When someone accused of a crime is found unable to aid and assist in their own defense, they are sent to the Oregon State Hospital for an evaluation. After that, they often need to spend time at a residential treatment center until they are fit to stand trial. A new rule from the Oregon Health Authority requires residential treatment facilities in the state to accept those patients ahead of any who might be on their waiting list, setting aside their normal admissions standards. Attorneys for the Oregon Council for Behavioral Health and six residential treatment providers filed a petition with the Oregon Court of Appeals to block that rule.  We hear from Heather Jefferis, executive director of the Oregon Council for Behavioral Health, about the challenges faced by behavioral health providers in Oregon.

Dr. Andrew Orf, partner of Lithia Forensic and Consulting LCC and a certified forensic evaluator, discusses: Oregon began the certification for forensic evaluators in 2012 for fitness to proceed evaluations, and the courts now prefer Certified Forensic Evaluators for pre-adjudication services. The level of nuance between evaluations, as it is combining the clinical perspective with the legal perspective.  The many clinical components to consider, such as neurocognitive conditions, personality disorders, or substance use.  Legal considerations for statutory evaluations are related to an individual's intent. Evaluations are also conducted in order to determine if a person's qualifying mental health disorder impacted their capacity to form intent. The pressing need for more Certified Forensic Evaluators, as a lot of people are in correctional settings, and end up waiting for evaluations. When people are acutely ill, there are few, if any places to send them for help, as the bar for civil commitment in Oregon is very high. Rapid evaluations increase access, and timeliness in more rural areas, as the majority of certified evaluators are in the Portland, Eugene, and Salem areas. There is a collaborative effort between community mental health programs, district attorney, courts and the defense attorney to identify who needs a rapid evaluation. Regular consultation with other evaluators is important for maintaining wellness as a clinician doing the evaluations day in and day out. Certified Forensic Evaluators can conduct several different types of evaluations based on the requests from the court, such as: guilty except for insanity, juvenile waiver evaluations, risk assessments, mental health evaluations for qualification, neuropsychological evaluations, and civil evaluations. People assume that evaluators are advocates, but they strive to be independent and ethical. There are layers of complexity within human beings. People can have multiple underlying conditions that make it difficult to know a conclusive answer as to what drives behavior. Two well-trained, experienced evaluators can disagree on a diagnosis, and neither are necessarily wrong. Nuanced and well thought-out evaluations are crucial due to the real world implications and ripple effects for people. There is a vested interest from the general public because once the process is initiated, costs pile up. One day at the Oregon State Hospital for a person is over $1000. Oregon is in a transitional phase with mental health conversations and legislature. It's easy for everyone involved to point out the problems, but very hard to come up with solutions. A new navigation center in Salem may help ease city's growing homelessness crisis

On April 24, a 75-bed navigation center for people experiencing homelessness will open in Salem. The facility will be open 24 hours a day, seven days a week and will be the first of its kind in Marion County. Case workers will be on site to help clients access medical care, behavioral health services and transition to stable housing. City officials say it is designed to be a “low barrier” shelter which does not require sobriety for entry, and accepts all genders, as well as pets. The Salem City Council has allocated more than $23 million in state and federal funds to expand shelter and homeless services, including launching this spring a third micro-shelter community of small living units to temporarily house young adults, 18 to 24 years old. The city is also opening 52 units inside a former Oregon State Hospital building to provide permanent supportive housing for unsheltered people who are disabled, mentally ill or have other complex medical and behavioral health needs. Joining us to talk about Salem's efforts to tackle a growing homelessness crisis are Salem Mayor Chris Hoy and Salem Housing Authority Administrator Nicole Utz.

Last week, a federal judge ruled that time limits for how long someone charged with a crime can stay at Oregon State Hospital will continue. This means the September order requiring the psychiatric facility to release patients facing misdemeanor charges in 90 days, felony charges in six months and more violent felonies within a year, will remain.The Oregon State Hospital also received news that it passed its federal inspection. However, investigators noted that the facility still faces issues over food safety, medication storage and hygiene. Ben Botkin is the criminal justice and health reporter for the Capital Chronicle. He joins us to share what this ruling means for the future of the state and the details of the inspection.

In Oregon, people who are accused of crimes but found unable to participate in their own trial because of mental illness are supposed to be sent to the Oregon State Hospital until they are ready to “aid and assist” in their own defense. Advocates say jail is a dangerous place for people with mental illnesses, but even before the pandemic, “aid and assist” patients often faced long waits in jail for space at the hospital. Staffing shortages and other challenges have made the problem even worse. Sally Reid's son Phillip is currently at the Oregon State Hospital under “aid and assist” after spending over a month in jail in Astoria. He has also spent time at the hospital for civil commitments. Reid tells us how these commitments have affected her family.

This is according to Disability Rights Oregon, which performed an unsupervised walkthrough using Oregon's Protection and Advocacy System. The group wrote a letter to Gov. Brown on what they saw and the “lack of urgency” from OSH administration. Emily Cooper is the Legal Director of DRO and joins us to share what she saw on this walkthrough.

The book covers the history behind the infamous Riverside patient Mary Mallon, also known as Typhoid Mary, the gothic and foreboding buildings at Danvers State Hospital in Danvers, Massachusetts, which became both the inspiration and the filming location for the movie Session 9, and Oregon State Hospital, where Jack Nicholson's famous One Flew Over the Cuckoo's Nest was filmed. Today, these abandoned state institutions have been converted into other uses or remain in shambles, but the ghosts of their pasts linger. One Flew Over the Cuckoo's Nest (1975)​ ​ Considered one of the greatest American films of all time, One Flew Over the Cuckoos Nest is directed by Milos Forman.  The film would be filmed at the Oregon State Hospital in Salem, Oregon where the novel takes place.    The film would be produced by Michael Douglas and stars Jack Nicholson, Louise Fletcher, Brad Dourif, Christopher Lloyd, Danny DeVito, Michael Berryman and Scatman Crothers.  The film would be the third highest grossed film of 1975 and has since been inaugurated into the Library of Congress.  An interesting fact the author of the book, Ken Kelsey, who disliked the film.  ​ ​ Dancer in the Dark (2000)   The 2000 Danish musical melodrama directed by Lars Von Trier tells the tale of a daydreaming factory worker saving up for an eye operation  for her son who maybe suffering from the same degenerative eye condition for which she suffers from.    The film is very mixed with some considering it to be too melodramatic whilst others considers this to be the most important film of the 21st Century.  The film is considered the third in a series of films known as the Golden Heart Trilogy.  Breaking the Waves and The Idiots being the first two in the trilogy.   The film stars Bjork, Catherine Deneuve, David Morse and Peter Stormare.  Bjork claims that making the film was emotionally draining and she would not make another film but would make one other film, Drawing Restraint 9.  In 2017, Bjork would join the #metoo movement by stating that Von Trier allegedly acting inappropriate towards her which he denies.    Opening Credits (.20); Introduction (07.10); Forming the Plot (12.50); Film Trailer (18.39); Page to Page (22.13); Outlining the Script (1:02.12); Film Trailer (1:04.27); Lights, Camera, Action (1:07.44); Epilogue (1:39.22); End Credits (1:44.39); Closing Theme (1:46.44)   Opening Credits – Virtual Insanity – by Jamiroquai from the album  High Times:  Singles 1992 - 2006   Closing Credits – I Go Crazy – by Paul Davis from the album Singer of Songs, Teller of Tales   All songs rights reserved   All music available through Amazon.

If a person charged with a crime is too mentally ill to aid in their own defense, the state must provide them with enough treatment to get them ready for trial. This can be done at the county level, or a judge can send defendants to the overcrowded state hospital. A new investigation in the Eugene Weekly found that Lane County sends more people to Oregon State Hospital, and that the numbers have been increasing. Reporters Gina Scalpone and Emily Goodykoontz tell us about the impacts of this system.
