In this week's episode, we speak with Steve Harmon, chief operating officer and general counsel at Elevate, a company that provides software and services for the intersection of business and law. Like many of our guests, Steve has had an unconventional—but truly fascinating—career path. While attending undergrad at BYU, he and some of his classmates founded a company, prompting him to earn a business degree and attend law school so that he could serve as the patent lawyer on the team. He would go on to leverage his combined legal and business knowledge throughout his career. Before joining Elevate, he worked at Cisco Systems for almost 20 years in various functions, where he and his team built one of the most innovative legal departments in the world. Steve was also a co-founder and board member of the Corporate Legal Operations Consortium (CLOC). Although he is no longer on the board, he remains committed to its mission to promote collaboration among legal ops professionals. We had so much to discuss with Steve that we split the conversation into two parts. In the first half of our chat, he talks about how he learned to be an in-house lawyer, the question every lawyer should ask their clients, his proudest accomplishment at Cisco, and his initial skepticism of having a legal ops role. We will be taking a break next week, but we will return on June 26 for part two of the conversation, where we explore Steve's work at Elevate, the impact of legal technology, and other fascinating topics.

Beth and Steve discuss implementing change, how change can motivate and challenge a team, and that success should be measured by looking at metrics and the organization's values to ensure qualitative priorities are not missed.[00:46] Beth shares her journey from litigation to corporate law and her current position.[02:48] Developing your knowledge of the business will help you support the legal needs of your colleagues.[04:47] One advantage of being in-house is you are closer to the business and the people conducting business. Your role is translator or interpreter of that legal risk.[07:43] Part of leadership is assigning responsibility and a charter appropriate for an individual's skillset and experience.[08:28] Contracts is required for first-year law students, but remedies is optional. If the remedy doesn't matter, does the breach?[10:55] NetApp needed to reorient the legal team to support a new area. They used legal outsourcing resources to help right-size their organisation to support new areas.[12:49] Engaging underrepresented groups regionally required working with outside counsel, to establish different goals, for each region of the business. 'Think globally, act locally.'[16:49] Some professionals raise their hand and say, "I want to go after this new thing.” As leaders, our role is to make people comfortable taking risks. [19:44] When implementing change there's a certain level of winging it. It's not all buttoned up and drawn out with rules and responsibilities.[23:22] The way to assess good versus poor legal performance is to understand how your clients are being measured.[27:39] Evaluate opportunities to push things to legal operations. As a general counsel, we must address resource allocation, and how much of our internal budget is allocated to tasks. There's a finite number of resources and budget to allocate.[29:32] I could be your favorite lawyer if I agreed to everything you wanted.

The novel begins with 16-year-old Steve Harmon writing in his book awaiting his trial for murder. Musing on his short time in prison so far, he decides to record this upcoming experience in the form of a movie screenplay. Kathy O'Brien, Steve's lawyer, informs him of what will happen during the trial. At this stage, only two of the four accused – James King and Steve – will be tried, since the other two accused – Richard "Bobo" Evans and Osvaldo Cruz – have entered into a plea bargain. When the trial first begins, Steve flashes back to a movie he saw in his school's film of predictability. The trial begins with the opening statements of the prosecutor Sandra Petrocelli, Miss O'Brien, and King's lawyer, Asa Briggs. Petrocelli labels the four accused men, including Steve, as "monsters." The lawyers call on several witnesses, including Salvatore Zinzi and Wendell Bolden, illicit cigarette traders, who admit to buying cigarettes that came from a drugstore robbery that led to the murder. The story of the trial is often broken up by a variety of flashbacks, including ones showing that King is only acquainted with Steve, that King had accused Steve of pulling the trigger during the robbery. Petrocelli calls as a witness Osvaldo Cruz, who is affiliated with the Diablos, a violent street gang. Cruz admits to participating in the crime only due to coercion by Bobo. The novel depicts the themes of identity, race, peer pressure, dehumanization, crime, teenaged masculinity, and the relative or subjective nature of the truth.

Gwen and Andy are back this month to discuss two new graphic novels for young readers. First up, they discuss Monster  (Amistad/Harper Collins), a book for teens by Walter Dean Myers, adapted by Guy A. Sims and with art by Dawud Anyabwile. Based on the multi-award-winning young adult novel by Myers, the graphic novel version of Monster chronicles the tension-filled trial of Steve Harmon, a African American teen being tried as an accessory to the murder of a convenience store clerk. Gwen and Andy both agree that Anyabwile's stunning black-and-white art delivers a powerfully effective treatment of this famous novel and in some ways enhances an already stunning look at how society looks at race and identity. Next, the two people with PhDs look at a book for younger readers, Barry Deutsch's Hereville: How Mirka Caught a Fish (Amulet/Abrams). If the title sounds familiar, that's because How Mirka Caught a Fish is actually the third book in the Hereville series, following How Mirka Got Her Sword and How Mirka Met a Meteorite. But no worries! Gwen and Andy give you just enough info about the first two books to bring you up to speed without giving away any major spoilers. Mirka is an 11-year-old orthodox Jewish girl who has adventures fighting trolls, encountering meteors, and even time-traveling, and as much as Gwen and Andy like the first two volumes, they think this third may be the best of the bunch. And while Monster and the Hereville books may appear to be vastly different, Gwen and Andy find that they share some interesting similarities. As an added bonus, Gwen and Andy also discuss four additional current titles that listeners will want to check out. (But you'll have to listen to the podcast to find out what those books are!)
