Campbell, 2024 SCC 42 where police arrested a known drug dealer and lawfully seized his cellphone. After the arrest, four text messages lit up the locked cellphone screen and appeared to offer a sale of drugs, possibly laced with fentanyl. Without a warrant, the police engaged in a conversation with the sender of the texts by impersonating the drug dealer and — in the process — orchestrated a meet to purchase drugs. When the accused came to the drug dealer's apartment, he was arrested and found in possession of heroin laced with fentanyl. Was the conduct of the police by engaging in the text conversation a search for Charter purposes? If it was a search, could the police lawfully do what they did? Was the situation facing the police urgent enough to trigger exigent circumstances? Was a Part VI authorization under the Criminal Code required? Did the search incident to arrest doctrine apply? Police seized a cellphone during a search incident to the arrest of a known drug dealer. The phone was displaying incoming text messages on its screen. The police believed the messages revealed a transaction for heroin, which would likely be laced with fentanyl, was in progress. The police impersonated the drug dealer by responding to the text messages, and arranged to have the drugs delivered to the dealer's residence. Applicant Dwayne Alexander Campbell arrived at the residence and was arrested. Mr. Campbell was charged under the Controlled Drugs and Substances Act (CDSA). At trial, Mr. Campbell brought a motion to exclude evidence, claiming that his rights under s. 8 of the Charter had been infringed by the police action in using the dealer's phone to communicate with him. The trial judge rejected Mr. Campbell's claim that he had a reasonable expectation of privacy in the text messages, and concluded that the likelihood that the drugs were laced with fentanyl created exigent circumstances that justified the warrantless use of the drug dealer's cellphone. Mr. Campbell was convicted and sentenced. The Court of Appeal held that Mr. Campbell did have a reasonable expectation of privacy in his electronic communications, but that the police action was justified by the exigent circumstances doctrine. Consequently, there was no breach of Mr. Campbell's s. 8 rights. The Court of Appeal dismissed Mr. Campbell's appeal. Before exigent joined the language in the early 1600s, the noun exigency was being used to refer to something that is necessary in a particular situation—for example, the exigencies of an emergency situation might require that certain usual precautions be ignored. Des soldats anglais viennent s'y entrainer avant d'être déployés à l'étranger. Mais leur présence est entachée par plusieurs scandales. Il y a notamment cet incendie déclenché en mars 2021 lors d'un entrainement dans la réserve privée de Lolldaiga. 4 800 hectares de terrain ont brûlé, avec des conséquences sur le mode de vie des communautés pastorales et agricoles vivant aux alentours. Depuis, elles se battent pour obtenir des dédommagements. De notre correspondante de retour de Nanyuki,Saituk Kaituto Kaparo vit près de la réserve de Lolldaiga. Cet éleveur masaï de 68 ans était aux premières loges lors de l'incendie de mars 2021. Il a tout fait pour tenter de sauver son bétail, mais sur ses 200 vaches, il ne lui en reste plus que 4. Il en garde un souvenir amer : « Le feu venait de cette colline juste derrière, on le voit, on vit à côté. Tout ici était recouvert par de la fumée, on ne pouvait rien voir. Les soldats britanniques avaient tous les équipements nécessaires, mais pour nous c'était différent, précise l'éleveur, on récupérait des branches et on essayait de combattre le feu avec. Quand ça devenait incontrôlable, on se mettait à courir ».Saituk dit ne presque plus voir aujourd'hui à cause de la fumée qui a abimé ses yeux. Il n'a pas les moyens de se payer les soins nécessaires. Il fait partie des 7 000 plaignants qui demandent une compensation aux autorités britanniques. Une compensation pour répondre aux problèmes médicaux et à la perte des récoltes et de bétail. L'affaire est entre les mains d'un comité de médiation, avec des représentants des deux pays. Mais le processus stagne, explique Saituk Kaituto Kaparo : « Ils doivent nous payer des dédommagements avant de reprendre leurs entrainements, la situation est très difficile pour beaucoup d'entre nous aujourd'hui, qui avons beaucoup perdu dans l'incendie. C'est particulièrement douloureux de voir les soldats, les responsables de l'incident, continuer à s'entrainer ici. »« Une stratégie tirée de l'époque coloniale »En 2002, Londres avait déjà versé plus de 4 millions de livres sterling, soit environ 5 millions d'euros, à plus de 200 familles masaï dont les proches avaient été blessés ou tués par des munitions abandonnées. Une assurance désormais réclamée par de nombreux pays Il ne suffit pas toujours de présenter un passe vaccinal pour pouvoir entrer dans le pays où l'on souhaite séjourner. Il faut également se munir d'une attestation d'assurance couvrant les frais liés à une éventuelle contamination par le virus de la Covid. Il y a peu, seuls 6 pays exigeaient ce document. On en compte aujourd'hui 41. Outre la Chine ou la Russie, qui demandaient déjà cette assurance, on trouve dans cette liste des destinations prisées des touristes, comme Cuba, la Thaïlande ou encore le Costa Rica. Le document est le plus souvent vérifié au moment de monter dans l'avion. Faute de le présenter, un voyageur peut s'en voir interdire l'accès. La couverture de tous les frais liés à la Covid Cette assurance doit couvrir toutes les dépenses de santé associées à une infection par le virus de la Covid. Elle doit donc prendre en charge les frais d'hospitalisation ou de consultation médicale sur place, ainsi que les dépenses provoquées par une éventuelle quarantaine. Un possible rapatriement vers le pays de résidence doit être également prévu. Toutes ces situations, ainsi que la mention de la maladie, doivent être indiquées de manière explicite sur le document. Mais certains pays ont une exigence supplémentaire. Ils réclament que le montant minimal de la prise en charge soit mentionné dans l'attestation d'assurance. Et, à cet égard, certains pays ont la main lourde. Ainsi, la Thaïlande exige une prise en charge supérieure à plus de 100.000 dollars. Ces clauses spécifiques d'assurance sont parfois incluses dans certaines cartes bleues ou ont été intégrées dans les contrats par les assureurs.
