The case was decided on January 21, 2025. Brenda Andrew was convicted by an Oklahoma jury of murdering her husband, Rob Andrew, and was sentenced to death. During her trial, the prosecution introduced extensive evidence about her sex life and personal failings, which was later conceded to be irrelevant. Andrew argued in a federal habeas petition that this evidence was so prejudicial it violated the Due Process Clause. The Oklahoma Court of Criminal Appeals (OCCA) upheld her conviction, finding some of the evidence about her extramarital affairs relevant but acknowledging that much of the other evidence was irrelevant. Despite this, the OCCA deemed the errors harmless. Two judges dissented, arguing that the prejudicial evidence undermined the fairness of the trial. In federal court, the District Court denied relief, and the Tenth Circuit Court of Appeals affirmed, stating that Andrew failed to cite clearly established federal law. The Tenth Circuit majority acknowledged the precedent set by Payne v Tennessee but dismissed it as a pronouncement rather than a holding. Judge Bacharach dissented, arguing that the prejudicial evidence deprived Andrew of a fair trial. The Supreme Court of the United States reviewed the case and held that the Tenth Circuit erred in its interpretation. The Court clarified that Payne established that the Due Process Clause can protect against the introduction of unduly prejudicial evidence that renders a trial fundamentally unfair. The Court vacated the Tenth Circuit's judgment and remanded the case for further proceedings to determine if the trial court's admission of irrelevant evidence was so prejudicial as to render Andrew's trial fundamentally unfair. The European outdoor festival season is slowly winding down, the light starts to get a little more golden, the air a little crispier and the idea of turning a little more inward doesn't feel too strange anymore. With summer almost over, still two events “jewels” remain for ambient and spiral electronic aficionados. Some will make the trek to the Labyrinth Festival far away in Japan, a festival that became an inspiration for so many others. Japan, though, will also be represented at Les Chaos Ambiants. It's an intimate event with a purposeful curation, nestled in a nature reserve in France. The Japanese artist Occa will play for the first time in France and bring his unique transcendental way of DJing to Burgundy. Occa has been organizing the ARCHIV events for over 10 years at Precious Hall in Sapporo, located in the far north. Having played for Nobu's Future Terror and the aforementioned Labyrinth Festival, he is a fixture in the Japanese scene and now gains international attention. For "Delayed with..." Occa shares a mix recorded at the atmospheric Moment Festival, and it's warping and rumbling, twisting, and circulating there as if forest and mountain spirits congregate to show you the way. Moment Festival is held in a sacred zone in Nara Prefecture, which has significant origins in Japanese history. Occa is a DJ and promoter from the northernmost region of Japan, Hokkaido. Occa has been organizing his own party ARCHIV at the sacred club, Precious Hall for over 10 years. Musically he combines the spiritualism of Psychedelic Music, the storytelling nature of House Music, the sci-fi dystopian feel of Detroit Techno and the trance of Minimal Music in a three-dimensional way through his deft mixing. He has been invited to play at institutions such as DJ NOBU's Future Terror, Mindgames' The Labyrinth/Balance, Spekki Webu's Mirror Zone 5 Years Tour in EU, System Revival and Georgia's legendary Bassiani. This mix is inspired by his Sci-Fi Shamanism set recorded at the Transcendence 2024 ceremony, held deep in the forests of Japan. It's not that the quest of happiness will fail. It's just that you're missing out on a deeper, qualitatively richer version of happiness if you try and do it in your own strength. And so that's where we talk about, I think, point to Scripture where the Bible actually doesn't say that much about happiness. It's not actually that interested in our happiness. What it says a lot about is joy. And here's where we talk about the one thing that you could say, for almost every ideal and pursuit of the modern mind, and kind of the modern, intelligent, educated person is that what the Bible offers is not something that's just quantitatively different. So, it's not saying: Come to Jesus and you'll be more happy. It's saying: Come to Jesus, and you'll have something that's qualitatively better than happiness. Christian joy just holds. It holds kind of above the storms, regardless of what's happening. I remember when I first started in youth ministry, a few years after my conversion, you'd shy away from the whole God is judge thing. Maybe we save that for Bible study or one-on-one conversation, you know, we don't want to put people off. And it's like, no, man, you need to come out with that. Like if there wasn't a hell, and if there wasn't a judge, I don't even know if I could be a Christian. And so, when we reframe things, and give the reasons for why we think this. But ultimately, it's based on the assumption that justice is good, yeah or that there is a thing called justice that is driving us to the heart of the gospel of God, who Himself is justice personified. So don't think that in dealing with this situation, you're losing sight of Scripture. You're not. It is about, again, getting back in the Word and seeing what God says about us. And not just taking you know, Galatians 3:27 and 28. There is neither slave nor free, Jew nor Greek, male nor female. A lot of people use that Scripture to say, therefore we should have the conversation. That Scripture's not doing what we think it's doing. It's not. Have a conversation, look back at Scripture. What is the question behind the question? It is a question of justice, and all of our hearts desire for justice is found. Bless the Lord in the God of the Bible. This Labor Day weekend will find Okeechobee abuzz with both locals and our urban coastal neighbors eager to take in yet another rodeo experience in one of Florida's iconic arenas - one of the few remaining outdoor, uncovered, and privately owned venues. It's a piece of Florida history and a solid slice of Americana. The rodeo is the largest fundraiser for the non-profit Okeechobee County Cattlemen's Association and it affords the association the ability to give back primarily to the youth of the community, but to others as well. The rodeo is held biannually - once in spring with The Speckled Perch Festival and again in September as the Pete Clemons Memorial Labor Day Rodeo. This week as Hurricane Idalia bears down on the Big Bend and North Florida, I sit down at the Okeechobee Cattlemen's Arena with fellow OCCA officers/board members to discuss our memories of growing up around the rodeo, how it's shaped us as leaders, and how it helps our community on so many levels.
