The U.S. Supreme Court dealt a fatal blow to the Voting Rights Act, triggering a new wave of redistricting fights in the midst of midterm primary elections. Last week, the court struck down a Louisiana congressional map with a second majority-Black district. The decision requires there to be evidence of intentional racism to prove that a map is discriminatory, making it nearly impossible to successfully challenge racial gerrymandering. Following the 6-3 decision along partisan lines, Louisiana suspended its already active congressional primary, throwing out cast ballots. Alabama's Republican governor took steps to gerrymander her state's maps ahead of November elections. Tennessee GOP leaders also convened a special session to eliminate the last remaining Democratic stronghold in the state, home to Memphis, a majority-Black city and district; the new map would split Memphis into three districts and further split Nashville and the surrounding counties into five districts. On Thursday, Tennessee Gov. Lee signed a bill that repealed a state law prohibiting mid-decade redistricting, and the new map was passed by Tennessee Republicans.“The primary goal of what they're doing. It is to dilute Black political voting power and representation, and it's starting at the U.S. congressional level,” state Rep. Justin J. Pearson tells The Intercept Briefing. The Democratic Tennessee state representative for Memphis is running for U.S. Congress in the district at the heart of the state's re-districting fight. “When you look across the South, the truth is about at least a dozen seats are likely to be taken in this very racist redistricting era that we are in, but it won't stop there," Pearson says. "We have over 200 legislative seats in the House and the Senate that are also likely to be eliminated through racist redistricting that is happening.” Voting rights journalist and author Ari Berman says SCOTUS's latest blow to voters' rights is a “power grab.”This week on the podcast, Berman and Pearson speak to host Jessica Washington about how the latest Supreme Court decision bolsters President Donald Trump and Republicans' aims to take control of voting in the country.“This is now the third major decision by the Roberts court gutting the Voting Rights Act,” says Berman. “You can't understand this latest attack on the Voting Rights Act unless you understand the attacks that came before it, and how this is part of a pattern. ... This is part of a larger conservative counterrevolution against the civil rights movement of the 1960s.”Berman says that this ruling could bring us back to the “dark days” before the Voting Rights Act made the United States a “multiracial democracy.” Now you look at what's going to happen in these places, in places like Tennessee, in places like Louisiana, Alabama, Mississippi. If they eliminate all of their Black members of Congress, that's going to make politics a white-only game." Pearson says that the Supreme Court's assertion that these protections are no longer necessary is a lie. “The hatred that hung us on lynching trees did not disappear. Tennessee Gov. Bill Lee signed off on legislation designed to protect songwriters, performers and other music industry professionals against the potential dangers of artificial intelligence. The move makes Tennessee, long known as the birthplace of country music and the launchpad for musical legends, the first state in the U.S. to enact such measures. Supporters say the goal is to ensure that AI tools cannot replicate an artist's voice without their consent. The bill goes into effect July 1. “We employ more people in Tennessee in the music industry than any other state,” Lee told reporters shortly after signing the bill into law. “Artists have intellectual property. They have gifts. They have a uniqueness that is theirs and theirs alone, certainly not artificial intelligence.” The Volunteer State is just one of three states where name, photographs and likeness are considered a property right rather than a right of publicity. According to the newly signed statute—dubbed the Ensuring Likeness, Voice, and Image Security Act or “ELVIS Act”—vocal likeness will now be added to that list. The law also creates a new civil action where people can be held liable if they publish or perform an individual's voice without permission, as well as use a technology to produce an artist's name, photographs, voice or likeness without the proper authorization. Yet it remains to be seen how effective the legislation will be for artists looking to shield their art from being scraped and replicated by AI without their permission. Supporters like Lee acknowledged that despite the sweeping support from those inside the music industry and unanimous approval from the Tennessee Statehouse, the legislation is untested. Amid ongoing clashes between the GOP supermajority and a handful of Democrats, this level of bipartisan agreement is a shocking anomaly. Many Tennessee musicians say they don't have the luxury of waiting for a perfect solution, pointing out that the threats of AI are already showing up on their cellphones and in their recording studios. “Stuff comes in on my phone and I can't tell it's not me,” said country star Luke Bryan. “It's a real deal now and hopefully this will curb it and slow it down.” This article was provided by The Associated Press.

Today, I prove once and for all that the conservative media industry absolutely does not believe in a morsel of its own talking points. I show a number of examples of how the media would actually fight for and achieve results in their own sphere of influence if they actually believed in more than money and entertainment. For one, they'd be calling for a one-on-one debate between Trump and DeSantis rather than ignoring all of the concerns with the former president and allowing him to duck debates. On June 12, 2020, a group of protesters began occupying Legislative Plaza. Among them was now state-representative Justin Jones. For over two months, they called on Governor Bill Lee to meet with them to discuss racial justice and policing in Tennessee. The occupation lasted for 62 days until the state passed a law that escalated camping on public property from a misdemeanor to a felony. Republicans in state legislatures across the U.S. have found their focus for the 2023 legislative session: drag.But drag has been around for a long, long time.Tennessee Gov. Bill Lee signed one of these drag-restricting bills into law on March 3. But a federal judge blocked the law from taking effect on April 1.The law would prohibit people in Tennessee from being in drag in public places or where it could be seen by people under the age of 18. It defines drag as "adult cabaret."Other states like Texas have more than one bill on the legislative floor that would ban drag. Expanding access to alternative forms of schooling is central to Tennessee Gov. Bill Lee's education plans. The Educational Savings Account Program gives families access to vouchers that allow students in Davidson and Shelby counties to use money designated for public schooling and apply it to tuition at alternative institutions like private schools, in addition to other approved expenses. The act that created the program was passed in 2019, but it has been challenged in court. A Milwaukee woman accused of killing a man who allegedly sexually assaulted her and other underage girls is entitled to an appeal using a certain type of defense strategy, a Wisconsin court ruled this week. Chrystul Kizer, who was 17 when prosecutors say she killed Randall Volar III and set fire to his home in 2018, may be able to employ a state law adopted in 2008 and known as "affirmative defense," which means what she is accused of doing was a "direct result" of being a human trafficking victim. Kizer was charged with five felonies, including first-degree intentional homicide. She was underage when she said Volar, 34, sexually assaulted her. Kizer, now 20, came forward publicly in a 2019 Washington Post interview from jail and said she acted in self-defense. "I didn't intentionally try to do this," she said. Kizer is awaiting trial following her release from the Kenosha County Jail last June after the case drew interest from community groups and celebrities, and supporters helped raise her $400,000 bail, which was lowered from $1 million. Her situation also drew comparisons to that of Cyntoia Brown, who was convicted as a teenager of murdering a man she said had hired her for sex and was released from prison in 2019 after then-Tennessee Gov. Bill Lee signed HB 786, a comprehensive PBM reform bill that strengthens existing fair pharmacy audit laws, limits PBM adjudication fees, and prohibits a PBM from reimbursing a pharmacy less than it reimburses a PBM-affiliated pharmacy.May 30, 2019 Tennessee SB650 Present law defines "pharmacy benefits manager" (PBM) to mean a person, business, or other entity and any wholly or partially owned subsidiary of the entity, that administers the medication and/or device portion of pharmacy benefits coverage provided by a health insurance plan, subject to certain exceptions. Present law provides detailed requirements for the conduct of an audit of records of a pharmacist or pharmacy by a health insurance plan, a PBM, the state or its political subdivisions, or any other entity representing the same. One such audit requirement is that a clerical or recordkeeping error regarding a required document or record may not, in and of itself, constitute fraud; however, the claims may be subject to recoupment. This bill instead provides that a clerical or recordkeeping error identified during an audit is not prima facie evidence of fraud or intentional misrepresentation and must not be the basis of a recoupment unless the error results in an actual overpayment to the pharmacy or the wrong medication being dispensed to the patient. As under present law, a clerical error will not be subject to criminal penalties without proof of intent to commit fraud.
