The UCPD has received four reports of hate crimes since April 28th, all based on ethnicity or national origin. Jam was on the phone with her friend walking by student health when she heard a man yell “get out of my country” and repeatedly ask for her green card. While waiting on the police non-emergency line with two girls who came over to help, the man who yelled at Jam aggressively rode his bike next to her, spat on her face, and rode off. These attacks at UCSB come as the Donald Trump administration continues their crusade against immigrants. Jam said that she and her family have been noticing an increase in hatred under the new administration, adding, “I don't know what it is going to take for them to acknowledge that the presidency has had an impact on people. They feel like it's normal now. Like people with those sentiments, they feel like it's normal. And we can't let them think that.” UCSB Sent out a timely alert the day after Jam's assault, once a second instance of a hate crime was reported to the UCPD. KCSB asked UCSB spokesperson Kiki Reyes why the alert went out a day after the initial hate crime. She said that, "Initial reports related to this incident indicated that the perpetrator left campus and was no longer on campus. A second report indicated a pattern and a timely warning was issued." Reyes is referring to requirements for universities to send out timely alerts when there is a "serious or ongoing threat to the campus community," as outlined under the Clery Act. The UCSB crime log indicates that all four hate crime instances would qualify under the Clery act. Jam expressed frustration that the instance of her assualt wasn't enough to trigger a timely warning. Jam thinks that her experience wasn't "an individual issue, but a community one," and wants people to know, if they "see something, say something."

In April of 1986, Jeanne Clery, a freshman at Lehigh University was raped and killed in her campus dormitory room.  She awoke during the robbery of her dorm room in which her killer permanently silenced her to thwart any efforts of her positivity identifying him. This week on SA Voices From the Field we interviewed Courtney Bullard, Founder of Institutional Compliance Solutions about the many Title IX changes that are coming about and their impact on your own college campus.  Courtney Bullard has over ten years of experience representing institutions and organizations in matters involving sexual misconduct, including 8 years as a University system attorney. As in-house counsel, she served as a trusted advisor to the Chancellor, Vice Chancellors, Athletic Director, Director of Office and Equity and Diversity, Title IX Coordinator, Provost and other top level administrators on all legal matters affecting the institution. Her breadth of knowledge and familiarity with the unique aspects of a college campus provide a distinctive approach to partnering with institutions and school districts to assist with their legal needs. She excels in advising clients on all aspects of institutional compliance, including Title IX of the Education Amendments of 1972 and the Violence Against Women Act Reauthorization amendments to the Jeanne Clery Act, and specializes in providing legal advice to institutions during sexual misconduct, stalking and relationship violence investigations. Amber Grove, an adjunct faculty member and the Director of Title IX and Clery Compliance at the University of North Carolina Wilmington spoke to On Campus with CITI Program about the overlap between Title IX and the Clery Act. Amber has served in her role at the University of North Carolina Wilmington since January 2016. She initially got her start in higher education in residence life at Duquesne University. In her role as resident director, Amber became involved in Title IX investigations, which transitioned her focus in the field to Title IX. She went on to serve as the Director of Student Engagement and Responsibility at Bethany College, where she oversaw conduct and served as Title IX coordinator.The Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act or Clery Act is a federal law signed in 1990 that requires institutions of higher education to disclose information regarding campus security. The Clery Act, which amended the Higher Education Act of 1965, is viewed as a consumer protection law, which seeks to provide transparency around crime, policy, and statistics on campus. The Clery Act also requires that institutions of higher education that receive federal funding report crimes that occur on or near campus and implement school safety policies. Training is a central component of Clery Act compliance for the majority of institutions across the United States, specifically for those who have a reporting responsibility under the law. This week on SA Voices From the Field we interviewed Beth Devonshire, J.D., and Diana Ali and talked about some of the basics as it comes to Public Policy and how this intersects with the work that we do every day.  Beth Devonshire, J.D. is an experienced student affairs professional with expertise in student conduct, Title IX, threat assessment teams, policy development, trainings for various constituencies, and the impact legislative and legal decisions have on higher education.  From 2006-2018, Ms. Devonshire worked as the Associate Dean of Students at UMass Boston, the Director of Community Standards at Bridgewater State University, and the Director of Community Standards at Stonehill College.  In these roles, Ms. Devonshire was charged with oversight of the student conduct systems, membership in CARE/BIT teams, serving as the Deputy Title IX Coordinator, and drafting policies and procedures related to students. Prior to her work in higher education, Beth served as a law clerk for the Justices of the Superior Court in Massachusetts and in multiple roles at the Massachusetts State House.   Ms. Devonshire has been an Associate with D. Stafford & Associates (DSA) since 2012 and she joined as a full-time consultant in August of 2018.  In this role, Beth works with institutions on issues involving Title IX, Clery Act, threat assessment, and other compliance related issues; and advises on policy and procedures, conducts trainings, participates in investigations, reviews enforcement practices of campus law enforcement, and serves in interim roles.  Ms. Devonshire also speaks on a variety of other topics including legislative and legal issues impacting higher education including FERPA, Clery, and Alcohol and other Drug Prevention.   Ms. Devonshire is a faculty member in New England College's Doctorate of Education Program and the Higher Education Administration program at Bridgewater State University. Additionally, Ms. Devonshire serves on the Public Policy Division for NASPA, and is also the former Massachusetts Public Policy Liaison for MA NASPA.  Beth also served as the Director of the Legislative Committee for the Association for Student Conduct Administrators (ASCA) for two years.    Ms. Devonshire is a member of the Massachusetts Bar.  She is a graduate of Stonehill College with a degree in English and Secondary Education and holds a J.D. from Suffolk University School of Law.  She is also a trained mediator. Episode 1 Jeanne Clery In April 1986, first year student Jeanne Clery, a bubbly member of the tennis team, was brutally slain in her dorm room bed. The crime was incredibly violent and disturbing. But it did not take authorities long to find her killer, as he had confessed – and to everyone's shock, he was also a Lehigh student. Josoph Henry told his friends he had killed a girl and stolen some of her stuff. Henry was quickly tried for the crime and sentenced to death. His sentence was eventually pleaded down to life in prison. But Jeanne's legacy lives on, thanks to her parents. The Clerys sued Lehigh for lax security, and initiated a sweeping legislative trend that engendered a federal law named after their daughter. As a result of the Clery Act, colleges and universities that receive federal funds must be accountable for reporting crimes on their campuses, and ensuring that their students stay safe. 'The Clery Act' requires colleges and universities to report campus crime data, support victims of violence, and publicly outline the policies and procedures they have put into place to improve campus safety. Amber Grove, the Director of Title IX and Clery Compliance at the University of North Carolina Wilmington spoke to On Campus with CITI Program about the overlap between Title IX and the Clery Act. Amber has served in her role at University of North Carolina Wilmington since January 2016. She initially got her start in higher education in residence life at Duquesne University. In her role as resident director, Amber became involved in Title IX investigations, which transitioned her focus in the field to Title IX. She went on to serve as the Director of Student Engagement and Responsibility at Bethany College, where she oversaw conduct and served as Title IX coordinator.To date, the Department of Education has not identified any conflicts between the Clery Act and Title IX. However, it is necessary to understand the reporting requirements for both the Clery Act and Title, with special consideration given to cases of sexual violence and concerns about both federal requirements. With a new administration likely to take office in January, what are the changes we can expect to see in Title IX space under Joe Biden's presidency? In this episode, Jody Shipper, Title IX consultant and Managing Director at Grand River Solutions, Scott Schneider, litigator and lawyer at Husch Blackwell, and Joe Storch, in-house counsel at SUNY, share their unique perspectives on the implications of the election on Title IX. Today we are doing something a little special and different! This episode is taken from our friends at the Higher Ground Podcast and features John Graff looking at the recent rescinding of the Clery Handbook by the Department of Education and the array of implications of this motion. John goes into loads of detail and gives a great overview of the decision, providing listeners with both forward and backward-facing context on the issue. Episode 21: Filling the Title IX and Clery Gap in Schools and Universities with Jody Shipper, Part 2

This episode continues Courtney's deep dive with Jody Shipper into the complexities that typically arise concerning Title IX, Clery, and VAWA investigations in colleges and universities. Jody is a nationally recognized subject matter expert with more than 20 years' experience in policies aimed at addressing sexual misconduct on campuses; it has been a privilege to hear her thoughts in this extended conversation. In our discussion today, we continue on the topic of the overlap between Clery and Title IX, particularly around VAWA cases. For example, dating violence, domestic violence, stalking, and sexual assault all fall under Clery and VAWA, but not Title IX. They have been adopted within Title IX procedures nevertheless though, which both suggest the necessity for collaboration between fields but also produce grey areas. This segues into a discussion about the pitfalls of siloing, where we stress the idea that Clery, threat assessment, and Title IX teams should all be working together in a closer way than what meets the bare minimum defined as ‘compliance.' Indeed, many cases that meet compliance are in fact failed cases, and Jody gives an example of how collaboration saved a woman from being murdered by her boyfriend. Our conversation turns to stalking and relationship violence, and we discuss the necessity for professionals to be highly trained and therefore equipped to discern between ‘benign' and severe cases, and how sending out warnings inappropriately can actually escalate violence. Title IX and Clery procedures are complex and ambiguous for all parties involved, but the importance of maintaining an institutional culture that upholds these laws cannot be overstated. Following Clery legislation should not stop at mere compliance either. In this episode, Courtney talks with Jody Shipper, a nationally recognized subject-matter expert in Title IX and related fields, about her approach in working with universities and colleges in Title IX compliance. They talk about the intersection of Clery and Title IX, and common Clery mistakes Jody sees in the work she does with clients. Jody talks about the complexities around filing timely reports, typical daily and yearly duties of logging data, and ways schools can get better at their Annual Service Reports.
