In Bear Warriors United v. Secretary, Florida Department of Environmental Protection the Eleventh Circuit is considering the question of whether the Endangered Species Act can hold states responsible for the harms of regulated private parties without running afoul of the Constitution's anti-commandeering doctrine.The Endangered Species Act prohibits anyone, including a state, from harming an endangered or threatened species. But threats to species are often driven by many small harms, which makes enforcement difficult. In Florida, manatee habitat is degraded by nitrogen released from septic tanks, none of which contributes substantially to the problem on their own. Bear Warriors United, an environmental group, sued Florida's Department of Environmental Protection alleging that it is liable for these harms as the regulator of septic tanks. A Florida district court agreed, ordering the state to prohibit new septic tanks in the watershed, to implement various conservation programs, and to maintain these policies unless and until a federal agency authorizes the state to change them.The anti-commandeering doctrine prohibits the federal government from "seeking to control or influence the manner in which States regulate private parties." But every court to have considered the question so far has held that enforcing the ESA against states for harms created by private permittees does not run afoul of the doctrine. The panel will discuss the questions left open—or raised—by the Supreme Court’s decisions in FCC v. Consumers' Research and Loper Bright Enterprises v. Raimondo, about the proper approach to statutory construction and the role that the nondelegation doctrine should play as a background principle in statutory analysis in cases where an agency has claimed broad authority to weigh competing public values when promulgating legislative rules. The discussion might address such subtopics as:Whether the Supreme Court’s rejection of an “extravagant” interpretation of FCC’s statutory authority in Consumers’ Research tells us anything about how courts should approach statutory cases where an agency is asserting an expansive view of its statutory authorities—given that the Court appeared to say that the dissent’s (supposedly “extravagant”) interpretation would present a nondelegation problem.What role nondelegation concerns should play under the avoidance canon in cases where an agency seeks to stretch nebulous or expressly open-ended delegations to achieve whatever policy objective the Executive Branch deems fit from one administration to the next.Whether these kinds of concerns can be dealt with by expanding clear statement rules—like that the Court has begun to develop with the major questions doctrine.Whether and to what extent legitimate nondelegation concerns arise in cases where Congress has expressly said that an issue is vested to agency discretion—as was contemplated in Loper Bright for certain kinds of rules for which the Court said the agency gets to decide.Featuring:Prof. Jonathan Adler, Tazewell Taylor Professor of Law and William H. What has been the secret to Jonathan Adler's success? A little bit of luck, a passion for craft and a philosophy of saying yes.  Around three decades ago, Adler's “lifelong love” of clay that began at summer camp transitioned from a hobby to a career. He sold his first pot to the American Craft Museum—now the Museum of Art and Design—and a Barneys New York order quickly followed. The rest is history. “I got very lucky, got my order from Barneys, and quite unexpectedly and accidentally became a potter,” he said. In addition to his own eponymous home décor label, Adler has collaborated with buzzy brands, including designing a house for cultural icon Barbie. Some have also turned into ongoing relationships, such as his multi-collection partnership with Ruggable. Creative alliances are one area where his tendency to say yes comes into play. “Collaborations are just a great way to be creative, to make news, and hopefully to ring the register as well,” he said. This week, we're zooming out a bit and looking at the state of the federal judiciary. To help us understand what's going on, we've got William & Mary law professor Jonathan Adler back on the show. He recently wrote a piece that laid out just how few judicial appointments President Donald Trump has actually made since the beginning of his second term. Not only that, but just how few opportunities he has to make new appointments from here through the end of his term. Adler said there are just not as many federal judges retiring or creating openings by taking senior positions as there have been for other presidents, or even for Trump's first term. He said Trump's controversial appointment of his former personal lawyer Emil Bove to an appellate seat, and the potential shift in approach toward vetting it represents, may be giving current judges pause. But, he argued non-political factors, such as the increasing longevity of judges, may be playing an even bigger role. Adler said the slow pace of vacancies and the uncertain nature of Trump's approach to his second-term appointments cast doubt on whether he'll have as much of an impact on the ideological balance of the federal judiciary as he did the first time around. Litigation Update: City and County of San Francisco v. Environmental Protection Agency

The Supreme Court recently decided that they will review a case dealing with the Clean Water Act (CWA), which prohibits the pollution of US waters without a National Pollutant Discharge Elimination System (NPDES) permit. In order to comply with the statute, the city of San Francisco was issued a permit by the Environmental Protection Agency (EPA) in 2019. The permit, however, lays down narrative limitations on the discharge of pollutants, such as anything which may “cause or contribute to a violation of any applicable water quality standard.” The city of San Francisco challenged the EPA’s permit, arguing that these restrictions “expose San Francisco and numerous permit-holders nationwide to enforcement actions while failing to tell them how much they need to limit or treat their discharges to comply with the Act.” In July 2023, the Ninth Circuit Court of Appeals rejected San Francisco’s argument, finding that the narrative limitations are not too vague but are rather important to ensuring that state water standards are met.
