Charlie Adelson Seeks Retrial in Dan Markel Murder Case Due to Alleged Conflict of Interest

Charlie Adelson, convicted of orchestrating the murder of FSU Law Professor Dan Markel, is seeking a retrial due to a claim of unfair legal representation. His new appellate attorney, Michael Ufferman, filed a motion with the First District Court of Appeals requesting that the case be sent back to the lower court. Ufferman argues that a conflict of interest involving Adelson's former attorney violated his client's 6th Amendment rights. According to the motion, Ufferman claims that Adelson's former defense attorney, Dan Raushbaum, had a conflicting role during the trial, as he was simultaneously representing Charlie Adelson's mother, Donna Adelson, since 2022. This overlapping representation began prior to Charlie's arrest. Donna Adelson is an alleged co-conspirator in the 2014 murder-for-hire plot that resulted in Markel's death. Prosecutors allege that Charlie hired hitmen to carry out the killing of his former brother-in-law amid a contentious custody dispute involving Charlie's sister, Wendi Adelson. The conflict of interest, Ufferman argues, stems from Raushbaum's representation of both Charlie and Donna Adelson. Florida criminal defense attorney Don Pumphrey reacted strongly to the development, calling it a “plot twist.” “He represented them both,” Pumphrey explained. “He automatically has the potential for a divided loyalty, but after Charlie Adelson is arrested and continued representation, that creates an actual conflict of interest.” This alleged conflict was significant enough, according to Ufferman, to warrant a retrial. He noted that Donna Adelson had initially been placed on the defense's witness list for Charlie's trial in 2023 but was later removed. Ufferman contends that the removal served Donna's interests more than Charlie's, suggesting divided loyalties during the trial. “There are indicators that loyalty was shown to Donna Adelson during Charlie Adelson's trial representation,” Pumphrey said, emphasizing that Raushbaum's decision to remove Donna from the witness list could raise questions about the fairness of the defense. Ufferman believes that the conflict of interest impacted Charlie Adelson's ability to receive a fair trial and has requested the Court of Appeals return jurisdiction to the lower court. If granted, a lower court judge would decide whether Charlie should be retried. However, Pumphrey predicts that a retrial could prove challenging for Charlie Adelson. “I think the state's case only gets stronger, not weaker, so if he does get a new trial, I think the state will be prepared,” Pumphrey said. Donna Adelson, who is awaiting trial for her alleged role in the murder conspiracy, is set to appear in court next. As her legal battle continues, Charlie Adelson's attempt to secure a new trial will be closely watched by those following the case. While Ufferman's motion lays out the argument for divided loyalties, the ultimate decision rests with the appeals court and potentially a future trial court. For now, both Adelson and his mother remain central figures in a high-profile case that has drawn national attention for its shocking details and legal complexities. OzAurum Resources Ltd (ASX:OZM) has commenced drilling at the Boca Rica Lithium Project in Brazil, using its own drilling rig which has been updated to meet Australian standards. CEO and managing director Andrew Pumphrey tells Proactive's Stephen he has been in Brazil for the past few weeks preparing the site. The company has achieved significant milestones in enhancing site access and positioning the drilling rig on a steep hill. The drilling program is set to explore below a weathered zone, aiming to reach fresh rock at approximately 80 metres depth, targeting a spodumene crystal formation previously discovered in an underground adit. This zone is anticipated to yield more extensive geological data and potential significant lithium deposits. OzAurum is financially prepared for this phase, with cash of A$1.4 million and benefiting from lower operational costs due to owning its drilling equipment. Pumphrey said this cost-efficiency allows flexibility in its ongoing diamond drilling programme. The results from the first drill hole will guide future drilling efforts. Pumphrey also mentioned that sample analysis by Brazilian labs could take about a month, with results expected to influence the next steps in their exploration. #OzAurumResources #PuertoRicoLithiumProject #LithiumMining #AndrewPumphrey #MineralExploration #Geology #DrillingProgram #ResourceSector #LithiumCrystals #MiningIndustry #ProactiveInvestors #invest #investing #investment #investor #stockmarket #stocks #stock #stockmarketnews

OzAurum Resources Ltd (ASX:OZM) CEO and managing director Andrew Pumphrey sits down with Proactive's Jonathan Jackson to discuss an upcoming drilling program at Boca Rica Lithium Project in Brazil, following the identification of a spodumene zone. The company plans to start drilling in the next three to four weeks, contingent on weather and the receipt of environmental permits. Pumphrey emphasised the project's potential for a major lithium discovery, highlighting the strategic scale of the site and the comprehensive fieldwork conducted in Brazil. Besides Boca Rica, OzAurum is actively pursuing other lithium opportunities and is engaged in discussions for additional acquisitions. The company also has interest in niobium and rare earth element (REE) opportunities in Brazil, and has lodged applications for 50,000 hectares of tenure prospective for niobium and REE near known Brazilian carbonatite complexes. #ProactiveInvestors #OzAurumResources #ASX #CriticalMinerals #Lithium #Niobium #invest #investing #investment #investor #stockmarket #stocks #stock #stockmarketnews

How incredible would it be if you would work on a project with one of your closest friends? How incredible would it be if that friend were your brother? How cooler still if the project was a book based on your own adventures growing up? That's the case with the guests on the latest episode of The DTALKS Podcast. Jarrett & Jerome Pumphrey have been working on books for years and only recently were able to show the world what a dynamic duo they are. They're publishing the books they wish they had growing up and telling the stories they want to tell. Our conversation on the podcast covered their backgrounds in writing & illustrating, the decision to make their latest book a "part comic/part written word" book, and what's next. Enjoy! About Jarrett & Jerome Pumphrey Jarrett is an award-winning author-illustrator. He makes books for kids with his brother, Jerome. Their books include It's a Sign!, Somewhere in the Bayou, The Old Boat, and their author-illustrator debut, The Old Truck, which received seven starred reviews, was named a Best Book of the Year by Publishers Weekly, and received the Ezra Jack Keats New Author Honor. Jerome is a designer, illustrator, and writer, originally from Houston, TX. He studied graphic design at the Art Institute of Austin and has worked as a technical writer, freelance graphic designer, and illustrator. About Link + Hud: Heroes by a Hair Meet Link and Hud―brothers causing chaos in the first of a new middle grade series from real-life brothers Jarrett and Jerome Pumphrey. Lincoln and Hudson Dupré are brothers with what grown-ups call “active imaginations.” Link and Hud hunt for yetis in the Himalayas and battle orcs on epic quests. Unfortunately, their imaginary adventures wreak havoc in their real world. Dr. and Mrs. Dupré have tried every babysitter in the neighborhood and are at their wits' end. Enter Ms. Joyce. Strict and old-fashioned, she proves to be a formidable adversary. The boys don't like her or her rules and decide she's got to go. Through a series of escalating events―told as high-action comic panel sequences―the brothers conspire to undermine Ms. Joyce and get her fired. When they go so big that even Ms. Joyce can't fix it, suddenly she's out. Finally, success! Or is it? With warm and authentic humor, Jarrett and Jerome Pumphrey have blended prose and graphic novel-style illustrations to craft a unique and subversive new series full of brotherly mischief and mayhem. Kirk Pumphrey grows 160 acres of almonds on Westwind Farms in Yolo County. He has been on a seven-year journey to finetune his operation, especially in the areas of irrigation efficiency and distribution uniformity.   “In ‘13 and ‘14 the market was down, and a piece of property became available. I got through the planning of the orchard probably moving, I would say a bit quick in not doing as much research as I probably should have…. I quickly learned and understood the deficiencies of those decisions and reached out for help. - Kirk Pumphrey   Through this process he has developed close relationships with researchers at UC Davis, local resource conservation districts (RCDs) and others. Pumphrey has been driven to find the latest research and best practices that work for him on his farm. Not only is he collaborating with UC Davis on multiple research projects, but he has also worked with https://www.tehamacountyrcd.org/kevin-greer (Kevin Greer) at the Tehama County Resource Conservation District to run distribution uniformity tests, and has found a way to remove boron from his water and sell it as a fertilizer to areas that are deficient. Given the last few years of severe drought, Pumphrey has explored flowmeters and the impact they have had on his water efficiency.   “We'll find at the beginning of the year, the output of that well is “x.” We've already noticed by the end of this month of April that we're in right now, a difference that our well output already has. Consequently, runtimes are a bit longer and I'm sure as we progress through the season, the same thing's going to happen, and the water volume will change. You can't use anything that's theoretical. You've got to base it on gallons.” - Kirk Pumphrey   In Today's episode: Meet Kirk Pumphrey, an almond grower on Westwind Farms in Yolo County. Explore the journey he has taken towards collaborating with researchers and RCDs to best use the resources he has available Discover Pumphrey's use and recommendation of flowmeter sensors to increase his water efficiency Learn about his best practices in timing and application for pursuing grant money to help your operation be as efficient as possible without incurring extra expense “The volume of water in the world is not going to change tomorrow. It's a closed system and we have a management problem of that water. And we, as a society, need to understand how we are going to manage this better.” - Kirk Pumphrey   ABC Update There's no easy year when it comes to farming in California, and as you just heard from Pumphrey, the journey to get it right doesn't really have a final destination. Since 1973 the almond community has supported more than $89 million in research to improve farming practices. One of the many deliverables from this investment is a number of helpful research-backed resources that growers can access for free. Almond Board Senior Manager of Industry Relations and Communications https://www.almonds.com/about-us/meet-the-board (Jenny Nicolau) says a good place to start is http://almonds.com/growertools (almonds.com/growertools), where you'll find a whole irrigation section with each tool listed separately and east to access. The page also contains educational videos from the irrigation station series that the Almond Board produced a few years ago. Growers can get more information about the tools and topics by accessing the https://www.almonds.com/almond-industry/orchard-management (“Orchard Management”) section of the “Almond Industry” tab and search by topic.    For more information about this or any of the topics we discuss on this podcast, reach out to the Almond Board's Field Outreach Team directly at fieldoutreach@almondboard.com.      The Almond Journey Podcast is brought to you byhttps://www.almonds.com/ ( the Almond Board of California). This show explores how growers, handlers, and other stakeholders are making things work in...
