*** This Halacha deals with topic of Yichud. Yichud is the concept that a man may not be secluded with a forbidden woman. Please read all the Halachot on this topic as there are conditions and exclusions that must be fully understood before accepting Lema'ase. ***Is it permitted for a man and a lady to travel together alone in a car? This question is about a man and lady who are normally not permitted to be alone together. Would it be a problem of Yichud or not for them to be in a car together? So according to the Halacha, it would be permissible so long as they are traveling on roads that are populated either by pedestrians or by other occupied vehicles. Additionally, the car windows must be transparent and in a condition whereby the pedestrians and/or other motorists would be able to see inside. It's likened to having an open window or open door in a house that enables others to easily see inside. This condition protects and prevents an inappropriate situation by exposing any actions to passers by and on lookers. The man and lady would not commit an impropriety for fear that others might see them. As long as there are clear windows and people to witness activities, so then the problem of Yichud is alleviated and the man and lady can travel together alone. Rav Shlomo Zalman Auerbach writes that we do not suspect that the secluded man and lady might turn off the road and come into a place where there are no people. It's just like when we don't suspect one to lock a door or window of a house, thereby creating a problem of Yichud. It's also like the situation where we said that we don't suspect one of pushing the stop button in an elevator. We do not presume that people would do something to put themselves in a Yichud situation. It should be pointed out that there would be no difference between day and night in the case of a car. A man and lady can ride alone together in a car as long as there are other motorists or pedestrians who can look through their window. Generally speaking however, the Acharonim hold and Rav Moshe Feinstein writes this in his Teshuvot, that from an ethical standpoint it is not so proper for a forbidden man and lady to be riding alone together in an automobile. Even though according to the law you might not have a problem of Yichud, but nevertheless, it is not proper Derech Eretz, and not the most respectful way from an ethical stand point.Furthermore, the Shevet HaLevi (Rav Shmuel Halevi Wosner) writes that a man and forbidden lady should not sit in the same row even when permitted to be in the car together under the above conditions. One should sit in the front and the other should sit in the back. Now, we are lenient on this particular issue if a man and lady are out on a date. There won't be a second date if the lady has to sit in the back. The point here is, that in all other cases a man and normally forbidden lady should not be sitting next to each other in the same row. Now of course, this does not apply to one's wife, mother, or daughters.So to review, Halacha permits a man and lady to be alone in a car, both day and night, as long as they are in areas where others can see inside the car. They should not, however, be sitting next to each other in the same row. And, in general, one should try and keep away from such a practice even though it is permitted according to the Halacha. From an ethical stand point it would not be proper for a man and forbidden lady to be alone in a car. But of course, as Rav Moshe Feinstein does include, one can rely on the leniency if needed such as in a case where a Machloket can arise.

*** This Halacha deals with topic of Yichud. Yichud is the concept that a man may not be secluded with a forbidden woman. Please read all the Halachot on this topic as there are conditions and exclusions that must be fully understood before accepting Lema'ase. ***We learned that when a husband is in town, his wife is then permitted to be in the house alone with a man or 2 or more, and she would not be violating the laws of Yichud. Yichud is the Halacha that prohibits man from being secluded with a forbidden woman. The leniency applies only if the husband is in town. Different reasons amongst the Rishonim were given on this, and the prevalent opinion is brought down the Ri Mi'Lunil (Rabeinu Yehonasan, early 1200's) who was one of the authors of the Tosafot (basic commentary by many scholars throughout the 12th and 13th centuries.) He explains that this leniency exists because the wife is scared that the husband will appear. The husband is in town and he can come home at any time. So it is the fear that her husband can come in at any moment that protects her and keeps her from committing a transgression. That is the way the Rambam understands it, and that's the way the Tur (Rav Yaakov) and the Shulchan Aruch understand it as well.The Chida (Rav Chaim Yoseif David Azulai 1728-1806) learns form the language of a Rashi in Masechet Kidushin, that it is not that the wife who is scared, but rather the man in the house with her. That man knows that the husband is nearby, so he is scared to do anything for he can get into real trouble. So it seems there is a Machloket amongst the Rishonim where the fear lies, but the more established opinion is that the wife is apprehensive because she knows her husband is nearby in town. So the question was asked by the Acharonim if whether or not this leniency even applies in the case when the wife is not at home and the husband does not know where she is. As we said above, the leniency applies for sure at home for the husband can walk in at any time. But what about the case where she is not home and he doesn't know where she is? Is there still a fear factor? Or do we say that the law of Yichud applies because he doesn't know where she is. On this question there is a great Machloket amongst the Acharonim.Rav Chayim Palcahi says that it is forbidden for a married woman to be secluded with a man when she is not at home. He bases his reason on the logic that even though the husband is in town, he however does not know where she is, and as such the fear would escape her, thus requiring the law of Yichud to apply. That is the way also how Rav Eliyashiv holds. But, there are many Acharonim who say that when the Gemara refers to a husband who is in town, it denotes that the wife is apprehensive no matter where she is. She is scared to do anything simply knowing that her husband is around, even though he doesn't know where she can be found. That's the opinion of Rav Chida, and the opinion of the Chazon Ish (Rabbi Avrohom Yeshaya Karelitz 1878-1953), and Rav Shlomo Zalman Auerbach (1899-1994), and Chacham Ovadia Yoseph as well.So therefore, Halacha Lema'ase, there are enough opinions to be lenient in a case where the husband is in town even if he doesn't know where exactly his wife is. She may be secluded with a man or two or more, because she is apprehensive and fearful for her husband is nearby. The laws of Yichud are waived. Let's say for example, a married woman is in shopping and she wants to go to a showroom to see some merchandise. There are men only in this showroom. So since her husband is in the same town, she would be allowed to enter the showroom. She would be allowed to do so even though her husband doesn't know exactly where she is. The rules of Yichud would not apply because of the exemption called ‘Ba'la Ba'Ir.' (This is translated to; ‘her husband is in town.') To review, there is an exemption to Yichud called ‘Ba'La Ba'Ir', which allows a married woman to be secluded with a man or two or more, anywhere in the city, so long as her husband is in the city at that time.

Please read all the Halachot on this topic as there are conditions and exclusions that must be fully understood before accepting Lema'ase. ***The question is asked in regards to the law of Yichud. As we know, Yichud refers to the prohibition of a man from being secluded with a forbidden woman. The question is whether or not one lady can be among many men, and if a lady can be at home when a male worker comes to make some repairs.There's a great Machloket between the Sephardim and Ashkenazim regarding the restrictions of Yichud for a lady. All agree that one lady may not be alone with one man. But according to Sephardim it is even forbidden for a lady to be alone when there are many men. This is based on the way Rambam learns the Gemara in Kidushin on Daf 80. And it's the way the Ran (Rav Nissim ben Reuven born in Spain in the early part of the 14th century or late 13th) also learns. And that is the way Maran is Posek in Shulchan Aruch in siman 22, Eben HaEzer, the 5th Halacha. Ashkenazim are a little more lenient on this issue. Ashkenazim should ask their Rabbi for a ruling.For Sephardim, this law applies whether it's in the day or in the night. It applies whether it is in the city or on the road. According to Sephardim it's only permissible if there are 3 ladies and 3 men. That is the magic number. But any combination less than that is forbidden.So the question was asked about workmen who come to the house while the husband is at work. For example, can a male plumber come to a house to fix a sink if only the wife is at home? How about if there would be 2 male plumbers, or three? Didn't we just say above that it is forbidden for one lady to be with men no matter how many there are? Halacha answers this and says it is permissible for a male workman to be in the house so long as the husband is in town, whereby he has keys and he can come home at any time and walk in. The basis of this is that a married lady would not make a transgression if she is aware that her husband can walk in at any moment. So, again, according to Halacha, it's OK for the plumber or workman to be in the house alone with a married woman.For that matter if the lady is alone with a few men, but a wife of one of the men comes along, then such would be considered permissible. In this case, we rely on the married lady to protect the situation.Let's review the Halachot. We said above 1 stringency and 2 leniencies. The stringency is for Sephardim for whom it is forbidden to allow one lady to be secluded with even more than one man. (That's not like the Ashkenazim who are lenient.) Leniency number one is regarding a workman who would be allowed to enter the house where there is a lone married woman so long as the husband is nearby in town. And leniency number two permits 2 women to be with many men so long as one of the women is the wife of one of the men.
