Jonathan Drake is still long winded, Section Two of Spooner's "Natural Law" is still just one paragraph, and yet somehow this takes an entire episode. Predictably, it earns every minute. The central distinction of the night is one that sounds simple until you think about it: being illegal is always immoral, but being immoral is not always illegal. Legal violations empower the executioner. Moral violations empower your neighbors to stop returning your calls. Meting out the punishment reserved for one in the case of the other is itself a short circuit. Jonathan then turns to the concept of exigency, arguing that justice delayed is justice denied, and that the modern legal system's bloat and cost are not accidental. The episode closes with a deep dive into Kian vs. Florida, a SCOTUS case challenging whether a six-person jury satisfies the constitutional guarantee, and Florida's breathtaking response: overturning the precedent would jeopardize 90% of federal civil verdicts. Jonathan's take? That is precisely the point.

We’ve covered designing a smaller, smarter home, choosing an aligned team, creating an efficient structural design collaboratively, and future proofing your home with accessibility. I know that when most people think about sustainability, they’re thinking about energy, water, and materials, and how they can save all of those things. But a sustainable home is also a healthy home. And, given that we spend 80 to 90% of our time indoors, and especially since COVID, much of that time is now in our homes. The quality of indoor air that your renovation or new build creates will have a big impact on the health of all living in the home, and how the home functions for you long-term. Indoor air quality is directly impacted by decisions you make about the materials and finishes you include in your home, and the ventilation strategy you adopt. Those decisions are ideally made during design and specification. If indoor air quality is important to you, your goals for it belong in your Design Brief, right alongside other strategic design and specification decisions you want to prioritise in your project. In this episode, I take you through how indoor air quality is part of your sustainability considerations, the main sources of indoor air pollution in residential homes, how moisture and ventilation connect to this, and what you can actually do at the design and specification stage. This section covers the bigger-picture design and process decisions that make a home more sustainable from a strategic planning and design level, before we get into the detail of specific systems and materials. Interestingly, these decisions can often be the most impactful for your home’s sustainability as well. In my experience, when homeowners are considering sustainability, they’re often thinking of inclusions, upgrades and enhancements to their project. And design-wise, it can be common to be considering how many rooms you want, how much you can get for your budget, and how much functionality you can cram into the home you’re envisaging. However, whether you’re building or renovating, a foundational choice in sustainability can be to simply create a home that has a smaller footprint. And to do this, your project can begin with asking the question: ‘what is enough home for us?’ In this episode, I share the data on what Australian and international homes look like in terms of size, I introduce the concept of sufficiency or ‘enoughness’ as an alternative to the more common conversation about efficiency and sustainability, I give you a practical framework for interrogating your brief before design begins, and I explain why building less can create compounding benefits across sustainability, budget, and quality. In a 6-3 decision, the Court found that the Voting Rights Act did not authorize states the ability to create majority-minority voting districts. The ruling didn't overturn Section Two of the Voting Rights Act, but in the dissent, Justice Elena Kagan argued that it had done so in all but deed. Sophia Lin Lakin, JD '11 (MS '04, BA '02), director of the ACLU's Voting Rights Project, challenges the stated premises behind many current voting restrictions, including claims about widespread non-citizen voting. “If we're worried about the integrity of our elections,” she tells Stanford Law professor and host Pam Karlan, “we should be worried about making sure that more people are participating in our elections and not chasing a fantasy.” That concern—how long-standing efforts to restrict voting access can make it harder for eligible voters to participate—runs through the episode, which was recorded shortly before the Supreme Court handed down its decision in Louisiana v. Callais. In a 6–3 ruling, the Court struck down Louisiana's congressional map, which had created a second majority-Black district, holding that the map was an unconstitutional racial gerrymander. The decision could make it harder to use Section 2 of the Voting Rights Act to challenge maps that dilute minority voting strength. Lakin and Karlan discuss what is at stake when access to the ballot becomes harder and the rules for translating votes into political power begin to shift. The World Wide Digi DX Contest starts at 1200UTC on Saturday the 30th and ends at 1200UTC on Sunday the 31st of August. Using FT4 and FT8 on the 160 to 10m bands, where contests are permitted, the exchange is your four-character locator. Now the radio propagation report, compiled by G0KYA, G3YLA and G4BAO on Thursday the 21st of August Last week was relatively good from an HF propagation standpoint, with only a few periods with an elevated Kp index thanks to a high-speed solar wind stream from a coronal hole. The Kp index hit 4.67 on the 19th of August and 4 again on the 20th due to the solar wind hitting earth at more than 600 kilometres per second. Luckily, the interplanetary magnetic field remained mostly neutral, or north-facing, and the density was low, saving us from more disruption. Meanwhile, the solar flux index declined to 120 by Thursday the 21st. This is still high enough to affect the ionosphere, but well down on recent highs in the 140s and 150s. The daytime critical frequency has mostly remained above 7.5MHz, meaning the 40m band has managed to remain good for inter-UK contacts. This has also meant that maximum usable frequencies, or MUFs, over a 3,000km path hit 21MHz and even 24.9MHz at times. Nighttime critical frequencies have been around 5MHz, giving an MUF over 3,000km of below 14MHz and sometimes even as low as 10MHz. It may be another month or so before we see daytime F2-layer openings starting again on 28MHz. In the meantime, focus your efforts during daylight on 21MHz and below. T30TTT in Western Kiribati remains one of the DX stations to chase, mostly on 18 and 21MHz. The operators are alternating between using CW, SSB and FT8. Other choice DX worked included Jim, E51JD on South Cook Islands who has been active on the 17m band using SSB. TY5AD in Benin, Africa has been worked on the 10m band using FT8. And 3G1P, an IOTA DXpedition in Chile, was logged on the 15m band using SSB. Closer to home, today, the 24th, is the last chance to work OG0C on the Aland Islands. Next week, NOAA predicts that the solar flux index will remain in the 120s, until the end of the month when it could rise to 130 and even 150. Unsettled geomagnetic conditions are forecast for the 28th of August when the Kp index could hit 4. Otherwise, make the most of the relatively settled conditions over the first half of next week to work some choice DX! And now the VHF and up propagation news from G3YLA and G4BAO After this weekend, the weather changes from a Tropo high pressure pattern to an unsettled story with areas of low pressure and fronts together with wind and rain. This will remove any Tropo options and replace them with a possibility of rain scatter on the GHz bands. The auroral conditions have recently produced minor enhancements, although nothing too exciting so far radio-wise. It's worth noting that the autumn, along with spring, are times of the year when auroras are more likely. So, it's a good time of the year to keep abreast of the Kp index, especially if the Kp index goes above 5. We are at the tail end of the broader period of the Perseid meteor shower, ending today, the 24th. This leaves random meteor activity as the only option for a while. As those of you who are active in the mode already know, it tends to favour the early pre-dawn period for better chances of catching meteor scatter. Sporadic-E is hanging on for the last week or two of the 2025 season, but opportunities become much rarer. You'll need to keep a close watch on band reports to capture these increasingly fleeting events. In the main Sporadic-E season, there are usually two well-defined peaks of activity in the morning and late afternoon. However, in the tail of the Sporadic-E season you are just as likely to find it around the middle of the day as at any other time. The daily Sporadic-E blogs at propquest.co.uk  finish at the end of August, but in some years the last events have extended into the first week of September.  Moon declination is still positive, but falling, going negative on Monday. So, Moon window lengths and peak elevation will follow suit. Path losses are rising again as we approach apogee on Friday the 29th. 144MHz sky noise was low until lunchtime on Friday the 22nd, when the Sun and the Moon were very close in the sky. This continued throughout the Moon window on yesterday, the 23rd, and will revert to moderate-to-low next week.  And that's all from the propagation team this week.

Subject Matter Jurisdiction. Subject matter jurisdiction refers to a court's authority to hear a case based on the nature of the dispute. It's a threshold issue that determines whether a court can adjudicate a particular matter. There are two primary forms of subject matter jurisdiction: federal jurisdiction and state jurisdiction. Federal and State Jurisdiction. Federal jurisdiction pertains to cases involving federal laws, treaties, or the US Constitution. Federal courts also hear cases where the United States government is a party. The authority of federal courts is derived from Article III of the Constitution and various federal statutes. State jurisdiction, on the other hand, is much broader. State courts typically handle cases involving state laws, including family law, real estate, probate, and most contract and tort cases. State courts can also hear cases involving federal law, provided they don't exclusively fall under federal jurisdiction. A key aspect of subject matter jurisdiction is that it cannot be waived or consented to by the parties. If a court lacks subject matter jurisdiction, any judgment or order it issues is void. Federal Question Jurisdiction. Federal question jurisdiction exists when a plaintiff's claim arises under federal law. This concept is rooted in Article III, Section 2 of the US Constitution and is codified in 28 USC § 1331. A case can be brought in federal court if it involves the interpretation or application of a federal statute, a constitutional issue, or a federal treaty. The 'well-pleaded complaint' rule is central to federal question jurisdiction. This rule stipulates that the federal question must be present in the plaintiff's original complaint; it cannot be based solely on a potential defense or a counterclaim. Diversity Jurisdiction. Diversity jurisdiction, as outlined in 28 USC § 1332, gives federal courts the authority to hear cases where the parties are citizens of different states or a foreign country and the amount in controversy exceeds $75,000. This type of jurisdiction aims to provide a neutral forum for parties from different states or countries. For diversity purposes, a party's citizenship is determined by their domicile, not merely their residence. Corporations are considered citizens of both the state where they are incorporated and the state where they have their principal place of business. Supplemental Jurisdiction. Supplemental jurisdiction allows federal courts to hear additional claims that are related to those within their original jurisdiction, even if the related claims would not independently qualify for federal jurisdiction. Codified in 28 USC § 1367, this concept is grounded in judicial efficiency, allowing related claims to be heard in a single proceeding. Supplemental jurisdiction applies when the additional claims share a "common nucleus of operative fact" with the claims that invoked original federal jurisdiction. However, courts have discretion to reject supplemental jurisdiction if it would overshadow the original basis for jurisdiction or raise complex state law issues. Personal Jurisdiction. Personal jurisdiction refers to a court's power over the parties involved in the litigation. Without personal jurisdiction, a court cannot bind a party to its decisions. Traditional Basis of Personal Jurisdiction. Historically, courts could establish personal jurisdiction over a defendant if they were physically present in the state, domiciled in the state, or had consented to the jurisdiction. These traditional bases ensured that defendants had a clear connection to the state where the court was located. Long-arm statutes enable courts to reach beyond their state's borders to exercise jurisdiction over out-of-state defendants. The districts in question were initially crafted by the Republican-controlled state legislature, sparking controversy over their compliance with the fundamental principles of the democratic process. OVERVIEW from Cornell Law School - The Fourteenth Amendment contains a number of important concepts, most famously state action, privileges & immunities, citizenship, due process, and equal protection—all of which are contained in Section One. However, the Fourteenth Amendment contains four other sections. Section Two deals with the apportionment of representatives to Congress. Section Three forbids anyone who participates in “insurrection or rebellion” against the United States from holding federal office. Section Four addresses federal debt and repudiates debts accrued by the Confederacy. Section Five expressly authorizes Congress to enforce the Fourteenth Amendment “by appropriate legislation.” The states ratified the Fourteenth Amendment in 1868 in the immediate aftermath of the American Civil War, along with the other Reconstruction Amendments—the Thirteenth and Fifteenth. On Thursday March 22nd, 2018 the Hermetic Hour with host Poke Runyon will present the second part of the Legenda of the O.T.A.'s Second Crata Repoa Degree, Neocoris. The Legenda is essentially the same as the degree script with a few secrets deleted. It is the story of the degree. This was the first O.T.A. degree back in the early 1970s and was moved up to second when we began to do all seven of the Crata Repoa system. Last week we covered the reception, testing, and the ordeals, in Section One. Tonight we move through the obligation and on to the knowledge lectures in Section Two. Our instructions in Solomon's magick are delivered in a biblical style like Mather's used in some of his G.D. lectures. So if you want to experience a magical initiation, tune in and we'll give you a word picture of the process.
