A recording of the inaugural Kaldor Centre Oration, delivered by Kate Eastman AM SC and Zaki Haidari on 21 November 2024. The Kaldor Centre Oration is a new flagship lecture hosted by the Kaldor Centre for International Refugee Law at UNSW Sydney, designed to enrich the public conversation on refugee issues by showcasing transformational ideas that can spark fresh thinking and action. It is a valuable opportunity to build shared understanding and positive solutions. The inaugural 2024 event builds upon the Kaldor Centre's track record of thought leadership, stemming from more than a decade of principled, evidence-based contributions to the refugee debate. This recording is for anyone interested in creating a better future – be they people with lived experience of displacement, civil society, legal practitioners, policymakers, business leaders or community members. About the speakers: Kate Eastman AM SC is a Sydney barrister working in the fields in human rights, discrimination, employment, public and constitutional law. Over her 30 years practicing as a lawyer, Kate has been committed to human rights and equality. At Allens, she represented asylum seekers in detention in Port Hedland. She then worked at the Australian Human Rights Commission before joining the Bar in 1998. Between 2019 – 2023, she was Counsel Assisting the Royal Commission into Violence, Abuse, Neglect and Exploitation of People with Disability. She has taught human rights law at UTS, Monash University and the University of Sydney, and in Burma and Uganda. Kate is chair of the Australian Bar Association's Diversity and Inclusion Committee and the Law Council of Australia's Equal Opportunity Committee. In 2023, she was appointed a Commissioner of the New South Wales Law Reform Commission. Kate has received the Law and Justice Foundation's Justice Award (2003), the Australian Human Rights Commission's Human Rights Award for Law (2019), a Lifetime Achievement Award from Women Lawyers Association (NSW) (2022), and the Law Council of Australia's President's Award (2022). She was appointed a Member of the Order of Australia for significant service to the law, to human rights, and to professional organisations. Zaki Haidari is a 2020 Australian Human Rights Commission Human Rights Hero, an Ambassador for Refugee Advice and Casework Service (RACS), and works at Amnesty International Australia as a Strategic Campaigner. Zaki is also a highly respected commentator in the media on refugee rights. Zaki is himself a refugee. He fled Afghanistan at age 17, targeted by the Taliban after his father was ‘disappeared' and this brother murdered. He survived a terrifying boat journey and arrived in Australia seeking protection in 2012. Since then, despite social, legal and financial obstacles, he has thrived. Having arrived with little English, in 2015, just three years after he came to Australia, he won the NSW Government's International Student of the Year Award (2015). He has also completed a Diploma in Computing and a Diploma in Graphic Design. Zaki is a compelling human rights advocate. Even while he was on a temporary protection visa, and since he was granted permanent protection, Zaki has continually and courageously shared his experience and expertise with the media and the wider community, speaking out about the cruel regime of permanent temporariness faced by people like him who came to Australia by sea seeking safety.

Noam Chomsky needs no introduction. He's a celebrated linguist, who has long denounced U.S. empire at home and abroad. And he has a long relationship with Latin America.Chomsky's 1985 book, Turning the Tide: U.S. Intervention in Central America and the Struggle for Peace, was formative for many academics and activists analyzing the U.S. role in the region. In 2012, NACLA awarded him the Latin America Peace and Justice Award for his ongoing commitment to social justice in the Americas.Chomsky's wife, Valeria Wasserman, is from Brazil. That's where he is now. Chomsky suffered a stroke last year and was recently in a hospital in São Paulo, though he has since been released.  You can think of this as our small tribute to the great Noam Chomsky.  In this second bonus episode of Under the Shadow, host Michael Fox takes us to a October 26, 1983 lecture by Noam Chomsky, at the University of Colorado, on the impact of U.S. military intervention in Central America. It's fascinating to look into what we knew then, even as the events were still unfolding, and hear the historical context from someone like Chomsky.Under the Shadow is an investigative narrative podcast series that walks back in time, telling the story of the past by visiting momentous places in the present. In each episode, host Michael Fox takes us to a location where something historic happened—a landmark of revolutionary struggle or foreign intervention. Today, it might look like a random street corner, a church, a mall, a monument, or a museum. But every place he takes us was once the site of history-making events that shook countries, impacted lives, and left deep marks on the world.  Hosted by Latin America-based journalist Michael Fox.  This podcast is produced in partnership between The Real News Network and NACLA. Shirley Stancato is known for her leadership in Detroit and enduring commitment to social justice. She talks with Denise about the New Detroit coalition, race relations, and dealing with adversity. “Having conversations about race helps leaders in their organizations”. Top down, leaders and educators must set standards for interaction and rules of engagement. For an honest and productive discussion we need a no fault environment and a focus on the issue rather than an individual. She also poignantly reminds us that even if you are alone in your opinion, it doesn't mean that you are wrong. Shirley shares personal stories of growing up and having responsibilities of an adult while still a child herself. Tune in to hear about empathy, ethical decision-making, inclusivity, and a vision for positive change. Shirley Stancato is a seasoned executive, a prominent civic leader, expert on race relations and social justice advocate. She serves on the Board of Governors for Wayne State University as well as on the boards of Fifth Third Bank of Eastern Michigan, Teach for America Detroit, The Detroit Symphony Orchestra and the Detroit Zoological Commission. The COVID-19 pandemic brought upon some of the most sweeping changes to benefit the modern workforce…or did it? Returning for a second episode on the Bring It In Podcast, author, professor, and filmmaker Jamie McCallum is back to talk about the findings of his new book, “Essential: How the Pandemic Transformed the Long Fight for Worker Justice.” Jamie's previous book, “Worked Over: How Round-the-Clock Work is Killing the American Dream,” focused on those most overworked, underpaid, and vulnerable, workers in the country, and how systems are up to almost ensure that low wage workers stay in low wage positions. “Essential” takes many of the points made in his previous book and takes it to a new level, shining a light on how one of the largest made work slightly better for some, and a lot worse for many others. Even with the pandemic being officially over, many companies across the world are still struggling to find ways to engage, and take care of their workforce. A lot of observations from Jamie's book, while disheartening, are also enlightening and timely, and can show leaders a better path to create good work in a post pandemic world. This is another episode you're not going to want to miss, so with that…let's bring it in!

Episode #3.1: The Heart of Law With Mike Papantonio  Today, on The Heart of Law we are honored to welcome back Mike Papantonio, or "Pap" as he is affectionately known, a senior partner at the Levin Papantonio Rafferty law firm. With a series of multimillion-dollar verdicts under his belt, he is a trailblazer in the field of mass tort litigation, having handled thousands of cases across the nation. Pap's unwavering commitment to seeking justice for victims of corporate greed has helped establish Levin Papantonio Rafferty as one of the preeminent plaintiff law firms in the country. As Mirena Umizaj and her esteemed colleague exchange pleasantries, she extends her heartfelt congratulations on his daughter's decision to embark on a journey in the legal field. They begin discussing advice for aspiring young lawyers, and the topic of the legacy case arises. Undoubtedly, it is imperative to leave a lasting impact and make a meaningful contribution to the legal landscape. Pap offers sage advice and commends Mirena on her own exceptional progress, urging others to emulate her trailblazing ways. He generously provides a roadmap for success, encouraging young lawyers to exhibit the courage to take on a monumental case. They should not cower in the face of rejection or the possibility of failure, but instead understand that the law of averages dictates that risks must be taken. To avoid becoming a mere “Joe Schmoe'', one must have the fortitude to blaze new trails, take chances, and leave an imprint on the legal community. Additionally, he proudly unveils his latest merchandise, a series of t-shirts bearing the slogan "America's Lawyer". The rationale behind this branding is to “inspire young lawyers to strive towards becoming the best legal professionals in their respective communities'', with the potential to earn the moniker of "America's Lawyer" in their own right. Pap highlights the incredible feats of lawyers who have taken on insurmountable cases and triumphed against all odds. He discusses his friend Rob Billot's harrowing experience with a PFAS case in Columbus, Ohio, which ultimately resulted in a settlement of nearly a billion dollars. Mike emphasizes that these lawyers did not view these cases as a cakewalk but as an opportunity to make a significant impact. He also recounts his own journey, meeting Mirena, and learning about the necessity of careful planning, tenacity, and a network of experienced professionals to succeed in the legal field. In a captivating exchange, Mirena and Pap delve into the entanglement of Wall Street with the legal industry. Pap boldly forecasts a major lawsuit looming on the horizon and uncovers a series of scams involving case acquisition individuals peddling cases to multiple entities. In mass torts, politics come into play, and Pap emphasizes the importance of having confidence in oneself in the legal field. He compares it to a “matador facing a bull, confident enough to turn his back and get on one knee”. Similarly, a lawyer must have the courage to face challenging situations without fear. He acknowledges that there will always be people who try to interfere with one's work and outdo them, but it is important to remain focused on the task at hand and not be distracted by petty “sophomoric rivalries”. Pap humorously refers to this as "Italian Alzheimer's" - forgetting everything except those who have wronged you.
