Idaho Murders Why Prosecutors Just Filed BOMBSHELL Motion Against Kohberger's Latest Stall In this explosive deep dive into the Bryan Kohberger case, we examine the prosecution's June 5, 2025 filing that calls out the defense's "eleventh-hour motion" for what it really is - another delay tactic in a long pattern of stall strategies. After 2.5 years since the horrific murders of Kaylee Goncalves, Madison Mogen, Xana Kernodle, and Ethan Chapin, prosecutors say they're 95% ready with overwhelming evidence including DNA on the knife sheath, surveillance footage, and 51 terabytes of digital evidence. The defense team, despite having three attorneys, two investigators, and over a dozen experts, claims they need more time due to an upcoming Dateline episode and James Patterson book. But prosecutors aren't buying it. They've exposed how the defense has systematically delayed since December 2022 - from waiving speedy trial rights to filing multiple failed suppression motions, securing a venue change, and now citing media coverage as their latest excuse. We break down why Judge Steven Hippler faces a critical decision on June 18th, the constitutional rights of victims' families hanging in the balance, and how witness Dylan Mortensen's testimony could be impacted by further delays. Learn why legal experts say this defense strategy of delay is "working beautifully" and what the prosecution's "it is time to try this case" really means for the pursuit of justice in one of America's most watched murder cases. This comprehensive analysis includes exclusive insights into the "moon and stars" alibi, the alternative perpetrator theory the judge called "just allegations," and why the defense's complaints about discovery have been labeled "utter nonsense." #BryanKohberger #IdahoMurders #TrueCrime #UniversityOfIdaho #KayleeGoncalves #MadisonMogen #XanaKernodle #EthanChapin #MurderTrial #JusticeDelayed Want to comment and watch this podcast as a video? What would drive someone to leave behind a comfortable six-figure corporate career and sell everything they own to pursue writing? For JD Barker, New York Times bestselling author and collaborator with James Patterson, it was a calculated risk that changed everything. In this conversation, Barker reveals the eerie inspiration behind his upcoming thriller Something I Keep Upstairs, a real-life haunted house perched on a tiny granite island just off the New Hampshire coast. He describes his personal experiences visiting the isolated structure and the visceral, instinctual dread it evoked. "I felt something really weird. I just did not want to be in there," Barker confesses, explaining how the island's dark history as a quarantine facility, prison, and site of mysterious deaths dating back centuries formed the foundation for his novel's supernatural elements. The conversation discusses modern publishing as Barker shares his journey from indie author to creating his own imprint with Simon & Schuster. His unconventional marketing approaches, from television commercials to streaming platforms and innovative BookTok strategies, showcase why his books consistently reach audiences that other authors miss. JD's daily writing discipline (even while working 80-hour weeks in finance), strategic business thinking, and willingness to reinvent himself demonstrate what it takes to succeed in today's publishing landscape. As he explains his philosophy: "I look at what everybody else is doing and then I try to come up with something different." Listen now to discover how this approach transformed his life and might just transform yours.Have a comment? Bryan Kohberger's has filed a 40-page motion to continue the trial, arguing they are not ready and need more time for investigation and preparation, particularly for the death penalty phase. The defense is also concerned about a Dateline special that aired, featuring non-public information allegedly leaked from law enforcement or the prosecution. They argue the special was prejudicial and portrayed Kohberger negatively. In addition, a forthcoming book by James Patterson titled "The Idaho Four: American Tragedy" is also cited as a major concern. The book claims to have "unmatched access" to the investigation and is set to be released shortly before jury selection in July. The defense argues it will further prejudice the jury pool. The court had previously issued a non-dissemination order to restrict the release of certain information. The defense argues that both the Dateline special and the book appear to violate this order. The defense asserts that proceeding with the trial as scheduled would violate Kohberger's constitutional rights, including the right to a fair trial, due process, and effective counsel. The defense suggests that a trial delay might not be the only remedy, hinting at the possibility of further motions, such as removing the death penalty or dismissing the case.RESOURCESPrevious Podcast Episode - https://www.youtube.com/watch?v=IAF8jCkNKn4 Karen Read Retrial Playlist - https://www.youtube.com/playlist?list=PLsbUyvZas7gKOJlfL__9F027hlETVU-vo This podcast uses the following third-party services for analysis: Spotify Ad Analytics - https://www.spotify.com/us/legal/ad-analytics-privacy-policy/Podscribe - https://podscribe.com/privacy

Five Legal Time Bombs in the Kohberger Case That Could Explode at Trial Former prosecutor and defense attorney Eric Faddis joins us for a deep dive into the legal chess match unfolding in the Bryan Kohberger case. As Kohberger faces capital murder charges for the killings of four University of Idaho students, his defense team has filed a motion to delay the trial, citing constitutional violations and incomplete forensic and psychological investigations. But as Faddis explains, there's much more going on beneath the surface. This isn't just about trial prep—it's about preserving appellate leverage. The motion to continue includes references to landmark Supreme Court cases like Wiggins v. Smith and Powell v. Alabama, invoking the concept of “heightened reliability” required in death penalty proceedings. Kohberger's attorneys argue they need more time to complete a full “life history” mitigation investigation—one that includes trauma, mental health evaluations, and multi-generational background records. According to Faddis, these steps are standard in capital cases, but failing to do them thoroughly could open the door to a future reversal on appeal. We also unpack how the defense is weaponizing media coverage, including the recent Dateline NBC special and James Patterson's upcoming book, to argue that Kohberger cannot receive a fair trial under current conditions. Faddis provides expert commentary on whether this pretrial publicity genuinely threatens the jury pool—or if it's a calculated move to frame a potential mistrial argument before trial even begins. Is this defense strategy brilliant or overplayed? What forensic evidence still hasn't been fully vetted? And how is this shaping up to be one of the most complicated capital trials in recent memory? Faddis brings clarity to a case that's anything but clear. #BryanKohberger #EricFaddis #KohbergerTrial #TrueCrimeAnalysis #DeathPenaltyDefense #ForensicLaw #IdahoMurders #KohbergerEvidence #CapitalTrial #CriminalJusticeSystem Want to comment and watch this podcast as a video? 10 Reasons Kohberger's Lawyers Say the Trial Must Be Delayed Bryan Kohberger's defense team just filed a critical motion to delay his August 2025 trial—and the stakes couldn't be higher. This video dives into the explosive details of that motion and why his lawyers are arguing that going to trial now could violate multiple constitutional rights and permanently damage the integrity of the case. Kohberger, charged with the brutal murders of four University of Idaho students, is facing the death penalty. His defense says that “death is different”—and legally, they're right. In capital cases, the standards are higher, the investigations deeper, and the procedural requirements stricter. In this in-depth breakdown, we unpack how the defense is using precedent from landmark Supreme Court cases like Wiggins v. Smith and Powell v. Alabama to argue for more time to prepare. But there's more. The motion accuses law enforcement of possible leaks to the media, points to damaging pretrial publicity from NBC's Dateline and an upcoming James Patterson book, and raises the alarm over the inability to seat an impartial jury. Kohberger's attorneys say the trial can't be fair unless they're given time to complete their discovery review, hire key expert witnesses, and finish a legally required “life history” investigation that could determine whether he lives or dies. This isn't speculation—it's strategy. Defense teams often build the foundation for appeals before trial even begins. If this motion is denied and the trial proceeds, Kohberger's team will have documented every issue they believe could later overturn a conviction or death sentence. Join us as we break down what this motion means, how it could reshape the entire trial timeline, and why this may be one of the most legally important motions filed so far in the Kohberger case. #BryanKohberger #TrueCrime #KohbergerTrial #IdahoMurders #DeathPenalty #MurderTrial #ForensicLaw #KohbergerDefense #MediaLeaks #CourtroomDrama Want to comment and watch this podcast as a video? So what's the king of paperback fiction doing writing a book about fatherhood? On this episode of Paternal, Patterson discusses the motivations for his new how-to manual The #1 Dad Book and what he's learned from his own experience as a father, and how to turn kids on to reading. He also reflects on the life of his own dad, who grew up in a poorhouse in upstate New York without ever knowing who his father was. Patterson's latest, The #1 Dad Book, is available wherever you buy books.

Lindsay is joined by author Samuel Marquis to discuss his book, “Captain Kidd: A True Story of Treasure and Betrayal,” which will be released on May 13, 2025, by Diversion Books. Captain Kidd has captivated imaginations for over 300 years and inspired many stories about pirates, but was he a criminal? Just how many ships did he plunder, how many men did he force to walk the plank, and how many throats did he slit? Or is the truth more inconvenient, that he was a buccaneer's worst nightmare, a revered pirate hunter turned fall guy for scheming politicians? In “Captain Kidd,” Marquis reveals the real story. Kidd was an English-American privateer and a leading New York husband and father, dubbed “trusty and well-beloved” by the King of England himself and described by historians as a “worthy, honest-hearted, steadfast, much-enduring sailor” who was the “victim of a deliberate travesty of justice.” With honors far more esteemed than the menacing Blackbeard or any other sea rover at the turn of the 17th century, how can Kidd be considered both a gentleman and pirate, both hero and villain? The ninth-great-grandson of legendary privateer Captain William Kidd, Samuel Marquis, M.S., P.G., is a professional hydrogeologist, expert witness, and bestselling, award-winning author of 12 American nonfiction-history, historical fiction, and suspense books, covering primarily the period from colonial America through WWII. His American history and historical fiction books have been #1 Denver Post and Amazon bestsellers, and have received multiple national book awards in both fiction and nonfiction categories, including the Kirkus Reviews and Foreword Reviews Book of the Year, American Book Fest and USA Best Book, Readers' Favorite, and the Colorado Book Awards. His historical titles have also garnered glowing reviews from #1 bestseller James Patterson, maritime historians, U.S. military veterans, Kirkus Reviews, and Foreword Reviews (5 Stars). His pirate book, “Blackbeard: The Birth of America,” has been an Amazon #1 Bestseller in U.S. Colonial Period History. The Marquis lives with his wife in Louisville, Colorado, where they raised their three children. Become a member on Buy Me A Coffee for as little as $1/month to support the show.
