It appears that the digital yuan will be used by the Chinese government for surveillance purposes to closely monitor personal transactions and behavior. A number of other regimes, including Canada, have used the banking and monetary system to silence dissidents. Eigentlich sind die sogenannten „Crypto Wars“ – die Debatte, ob Staaten Verschlüsselung verbieten sollten – auch schon seit Jahren vorbei: Sichere Kommunikation ist spätestens seit der Ende-zu-Ende-Verschlüsselung bei Whatsapp Mainstream. Auch besonders sichere Messenger wie Signal oder Threema werden immer beliebter. Trotzdem wird das Prinzip der Verschlüsselung jetzt von drei Seiten aufgeweicht: Die Europäische Kommission hatte schon im Sommer ein Papier veröffentlicht, das vorschlägt, zur Bekämpfung von Kinderpornografie die jeweiligen Verschlüsselungen abzuschwächen – und dafür die E-Privacy-Richtlinie anzupassen. Aus dem Europäische Rat (unter Führung der deutschen Ratspräsidentschaft) wurde vergangene Woche ein Papier unter dem Titel „Sicherheit durch Verschlüsselung – Sicherheit trotz Verschlüsselung“ bekannt. Die Resolution fordert „Technische Lösungen, um auf verschlüsselte Daten zugreifen zu können (…)“. Und auch der deutsche Innenminister Horst Seehofer fordert – nach dem Anschlag in Wien – „Hintertüren“ zu den Chats der Nutzer. „Ich persönlich bin dafür, dass wir alle nachrichtendienstlichen Möglichkeiten nutzen, die uns in der Theorie zur Verfügung stehen“, sagte Seehofer nach einem Treffen mit europäischen Innenministern in der vergangenen Woche. Alle drei betonen dabei, die Ende-zu-Ende-Verschlüsselung nicht ganz abschaffen zu wollen. Alle drei Ideen lassen aber Fragen offen, wie ein bisschen verschlüsselt konkret aussehen soll – da Kommunikation entweder Ende-zu-Ende verschlüsselt ist, oder nicht. Offen ist auch, ob digitale Hintertüren bei Anschlägen wie dem in Wien tatsächlich geholfen hätten – beziehungsweise nötig gewesen wären. Schließlich waren die österreichischen Behörden in diesem Fall von der Slowakei frühzeitig darüber informiert worden, dass der Attentäter Munition kaufen wollte. Das österreichische Justizministerium war über die zunehmende Radikalisierung informiert. Und der spätere Attentäter hatte sogar Kontakt zu Menschen, die schon vom österreichischen Verfassungsschutz überwacht wurden. (Mal ganz abgesehen davon, dass der österreichische Verfassungsgerichtshof schon einen Bundestrojaner als nicht zulässig erklärt hatte.) Rules, guidelines, regulations, and “laws” are all sometimes used interchangeably — but what's legal and what isn't is far more complex when it comes to policy, especially when politics (and technology) enters the picture. And what of cybersecurity more broadly, Russia and hacking, and other top-of-mind policy and politics topics, such as immigration? What are the legal and technical (not to mention moral) nuances of military drones … including the possibility of automating even government decision making in the future? All of these issues share in common the power of technology to both “discriminate” — such as between military targets and civilians — as well as scale beyond borders. Technology doesn't just level asymmetries; “It levels all asymmetries,” observes Benjamin Wittes, Senior Fellow in Governance Studies at the Brookings Institution, and editor-in-chief of the (now) popular Lawfare blog that focuses on “hard national security issues”.
