In this episode, Sarah is joined by Katie de Kauwe, a senior lawyer with Friends of the Earth, to discuss the vital role of legal actions in holding the UK government accountable for its climate obligations. They explore significant cases, some of which have disrupted the fossil fuel industry, including the Horse Hill (Finch) case which reached the UK Supreme Court, High Court challenges over the government's inadequate climate plans, and other important litigation.  Katie discusses how lawyers collaborate with grassroots activists to achieve long-term societal change, young climate change activists and the relationship between climate change and gender inequality. The conversation also touches on the rise of 'persons unknown' injunctions, which pose a serious threat to democracy and the right to protest. Friends of the Earth has taken action on 'anti-protest' injunctions, even bringing cases before the European Court of Human Rights. Finally, Katie provides practical advice for those interested in pursuing a career as a climate justice lawyer. Not to be missed!   Katie de Kauwe specialises in environmental judicial review, and also has expertise in cases concerning the right to protest. Katie was listed in the ENDS Power List 2023 and 2024 of the UK's 100 most influential environmental professionals, and was ranked in the Lawyer Hot 100 for 2023.  Katie led Friends of the Earth's successful Climate Change Act challenges to the Government's economy-wide decarbonisation plans, first the Net Zero Strategy, and then the Carbon Budget Delivery Plan which replaced it. She has worked on several critical challenges to fossil fuel projects. These include Friends of the Earth's intervention in the landmark Finch appeal regarding oil drilling in Surrey, where the Supreme Court ruled in June 2024 that end-use emissions from fossil fuel projects must be included in the environmental impact assessment. Katie also worked on the organisation's successful challenge to the grant of planning permission for a coal mine in Whitehaven, which was strengthened by Finch and ultimately succeeded on all grounds in September 2024, including those aspects relating to substitution, international impacts and carbon offsetting. Katie leads on Friends of the Earth's casework on civil liberties, including its live application to the European Court of Human Rights, challenging the use of ‘anti-protest' persons unknown injunctions.  Katie holds a degree in Biology BSc (1st Class Honours) and converted to law through a Masters in Law.  [Katie has previously worked in criminal defence. She completed her training contract in private practice, and worked in civil litigation, before joining Friends of the Earth in 2018. She was previously involved in the Colombia Caravana, and has participated in two human rights delegations to Colombia. Katie is half-Sri Lankan, and strongly believes in the importance of addressing the deficit in representation of people of colour in both the legal profession and the environmental movement. A message from the Deputy Executive Director at Friends of the Earth Japan, Ayumi Fukakusa (pictured) was read out to those at a Bourke St, Melbourne protest staged out the front of the Japanese Embassy. The Melbourne protest was organised by that city's Friends of the Earth. Ms Fukakusa's message, delivered at similar protests all around the world said: "Japan is one of the top financier of fossil fuel projects. Japan uses public money to support destructive projects. Back in April, the G7 Ministers' Meeting on Climate, Energy and Environment was held in Sapporo. The joint communiqué included a commitment to achieving a decarbonized power sector by 2035, as in the previous year. It also noted that accelerating the transition to “clean energy" is the key to energy security, and that the phase-out of unabated fossil fuels must be accelerated. This statement is an indication of the international community's strong sense of urgency regarding the need to strengthen measures in the face of the accelerating climate crisis. On the other hand, Japan's backward-looking stance was conspicuous among the G7 members, as it opposed the inclusion of a deadline for phase-out of coal-fired power generation and insisted that gas be maintained as a “bridge fuel” in the shift to clean energy. "The promotion of an international “Green Transformation" was clearly stated in the Ministers' Meeting's Joint Communique. It needs to be emphasised that Japan's “Green Transformation”  is full of “misguided climate change measures" that have uncertain carbon reduction effects and are not consistent with the 1.5°C target of the Paris Agreement, such as building or extending the operation of nuclear power plants, extending the life of thermal power generation through co-firing of hydrogen, ammonia, and biomass or CCS. Fuel sources and technologies such as hydrogen, ammonia, and CCS, have yet to be proven for practical application and commercialization, and their emission reduction effects and economics are questionable, which will delay real measures from being implemented, and these technologies will not be ready in time for 2035. Although hydrogen and ammonia are mentioned in the joint statement as low-carbon technologies, various conditions are attached to their development and use, including the need to be able to demonstrate emission-reducing effects and consistency with the 1.5°C target. "It is very important for us that you all from Australia to put pressure on the Japanese government and Japanese corporations that are still running fossil fuel projects in Asia and Australia by holding a protest and showing solidarity during the G7 summit. We need to strengthen our international cooperation to make Japan completely withdraw from all of their fossil fuel projects and financial supports. Not only during the G7 summit, let's continue to focus on amplifying the voices of people throughout the world, especially from Asia where many Japanese fossil fuel projects are ongoing despite the severe impacts of climate change in the region, against the Japanese government and Japanese corporations." --- Send in a voice message: https://podcasters.spotify.com/pod/show/robert-mclean/message

Freja Leonard (pictured) from Friends of the Earth in Melbourne was a surprise guest at a recent monthly meeting of Zero Cabon Tatura and told members about the group's "Community Gas Retirement Roadmap". In talking about the need for people to get off gas and go all-electric, Freja mentioned what she said was a rather special Facebook page organized by Tim Forcey - "My Efficient Electric Home - switching off fossil fuels" - encouraging everyone to access the page and take note of the included advice. At this point, Freja will launch the report for northern Victoria in Shepparton on Saturday, July 29, at a free barbecue organized by the Shepparton-based group, "Slap Tomorrow". The barbecue will see the sausages and onion cooked on an induction hotplate, powered by an electric car. Jeff speaks about a recent report supported by Friends of the Earth and also the Network for Social Justice and Human Rights in Brazil, which details the ways that international pension fund investments, particularly American pension funds are involved in driving deforestation in Brazil through the pushing of the expansion of agribusiness and the monocropping of soy in areas of the Amazon and Sertão regions. Also this interview looks specifically at the investments of Bunge corporation in this regard. The interview offers a wave of insights on the ways that environmentally destructive policies in Brazil are not simply occurring in a local context of the extreme right government of Bolsonaro, but are connected to an international infrastructure of financial investment that is pushing such environmentally destructive policies in Brazil. Cam Walker (pictured), from Friends of the Earth in Melbourne, was excited, relieved, and delighted with the outcome of the May 21 Federal election in Australia, so much so that he was somewhat distracted when talking recently on a webinar with the Bayside Climate Crisis Group (BCCG) that he almost forgot that purpose of his visit was to talk about halting logging in the pristine wilderness of Little Dargo in north-west Victoria. As campaigns coordinator at Friends of the Earth, Cam is untroubled in talking about climate change at work as that is one of his prime responsibilities. However, the Climate and Health Alliance (CAHA) recognises and acknowledges that many people are both troubled and concerned about raising the issue with fellow workers, customers and management and so the first in a series of webinars about climate and health conducted by CAHA was about discussing climate change at work. One of the speakers at the event was South Australia general practitioner, Dr Kate Wylie, who talked about how and when she and her patients talked about the state of the planet.
