A judge asked Bryan Kohberger, under oath, whether he was pleading guilty because he was guilty. He said yes. Thirteen months later, that exchange is the exact thing threatening to sink the petition he just filed to take it all back. Representing himself, Kohberger filed a handwritten petition for post-conviction relief in Ada County District Court, telling the New York Times that his actual innocence is his truth and calling the investigators' account a work of fiction. Before any of that reached a court, he got to a prison phone and called a reporter. Not a lawyer. Not a filing. A newspaper. What followed has put the families of Kaylee Goncalves, Madison Mogen, Xana Kernodle, and Ethan Chapin in a position they were promised in writing they'd never be in. The petition alleges ineffective assistance of counsel, evidence his defense team failed to disclose, and a distorted picture of what a life sentence and death row would actually look like, with threats and false promises blamed for the original confession. He's also said he'd welcome prosecutors seeking the death penalty again if this goes to trial. There's a procedural detail most coverage has skipped: the appeal waiver he signed never blocked a challenge to whether the plea itself was valid, which is the entire basis for this filing. The Goncalves family answered within hours, dismantling the petition point by point. There was never a trial, never a cross-examination, and no motive was ever put on the record. We go through the filing, the phone call, and the sentence that may undo both. None of this gets decided by a headline. A judge in Ada County reads it next.
