In today's episode, David McKnight breaks down the creditor protection rules for Roth IRAs and Roth 401(k)s, as well as why more and more Americans are turning to tax-free accounts to insulate themselves from creditors… and the Government itself. In theory, under Federal Law, all IRAs traditional or Roths receive a certain level of bankruptcy protection under the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005. However, that protection is specifically tied to bankruptcy proceedings. If you're sued in civil court, the Federal bankruptcy statute doesn't automatically apply, state law takes over… By pointing out differences between states like Texas, Arizona and Florida on one end, and California and Montana on the other, David explains that whether your Roth IRA survives a potential lawsuit intact depends largely on the state in which you reside. Roth 401(k)s play by a different set of rules, as they fall under the 1974 Employee Retirement Income Security Act (ERISA). David notes that "ERISA is the big Federal law that governs most employer-sponsored retirement plans, and it comes with some of the strongest creditor  protection available anywhere in the financial world."  According to David, it's not hard to see why the Federal Government is going to need huge infusions of new revenue in the very near future. Wondering how they will be raising that capital? By targeting the nearly $45 trillion in tax-deferred retirement accounts like IRAs and 401(k). In other words, while your retirement accounts may indeed be largely immune to lawsuits, they're entirely exposed to the impact of rising tax rates. David points out that contributing to 401(k)s or IRAs is like going into a business partnership with the IRS – every year, they get to vote on what percentage of your profits they get to keep. Last month, former Democrat Speaker of the House Nancy Pelosi suggested that local and state authorities in California, a sanctuary state, could arrest federal agents for enforcing federal immigration law, saying that while “the president may enjoy absolute immunity courtesy of his rogue Supreme Court, those who operate under his orders do not.” The former speaker, as well as other mayors and governors who see fit to nullify federal law, should take a moment and reread the supremacy clause of the U.S. Constitution, which “details that local state authorities are subject to treaties and the laws that the federal government makes. And, therefore, pursuant to those laws, they are subordinate,” argues Victor Davis Hanson on today's edition of “Victor Davis Hanson: In a Few Words.” “We know in 1961-63, we had another attempt to nullify the supremacy clause. Southern governors in Mississippi and Arkansas and Alabama said, 'Federal law does not apply here. The Supreme Court ruling does not apply here. In our opinion, we can run our schools the way local people want. And we're gonna resist you.' The Eisenhower, and then later the Kennedy administration, said, 'No, you're not. We have the federal government's military, and we can federalize and hold you in contempt and arrest you because of the supremacy clause.'"

The Rich Zeoli Show- Hour 3: 5:05pm- On Tuesday, President Donald Trump held a press conference from the Oval Office—announcing that Space Command headquarters will move from Colorado to Alabama. While taking questions from reporters, Trump addressed ridiculous rumors circulating on BlueSky claiming that he had died over the weekend. The president also vowed to deploy National Guard and ICE to Chicago as part of an effort to crackdown on crime and illegal immigration. 5:15pm- Why aren't Governor JB Pritzker and Mayor Brandon Johnson willing to accept help from the federal government? According to The Washington Post, D.C. Mayor Muriel Bowser has issued an executive order welcoming federal law enforcement's presence with no expiration date. Bowser, a Democrat, emphasized her “shared priorities” with President Trump to crackdown on violent crime. Rich emphasizes this is more proof Trump's plan is working. 5:20pm- Co-Director of Harvard CAPS/Harris polling Mark Penn notes that there is a “favorable” response from Americans—regardless of political party—for Trump's crackdown on violent crime. 5:30pm- While endorsing Zohran Mamdani for Mayor, New York Attorney General Letitia James explained that Mamdani is qualified because he once served as Vice President of his high school class. 5:40pm- Matt is still watching “Leave It To Beaver” reruns—he's now on Season 3, in case anyone was wondering (you probably weren't). Plus, can he even name a Woody Allen movie? 5:50pm- We debut Newman Price's brand-new song (maybe his best one ever): “When Friday Rolls Around, Zeoli is Off.”
