This Day in Legal History: Wilder Elected First Black GovernorOn January 13, 1990, Lawrence Douglas Wilder made history by becoming the first African American elected governor of a U.S. state, taking office as the 66th governor of Virginia. Sworn in by former U.S. Supreme Court Justice Lewis F. Powell Jr., Wilder's inauguration symbolized a milestone in American political and civil rights history. His election represented the culmination of decades of progress in dismantling racial barriers, particularly poignant in Virginia, a state with a complex history as the capital of the Confederacy during the Civil War. Wilder, a Democrat, had previously served as the lieutenant governor of Virginia from 1986 to 1990, and earlier in the Virginia State Senate, where he was known for his advocacy for civil rights, education, and criminal justice reform. His gubernatorial campaign focused on pragmatic leadership, fiscal responsibility, and bridging divides in a state still grappling with its historical legacies of segregation and inequality. Wilder's narrow victory highlighted the increasing political influence of African Americans in the U.S. and underscored the potential for diverse representation at the highest levels of government.During his tenure, Wilder prioritized issues such as improving public education, reducing the state budget deficit, and enacting stricter gun control measures. Following his time as governor, he continued to serve the public as the mayor of Richmond from 2005 to 2009, further solidifying his legacy as a trailblazer and dedicated public servant. Wilder's career remains a testament to the possibilities of progress and a reflection of the changing political and social landscape of the United States. The U.S. Supreme Court is considering a case involving a law that requires TikTok's Chinese parent company, ByteDance, to sell the platform or face a U.S. ban, with a compliance deadline of January 19, 2025. TikTok's lawyer, Noel Francisco, warned that endorsing such a law could set a precedent allowing Congress to target other companies on similar grounds, potentially infringing on First Amendment protections. Francisco cited examples like AMC Theaters, which was once owned by a Chinese company, to illustrate the broader implications. The law was passed with bipartisan support due to concerns over national security, with lawmakers fearing the Chinese government could use TikTok to spy on Americans or spread propaganda. TikTok content creators, represented by lawyer Jeffrey Fisher, argued the law unfairly singles out TikTok while ignoring other Chinese-owned platforms like Temu, which also collect U.S. user data. Solicitor General Elizabeth Prelogar, representing the Biden administration, defended the law, stating it is essential to push ByteDance toward divestiture to mitigate risks from foreign adversaries. If implemented, the ban would prevent new downloads of TikTok, leading to the app's eventual obsolescence. The justices appeared divided, balancing national security concerns with constitutional protections of free speech. Former President Donald Trump has urged the court to delay the deadline until his administration, beginning January 20, could pursue a political resolution.TikTok warns of broad consequences if Supreme Court allows ban | ReutersU.S. Special Counsel Jack Smith, who prosecuted federal cases against Donald Trump for attempting to overturn the 2020 election and mishandling classified documents, has resigned from the Department of Justice. His resignation, effective January 10, 2025, follows Trump's victory in the 2024 election, which made the continuation of these cases against the president-elect untenable due to DOJ rules prohibiting the prosecution of a sitting president. Smith's cases were already hindered by legal setbacks, including rulings granting Trump broad immunity for actions taken as president.Smith submitted his final confidential report on January 7 and defended the merits of his prosecutions while requesting dismissal of the charges. His work led to historic firsts, as Trump became the first former U.S. president federally indicted, accused of retaining classified national security documents and attempting to disrupt the certification of the 2020 election. Both cases, however, faced legal delays, with one dismissed by a Trump-appointed judge and the other paused due to Supreme Court rulings on presidential immunity.Trump criticized Smith's investigations as politically motivated and pledged to dismiss him upon taking office. Smith's tenure included significant legal challenges, culminating in the decision to halt prosecutions against Trump while continuing efforts against associates involved in obstruction. Other legal cases, such as the Georgia election interference case, remain stalled or unresolved. Smith's resignation marks the end of his role in a polarizing chapter of U.S. legal and political history.Trump prosecutor Jack Smith resigns from Justice Department | ReutersApple is defending itself against a £1.5 billion ($1.8 billion) class-action lawsuit in the UK, which alleges the company abused its dominance by charging a 30% commission on App Store transactions, unfairly inflating costs for approximately 20 million iPhone and iPad users. The lawsuit, led by British academic Rachael Kent, claims Apple maintains a monopoly over app distribution and imposes restrictive terms that harm developers and consumers alike. Apple argues the case lacks merit, emphasizing that most developers pay no commission and highlighting the benefits of its iOS ecosystem, which prioritizes security and innovation. The company further defends its practices as a legitimate use of its intellectual property, dismissing allegations as an attempt to undermine its rights. This is the first large-scale lawsuit against a tech giant to go to trial under the UK's new class-action regime, with additional cases targeting Apple, Google, Meta, and Amazon expected to follow. A similar $1.1 billion case against Google over Play Store fees is set for later in 2025. The trial will last seven weeks, with Apple's CFO, Kevan Parekh, scheduled to provide testimony.Apple fights $1.8 billion App Store lawsuit in first of UK class actions against tech giants | ReutersThe Biden administration's negotiation of Medicare drug prices under the Inflation Reduction Act revealed the strategic approaches taken by both the Centers for Medicare & Medicaid Services (CMS) and pharmaceutical companies. These closed-door negotiations included legal, commercial, and policy experts on both sides, reflecting the complexity of determining prices for some of Medicare's most expensive drugs. The finalized cuts, announced in August 2024, ranged from 38% to 79%, aiming to generate billions in savings. However, skepticism remains over whether these savings will fully materialize due to offsetting factors.Pharmaceutical companies tailored their delegations to include experts in market access, global pricing, health economics, and portfolio strategy, reflecting their varied priorities. AstraZeneca, for example, sent contract operations specialists as part of its broader lawsuit challenging the program's implementation. Meanwhile, Novartis focused on market access for its heart failure drug, Entresto, expressing concerns about reduced patient access. Other companies, including Merck and AbbVie, redacted participant details, citing proprietary considerations.Legal teams were present at nearly every meeting, underscoring ongoing litigation over the program's constitutionality. Manufacturers have largely been unsuccessful in court, although some have won partial victories. Topics discussed during negotiations, such as clinical value and FDA approvals, offered insights into how both sides justified price cuts. The CMS plans to expand the program with additional drugs in its next negotiation round, which will occur under the incoming Trump administration. President-elect Trump has appointed Mehmet Oz to lead the CMS, signaling potential shifts in how the program is managed. Industry observers see these initial negotiations as a test case for broader reforms in U.S. drug pricing policy.Drug Industry Lawyers, Experts Helped Shape US Drug Price Cuts This is a public episode. Lawrence Douglas Wilder, born on Jan. 17, 1931, and named after abolitionist Frederick Douglass, made history as America's first Black governor when he was elected in Virginia on Nov. 7, 1989. Serving from 1990 to 1994, Wilder, the grandson of a formerly enslaved person, was drafted into the U.S. Army during the Korean War, where he earned a Bronze Star for bravery but still confronted segregation. Using the GI Bill, Wilder attended Howard University School of Law, as Virginia's law schools barred Black students. He later founded his law firm in Virginia and began his political career, winning a seat in the Virginia State Senate, where he served five terms. After serving as lieutenant governor, Wilder made history in 1989 as governor. Following a decade out of politics, he returned as mayor of Richmond from 2005 to 2009, continuing his legacy of groundbreaking public service. Learn more about your ad choices. The first half of today's show dives into yet another crazy episode of The Big Fani Willis Reality TV Show. Late yesterday, we found out the judge who spent the last week and a half mulling over attorney-client privilege options available to Terrance Bradley, has decided it does not exist in this case. There is too much evidence to show the knowledge Bradley would have gained did not come while he was acting as Nathan Wade's attorney. We do not yet know if the cell phone affidavit is going to be allowed. We do know that the Fani Willis team of lawyers issued a response, calling for every technicality to be issued to prevent the judge from even considering any of that evidence. It's a sad result for Fani Willis and her team, but the only option they really have to play. In the meantime, whistleblowers inside the Fulton County DA's office have revealed that the White House had a plant in the office who was calling all the shot and helping to drive the Trump RICO case. If that is the case, then the White House would be guilty of election interference in the 2024 race. It's almost like Fani Willis has been setup to lead the charge against Trump, but take the fall if it were to fail. Those same anonymous insiders have also discussed how rabid Fani Willis was about implementing radical DEI policies in the office. We then move onto an odd kerfuffle that took place inside the Virginia State Senate. Apparently, a man who thinks he is a woman stomped out of session in a huff because the Lt. Governor, Winsome Sears said “sir” to him instead of his preferred, “ma'am.” So, I take a moment to discuss the issue of mental illness and where do we draw the line in allowing those with problems drive the narrative? Just because someone wants to pretend they are something they are not, does not mean I should be forced to indulge in that unhealthy fantasy. Onto the topic of the border and the President's policies of encouraged invasion. Rachel Campos-Duffy exposed a taxpayer funded NGO, Casa Alitas, harboring an entire hotel building full of illegals in Tucson, AZ. These non-government organizations survive on our tax dollars, yet they are knowing breaking our laws and ignoring our sovereignty. For Rep. Doug Collins (R-GA) is upset that while Joe Biden eats an ice cream cone and acts cavalier about the open border, we are still mourning the bludgeoning death of Laken Riley. It's infuriating. Even Axios just ran a story entitled, “How Biden Botched the Border.” In another topic, Rep. Katie Porter (D-CA) thinks it's is wrong to use words like “groomer' and “pedophile” because those words come across as sounding criminal. In her mind, pedophilia is not a crime, but just someone's personal identity. We should not criminalize the act of sexual interaction with children, because who are we to judge who a person loves? It's literal lunacy to believe that way. My closing comment is on some of the scuttle about who Donald Trump will name as his VP. While I understand the allure of Tulsi Gabbard, I do not think she is the best person for the long-term. Short-term, it would be a massive win for pulling over moderates and even left-of-center Democrats. BUT...the VP will be the presumptive nominee for president in 2028. I think a much better pick would be Gov. Kristi Noem (R-SD). She has a track record, experience, has been a leader and has shown how she would govern. Dr. Ben Carson and Gov. Ron DeSantis (R-FL) are also good options, but I think Noem is the best possible fit for both 2024 and to run for the Oval Office in 2028. The winner and incumbent Parisa Dehghani-Tafti joins Kojo and Tom to talk about why she thinks residents voted to give her a likely second term. Plus, what will her priorities be over the next four years as the county's top prosecutor? Perhaps the biggest upset on Tuesday was Saddam Salim defeating long-time lawmaker Chap Petersen for the Democratic nomination to vie for a seat in Virginia State Senate representing the 37th District. The Loudon Love Warriors, a Facebook group of radical activists and ideologues, were targeting parents who were speaking out for more safety in schools. Pablo discusses their connections to government officials and power brokers, and talks more about the issues that will drive the November 2023 election.

Mark Morgan and I share a history together from the FBI Academy. Mark was the Assistant Director of the Academy, and I was an instructor and Employee Assistance Program Peer Counselor. After retiring from the FBI, Mark went on to become the Chief of the United States Border Patrol, Acting Director of the U.S. Immigration and Customs Enforcement, and then Acting Commissioner of the U.S. Customs and Border Protection. Mark also retired from the FBI after twenty years and served as a Sheriff's Deputy and Police Officer. Mark has extensive experience dealing with Border issues, and in this episode, we had a great conversation about the border, and how the crisis we are now facing makes every state a border state. https://www.heritage.org https://www.fairus.org I need the support of every voter on November 7, 2023, so please visit my website to see how you can help us take back the Virginia State Senate by supporting me in my run for the 33rd District. I had the pleasure of being interviewed by Larry O'Connor and Julie Gunlock on O'Connor and Company on 3/6/2023 after CPAC. It was a great honor to have the opportunity to discuss the issues that are important to the voters of Northern Virginia on WMAL 105.9. Virginians are demanding we have a State Government that is going to place their safety first, prioritize the education of their children, deal with the horrific opiate crisis we are facing, and improve our floundering economy. As the future of Virginia political power in the Virginia legislature hangs in the balance in 2023, the dispute over the Republican nominating process for Hermie Sadler's grass-roots, anti-establishment run for the Virginia State Senate heats up and heads for the courts as the Republican Party and its leaders attempt to put their “thumbs on the scales” to favor Sadler's opponent, and use their power to take the decision on who will be their candidate for the November elections away from the citizens of Southside. Listen as Senator Stanley, Sadler and the “Swear Bear” Shep Moss discuss the recent lawsuit filed by the 17th Legislative District Committee Chair Dawn Jones, as she fights a one-woman battle on behalf of the grass-root Republicans against the State Board of Elections, a Virginia government agency that may have improperly bowed to the political pressures from the highest levels of government. Then the boys talk about the endless (and ridiculous) efforts of the Democrats to prosecute Donald Trump, why Democrats always seem to want to weaponize the powers of government to use against their enemies – and make sure you hear how Senator Stanley the lawyer breaks down the case against the 45th President of the United States, and why if he was Trump's attorney, he would win the case in a “New York Minute.” Plus, the boys get visits from Hermie's wife Angie, and his darling daughter Hailey as they tape their episode at “Hermie Sadler's Fo Sho Restaurant,” in beautiful downtown Emporia. In the second segment of this week's LRTL, Stanley and Sadler talk about more pleasant things, like their race team and their drivers for Sadler/Stanley Racing, the ongoing NASCAR® season, and the joys (and sometimes expensive) adventures of owning an RV! Once you pick this episode up, you won't be able to put it down!!! The Virginia General Assembly wrapped up its work at a furious pace in order to adjourn “sine die” (latin for “without day”—which means that its now gone from the Capitol, “indefinitely”), with tempers flaring, bills either living or dying, and a still-undecided battle raging over the Virginia State Budget. Hermie and the Senator go over the last days of the 2023 General Assembly session – the ups, the downs, and the still unknowns. They even have an interesting discussion on how Senator Stanley's legislative agenda fared during session, and how a great bill that he sponsored that would have helped students in our rural and urban areas may have actually been killed because of Hermie and Bill's successful lawsuit on behalf of the small business owner and skill games. Hermie and Bill also talk about the status of Hermie's race for the Virginia State Senate, and take a look at the upcoming 2023 SMART and WHELEN open-wheel modified race seasons for Sadler/Stanley Racing with Bobby Labonte and Ryan Newman behind the wheel of their two-car team! In the second segment, Senator Stanley sits down for a compelling political and regional discussion with his friend, Democrat State Senator Dave Marsden. Listen as both senators discuss the philosophical differences between Republicans and Democrats, as well as the issue that transcends party affiliation in Virginia: Regionalism. Bill and Dave even discuss ways that all regions can come together for the betterment of the Commonwealth. And that even though the two senators don't agree on some issues, they still try to work together to solve the issues that all Virginians care about -- like the Envigo Beagles! Matt Strickland's story is one on which the America Dream is built on. His 15 years in the military and 7 years as a small business owner exemplifies the qualities of patriotism, hard work, family responsibilities, Christian values, service and community involvement. He has seen the horrors of the battlefield and shed blood, sweat and tears building up his family's new business. He then fought and won against the regulatory system that tried to close down his business under tyrannical and nonsensical covid rules. Now Matt is running for the Virginia State Senate to be a voice of reason and common sense for his community and beyond. Join us this episode to see what the American Dream should look like in the 21st century and you will be inspired to make a difference wherever you are around the world. At the age of 17, Matt Strickland joined the United States Army to escape the gang violence of the neighbourhoods where he was raised. Inspired by his grandfather, who served as an Infantryman under General Patton in World War II, Matt enlisted in the Army in 2001. After completing basic and advanced training, Matt received orders to his first duty station, 25th Infantry, at Ft. Lewis, WA. He reported to 25th Infantry on September 10th, 2001, not knowing the next day, life as we once knew it would change forever. Matt knew he had a full life ahead of him, but he was ready to give it up in defence of his country. Matt spent most of the next ten years in Iraq & Afghanistan defending his country. Matt's service to his country includes multiple deployments as a private military contractor as well, serving on Blackwater's Counter Assault Team until 2010 when he decided to accept a position as an Intelligence Analyst back in Virginia. In 2014, when ISIS began sweeping through Iraq, Matt could not sit back and watch, so he deployed once again to join the fight against The Islamic State. In 2016, after fighting ISIS for two years, Matt hung up his combat boots. The previous two years allowed Matt to reflect on the legacy outside of combat that he wanted to leave for his children. Cooking has always been one of Matt's hobbies and biggest passions, and owning a restaurant was always his ultimate goal. Matt opened his first food truck in 2016 which quickly became a success, and he and his wife, grew from one truck to three trucks in just over a year. Two years later he sold the food trucks and opened the doors to the restaurant version, and it continued to grow in success. Everything was great until 2020 when the government began using the Coronavirus as an excuse to control society. Matt continued to open without restrictions, regardless of the consequences, he and his wife opposed the unconstitutional mandates and the restaurant was filled with Patriots from open to close. Despite numerous threats and attempts to shut them down by the state and federal government, he remained open and stood with the people. The Attorney General of Virginia sued Matt in an attempt to shut their doors, but he won, restoring his hope for the country's future. Through his fight against the tyrannical government, Matt realised there was a void in Virginia politics and that catalyst sparked his interest in running for State Senate and with him being a fifth-generation Virginian, his state and his country mean everything to him. In this week's episode, Sadler and the Senator have the privilege of interviewing one of the greatest people to ever walk this Good Earth, NASCAR® great and Daytona 500 winner Michael Waltrip, in a compelling and honest talk about his life in stock car racing and his place in history in the sport. Learn about his thoughts on the 2001 Daytona victory when we lost Dale Earnhardt, his love of the sport, and his dedication to not only being a steward of racing history, but also his involvement in broadcasting to keep the future of the sport as an important aspect of the American experience. In Senator Stanley's Leaning Right moment, sponsored by Senator Stanley's college roommate Tom Graziano and his Farmville restaurant Charley's Waterfront Café, Bill and Hermie discuss Virginia Gov. Youngkin's unique and powerful initiatives to create private/public partnerships to save and revitalize Petersburg, one of the great historical cities of Virginia. Sadler and the Senator then relive “private citizen” Hermie's foray into local politics and the speech he made at a local county's Republican Committee (and the petty politics of those that may challenge him in a primary), as he determines whether to throw his hat in the ring for the newly created 17th District for the Virginia State Senate. And in Hermie's Turning Left moment, sponsored by Stanley's wife's company Vista Installations, the boys talk about the races at Watkins Glen, the insertion of F1 racers into the cup race, the finish between Kyle Larson and Chase Elliott, and the good showing by our friend Chris Rice's team Kaulig Racing in both the Xfinity and Cup races with AJ Allmendinger. Hermie also discusses the charter system, and how the racing would be even better if the Michael Waltrip Racing Team was still a force in NASCAR®. As always, The Leaning Right and Turning Left With Sadler and The Senator is sponsored by Pace-O-Matic, an entertainment company which develops gaming software that players love to play and can use their skills to win, every time. Pace-O-Matic is focused on people having fun, the small businesses that love them, and generates millions of dollars in Virginia. A day after the defensive coordinator for the Washington Commanders doubled down on his tweet minimizing the January 6th attack on the U.S. Capitol, Virginia lawmakers withdrew legislation that could have brought the team's new stadium to the Commonwealth. WTOP's Sports Director George Wallace tells us what Jack Del Rio said and why it's having such an impact. Then, we speak with lawmakers from both Virginia and D.C. about why they chose to speak out in opposition to a stadium for different reasons.
An update on Wednesday's show. We are still looking to hire a researcher for a part-time/one-off project we are working on. Please send your resume to nothingpersonalds@gmail.com if you are interested. Today's word of the day is ‘void' as in the Angels Stadium land deal has been voided because of the owning FBI investigation into corruption of the Anaheim city council. It is a major story involving the Mayor, the Angels, and now Disney. (18:25) So what's happening in Washington D.C. ? It looks like the Commanders may have met a big snag in their hunt for a new stadium. The Virginia State Senate is now saying they do not support Daniel Snyder at all. State Senator Bryce Reeves joined Jeff Katz to debrief with what happened in the Virginia State Senate and to catch up on the charity gaming bill that was hotly discussed throughout.
Since Mark Zuckerberg provided hundreds of millions of dollars to assist governmental agencies in administering the 2020 elections through the private Center for Tech and Civic Life, state legislatures have considered and in many cases taken action to prevent future billionaires from privately funding the administration of elections. This week, Capital Research Center president Scott Walter testified on one such bill before the Virginia State Senate; he joins us to discuss the “Zuckbucks” and legislative responses to them. Also joining us are Hayden Ludwig and Parker Thayer, two of my colleagues who have put in yeoman's work crunching the numbers on where exactly the Zuckbucks went. A quick fact check followed by an introduction to ALEC, the association of lawmakers and corporations working together to write bills. Fact Checking CD011 Conversation Kim DotCom's Story Al Qaeda has been reported to be operating in the following countries Afghanistan Iraq Pakistan Sudan Bosnia Syria Somalia Egypt Saudi Arabia Yemen Algeria Mali Mauritania Morocco Niger Tunisia Turkey Kenya Tanzania United States What happened in Virginia: Last week, a bill was rammed through the Virginia State Senate that redraws the maps for their State Senate races in a way that gives more votes to Republicans. Henry Marsh is a civil rights lawyer and Democratic VA Senator who went to Washington D.C. for the inauguration. The VA State Senate is a 20-20 split, so while he was gone, the GOP surprised the DEM's by bringing the bill up for a vote knowing they would be able to pass it with a DEM Senator missing. The House and Governor of Virginia are Republicans. The bill's chances look good. There is SEPARATE bill that addresses the Electoral College that was just born in Subcommittee. The electoral college bill's path to law looked good but the bill was defeated in committee Tuesday on an 11-4 vote after the Governor came out against the bill.
