Eastman earned his Juris Doctor in 1995 from the University of Chicago Law School and From 1996 to 1997 he served as a law clerk with the Honorable Justice Clarence Thomas in the United States Supreme Court. Matthew Continetti is a journalist and historian of American conservatism. He is currently a fellow at the American Enterprise Institute. He joins this Saturday Edition of the Daily Signal Podcast to discuss his new book, The Right: The Hundred-Year War for American Conservatism.Continetti covers the history of American conservatism stretching back to the 1920s and the presidencies of Warren Harding and Calvin Coolidge. He makes a number of thought-provoking observations in the book. He notes that "I'm looking at how the intellectuals, the writers, the thinkers, the economists responded to politics, how they influence politics, how they reacted to political developments. And then I'm also looking at how the institutional Republican Party, how did it fit into this picture? What conservative ideas did it adopt? How did it begin to regain its majority after the new deal era?"He also adds that much of conservatism is now led by the Heritage Foundation, Hillsdale College's DC Kirby Campus, and the Claremont Institute's Center for the American Way of Life. QUESTION PRESENTED:This case presents a clear and intractable conflict regarding an important jurisdictional qNew York prohibits its ordinary law-abiding citizens from carrying a handgun outside the home without a license, and it denies licenses to every citizen who fails to convince the state that he or she has “proper cause” to carry a firearm. In District of Columbia v. Heller, this Court held that the Second Amendment protects “the individual right to possess and carry weapons in case of confrontation,” 554 U.S. 570, 592 (2008), and in McDonald v. City of Chicago, the Court held that this right “is fully applicable to the States,” 561 U.S. 742, 750 (2010). For more than a decade since then, numerous courts of appeals have squarely divided on this critical question: whether the Second Amendment allows the government to deprive ordinary law-abiding citizens of the right to possess and carry a handgun outside the home. This circuit split is open and acknowledged, and it is squarely presented by this petition, in which the Second Circuit affirmed the constitutionality of a New York regime that prohibits law-abiding individuals from carrying a handgun unless they first demonstrate some form of “proper cause” that distinguishes them from the body of “the people” protected by the Second Amendment. The time has come for this Court to resolve this critical constitutional impasse and reaffirm the citizens' fundamental right to carry a handgun for self-defense. Vance warned that "the biggest businesses, the most powerful institutions, the most powerful banks in this country have aligned themselves against [political and social conservatives]." He urged conservatives to fight back and outlined a plan for doing so. "We're never going to beat them unless we go after them," he said. Mr. Vance is the best-selling author of Hillbilly Elegy: A Memoir of a Family and Culture in Crisis (Harper Press, 2016). He is also the co-founder of Narya, a venture capital firm based in Ohio.
