We start with some thoughts about the big international story of the moment, the idea from US President Donald Trump that all Palestinians be removed from Gaza so that it can be redeveloped as a luxury waterfront enclave. This does not seem a particularly good idea as President Trump has not yet explained where the 2 million Palestinians will go, or who will pay for the redevelopment. All that the mealy-mouthed Australian government will say is that it remains in favour of a Two State solution, a line echoed by the Opposition. This seems to overlook the fact that one of those states – Israel – is no longer interested in that approach and as well as having Palestinians kicked out of Gaza would like them kicked out of the West Bank as well. Australia has just handed over $800 million as a gift to very profitable US submarine manufacturers with another $4.2 billion to follow – and the media thinks it's a wonderful idea. ERCowboy wrote on Twitter a while back, “In any complex system, the likelihood of unintended consequences vastly outweighs the predictability of intended ones.” In this healthcare podcast, we're talking about two state laws where this is apropos: CON (Certificates of Need) laws and then COPA (Certificates of Public Advantage). Turns out, states actually have pretty much power to impact the competitive landscape in their state. They have a lot of levers they can pull. States really can make a difference in terms of improving real competition on value and on cost and quality. So, these two laws are, in a way, their attempt to do so. Before we kick into what's going on here, I think it is important to point out that these laws on their face aren't an obviously and overtly terrible mistake. This isn't like equivalent to accidentally putting ChapStick in the dryer. There were good people who spied a problem and had an idea for how to fix it. I'm reminded of something I read by Nicholas Kristof on a totally different topic, but he wrote, “The central problem is not so much that the effort was unserious as it's more focused on intentions than on oversight and outcomes.” And that pretty much sums up, I think, the gist of what's going on here. And I can say that because here we are in a position to Monday morning quarterback. So, I've invited Ann Kempski on the pod to point out what hindsight may reveal about these well-intentioned efforts, the CON and COPA laws. First up, let's talk about Certificate of Need laws, or the CONs. Currently, we have 35 states and Washington, DC, that operate CON programs with wide variations by state. The National Conference of State Legislatures has a good overview of each state's laws. Why did these laws originally get put into effect? They got put into effect to cut down on supply-driven demand that was considered to potentially raise total cost of care—because in healthcare, unlike Econ 101, more supply doesn't mean lower prices. In the real world, if you have more supply, volume goes up and total cost of care goes up, too. So, it could be considered good thinking to limit the amount of supply. Except there's four problems that wind up happening often enough, which is why some states are busy repealing these CON laws. We cover these four problems in the show that follows. Spoiler alert: What happens a lot of times is that the big get bigger. Consolidated entities have an upper hand, and we all know consolidated entities are generally not known for their competitive prices or their desire to rationalize volume. So, yeah … we dig into this and parse it out into, as I said, four main problems; but this is most commonly where it all winds up (ie, total cost of care does not go down). I have included links that Ann Kempski shared with me, including a statement from the Federal Trade Commission (FTC) and Department of Justice detailing the anticompetitive effects of state CON laws. There's also a document written by a former FTC commissioner that highlights how state CON laws can inhibit competition. And then lastly, a systemic review of 90 studies that find the costs of CON laws exceed their benefits. Okay, so let's move on to our number two state law that often does not go as planned; and this is the Certificate of Public Advantage, or the COPA, laws. Approximately 19 states have them, and these laws attempt to immunize hospital mergers from antitrust laws by replacing competition with state oversight. The idea here is that a state tells the FTC to stand down and gives their seal of approval to a merger to stop it from getting scrutinized for antitrust violations. So, like, a big dominant health system gets an okay to buy a rural hospital. Meanwhile, everybody realizes this will lead to a situation where there is a dominant health system and that dominant health system will reduce competition. But the state may choose to do this because … public advantage, as in the “PA” in COPA, Certificate of Public Advantage. But they'll do this because the state has decided that the public advantage of allowing the possibly problematic anticompetitive merger to move forward, the public advantage is a bigger advantage than having competition. Hmmm … what could go wrong here? Well, several things that Ann Kempski discusses in the show that follows. The Federal Trade Commission strongly advised the states against enacting these laws. Here is a link to this article that was on the FTC Web site. I was so thrilled to get the chance to chat with Ann Kempski, who knows so much about these topics. Ann Kempski is an independent healthcare consultant with a background in the labor movement, advocating for healthcare workers and purchasers for many years. Ann Kempski collaborates with clients to strengthen primary care, enhance union health funds, and reduce commercial prices. She often partners with academics from Johns Hopkins to analyze hospital transparency data for insights into market trends. Before we jump into the episode, we've had a loss in our community. Upgrade your subscription here.**  As university campuses have become sharply divided in the wake of the October Hamas attack and the ensuing war between Israel and Gaza, Dartmouth has emerged as a model for productive dialogue among students and faculty alike. This is due largely to the efforts of Bernard and Ezzedine, who lead by example in and out of the classroom and have recently been featured on Sixty Minutes, PBS, and elsewhere.  In this conversation, they talk about their approaches to teaching, the professional paths that led them to the classroom, and how to honor personal feelings while encouraging intellectual humility over reflexive emotional reaction. Ezzedine also discusses the limits of viewing political history through a colonial/anti-colonial framework and Bernard reflects on the complexities of Zionism and why he was so excited about the Zionist project back in 1968. GUEST BIOS: Bernard Avishai, a Visiting Professor of Government at Dartmouth College, has taught at Hebrew University, MIT, and Duke. He's a Guggenheim fellow and author of four books. A regular contributor to The New Yorker on political economy and Israeli affairs, he has also written for Harper's, The New York Review, The Nation, and New York Times Magazine. Formerly an editor of Harvard Business Review and KPMG's International Director of Intellectual Capital, his upcoming Harper's cover story on Israel's culture wars will be released on January 15. Ezzedine C. Fishere, a renowned Egyptian writer and academic, is currently a visiting professor at Dartmouth College, teaching Middle East politics and cultures. Karim Haggag joins us to offer his thoughts and commentary on Israel/Palestine and the Gaza War with a particular focus on the transformation of the Israel-Palestine conflict over the past three decades, the dangers of the current moment, the divisions in the Palestinian national movement, the Israeli settlement project and the influence of the far-right in Israel, the existential narratives at work in both Israeli and Palestinian political and social life, and the erosion of the two-state solution paradigm. Karim Haggag served for twenty-five years in Egypt's diplomatic corps, is a former Egyptian Press & Information Office Director, a professor of practice at the School of Global Affairs and Public Policy at the American University in Cairo, and co-managing editor of the Cairo Review of Global Affairs and director of Masters of Global Affairs. Other topics covered in the course of our conversation: - Israel's 2018 Jewish State Law, the rise of the messianic Jewish far-right in Israel and the mainstreaming of expulsioninist rhetoric in Israel, and Palestinians fears of a new Nakba (referring to the 1948 expulsion of Palestinians) - The Israeli intelligence ministry concept paper that lays out a program for pushing Palestinians from Gaza into Egypt's Sinai Peninsula and how Egypt & President Abdel Fattah El-Sisi's objections to this plan - El-Sisi's core considerations: 1.) not wanting Egypt to be party to another expulsion of Palestinians (we discuss this in relation to criticisms arguing that Egypt simply doesn't want to accept refugees), 2.) the security threat potentially posed by such an expulsion (ie: if Gazans are pushed into the Sinai so too will Hamas) - Criticism of Israel's lack of clearly stated strategic goals in the current war beyond "the destruction of Hamas", the logic of Israel's previous "mowing the grass" military approach to the conflict in the past and its failure, and the maximalist approach Netanyahu is taking to the Gaza War - The failure Western diplomatic approach to the conflict and the assumption that there will be a "Day After" scenario where Hamas is destroyed - Entrenched divisions in the Palestinian national movement between Hamas and Fatah -  The Camp David 2000 Summit that brought together Bill Clinton, Ehud Barak, and Yasser Arafat in peace talks; the narrative that Arafat passed up a "generous offer" from Israel - And much, much more!

Then, she speaks with Jonah Walters, postdoctoral scholar at UCLA's Institute for Society and Genetics, to discuss a book compilation he co-edited entitled Only The Good Die Young: The Verdict Against Henry Kissinger, published via Jacobin and Verso Books. First, Emma runs through updates on Jake Sullivan's visit to various authoritarian utopias, Israel's indiscriminate bombing, growing backlash to Israel, Biden's bleak polling, the House impeachment inquiry, January 6th, and Floridian education action, before touching on Israel's abuse of the Two-State solution. Rebecca Jane Morgan then joins, first taking on the definition of Trans-Exclusionary Radical Feminism, before stepping back to walk through the longer history of Evangelical Christianity to trans identity, including a long period of a mixed yet positive recognition of the community – particularly with the parallels of “rebirth” – over the 20th Century. Moving into the 2000s, Morgan tackles the role of the Gender Recognition Act in the UK in igniting Evangelical backlash – largely because of its policies around same-sex marriage – whereas the US' legislative body took until the 2010s for the bathroom debate came to the fore. Rebecca concludes the conversation by walking through the particular alignment of Terfs and Evangelicals over their somatophobia towards trans people, and what that means for the fight for trans rights moving forward. Jonah Walters and Emma then explore the life and legacy of Henry Kissinger as they walk through his prevalent (and bipartisan) role in US politics, and his ideological grounding in pure American hegemony, before stepping back to assess the importance of his rise to power during the Cold War, bolstering the growth of America's capital order internationally while continuously and intentionally undermining any liberatory and anti-capitalist movements in the third world. Wrapping up, Walters parses through the obscene death count that follows Kissinger to his grave. And in the Fun Half: Emma is joined by Brandon Sutton and Matt Binder as they talk with Eddie from Ft. In the wake of the horrors of the recent Israel-Hamas conflict, Steve ponders the deep divisions such wars reveal in our own society.The West, he observes, has a fascination with conflict.After all, it took the recent conflict in the Middle East to wipe battlefield reports of Eastern Europe off the front pages of newspapers around the world.The response to the recent conflict in Israel is emblematic of a constantly shifting culture, albeit one that remains deeply divided.But as Steve notes, perhaps the call of Jesus to "love your enemies" is the only real solution in a world unable to rid itself of physical and cultural conflict.  In our post-Christian West, we've looked everywhere else for a solution. Perhaps it's worth checking the story of Jesus again.

In an essay in Foreign Affairs, four scholars of the Middle East argue that analysts and policymakers should drop the illusion a two-state solution is possible as long as Israel's military occupation of the West Bank and blockade of Gaza continue.
