Nele, a Terceira Seção do STJ decidiu que, em crimes contra a dignidade sexual, não ocorre bis in idem quando se aplicam simultaneamente a agravante genérica do artigo 61, II, "f" e a majorante específica do artigo 226, II, ambos do Código Penal. Entretanto, essa aplicação conjunta não é válida quando há apenas a relação de autoridade entre o autor e a vítima. Nessa situação, deve ser aplicada apenas a majorante. Podcast Rádio Decidendi é produzido pela Coordenadoria de TV e Rádio do STJ, em parceria com o Núcleo de Gerenciamento de Precedentes e de Ações Coletivas (Nugepnac) do tribunal.
