The Supreme Court recently decided that they will review a case dealing with the Clean Water Act (CWA), which prohibits the pollution of US waters without a National Pollutant Discharge Elimination System (NPDES) permit. In order to comply with the statute, the city of San Francisco was issued a permit by the Environmental Protection Agency (EPA) in 2019. The permit, however, lays down narrative limitations on the discharge of pollutants, such as anything which may “cause or contribute to a violation of any applicable water quality standard.” The city of San Francisco challenged the EPA’s permit, arguing that these restrictions “expose San Francisco and numerous permit-holders nationwide to enforcement actions while failing to tell them how much they need to limit or treat their discharges to comply with the Act.” In July 2023, the Ninth Circuit Court of Appeals rejected San Francisco’s argument, finding that the narrative limitations are not too vague but are rather important to ensuring that state water standards are met. Law Professor Jonathan Adler on the Supreme Court's New "Ghost Gun" Case

The Supreme Court has decided to take up another gun case. Although, it's another one that doesn't touch on the Second Amendment. This time, the Court will decide if the ATF's rule restricting unfinished frames and receivers is an unlawful overreach of the agency's power.  Jonathan Adler, a law professor at Case Western Reserve University, joins the show to give us his insight into this case and the Court's recent uptick in gun cases. He argued that the Court's acceptance of two cases challenging ATF administrative power alongside an NRA First Amendment case and an actual Second Amendment case should be read as an increased appetite for gun cases. He noted that the Supreme Court has actually been taking fewer and fewer overall cases in recent years but more and more gun-related ones. He doesn't think that can be brushed aside, even if most of the cases don't deal with Second Amendment claims. Still, Professor Adler said he isn't confident the Court will side with the gun-rights plaintiffs in the so-called ghost gun case. He argued the way they intervened in the lower court case to issue stays on multiple rulings against the ATF should be read as tell for where the justices plan to go on the merits. He said a move like that might be more predictive of intent than most stays issued by federal courts. You can listen to the show on your favorite podcasting app or by clicking here. It was, says Doonan, an “unhinged visual extravaganza.”Doonan peppers the conversation with amusing insights. The Supreme Court hasn't released an opinion in weeks, but it did add a major case on May 1 to its docket looking at the power of administrative agencies. A dispute that started over a federal rule for companies fishing for herring off the Atlantic coast could wipe out a legal doctrine that tells courts they should defer to a federal agency's interpretation when the law they're administering is ambiguous. Jonathan Adler, who teaches administrative and constitutional law at Case Western Reserve University School of Law, joins Cases and Controversies to discuss how the court next term could narrow the Chevron doctrine without overruling it.
