This Day in Legal History: United States v. CruikshankOn March 27, 1876, the U.S. Supreme Court decided United States v. Cruikshank, a ruling that exposed the Court's deep reluctance to enforce the promises of Reconstruction. The case arose from the Colfax Massacre, where dozens of Black citizens were murdered by white supremacists attempting to overturn a contested election. Federal prosecutors secured convictions under the Enforcement Act, aiming to protect Black citizens' constitutional rights in the face of organized racial violence. The Supreme Court, however, dismantled those convictions with striking indifference to the underlying atrocities. The Court held that the Fourteenth Amendment constrained only state action, not the conduct of private individuals, effectively shielding perpetrators of racial terror from federal accountability. It further ruled that rights such as assembly and bearing arms were not protected from state interference through the Constitution at that time. This narrow interpretation gutted federal enforcement power at precisely the moment it was most needed. The decision ignored the reality that state authorities in the South were often unwilling—or actively refusing—to protect Black citizens.Critically, the Court's reasoning elevated formal legal distinctions over the lived experience of widespread, systematic violence. By insisting on a rigid state-action requirement, the justices created a legal loophole large enough to permit organized terror campaigns to flourish unchecked. The ruling signaled to white supremacist groups that federal intervention would be weak or nonexistent. In doing so, it contributed directly to the collapse of Reconstruction-era protections and the rise of Jim Crow. The long-term consequences were profound, as Cruikshank became a cornerstone for limiting civil rights enforcement for decades. It delayed meaningful federal protection of individual rights until well into the twentieth century. Modern constitutional law has largely rejected its reasoning through incorporation doctrine, yet its impact remains a stark reminder of how judicial decisions can entrench injustice.A federal judge in California issued a preliminary injunction blocking the Trump administration from labeling Anthropica national security supply chain risk, finding the move was likely unconstitutional retaliation. The dispute arose after Anthropic pushed back during contract negotiations with the government, arguing it should be allowed to limit how its AI system Claude is used, particularly for mass domestic surveillance and autonomous weapons. Shortly after the company made its position public, the administration directed agencies to stop using its tools and moved to formally designate it as a security risk.Judge Rita F. Lin concluded that Anthropic is likely to succeed on its claims, emphasizing that the government appeared to be punishing the company for publicly criticizing its contracting stance. She found that the measures were not closely tied to genuine national security concerns and instead resembled retaliation for protected speech. The court stressed that while the government is free to choose its vendors, it cannot take additional punitive steps that violate constitutional protections. The ruling also found that the designation was likely unlawful under the Administrative Procedure Act and potentially violated due process because Anthropic had no opportunity to respond. The judge noted that branding a company as a national security threat for expressing disagreement raises serious constitutional concerns. The injunction blocks enforcement of the directive and prevents further action against the company while the case proceeds. The decision highlights broader tensions between government control over AI use and private companies' efforts to impose ethical limits. It also underscores concerns that government retaliation could chill public debate about AI safety. The administration must now report back to the court on its compliance with the order.Anthropic Blocks Pentagon's ‘Orwellian' Security Risk Label - Law360US judge blocks Pentagon's Anthropic blacklisting for now | ReutersA lawyer for Elon Musk has asked a federal judge to review a jury verdict that found him liable for defrauding Twitter investors during his acquisition of the platform, now known as X. The request focuses in part on the jury's use of the number “$4.20” on the verdict form, which Musk's attorney argued was an intentional joke that showed bias and suggested the jury was trying to “send a message” rather than decide the case impartially.Musk's legal team claims this, along with other alleged trial issues, undermines the integrity of the verdict and warrants further judicial review by Judge Charles Breyer. The verdict, issued on March 20, found Musk liable for certain public statements he made about the prevalence of bots on the platform during the acquisition process, which investors argued harmed the company's stock price. Potential damages in the case could reach as high as $2.5 billion.Attorneys for the investors strongly rejected Musk's arguments, calling them baseless and accusing him of attacking the jury instead of accepting responsibility. They emphasized that the verdict followed substantial evidence presented at trial. The dispute stems from claims that Musk publicly criticized Twitter to renegotiate or exit the deal, ultimately affecting shareholders who sold at lower prices. While the jury found him liable for some statements, it did not conclude that he engaged in a broader scheme to defraud.Musk urges judge to review Twitter verdict, accuses jury of ‘mocking' him | ReutersThe U.S. Court of Appeals for the Second Circuit revived part of an ERISA class action against Wells Fargo and Ocwen Financial Corp., overturning a lower court decision that had dismissed the case before trial. The lawsuit was brought by trustees of a union pension fund, who claim the companies mishandled subprime mortgages tied to the fund's investments in mortgage-backed securities. The appellate court found that the trial judge made a key mistake in concluding that none of the underlying mortgages qualified as ERISA plan assets. While the court agreed that some mortgage-backed securities—specifically those structured as notes—are not plan assets, it ruled differently for securities issued as trust certificates. In those instances, the underlying mortgages can count as plan assets because the investment structure gives the pension fund an equity-like interest in the trust. This distinction matters because ERISA fiduciary duties apply only to plan assets. By recognizing that certain underlying mortgages fall within that definition, the court reopened the possibility that the companies could be held liable for breaching fiduciary duties. The pension fund alleges that the defendants mishandled loans during the 2007–2009 financial crisis, including pushing borrowers into foreclosure, which harmed the fund's investments. The court declined to decide whether Ocwen acted as an ERISA fiduciary, noting that the lower court had not addressed that issue. As a result, the case will return to the trial court for further proceedings on the revived claims.2nd Circ. Reopens Mortgage-Backed Securities ERISA Suit - Law360 This is a public episode. The podcast episode explores the perceived "2-year rule" for new motorcycle clubs (MCs) throwing parties or annuals, stipulations from coalitions, blacklisting practices, and whether any of this violates U.S. anti-trust laws. Let's break it down. Why Can't an MC Just Throw a Party Whenever It Wants? Stipulations & the "2-Year Rule"Traditional MC protocol often requires new clubs to "earn" the right to host events by demonstrating respect, loyalty, and commitment to the existing MC community. This isn't a universal "law" but a common practice enforced by regional Confederations of Clubs (COCs) or coalitions—loose alliances of established MCs that set guidelines to avoid conflicts, overcrowding of events, and territorial issuesrcvsmc.net +1.The "2-Year" Practice: Many COCs expect new clubs to start as riding clubs (RCs) and spend 1-2 years attending other clubs' functions, supporting events, and building relationships before "graduating" to full MC status and hosting their own parties. This includes paying entry fees, showing up consistently, and getting a "sponsor club" (an established MC vouching for them). The idea is to prove you're not a "pop-up" club causing drama or diluting the scenereddit.com +1.Why the Stipulations?: Overcrowded calendars (e.g., multiple parties on the same weekend) lead to low attendance and resentment. Coalitions coordinate to "space out" events and ensure new clubs "pay dues" by supporting others first. It's about maintaining order in a scene where rivalries can escalate fastfacebook.com +1.Origins: This stems from post-WWII MC culture, where clubs like Hells Angels and Outlaws established informal "rules" through dominance and respect. Coalitions (e.g., in Ohio, Texas) formalized it in the 1980s–90s to reduce violence and promote unity. It's not in any "official MC bible"—just evolved customscribd.com +1.Blacklisting/Blackballing by Coalitions: Is It Legal Under Anti-Trust Laws?Blacklisting (coalitions agreeing not to support or attend a club's events) or blackballing (excluding a club from alliances) happens when a new club violates protocol—e.g., throwing parties too soon or not supporting others. Is it anti-trust?Not Likely Illegal: U.S. anti-trust laws (e.g., Sherman Act 1890, Clayton Act 1914) target commercial boycotts by competitors with market power that harm trade (e.g., price-fixing, refusing to deal to raise prices)ftc.gov +1. MC coalitions are social/non-commercial—they're not businesses competing for profit. Boycotts here are about community norms, not economic harm. Courts have ruled similar social boycotts (e.g., NCAA rules, political actions) don't violate anti-trust if not commercially motivatedftc.gov +1.1920s/30s Anti-Trust Context: You mentioned anti-trust battles (e.g., Standard Oil breakup, Sherman Act enforcement). Those targeted monopolies and business cartels—not social groups. No cases apply to MC coalitions, as they're not "restraining trade" in a legal sensenyulawreview.org.Potential Gray Area: If a coalition has "market power" (e.g., controlling events in a region) and blacklisting harms a club's "business" (e.g., charity funds, dues), it could be challenged—but MCs aren't typically seen as commercial. No known successful anti-trust suits against MC coalitions.Should MC Protocol Change?Protocol isn't set in stone—it's evolved from military/veteran roots to modern realities. The 2-year rule and blacklisting promote stability, but critics say it's gatekeeping that stifles new clubs. With social media, recruiting is easier, so perhaps shorten probation or make coalitions more inclusive. But change risks diluting tradition—strong clubs adapt carefully. What do you think? Is the 2-year rule fair, or outdated? Call in and let's discuss. ►WEITERES VON CHRISTIAN RIECK ○ Instagram: /profrieck ○ Twitter: /profrieck ○ LinkedIn: /profrieck #profrieck #cancelculture #politik

Free Speech and Free Association are the essence of the United States, and both fell under the jackboots of politically weaponized “wokeness” here in Virginia when a realtor decided he wanted to run for city council of Staunton. What happened next reads like the script for a Daniel Craig movie as agents for his opponents found a social media post from years before in which he reposted a Biblical passage, Leviticus 20:13, that had been shared with him by Franklin Graham. Not only was the passage used to rally opposition to his run for public office, after that election was completed they shared the passage with his business association, the National Association of Realtors in an effort to have him expelled from the organization and prohibiting him access to the real estate listings he would use to help his clients find a home. Two weeks ago the National and Virginia Association of Realtors reversed their original determination against Mr. Fauber and changed their code of ethics to only regulate speech used during a realtor conducting of real estate business. Then, on Tuesday HJuly 29th Mr Fauber's legal team from the Founding Freedoms Law Center, a division of Virginia's Family Foundation, announced that the Department of Justice had opened an investigation into the Conduct of both organizations. We sit down with Mychael Sylvester, on e of Mr. Fauber's lawyer from the Founding Freedoms Law Center to catch up of this attempt to ruin a person's life simply because you disagree with them. It was one of her briefest but boldest moves, and like anyone who spoke out against the monster, it got her blacklist. RUSSIA. NO BLACKLISTING YET. @THADMCCOTTER @THEAMGREATNESS 1900 MOSCOW
Send us a textEven before Judge Kennesaw Mountain Landis banned eight #Whitesox players for their attempted fix of the 1919 World Series, players had been banned, blacklisted and banished from baseball mostly for trying to fix games but not always. Once Commissioner Landis was given the job and power to kick players and people out of baseball he used it liberally as did his successors. Even Willie Mays and Mickey Mantle were banned from #MLB in 1983 for being greeters at different casinos in Atlantic City. Finally Peter Ueberroth un-banned them which might have been his finest moment as commish. Sometimes it's gambling, other times drugs, and still other instances are even more serious and criminal. We talk about the difference between black-listing and blackballing and how #baseball hopes one of the other major sports has a gambling scandal before MLB does. American Presidents have been addicted to international sanctions for much of the modern era, as a way to influence the behavior of other countries. Russia, Iran, Venezuela, Syria – all have been subject to U.S. sanctions over the past four decades. But these regimes remain as defiant of U.S. geostrategic goals as ever. This week we explore Russian yacht snatching, the impact of sanctions on the Iranian people, and how a once-obscure office inside the Treasury Department ended up putting a chokehold on national economies all over the world.Go to audible.com/news where you'll find Peter Bergen's recommendations for other news, journalism and nonfiction listening.See Privacy Policy at https://art19.com/privacy and California Privacy Notice at https://art19.com/privacy#do-not-sell-my-info.

While our weekly shows are edited to time for broadcast on Public TV and community radio, we offer to our members and podcast subscribers the full uncut conversation. The following is from our episode "Amanda Seales Takes the Heat: Speaking Out About Gaza & Hollywood". These audio exclusives are made possible thanks to our member supporters. What does it take to be politically outspoken in Hollywood? You may know Amanda Seales from her role on HBO's “Insecure”, her stand-up comedy, her podcast and radio show or her viral videos on social media. She's lost agents, her publicist, and has had speaking gigs retracted for her commitment to social justice. From Black women to Palestinians in Gaza, Seales uses her platform to speak honestly about harm done to others. She talks powerfully about her experiences with the dangers of fame and celebrity in Hollywood, neurodivergence, white supremacy and a whole lot more. In this conversation, Laura Flanders asks Amanda Seales about our progress as a country, what it means to be an “artistic intellectual” and about the educators who've helped her along the way. Hear why Seales is “divesting from celebrity” and taking backlash from her support for Palestinians as “a badge of honor”. Plus, go behind the scenes with Seales with the full, uncut conversation from this week's show. Laura will tell you more.“. . . You are definitely expected to just take whatever gossip is said about you. You have to take it all on the chin because you've made this somehow unspoken exchange that having monetary gain and visibility means that you have to allow harm. And what I've decided is I am divesting from celebrity.” - Amanda Seales“I lost my agents, I lost my publicist, and I have definitely had speaking engagements and different gigs retracted because of my support of Palestine and my outward support of the ending of apartheid in Palestine. I got to tell you, I take it as a badge of honor. I do. It's good trouble, rest in peace to John Lewis. I am so honored for all those people.” - Amanda SealesGuests: Amanda Seales, Artistic Intellectual Full Episode Notes are posted the Wednesday following the podcast release and are located HERE. Sara Stockton is a Licensed Marriage and Family Therapist, lecturer, researcher, and clinical supervisor of a psychotherapy practice in New York who has done a complete 180 on the subject of youth gender transition. Ms. Stockton spent the first part of her career advocating for “gender affirming care” in the treatment of trans-identified youth. Starting in 2008, her work with this population included traveling to teach and train medical facilities, physicians, and schools on “gender affirmation.” In 2013, she co-authored one of the first mental health assessments in the US utilized to assess youth “readiness” for gender transition. She treated over 100 families, and wrote many of the first letters that were used to approve gender transition surgeries on minors, before a change of perspective shifted the focus of her work. More recently, she was featured in the documentary “What is a Woman,” where she decided to speak out about her moments of doubt and realizations, and her decision to raise awareness about the pitfalls of this approach. She has also been interviewed by Jordan Peterson and on Gender: A Wider Lens.In this episode, Sara shares her journey from being a young graduate student specializing in gender issues to her eventual shift in focus towards sex therapy. We discuss the lack of historical context and critical examination of the treatment protocols for transgender-identified youth; the pressure to conform to a specific narrative without questioning the long-term consequences; and ways in which young therapists' naïveté, openness, and eagerness to prove themselves can all be utilized to further an agenda that might more easily be recognized as sinister by more grounded individuals.Sara opens up about the ethical dilemmas she encountered, including the issue of informed consent and the pressure to prescribe irreversible medical interventions to young people. We explore the concept of autogynephilia and its implications for understanding the motivations behind gender identity. We touch on the hyper-sexualization of youth in the context of gender issues; the links between sexual deviance and the “trans” movement; and the challenges of navigating discussions around sexuality and intimacy with young clients.Sara shares a pivotal moment in her career when she encountered a detransitioner and realized the lack of support and resources available for those who regret their medical transition. We discuss the vulnerability of individuals during times of personal struggle and the potential for manipulation and exploitation. This episode raises important questions about the need for a more nuanced and critical approach to gender issues. Join us as we delve into these complex topics and challenge the prevailing narratives surrounding trans-identified youth.
