who eat up My people as they eat bread, and do not call on the LORD?”  Toyota ends participation in sexually deviant corporate index Toyota told its U.S. employees last Thursday that it will no longer participate in the Human Rights Campaign's Corporate Equality Index. The Equality Index, run by the radical, pro-homosexual Human Rights Campaign, measures how supportive companies are of sexually perverted lifestyles. Toyota will reportedly no longer participate in events that celebrate such lifestyles. The Japanese car maker will also focus its community activities on workforce readiness and education in science, technology, engineering, and math. 10 states have abortion on the ballot Voters across 10 states will vote on ballot initiatives involving abortion this coming November. Those states are Arizona, Colorado, Florida, Maryland, Missouri, Montana, Nebraska, Nevada, New York, and South Dakota. In most cases, the initiatives would support abortion up to birth. U.S. Republican Sen. Josh Hawley of Missouri addressed the 2024 Pray Vote Stand Summit last week on the ballot initiatives. Listen. HAWLEY: “As the people go to the polls, let's be clear, as conservatives and yes, as Republicans, that we advocate life, that we urge our fellow Americans to support life.  We will do everything we can to protect life in the law all across this country. This is absolutely foundational!” Barna: 32 million Christians unlikely to vote in presidential election Dr. George Barna  released a report on the voting practices of people of faith. The survey found that 104 million people who identify with some religion are unlikely to vote in the upcoming presidential election. Sadly, this includes 32 million self-identified Christians who attend church regularly. People said they were unlikely to vote because they weren't interested in elections, disliked the major candidates, or didn't think their vote would make a difference. William Tyndale's momentous life and death And finally, this week is the anniversary of William Tyndale's death, traditionally commemorated on October 6. Tyndale faced arrest and later death in 1536 for alleged heresy. However, he had worked tirelessly to translate the Bible into English. It was his devotion to Scripture that brought him into conflict with church and civil leaders. In response to an assertion of the supremacy of the Pope, Tyndale famously said, “I defy the Pope and all his laws; and if God spares my life, ere many years, I will cause the boy that driveth the plow to know more of the Scriptures than thou dost!” Tyndale's final words, spoken at the stake with a fervent zeal, and a loud voice, were reported later as "Lord! Open the King of England's eyes." Then, Tyndale was strangled to death  while tied at the stake, and then his dead body was burned.   Copies of Tyndale's translation were smuggled into England by the thousands. His work would form the basis of the Great Bible, edited by Miles Coverdale which made its way into every parish church just three years after Tyndale's death. Volokh is the author of the textbooks The First Amendment and Related Statutes (8th ed., 2023) and Academic Legal Writing (5th ed., 2016), as well as more than one hundred law review articles. He is the founder and coauthor of The Volokh Conspiracy, a leading legal blog. Before coming to UCLA, Volokh clerked for Justice Sandra Day O'Connor on the US Supreme Court. Jane Bambauer is the Brechner Eminent Scholar at the University of Florida's Levin College of Law and the College of Journalism and Communications. She teaches Torts, First Amendment, Media Law, Criminal Procedure, and Privacy Law. Bambauer's research assesses the social costs and benefits of Big Data, AI, and predictive algorithms.
