With the passing of Justice David Souter, the legal establishment has lost one of its most honored members. In this and our next episode, we pay tribute to the man and his work with the help of an amazing roster of his former clerks, friends, and colleagues. We begin with Judge Kevin Newsom from the US Court of Appeals for the Eleventh Circuit, and the Dean of the Yale Law School, Heather Gerken, who share their experience working closely with the Justice on the Supreme Court, as well as his role in their lives that did and does inspire them. Meanwhile, Akhil, who considered the Justice a good friend and role model, offers an in-depth look at various aspects of the Justice, including why a Justice who disagreed with Akhil on method and, in many cases, substance, nevertheless is regarded by him as one of the great Justices in American history. In our next episode we will have more guests whom we will reveal in the discussion during this episode. CLE credit is available for lawyers and judges from podcast.njsba.com.

Marketing Must Make People Believe, Not Just BuyThe Journey from Content to ConversionAkhil Almeida shares his remarkable journey from Virgin Records to becoming Head of Marketing at Bandhan Life Insurance. With over two decades of experience across music, market research, and financial services, Akhil reveals his core marketing philosophy: "Marketing isn't about selling. It's about making people believe." Tracing his pioneering work in predictive content intelligence at Kantar and E-commerce research panels tracking 60,000 online shoppers, Akhil demonstrates how understanding consumer behavior at a deep level is the foundation for building brands people genuinely care about.Beyond Data: Creating Meaningful Marketing StrategiesAkhil identifies three critical skills modern marketers must master: 1. Pattern recognition to spot cultural shifts before they go mainstream2. Agility to pivot quickly when playbooks become outdated 3. Commercial acumen to articulate ROI to leadershipUsing his experience transforming Bandhan Life Insurance, he illustrates how focusing on underserved segments like self-employed individuals (60% of India's workforce) created strategic advantage in a crowded market. Perhaps most valuably, Akhil emphasizes the crucial distinction between data and insight: "Data tells you what people do, insight tells you why they're doing it. Data without interpretation is just noise." Through practical examples of landing page optimization and brand-agency partnerships, he demonstrates how cultivating insight as a daily ritual ultimately drives marketing that shapes behavior, builds habits, and creates long-term brand value. For Show Notes, Selected Links and ResourcesSubscribe to our weekly newsletterAbout Akhil AlmeidaAkhil Almeida, now the Head of Marketing of Bandhan Life, is a dynamic leader with over two decades of experience in marketing, specializing in brand building, digital strategies, and consumer insights. President Trump continues to wield the ax in a manner consistent with Unitary Executive theory. The question is, is it also consistent with the Constitution, and with the various statutes on the books that are at odds with that theory? Professor Calabresi returns for more discussion of this crucial question; in this episode, Akhil is pressing a number of challenges to the theory. Among these is an important example from the early Republic, which indeed followed soon after the Decision of 1789, which is so heavily relied upon by proponents of the unitary executive. History, text, structure - all come together in a lively debate.

A cancer patient relying on the kindness of strangers to fund life extending cancer medication wants to know why he's still waiting for Pharmac to deliver drugs the government committed to funding five months ago. After flip flopping on an election commitment; the government announced a 600 million dollar funding boost for cancer and other medications in June. It said seven of 13 drugs it promised on the election campaign would be covered and the others would be replaced by alternatives. Lung cancer drug Tagrisso or Osimertinib was supposed to be one of the first rolled out. It's a relief for former taxi driver and cancer patient Akhil Chaudhary; he's been funding an average of $1300 a week to buy the drug himself. But Pharmac is yet to make a decision on funding and Akhil is still paying, he spoke to Lisa Owen.

We are approaching our 200th episode and completing our 4th year of “Amarica's Constitution,” and it seems appropriate to take stock. By coincidence, the Yale Law School is celebrating its own anniversary, and these things come together as Akhil is part of a big event and presents a “big idea” that sounds like a strange saying: “the Constitution is a thing.” We explain, elaborate, and celebrate a little bit. We look back, and we look ahead to some real excitement over the next few months (besides the election, that is). CLE credit is available for lawyers and judges from podcast.njsba.com.
Today we discuss what a president is, what a president does, and what a president "should be." To quote Professor Amar, it can be hard to find someone to fill those shoes because they were designed for Washington's feet. Our guests are Akhil Amar, Sterling Professor of Law and Political Science at Yale University, and Andy Lipka, president of EverScholar.Akhil and Andy co-host Amarica's Constitution, a podcast that explores the constitutional issues of our day. It is a perfect companion show to Civics 101, and one we endorse wholeheartedly. Today's guest is Akhil Chauhan, who runs The Writer's Job Newsletter (TWJN). But he didn't create the newsletter — he acquired it.Akhil has been running TWJN solo (besides occasional social media help) for two years. The guy he bought it from ran it for only one year. We spoke about:
Akhil is in Boston this week and reminds us that the history of the American Revolution, where Boston is so pivotal, contains myriad lessons that provide insight into the student protests of today - so we look at this subject in some detail. Meanwhile, the Court issued opinions in two prominent cases, and Akhil seems to be reluctant to take “yes” for an answer in one of them, so we take another look at issues of standing. Does Akhil convince you of the correctness of his approach? Finally, the bump stock gun case, a statutory interpretation case, is lamented by many; we take a quick look at why it doesn't have to be the last word on this matter. On today's episode, we have a crossover from "Hi, I'm Dr." featuring Dr. Mark Costes, hosted by Akhil Chawla. Mark delves into his journey from clinical dentistry to a broader focus on entrepreneurship and education. Graduating from Marquette University in 2002 and starting his practice in Arizona, Mark quickly transitioned from an associate to owning his first of many dental practices. Over the years, he expanded his operations across Arizona and California, eventually owning 16 practices. Despite this success, Mark found his true passion in the business aspects of dentistry rather than clinical practice, leading him to found the Dental Success Institute in 2012, which focuses on coaching and consulting for dental practices. Throughout the interview, Mark discusses the challenges and insights he gained from managing multiple practices, emphasizing the importance of systems over reliance on individual personnel. He also highlights his shift towards education and philanthropy, particularly through his involvement with the Colorado Surgical Institute and founding Smile Outreach International. Akhil and Mark explore the intricacies of dental practice management, the impact of dental insurance on the industry, and the future of dental service organizations (DSOs). They discuss the importance of balancing business acumen with clinical skills and how dentists can better position themselves as entrepreneurs. The conversation also touches on the need for systemic changes in dental education and the insurance landscape to better support both practitioners and patients. This episode provides valuable insights for dentists who are looking to expand their professional horizons beyond clinical work and into areas like business management, education, and entrepreneurship within the dental industry. He also suggests that at least one Justice might benefit by attending. Oral arguments are approaching in the Trump v. Anderson case, and the nation is talking about little else. At the Harvard Law School, Professor Amar is invited to debate a former US Attorney General and Federal Judge, Michael Mukasey, who also submitted an amicus brief in the case together with Bill Barr and Ed Meese, among others. We analyze the debate - and the brief. And in that brief, Akhil identifies what he considers to be an egregious error, which is telling not only in its fatal weakening of the particular argument, but in the way it calls into question the entirety of their brief, and how it points the way to needed reforms in the legal ecosystem as a whole. This is an indispensable episode. CLE credit is available from podcast.njsba.com.
The nation awaits the Supreme Court's seemingly inevitable review of the Section Three case from Colorado, and perhaps Maine as well. Media around the world is weighing in with editorials and op-Ed's; a smorgasbord of legal, political, and predictive arguments from professors, editors, elected officials, and others with their own range of expertise. We continue our attempt to help you make sense of these by choosing pieces that make the range of arguments out there. We do our best to present their argument and respond to it, bringing Professor Amar's considerable armamentarium to bear for your benefit. And this week, Akhil has at least two - maybe three - major new ideas he brings to the national discussion. They can be found here first. CLE credit is available from podcast.njsba.com.

The administrative state is up for grabs, some say, in the case of SEC v. Jarkesy, which was argued before the Supreme Court recently. We have another “clip” episode, with Akhil weighing in on attorneys and justices alike. It's particularly appropriate in this case, because so much of the case concerns juries and the 7th amendment - which, by the way, Akhil has written extensively on. That's probably why he's cited in so many of the briefs. We also heard some noise out of Colorado, by the way. CLE credit is available for this episode from podcast.njsba.com.
There is no shortage of tributes to the just passed Justice Sandra Day O'Connor, and rightly so, and this first female Justice richly deserves praise and memory. We aim to offer a tribute by taking her seriously as a Justice of ideas as well as the frequently mentioned deeply human remarkable woman she was. Fortunately, Akhil's career has been intertwined with Justice O'Connor's in a remarkable back-and-forth of ideas, cases, refinement, and legal innovation, so our perspective is a deeply informative one. Among other things, we look at the 10 most significant areas of jurisprudential impact in this remarkable but somehow underestimated to the end titan. The Supreme Court heard oral arguments in US v. Rahimi, a significant gun case, and we get to work. We have pulled clips from the argument so you can hear the justices and advocates in their own words, and Akhil comments after each clip. The case is important in itself, with wide implications regarding permissible gun regulation, and it also touches on a number of key methodological points that teach about originalism - properly done, and perhaps at times, improperly done. The Amars' amicus brief in Moore vs. United States is the talk of the legal ecosphere. Akhil's co-author, Professor Vik Amar, joins us for analysis of the precedents that followed Hylton - faithful and otherwise. This tour de force of legal analysis is perfectly suited for your CLE credit. We also look at recent comments from the Supreme Court on Moore's issues, and survey the reactions to the brief's release. Various arguments that purport to address some of the brief's claims have emerged: in support, in conflict, and complementary; we analyze and respond to them.
Tune in to hear:- What convinces Akhil that we can forecast markets with any level of precision when lots of highly intelligent people have tried and failed?- How often does Akhil think market cycles occur, on average, and how can we use that to our benefit?- Once novel market anomalies or truths are discovered, they tend to get arbitraged away to zero unless they have a behavioral element to them that is hard to predict. Is there a behavioral thread that runs through the sorts of cycles Akhil talks about, or does he fear that by publishing this book, that the information might get arbitraged away?- On a high level, what does Akhil's model focus on in particular and how did he come across it? Why does he place such primacy on the land market within markets more generally?- What brings about the recovery stage and what is going on in peoples' heads in these moments?- During the mid-cycle is there broad recognition that things are getting better or are peoples' brains somewhat stuck in the prior cycle?- What is going on, psychologically speaking, during a market boom cycle?- What can we learn from the Great Financial Crisis of 07-08'?- What phase of the cycle does Akhil think we are in at the moment and how does Covid overlap with his market cycle model?- Does Akhil think that investment recommendations can be made based on these market cycles, or is it simply an expectation management tool?- How can we make better sense of Covid's impact on real estate prices?https://thesecretwealthadvantage.comOrion Portfolio Solutions, LLC, an Orion Company, is a registered investment advisor. Akhil became interested in such cycles after his family's business went through difficult periods during the major recessions in the early 1990s and 2008. He refused to accept the conventional wisdom that these events could not be forecast in advance. After much study, he decided to develop a body of work that would help people – whether they were investors, business owners or those just interested in doing something with their savings. With professional experience in the UK civil service and international development, Akhil has worked on a range of issues from reviewing large infrastructure deals to helping establish the UK's £3bn International Climate Fund. Meanwhile violence escalates in the Middle East. How are these connected? We explore all these, and Akhil has some fascinating originalist analyses - of history you surely didn't know; of structural reasons that the Speaker can't be in the line of succession; and a new textual analysis. Meanwhile - why can't the House act? Has this happened before? (Hint: yes) NOTE: CLE Credit Available for this episode by going to podcast.njsba.com after listening.

We all wish we could have a crystal ball that can tell us how to time the market… While crystal balls are impossible, today's guest has the next best thing. Akhil Patel, a repeat guest on the show, has identified an 18-year real estate cycle that runs like clockwork… His data predicts the next real estate bubble peaking in 2026… Although money is tight and the news headlines paint a grim picture, Akhil is not worried about a systemic banking crisis in the short term. In fact, he is pretty optimistic that inflation will subside in the near future and that the economy will begin a rapid rebound by the end of the year. However, his models anticipate the next period of rapid real estate asset price inflation as capital begins to flow out of banks. Although perfectly timing the market might be a pipedream, I suggest tuning in to get an edge as you strategize for the rest of the year!
