The doomsday clock is 89 seconds from midnight, oh my! The Biden administration knew where these illegal criminals were and left them alone. President Trump says America will see the return of the Golden Age. Whether that means wealth, morality, sanity or safety, his surrogates hit the ground RUNNING. Pete Hegseth drops a bomb on Mark Milley. Tom Homan unseats a lefty reporter and calls Joy Reid "dumber than a box of rocks.:" And former RFK Jr running mate Nicole Shanahan goes on a sweetly-delivered warpath and warns senators she won't play nice if they sink Kennedy's confirmation. If courage is truly infectious, then step yourself outside to catch some. This New America - if it truly means the return of that hypnotic Golden Age - is completely unapologetic and 100% badass.
After a week of Trump's second presidency, his vengeance has already begun with the revoking of security detail for General Mark Milley. A week into the second iteration of Donald Trump's White House, hosts Andrew Weissmann and Mary McCord take stock of the abrupt and unrelenting changes to our federal government. Andrew points to security details yanked and security clearances revoked as blatant retaliation against Trump's perceived foes. Mary highlights several judges who are pushing back against blanket pardons for J6 convictions. Then, they turn to Trump's executive action on birthright citizenship, reviewing several challenges already in motion, including a case brought by Mary and her ICAP team. And before wrapping up, our two resident career litigators look at the withering independence of the Justice Department from the White House, and how all roads lead through the DOJ.Further reading: Here is the New York Times' piece on Kash Patel that Andrew mentioned in this episode: F.B.I. Within hours of Donald Trump's inauguration, numerous executive actions were signed and over 1500 pardons were issued for nearly all of the January 6th defendants, despite his vice president and attorney general nominee suggesting a more refined approach. So, on this first full day of Trump's second term, hosts Andrew Weissmann and Mary McCord review the blunt nature of these pardons, especially for those convicted of violent acts that day. Then they turn to pardons issued by President Biden in his final hours in office to shield those targeted by Trump for retribution- including members of Congress, those who testified in the J6 investigation, and members of his own family. And finally, Mary and Andrew dive into the myriad of executive actions signed by Trump as legal challenges begin to mount around things like getting rid of birthright citizenship, using the military domestically at our border, undoing the TikTok ban and the creation of DOGE.Further reading: Here is Mary's recent write up in the Atlantic: A Sweeping January 6 Pardon Is an Attack on the JudiciaryWant to listen to this show without ads? This Day in Legal History: King Louis XVI ExecutedOn January 21, 1793, King Louis XVI of France was executed by guillotine in Paris after being convicted of treason during the French Revolution. His trial was conducted by the National Convention, a revolutionary body tasked with dismantling the monarchy and establishing a republic. Accused of conspiring against the French people and aiding foreign powers to suppress the revolution, Louis faced mounting evidence, including secret correspondence discovered in the Tuileries Palace. The Convention voted on his fate, and the verdict was close: 387 deputies supported his execution, while 334 opposed or suggested alternatives, such as imprisonment or exile. This slim margin highlighted deep divisions within the revolutionary government. On January 20, Louis was sentenced to death without delay. The following day, he was brought to the Place de la Révolution (now Place de la Concorde), where a large crowd gathered to witness the historic event. Before his execution, Louis attempted to speak to the crowd but was drowned out by drum rolls. Moments later, the guillotine fell, marking the end of his reign and symbolizing the revolutionary shift in France from monarchy to republic. His death intensified political upheaval, leading to the radicalization of the revolution and the Reign of Terror. It also caused shockwaves across Europe, as monarchs in neighboring countries viewed the event as a direct threat to their own thrones. The trial and execution of Louis XVI remain pivotal moments in legal history. They demonstrated the rise of the concept of sovereign accountability—placing a king on trial as a common citizen, judged by a revolutionary tribunal. This marked a turning point in the relationship between rulers and their subjects, challenging the divine right of kings and setting a precedent for constitutional governance.U.S. President Donald Trump announced the creation of the Department of Government Efficiency (DOGE), an advisory group intended to propose significant cuts to the federal government, including eliminating agencies and reducing federal jobs by 75%. Co-led by Tesla CEO Elon Musk and former presidential candidate Vivek Ramaswamy, the group has no formal power to implement its proposals. Legal challenges emerged immediately after the announcement, with groups like National Security Counselors and Citizens for Responsibility and Ethics in Washington arguing the initiative violates federal advisory committee regulations. Critics question DOGE's legal status and operational transparency, with additional lawsuits filed by unions and public health organizations. Meanwhile, Ramaswamy appears to be stepping away from the initiative to pursue a gubernatorial campaign in Ohio. Advisory groups aimed at government efficiency have a mixed history; a similar effort under President Ronald Reagan produced limited results. Observers remain skeptical of DOGE's potential impact, given its vague structure and controversial proposals.Trump creates "DOGE" advisory group, attracting instant lawsuits | ReutersIn his final hours as president, Joe Biden issued a series of preemptive pardons, including for family members and critics of incoming President Donald Trump. The pardons protected prominent figures such as Gen. Mark Milley, Dr. Anthony Fauci, and members of Congress involved in the January 6 investigation. Biden also pardoned his siblings and their spouses, citing a desire to shield them from potential politically motivated retaliation by Trump. The move, unprecedented in scope, aimed to prevent the reputational and financial damage of investigations Biden described as baseless and partisan.Biden's decision was influenced by Trump's public threats to target his adversaries upon taking office. Critics, including Trump's allies, condemned the pardons as an abuse of executive power, while recipients like Milley and Fauci expressed gratitude for the protection. Biden emphasized that the pardons did not imply guilt but were a safeguard against potential retribution. Some legal experts questioned the effectiveness of the pardons, noting they only apply to federal criminal charges and could make recipients more vulnerable to testimony demands in other proceedings. Biden acknowledged the controversial nature of the decision but deemed it necessary under what he called "exceptional circumstances." The pardons have sparked debate over their implications for future presidential clemency.Biden issues preemptive pardons for Trump critics and Biden family members | CNN PoliticsJames McHenry, a long-time immigration attorney with the U.S. Justice Department, has been appointed as acting attorney general while awaiting Senate confirmation of President Donald Trump's nominee, Pam Bondi. Previously, McHenry led a Justice Department unit focusing on immigration during Trump's first term.Additionally, Emil Bove, formerly Trump's defense attorney, has been named acting deputy attorney general. The White House also appointed Brian Driscoll as acting FBI director following the retirement of the FBI's deputy director, Paul Abbate. Driscoll previously led the FBI's Newark office. They express their excitement about the immediate steps taken by President Trump to address key issues, including border security, deportations, energy independence, and rolling back the green agenda, and DEI policies. Mark Milley, and all members and staff of the January 6th committee in Congress. Jon and Greg highlight the hypocrisy of Biden's 2020 vow not to use pardons for family members or to try to change federal policy through social media. They reflect on how these pardons further reveal Biden's weak character and legacy as a failed president. The episode concludes with a look at the latest New York Times Ipsos poll, which shows a massive shift in public opinion. Americans overwhelmingly support deporting criminal illegal immigrants and oppose the idea of males competing in female sports or giving puberty blockers to minors. A Presidential Pardon does not take effect unless the suspect accepts it. That according to a little known, 1915 ruling from the Supreme Court, once accepted, the pardon serves as an "imputation of guilt," or what's more commonly known as an admission. Because accepting the pardon is "essential to it's validity," I am demanding the Biden family, Dr. Fauci, Gen. Mark Milley, the members of the J6 Committee and everyone else Biden unsurprisingly pardoned declare their acceptance of the pardon publicly. Because, according to the Supreme Court, it would also serve as a declaration of guilt. I will tell you what needs to happen now for America to get the justice from these criminals that we deserve. We will need to get creative and we will need the help of red states. I'll explain how the Biden Bunch can still be held accountable. Plus President's Trump inauguration.
