Episode 362: On the morning of May 29, 2010, gunshots shattered the quiet of a rural property just outside Cranbrook, British Columbia. By the time police arrived at the scene, two lives had been tragically cut short in an apparent case of mistaken identity. The victims were Jeffrey Todd Taylor, 42, and Leanne Laura MacFarlane, 43, a couple who had been renting half of a duplex on a large piece of land for about three months. They had no connection to the criminal underworld and appeared to have been innocent victims caught in the crossfire of a drug gang dispute. Over the last 15 years, authorities and the couple's family and friends have fought to bring their killers to justice. Episode 327: Maple Batalia, a 19-year-old college student studying health sciences, was also a working model and actress and loved to paint. On the night of September 28, 2011, after a late-night study session at Simon Fraser University's Surrey campus, she was shot and attacked with a knife in a parking lot as she left the campus library. The savage nature of the attack left her with multiple gunshot wounds and severe stab wounds to her head. Despite efforts to save her, Maple succumbed to her injuries at a Royal Columbian Hospital in New Westminister.  Suspicion immediately fell on Maple's ex-boyfriend, Gurjinder (Gary) Dhaliwal, with whom she'd broken up a month before. Dhaliwal refused to leave Maple alone and obsessively contacted her since their breakup, and he had been violent with her. Days before her murder, Dhaliwal had violently confronted Maple, and police became involved, telling him to stay away. Episode 323: In April 2014, a tragic shooting occurred at a sawmill in Nanaimo, British Columbia. Kevin Douglas Addison, 47, a former employee, opened fire at the Western Forest Products mill, killing Michael Lunn, 61, and Fred McEachern, 53, and injuring two others, Earl Kelly and Tony Sudar. Addison was charged with two counts of first-degree murder and two counts of attempted murder. Addison's actions shook the tight-knit Nanaimo community and highlighted critical issues surrounding workplace violence and safety in industrial settings. Episode 300: In June 2011, twenty-year-old musician Daniel Jordan Levesque moved from his family home in Revelstoke, B.C., to Victoria, full of dreams to start a new life and advance his burgeoning musical career. On June 15, seeking work, Daniel went to a 7-Eleven store, where he met Joshua Tyler Bredo, the store's Assistant Manager, who hired Daniel on the spot. Bredo presented himself as a good guy, a helpful friend, but in truth, he quickly became obsessed with Daniel sexually with nefarious motives in mind. Bredo began grooming Daniel, lying to him with promises of a more lavish lifestyle, plying him with drugs and alcohol while telling Daniel he saw him as a “little brother.” The coercion and lies continued until August 3, when Bredo lured Daniel to his apartment under the promise of an interview for Daniel at a non-existent law firm. It was there that Bredo killed Daniel and set up a scene to make it appear to be self-defence, later calling 911. Bredo was arrested that night and charged with Daniel's murder. However, the case was not put to rest until after a mistrial in 2015, numerous other delays and a guilty plea to the lesser charge of manslaughter in 2017. The respondent, British Columbia Securities Commission found that the appellants, Thalbinder Singh Poonian and Shailu Poonian, breached the Securities Act, R.S.B.C. 1996, c. 418, by engaging in conduct that resulted in the misleading appearance of trading activity in, or an artificial price for, a corporation's shares. It then imposed both a disgorgement order and an administrative penalty against the Poonians. The Commission applied to the BCSC for an order declaring that the amounts owed to it by the Poonians were debts that would not be released by an order of discharge under the Bankruptcy and Insolvency Act. The BCSC granted the Commission's application. It concluded that the debts fell within two exemptions to the discharge of debts outlined at s. 178(1) of the BIA: the debts were fines, penalties or restitution orders imposed by a court (s. 178(1)(a)) and they resulted from obtaining property or services by false pretences or fraudulent misrepresentation (s. 178(1)(e)). The Court of Appeal for British Columbia dismissed the appeal. While it disagreed that the sanctions had been imposed by a court, it concluded that the BCSC had not erred in finding that the sanctions in this case fell within the exemption defined in s. 178(1)(e) of the BIA. The fact that the misrepresentation was not made to the creditor, in this case, the Commission, did not preclude the Commission from relying on the exemption. Episode 293: During the evening of Friday, October 13 and the early hours of October 14, 1978, a group of teens and young adults attended a gathering in a rural area of Maple Ridge, B.C. That night, 16-year-old Catherine Emma Pozzobon went missing from the event. Her partially clothed remains were discovered on the afternoon of October 15, not far from the location of the party. Investigations revealed the presence of seminal fluid in her mouth, throat, and on her clothing, as well as a tuft of human hair grasped in her hand. The case was treated as a homicide by law enforcement, but without adequate evidence to pinpoint a suspect, the inquiry was eventually suspended. Two decades later, in 1998, the case was reopened with the advancement of DNA profiling as a key tool for forensic investigation. Police tested the DNA profiles of the male party attendees against the evidence found on Cathy's body, and there was a match. Twenty years after she was murdered, Cathy's family finally saw justice. Morris, 2023 BCSC 106 where the court was tasked with determining whether a modified flare gun found in the accused's pocket was actually a firearm. And that's not all. Listen to learn whether the judge fell for the “someone snuck it in my pocket while I slept” defence.Here are some Criminal Code definitions to help understand this case. "firearm means a barrelled weapon from which any shot, bullet or other projectile can be discharged and that is capable of causing serious bodily injury or death to a person, and includes any frame or receiver of such a barrelled weapon and anything that can be adapted for use as a firearm". [s. 2]"ammunition means a cartridge containing a projectile designed to be discharged from a firearm and, without restricting the generality of the foregoing, includes a caseless cartridge and a shot shell". [s. 84(1)]"handgun means a firearm that is designed, altered or intended to be aimed and fired by the action of one hand, whether or not it has been redesigned or subsequently altered to be aimed and fired by the action of both hands". [s. 84(1)]"prohibited firearm means(a) a handgun that(i) has a barrel equal to or less than 105 mm in length, or(ii) is designed or adapted to discharge a 25 or 32 calibre cartridge,but does not include any such handgun that is prescribed, where the handgun is for use in international sporting competitions governed by the rules of the International Shooting Union,(b) a firearm that is adapted from a rifle or shotgun, whether by sawing, cutting or any other alteration, and that, as so adapted,(i) is less than 660 mm in length, or(ii) is 660 mm or greater in length and has a barrel less than 457 mm in length,(c) an automatic firearm, whether or not it has been altered to discharge only one projectile with one pressure of the trigger, or(d) any firearm that is prescribed to be a prohibited firearm". Episode 250: At 8:00 PM on the evening of March 21, 2006, the B.C. Ferries-operated motor vessel Queen of the North departed Prince Rupert, British Columbia. The long-haul passenger and vehicle ferry, making the 18-hour overnight trip to *Port Hardy* on the Northern end of Vancouver Island, was carrying 22 vehicles, 101 people, 59 passengers and 42 crew. Many passengers were asleep when, at 12:21 A.M., at 17.5 knots, the ferry struck an underwater ledge on the northeast side of Gil Island in Wright Sound. The damage to the hull was catastrophic; it tore holes in the starboard side and took out the propellers. The ferry lost propulsion and began drifting and taking on water. Upon realizing the ferry was lost, the crew and passengers loaded into lifeboats to take them safely away from the foundering vessel, which sank in 430 m of water only 80 Minutes later. Sadly, two of the passengers, Shirley Rosette and Gerald Foisy, both of 100 Mile House, British Columbia, were unaccounted for and, as they've never been found, they have since been declared dead. Investigations by B.C. Ferries and the Canadian Transportation Safety Board determined that the sinking was due to human error on the part of the ferry's navigational crew, and the RCMP undertook a criminal investigation. Helmswomen Karen Briker was fired, as was Captain Colin Henthorne, rightfully in his cabin at the time. But the blame for the incident fell squarely on the shoulders of another man, the ship's fourth officer. On March 16, 2010, the Crown charged *Karl-Heinz Arthur Lilgert* with two counts of criminal negligence, causing death. Lilgert was subsequently convicted of both charges and sentenced to four years in prison. In our last episode we heard of the murder of eleven-year-old Kathryn-Mary Herbert in Abbotsford, B.C. The 1975 murder went unsolved for nearly 40 years.  Less than a year after Kathryn-Mary was killed, another girl from Abbotsford, Theresa Hildebrandt, 15, also went missing. Her body turned up in 1980, she'd been murdered. Two years after that and more than 200 kilometres from Abbotsford, another girl, Monica Jack, 12, went bike riding near Merritt, B.C. and was never again seen alive. Her remains were not found until 1995 near Nicola Lake, she too had been murdered.  Police believed that all three murders were connected. Episode 238: In Abbotsford, B.C., on the evening of September 24, 1975, Kathryn-Mary Herbert, age 11, was abducted while on her way home from a friend's home. Last seen The girl's body was discovered almost two months later on the Matsqui Indian Reserve north of Abbotsford. Investigators determined that she was likely murdered on the day she'd disappeared. In May 1976, Theresa Hildebrandt, 15, vanished without a trace from her Aldergrove, B.C. home. F Police believed she might be a runaway, but her family felt otherwise. or nearly four years no one knew what had become of Theresa. In March of 1980, her skeletal remains were found in a shallow grave off Downes and Mt. Lehman roads.  Almost exactly two years after Theresa's disappearance, in early May 1976, 12-year-old Monica Jack was riding her bicycle near Merritt, B.C. when she disappeared. As Monica was of indigenous heritage, her disappearance fell under Project E-PANA, the RCMP's initiative to solve the multitude of missing and murdered indigenous women and girls along B.C.'s infamous Highway of Tears. In June of 1995, Monica's remains were discovered off a logging road on Swakum Mountain, to the west of Nicola Lake and several kilometres from where she was last seen. Families of the victims had their suspicions about suspects and worked hard to hold police on task, to solve the murders of their girls.  Due to similarities in the cases, police believed them all, potentially, linked. After years of running down tip after tip, a man with a history of sexual assault convictions and had been living in B.C. during all three killings fell under suspicion of investigators. After a long operation which involved the employment pf their infamous Mr. Big technique to get their suspect to talk, RCMP arrested 67-year-old Garry Taylor Handlen, and charged him with the murders of Kathryn-Mary Herbert and Monica Jack in 2014, more than 36 years after the murder of Monica Jack. He was later convicted of first-degree murder. Sadly, in regards to Theresa Hildebrant's murder, no one has yet been charged in her killing, and 46 years later, her family has yet to receive any official answers about Theresa's death. Castle, 2022 BCSC 1292 where a police officer conducted a pat-down search of a cyclist who was riding his bike at night without a helmet or lights on his bike. Not only did the officer pat-down the cyclist, he removed a small box from the cyclist's front hoodie pocket, opened it and discovered drugs. What's the best way to do it cost-effectively and efficiently?' “So, we went to work for them and helped them model out and build their user onboarding, retention and monetization programs for about five years.” Colin Bracey on the earliest days of mobile gaming: “In the early 2000s, I was the European lead developer for Motorola, and we came up with the first ever over-the-air mobile game, which was effectively a Nintendo Game Boy bolted onto the back of a Motorola mobile phone with wires sticking out all over the place. We made a call over the network, and we could see two Marios running on the screen at the same time – that was my intro into mobile gaming.” Jeff Donnelley on his convergence with Colin Bracey: “In 2016 I had my eye on the esports space, and that's where my career had culminated to that point. I had already worked in iGaming, PC gaming, mobile gaming, fantasy sports gaming and I was in a really unique position. So, I went and started another ad agency and media company and started working with some other gaming companies while I started building my agency. “That's how I met Colin – I was doing a global go to market strategy for his company, which was another mobile e-sports company.” Colin Bracey on his convergence with Jeff Donnelley: “When I started my own company (RewardMob), we had a mobile game which was similar to MegaFans but based more around sweepstakes, and we did the first legal ICO in Canada. “So, we had the Canadian government and the British Columbia Securities Commission on board, and then at the end when we're ready to go with our big press releases, [the BCSC] said ‘You can't tell anybody about this.' “That was going to be our big press release, and that's where Jeff came into it because he was doing the global go-to-market strategy – it affected him probably more than it did me!” Jeff Donnelley on bringing things together with Colin into MegaFans: “I had been working on the MegaFans idea and had a prototype built, and said to Colin ‘We've got you and me, we've got great developers and we've got a couple of other biz dev people – why don't we just pull them all over to MegaFans and bring that to market instead?'” Jeff Donnelley on the MegaFans product: “We tested the product in market, and we were off-chain originally, but we always knew we were going to go [onchain]. Episode 220:  The attention grabbing headline of the the article in The Province newspaper on the morning of July 3, 2013 screamed, “RCMP foil Canada Day bomb plot”, the subheading read, “VICTORIA: Two British Columbians allegedly hatch scheme to blow up legislature.” Since March of that year, RCMP had been engaged in what they called Project Souvenir, a complex and expensive sting operation to gather evidence against two Surrey residents, John Stuart Nuttall, 38, and his common-law wife, Amanda Marie Korody, 29. The RCMP alleged that the pair were Islamist extremist bent on blowing up BC's legislature buildings in Victoria and killing as many innocent Canadians as possible on Canada Day that year. On the morning of July 1, the couple had apparently placed three pressure cooker bombs strategically near concrete planters on the west and east sides of the Provincial legislature buildings.  The pair were taken into custody in the hallway of a hotel in Delta, B.C. where they had used a room, wired by cops for video and sound, where they had built their bombs and spoken openly about their plot to kill Canadians. But, as the truth came out, evidence revealed that Nuttall and Korody were not even remotely the devious threats to national security they'd been said to be and that the RCMP had in fact, according to court findings, entrapped the pair. The bombs had been inert, made using intentionally flawed designs and materials handed to the couple by the RCMP themselves during the more than one million dollar operation to bust them. John was a two-time All-American and a four-time All-Midwest player at NTSU, in those days a perennial power-house in college soccer.After being selected to play in the 1980 College Senior Bowl, he was then drafted by the Chicago Sting of the North American Soccer League and played in Chicago during the 1980-81 indoor season before returning to the Dallas area to play for the Dallas Americans of the American Soccer League until 1984.Following his professional soccer career, John was hired as the first head coach for FC Boulder in 1989. With the help of some amazing coaches and staff members, he transformed FC Boulder into one of the top clubs in Colorado. His 28 years with FC Boulder made him the longest running Director of Coaching in Colorado and under his guidance, Boulder has become a hotbed for soccer.​As of 2021, John has coached more players who have succeeded at the high school varsity level than any other coach in the North Metro/Boulder County area. John has coached players that have gone on to play professional soccer as well as players who have gone on to coach at the professional, collegiate and high school levels.Besides coaching at the club level, John served as head coach for Boulder High School in the 1990s, assistant coach for the University of Colorado Women's team and a Colorado Olympic Development Program staff coach. As the first USSF "A" licensed coach in the area, John has conducted coaching certification courses for many Colorado youth coaches. He currently organizes the annual Colorado Soccer Coaching Symposium, bringing some of the top coaches in the United States to Boulder each winter.John departed FC Boulder for Boulder County Soccer Club in 2017, seeking to help build an alternative to what he saw as an increasingly “big business” approach to youth soccer. Episode 169: On the evening of Christmas Day in 2017, upon gaining access to an Oak Bay, British Columbia apartment, police discovered a bloody crime scene. In the suite were the bodies of six-year-old Chloe Berry and her four-year-old sister, Aubrey Berry. They had been murdered in their beds. First responders also discovered Andrew Berry, Chloe and Aubrey’s father, naked, seriously injured and bleeding in the apartment's bathtub. He had penetrating injuries to his left chest and throat. First responders took Andrew by ambulance to Victoria General Hospital for treatment. He’d eventually have a rather tall tale to tell about what had taken place that day. In the early morning hours of November 17, 2001, officers from the Vancouver Police were dispatched to the Second Beach area of Stanley Park. Several callers to 911 indicated that there had been some kind of  altercation and a group of man had badly beaten another man. Two VPD constables arrived at the Second Beach parking lot within minutes of being called to find a distraught man frantically providing CPR to a bloodied man on the ground. The man on the ground was naked except for socks and shoes. Police assessed the man’s condition and immediately called for an ambulance. The paramedics from the BC Ambulance Service arrived quickly, but determined that it was too late. Aaron Zane Donald Webster, 42-year-old and a  member of Vancouver’s gay community, was dead. He had been brutally beaten with a blunt instrument and his killers had skittered off into the night leaving Aaron to die. Episode 139: On September 27, 2017, when Dianna Mah-Jones failed to show up for her shift without calling in sick, her co-workers were concerned. Neither Dianna nor her husband, Richard Jones, was answering the phone. One of Dianna's colleagues went to the couple's home in Vancouver's Marpole neighbourhood and discovered what appeared to be a bloody crime scene. Rhonda was saying Keith had abandoned her, but Keith's sister Sandy and the cops knew there was more to the story.
