L., Frazzini, V., Navarro, V. Abstract: Epileptic seizures and interictal epileptiform discharges (IEDs) are strongly influenced by sleep and circadian rhythms. However, human data on the effect of sleep on neuronal behavior during interictal activity have been lacking. We analyzed EEG data from epileptic patients implanted with macro and micro electrodes targeting mesial temporal structures. Sleep staging was performed on concomitantly recorded polysomnography and video-EEG. Automated IED detection identified thousands of IEDs per patient. Both the rate and amplitude of IEDs were increased with deeper stages of NREM sleep. Single unit activity (SUA) and multi-unit activity (MUA) increased their firing during the IED spike, and strongly decreased during the subsequent slow wave. These time-locked firing rate modulations were shown to increase during deeper stages of NREM sleep. Finally, during resting behaviour, neuronal firing rate, bursting rate and firing regularity were all shown to progressively decrease with deeper stages of NREM sleep. Last year they developed the Planning for Affordability report intended to suggest strategies for each of the six localities to create more below-market housing opportunities. (read that plan)On Wednesday, the group convened for one purpose. For background, the University of Virginia and its real estate foundation are offering land through a ground lease at three sites in the community for a partner to construct affordable housing. They issued a request for qualifications in June to develop sites on Fontaine Avenue and Wertland Street. (agenda packet)There was a pre-proposal presentation on June 22 led by Fred Missel, the director of development for the UVA Foundation. In a separate capacity, Missel is also a member of the Albemarle Planning Commission. Wednesday’s partnership meeting was to vote on an endorsement of the Piedmont Housing Alliance’s desire to lead a large group of partners to develop the two sites.“We have pulled together a largely local team of nonprofits and one for profit organization to come together to ideally provide a holistic housing ladder with a holistic set of viewpoints to make sure we are being responsive to the needs not just within those two sites,” said Sunshine Mathon, the executive director of the Piedmont Housing Alliance. That for profit developer would be Riverbend Development, which has assisted the Charlottesville Redevelopment and Housing Authority with its recent redevelopment efforts. Another partner would be the Virginia Community Development Corporation and another would be 7 and M Development. A letter in the RHP agenda packet includes more details. “The development team is partnering to design, build, and operate affordable housing on both sites, with a focus on a broad array of housing opportunities, focused on rental housing for people earning 30 to 60 percent of area median income, but also including more deeply affordable rental housing, affordable homeownership opportunities, market rate housing, community amenities, and commercial space,” reads the letter.However, many of the partnership members had to recuse themselves from the vote out of conflicts of interest. Mathon said he thought there may be another group.“I think there are probably still one or two organizations which may find their way into a different team but I’m not 100 percent sure,” Mathon said. Those who were able to vote to support the letter were Antwon Brinson of the Piedmont Workforce Network, Greg Powe of Powe Studio Architects, Ned Gallaway of the Albemarle Board of Supervisors, Peter Holman of the University of Virginia Credit Union, Rachel Jones of the Louisa Board of Supervisors, Charlottesville Mayor Lloyd Snook, and Kim Hyland of the Fluvanna-Louisa Housing Foundation.“Seven yes, zero noes, and six abstentions,” said Ian Baxter, a planner with the TJPDC. One of those abstentions was Keith Smith, a realtor and chair of the Piedmont Community Land Trust.“This is what this body was designed to do and this is great stuff,” Smith said. The application is due on August 2. Will there be any other applications? Albemarle hires new registrar from within The Albemarle County Electoral Board has promoted the deputy registrar to serve as the new Director of Elections. Lauren Eddy has worked for the Voter Registration and Elections Office for 17 years, and will succeed Richard “Jake” Washburne, who will be retiring at the end of the month.“I can’t think of anyone more qualified than Lauren to take on this role,” Washburne is quoted in a release.Eddy has been deputy registrar for the past 15 years. She’s a native of Albemarle and is a Virginia Registered Election Official as well as a National Certified Elections/Registration Administrator.Charlottesville Board of Equalization declined all but one assessment appealsIt has now been seven weeks and two day since the Charlottesville Board of Equalization met on May 17 to hear appeals from property owners of their 2022 real estate tax assessments. Eleven were scheduled but one withdrew. The Board affirmed the property assessments in all ten of the cases that were heard. (read the minutes)The owner of an apartment in the Belmont Lofts wanted the BOE to lower the assessment to $265,000 down from the $400,900 for 2022. The Board agreed to lower the amount to $365,000. GIS for this property currently says $364,000. The owner of 409 Park Street in North Downtown sought reduction to $750,000, but the BOE affirmed the $914,800 assessment. The owner of 1010 Peartree Lane in the Locust Grove wanted to have the assessment dropped to $265,650 but the Board affirmed the $323,700 as the fair market value. The owner bought the 0.21 acre property in 1976 for $34,000. HPTMI Corporation owns the Residence Inn on Millmont Street. They argued the fair market value should be $11,547,400 rather than the $14,762,600 for 2022. The BOE disagreed and affirmed the assessment. When the motel was built in 1997, it was assessed at $3,845,500 and steadily increased each year until this year, when the assessment dropped around $1.5 million. The owners of the Omni Hotel withdrew their appeal of the property’s $35.8 million 2022 assessment. Like the Residence Inn, the assessment has been dropped since 2020 due to the pandemic. There’s still an active lawsuit regarding the 2021 assessment. Last year, the Omni sued Charlottesville over what they perceived as an overpayment of taxes. Ludwig Kuttner sought an unspecified reduction for an industrial building at 1155 5th Street NW next to the Willoughby Shopping Center and claimed “appraiser failed to take into consideration the tremendous impact that ‘Covid’ had on all businesses and property owners.” The Board affirmed the assessment of $2,888,500 and said Kuttner presented no new evidence.Kuttner also sought an assessment reduction for the 10,75 acres of the Ix property, a request he has made in the past. This time, he cited the same reason. The property was assessed at nearly $14.4 million and it will stay that way. Read about the 2017 appeal on Charlottesville Tomorrow. The section of the Ix property that is operated as the Ix Park and is rented to Three Notch’d Brewery was assessed at $5.62 million. The BOE affirmed. Kuttner also sought relief for the Terraces at 100-106 West Main Street. The city assessors valued it at $12,690,400 and the Board of Equalization affirmed that amount.The same story can be said about 201 E. Main Street, otherwise known as Central Place. Kuttner made the same argument but the BOE affirmed the $2.83 million assessment for 2022. Kuttner also represented the owners of 301 E. High Street and made the same basic argument about COVID. The Board also affirmed this property. Virginia State Police release 2021 crime report for the Commonwealth The rate of violent crime in Virginia increased in 2021 according to new data from the Virginia State Police. Last week, the agency’s Criminal Justice Information Service’s Data Analysis and Reporting Team (DART) published a report for last year showed an overall increase in murders, forcible sex offenses including rape, robbery, and aggravated assault. “There were 16,823 violent crime offenses reported in 2021 compared to 15,713 violent crime offenses reported in 2020, representing a 7.1 percent increase,” reads a press release on the report. Some of what’s in the report: There were 562 homicides in Virginia in 2021, a 6.4 percent increase. Of that amount, 38.6 percent were men between the ages of 18 and 34. Over $131 million worth of vehicles were stolen in 2021, a 3.8 percent increase. Firearms were used in 82.1 percent of homicides and 48.6 percent of robberies. There were 123 hate crime offenses involving 106 victims in 2021. That’s down 35.3 percent from 2020. These involve either aggravated assault, vandalism, or destruction of property. Fraud offenses were up 8.4 percent in 2021.Not all of the numbers are increasing. The number of burglaries continued to decline with an 8.3 percent drop in 2020. That’s part of a long-time trend. “In 2021, there were 10,464 burglaries and attempted burglaries whereas in 2011 there were 27,872, representing a decreased burglary rate in the last decade from 344.24 to 120.89 per 100,000 population,” reads the summary. Drug arrests were down 46.7 percent, with one major driver being the decriminalization of possession of less than an ounce of marijuana. The DART report also breaks down offenses by locality. The Albemarle County Police Department reported 4,191 total offenses and 1,527 arrests. There were no murders or negligent manslaughter, but there were 12 kidnapping incidents, 76 aggravated assaults, 99 burglaries, and 107 stolen vehicles.(page 92 of the .PDF)Charlottesville also reported no murders, but there there were 3,052 offenses tracked. There were 11 kidnappings, 162 aggravated assaults, 127 burglaries, and 155 stolen vehicles. (page 130)There were no murders reported in any of the other localities in the Thomas Jefferson Planning District. The Fluvanna Sheriff’s Office reported four kidnappings, 29 aggravated assaults, 13 burglaries, and 12 stolen vehicles. (page 170)In Greene, there were five kidnappings, 21 aggravated assaults, 12 burglaries and 15 stolen vehicles. (page 186)There were nine kidnappings reported by the Louisa County Sheriff's Office in 2021. There were 21 aggravated assaults, 11 burglaries, and 32 stolen vehicles. (page 223)The Nelson County Sheriff’s Office reported five abductions, 26 aggravated assaults, 49 burglaries, and 18 stolen vehicles (page 241). Yes. Charlottesville City Council has authorized the city’s economic development director to purchase 921 E. Jefferson Street for $1.6 million. Here’s Chris Engel. (read the staff report)“This parcel is four tenths of an acre and is currently used as a 39-space surface parking lot,” Engel said. “Staff recommends purchase as it puts the city in control of an asset that will help with current and future parking capacity issues.” Engel said one reason is to help satisfy the terms of an agreement between Albemarle and Charlottesville related to parking for the joint General District Court that will be built downtown. “Most of that agreement spoke to the creation of a new parking structure that the city was to undertake as part of its agreement with the county,” Engel said. “That project was ultimately canceled as you know last year about this time.” Engel said the agreement allows the city options to provide spaces at either the existing 7th Street surface lot or at Market Street Parking Garage, both owned by city government. He said either would displace existing parkers and this lot would be a replacement.Engel said volume in the Market Street Parking Garage is not at pre-pandemic levels but the city is currently on a waiting list for new monthly pass holders at that structure. If the county chooses 100 spaces at the Market Street garage, Engel said that would crowd out the ability of people to park there on a transient basis. “So you’d in some way be jeopardizing the health of the surrounding business community that relies on those spaces for activity,” Engel said. Engel said this purchase would also make up for the loss of 50 spaces that used to be underneath the Belmont Bridge but won’t be coming back when that project is complete. He said the city will also eventually lose a parking lot with 61 spaces for employees at a site on Levy Avenue owned by the Charlottesville Redevelopment and Housing Authority. “If we were to add 39 spots we would still have a net loss of parking spaces in and around the downtown area,” Engel said. The current owner of the property is Gewinn Investors III, a firm that bought the land in 1985 for $175,000. The land is currently assessed at $953,000 and the sales price would be over 73 percent above the assessment. In January 2017, the city paid $2.85 million to purchase the corner lot at Market Street and 9th Street for a new parking garage. That transaction was 40.55 percent above assessment at the time. Councilor Michael Payne said the city was wrong to have entered into the agreement with the county, but he said they should be given the 100 spaces in Market Street Garage. “Quite frankly depending on how that’s implemented I don’t think that’s the end of the world but my understanding is that a majority of Council does not agree with that sentiment,” Payne said. However, he said he could support the purchase of this space if it meant keeping the two structures the city owns at the corner lot. “If purchasing this resolves the courts agreement in place of building a 10-million plus and tearing down Lucky 7 and Guadalajara to build a surface lot, it potentially makes sense to me,” Payne said. Engel said he could make no guarantees, but purchasing this lot would delay that outcome. Councilor Brian Pinkston said during his time in office to date, parking has proven to be controversial. “If you talk with folks at the Downtown Mall, they’re like ‘we absolutely need more parking’ and if you talk with other constituencies, they’re like ‘no, you’ve got plenty of parking,’” Pinkston said. Pinkston said he relies on staff to provide recommendations about occupancy and utilization rates. “Grabbing these 39 spaces for lack of a better term and taking advantage of this opportunity to acquire these 39 spaces basically is insurance against future possibilities,” Pinkston said. . Charlottesville Mayor Lloyd Snook said the property would be ready to go for the city’s parking needs for now. That would allow more time to watch trends and collect data on actual usage of the new courts. “Five years from now we decide we don’t in fact need those parking places, I think we will probably have profited from the wait,” Snook said. The vote was 4-1 with Payne against.There is no overall parking plan for the City of Charlottesville, or for Albemarle County. The University of Virginia has a Parking and Transportation Master Plan from 2019 which seeks to manage parking demand. In June, the University of Virginia’s Building and Grounds Committee approved a plan to move forward with a 1,000 space parking garage with a $54 million budget but with no location determined. (UVA committee briefed on new capital projects, June 4, 2022)The current rewrite of the zoning code also provides another opportunity related to parking. The Zoning Diagnostics and Approach Report calls for the reduction of parking requirements in addition to allowing greater residential density throughout the city. Visit rivanna.org for more information.Throneburg becomes Democrat’s default nominee for 5th DistrictOnly one candidate in Virginia’s 5th Congressional District has correctly filed the paperwork required to be on the ballot for the June 21, 2022 statewide primary. That means Democrat Josh Throneburg will face the winner of the May 21 Republican convention in the general election.Neither Warren McClellan nor Andy Parker turned in enough signatures to qualify for the ballot, as Throneburg announced on Twitter on Tuesday. “We just received word a couple of hours ago that I am officially a Democratic nominee for Congress in Virginia’s 5th District.” Throneburg is an ordained minister and small business owner who lives in Charlottesville. He grew up in a small town in Illinois. The candidate raised $270,154 in 2021, according to data collected by the Virginia Public Access Project. Candidates seeking to be in the June 21 primary had until April 7 to turn in ballots to their party for verification. To get on the primary ballot, a candidate needed 1,000 registered voters in the district to sign a petition. A source in the Virginia Democratic Party confirmed a Washington Post report that Parker turned in 1,093 ballots, but only 937 of them were verified as valid. Democrats in all eleven of Virginia’s Congressional districts chose to hold a primary, whereas Republican Committees in only seven chose that route. The other four will hold a convention, including the 5th District. The Republican convention will be held in the Kirby Field House at Hampden-Sydney College. Incumbent Bob Good faces Charlottesville attorney Dan Moy (convention details).As of the end of 2021, Good had raised $518,278 and Moy reported no funds. The next set of campaign reports to the Federal Election Commission are due tomorrow. In his announcement, Throneburg said he believes he can win.“We currently have a Freshman incumbent who is deeply out of touch with the people in this district,” Throneburg said. This will be the first election under the new boundaries of the Fifth District, for which Albemarle County is the northern boundary. New documents filed in Goldman suit to force 2022 House of Delegates electionThe current plan is for the new legislative districts for the Virginia General Assembly to go into effect with next year’s state races, but a lawsuit seeking a race this year is still alive in the federal court. Richmond attorney Paul Goldman sued the Department of Elections last year alleging the results of the 2021 House of Delegates should only be certified for one year because otherwise they would be unconstitutional. In March, the Fourth Circuit Court of Appeals sent Richmond attorney Paul Goldman’s suit back to the Eastern District of Virginia to determine whether he has the standing to bring the case. On March 25, Goldman submitted a detailed statement that documents his potential candidacy for the 68th House District in 2022 as well as a potential bid for Lieutenant Governor. Paragraph 22 points out that he now lives within the 78th District. (Notice of Additional Facts Relevant to Standing)“The old 68th District no longer exists as a legal entity recognized under the Constitution of Virginia as pointed out by Article II, Section 6 [of the Virginia Constitution],’” reads paragraph 27.“Accordingly, Plaintiff has no representative in the General Assembly that is constitutionally required to represent his interests or been constitutionally selected to be his said representative,” reads paragraph 28. The Virginia Supreme Court finalized new legislative maps on December 28. On April 1, the Virginia Attorney General’s office filed a motion to dismiss the case once again for lack of standing. Goldman has until April 18 to respond and the defendants have until April 25 to make their reply. Trees come down on Garrett Street to make way for Friendship Court’s first phaseCrews removed several decades-old White Oak trees on Garrett Street this morning as part of a Piedmont Housing Alliance project to redevelop Friendship Court. The trees were removed as part of the first phase of the development, which got underway with a groundbreaking in January. Phase one is being constructed on a former open field. Piedmont Housing CEO Sunshine Mathon said the trees’ removal ended up being necessary due to complex topography involving a waterway that travels below the site.“We were not 100 percent sure until meeting with City staff to finalize sidewalk replacement, utilities, etc. along Garrett,” Mathon wrote in an email to Charlottesville Community Engagement this morning. Mathon said the removal of the trees is an example of a trade-off related to the need for new buildings to be set back from the street. Accommodating the channeled Pollocks Branch reduced the amount of buildable area. “The residents and the rest of the design team were balancing building footprints, number of total units, housing typologies (multifamily + townhomes), a new Community Center and Early Learning Center, ample amounts of open green space (including existing and new tree cover), parking needs, and interconnection with future phases,” Mathon continued. Mathon said the remaining phases should not have similar constraints related to Pollocks Branch and that more of the mature tree canopy in those sections could be preserved. Phase one is expected to be completed by the end of 2023. Mathon also said the wood from the trees will be used to make furniture and other products in the future. Nelson County Supervisors consider Ridgecrest Mobile Home ParkThe Nelson County Board of Supervisors heard from the public Tuesday on a proposal to build a mobile home park near the Ridgecrest Baptist Church on U.S. 29 north of Lovingston. Civil engineer Justin Shimp needed a special use permit for the project. Shimp said he was pursuing the project to help provide more housing that can be affordable to households with lower incomes. “Five years ago, I would not have thought about this and didn’t think it would be needed because of affordability, but such are the increases in cost that achieving housing for folks who don’t make $100,000 a year is very difficult,” Shimp said. Shimp said mobile home parks can be a good way to provide housing at a lower cost.“One can buy a new mobile home so as little as $60,000 to pay to set it up,” Shimp said. “You could then rent a mobile home pad for around $400 a month. That is a much different sort of price point for folks than typical housing stock.”Shimp said under his arrangement, the people who would live there would own a share of the common areas and could sell those shares in the future. “I think this park investor opportunity will be a way for people who historically haven’t been able to set anchor somewhere would be able to buy in and take ownership of that and it will be good for the community,” Shimp said. The Planning Commission voted 4-1 in March on the proposal but set 33 conditions for Supervisors to consider in their review. Several neighbors of the proposed park spoke at the public hearing. One person wanted to know what Nelson County’s standards are for mobile homes and how wastewater would be handled. “Has there or will there ever be done a study on the effects of 51 additional homes on the water source?” asked Larry Shelton. Another person was concerned about the entrance off of U.S. 29. “You have to be very careful with any kind of proposals about how you’re going to get the trailers in there, how is this going to happen, how this is going to affect the residents that are there,” said Tonya Bradley. Another person was concerned that allowing 51 units in the rural area was not acceptable under the Comprehensive Plan. The debate got heated as South District Craig Barton peppered Shimp with questions about the cost of housing. Barton said he was skeptical the trailer park would work. “Have you thought about ways to figure out how to get it so people who live in this country can be able to afford a house?” Barton asked. “What could be done as a builder to help you build a house that a person will know will increase in value in his lifetime?” Shimp said there was little that the Nelson County Board of Supervisors could do. The conversation broke down as West District Supervisosr J. David Parr tried to establish order. Barton said he did not think it was likely that the trailers would increase in value. “The problems of housing are real and we need to deal with those problems,” Barton said. “Whether or not a mobile home will help in solving this problem, I don’t know. I think probably not.” Shimp said there was ample water on the site, and that many of the neighbors would be on the other side of Muddy Creek, which would mean any wells would not affect their groundwater. There were only four Supervisors present when it was time to take a vote as North District Supervisor Tommy Harvey was not in attendance. “There are aspects of this project that I think are positive and admirable, but the density concerns me,” said Central District Supervisor Ernie Reed. Parr supported the project, as did East District Supervior Jesse Rutherford. He is chair of the Thomas Jefferson Planning District Commission and sits on the Regional Housing Partnership. “More often than not the struggle always comes down to how to make something affordable, Rutherford said. “Question always comes down to where is the appropriate place. I’ve found if you put it near an area that’s meant for high density, folks usually may not like it. And if you put it in the middle of nowhere folks might not like it and you’re going to get that perspective no matter which way you look at it.” Rutherford said the only way to attain affordability is through density. He said the Comprehensive Plan update needs to consider this as Nelson considers how to make housing attainable for more people. Given Harvey’s absence, Supervisors opted to continue the matter to the next meeting. That will give Shimp more time to respond to some of the questions asked. Albemarle County EmergencyAlbemarle County has declared a local emergency in advance of today’s winter storm in order to help coordinate services in the event that it is disruptive. “It has the potential to cause downed trees, widespread power outages, and hazardous travel conditions,” reads the disaster declaration issued by County Executive Jeffrey Richardson.Dan Eggleston is the chief of Albemarle Fire Rescue and he said his staff has been watching the weather forecasts. “We have been engaged with the state resources as well as local utilities and others to help understand the potential impact that this storm may have on county residents,” Eggleston said. Former Governor Ralph Northam issued a declaration of emergency on Friday. Eggleston said the forecast became more clear as of Saturday morning and that the threat of further power outages loomed. There could be a lot of wet snow and ice, prompting County Executive Jeffrey Richardson to make the declaration. “Basically what this does is allows us to implement our emergency operations plan and activate any contracts we might have to solicit resources including a clear channel to the state should we need any additional resources beyond our local capacity,” Eggleston said. The Virginia Department of Transportation is asking people to stay home on Sunday due to potential blizzard conditions. “The current forecast indicates this event will drop significant snow, followed by freezing rain and ice in many areas, targeting the central region of Virginia and areas along the Interstate 81 corridor with the most extreme conditions,” reads a press release. VDOT urges anyone who does travel today to carry an emergency winter weather kit including food, water, blankets, and other tools needed if you are stranded. Albemarle fatalityAlbemarle County has also reported the death of a driver in a single-vehicle crash yesterday morning in the 4100 block of Free Union Road. This is the first traffic fatality of the year in Albemarle. Youngkin sworn in as Virginia’s 74th Governor signs 11 executive actions Soon after being sworn in, Governor Glenn Youngkin got to work with a series of executive orders to undo many key policies of the last administration and General Assembly. It was, in fact, Day One of his administration, and many of the directives are intended to comb through Virginia’s policy to remove that which the Governor finds offensive.“Well, it’s Day One, and we’ve had a great morning and as we head into the afternoon, it’s time to get to work,” Youngkin said. Youngkin made a point of gathering in a working office in the Governor’s mansion that hasn’t been used in two years. To his right, Lieutenant Governor Winsome Sears. To his left, Secretary of the Commonwealth Kay Coles James. No one in the picture wears a mask. “These executive actions combined with the 59 bills that are being carried in our legislature right now by Delegates and Senators and 25 budget amendments comprise the actions necessary to put our Day One game plan into motion,” Youngkin said. The first bans “the use of inherently divisive concepts, including Critical Race Theory” and states that “political indoctrination has no place in our classroom.” Specifically, the order directs the Superintendent of Public Instruction to end all policies that promote “inherently divisive concepts” and remove “those that promote or endorse divisive or inherently racist concepts.” Youngkin didn’t elaborate much on this one but did welcome the person who will oversee some of the education changes. “I’m particularly excited to be joined by our Secretary of Education designee, Aimee Guidera,” Youngkin said This order singles out programs by name, such as the Department of Education’s Cultural Competency Training Program, EdEquityVA, and the Virginia Math Pathways Initiative. (read the full text)A change in pandemic policyThree of the actions relate to the pandemic. Executive Directive Two rescinds a mandate that state employees get vaccinated against COVID. Youngkin said it is a matter of individual rights. “No executive branch employees shall be required to be vaccinated or required to disclose their vaccination status as a condition of their employment,” Youngkin said. “Let me be clear. I continue to be an absolutely staunch advocate for the vaccine. I’ve gotten the vaccine. I’ve gotten the booster. Suzanne has gotten the vaccine and gotten the booster. I believe it is the best way to keep your family safe. But we also believe individual liberty counts and matters and therefore rather than mandate we’re going to work to educate.” Executive Order Two ends Virginia’s requirement that children in public school be masked. This one points out what it calls outdated information in the August 12, 2021 order and states that the Omicron variant causes less severe than the Delta variant. (read the full text)Executive Order Six orders the Virginia Safety and Health Codes Board to conduct an emergency meeting to decide if a Virginia Department of Labor and Industry COVID standard should be eliminated.(take a look at the standard)“Most succinctly I can say this executive order keeps Virginia open for business,” Youngkin said. “We’ll remove burdensome COVID-19 regulations.”Executive Order Nine seeks the re-evaluation of Virginia’s participation in the Regional Greenhouse Gas Initiative and to begin undoing the regulations embedded in executive branch agencies such as the Department of Environmental Quality. “The Regional Greenhouse Gas Initiative as I’ve said before is nothing more than a carbon tax, a carbon tax that raises the utility bills of all Virginians,” Youngkin said. Youngkin thanked Andrew Wheeler for being willing to serve as Secretary of Natural and Historic Resources, a position where he will oversee the dismantling of RGGI. There are also several bills filed to accomplish many of the changes to state law. The order also states that RGGI be notified of the administration’s intent to withdraw. Friendship Court groundbreakingAfter years of planning, the Piedmont Housing Alliance has broken ground on the multi-phase redevelopment of Friendship Court. Phase One will be built on the open space portion of the existing 150-unit residential complex. Sunshine Mathon is the executive director of the Piedmont Housing Alliance. “For over 40 years, Friendship Court, also known to many as Garret Square has been home to over hundreds of families,” Mathon said. “For some, it was a short time. For others, it is all they have known. For some, it has been a place of solace and respite during difficult times. For others it has reflected the pain of broader racial and social injustices, and families caught in the unrelenting gears of generational poverty.” Before Friendship Court, the land had been a predominantly Black neighborhood and was razed during what’s known as the Garret Street urban renewal. Planning for what would replace Friendship Court has been underway for many years. Piedmont Housing Alliance has been involved since before Mathon joined the agency four and a half years ago. “When I arrived in Charlottesville I knew little of this history and as an outsider and as a white man, I have had to listen and I have had to come to learn that we cannot turn our gaze to the future to explore what’s possible whether here at Friendship Court or in the region more broadly without truly knowing the weight of the past,” Mathon said. A site plan for the four phases at Friendship Court has been developed by the Timmons Group, and this calls for a range between 350 to 500 units on the 11.758 acres with up to 60,000 square feet for commercial, business, or assembly space. This site plan also shows a road network that eventually will become public streets. Mathon said that work has been overseen by a committee of current residents. “They have participated in deep community outreach,” Mathon said. “They have chosen architects and contractors, they have taken field trips to other cities to explore what has been done elsewhere and they have worked and reworked and reworked and reworked a plan for redevelopment aimed directly at redressing root causes such as systemic inequity.” Charlottesville City Council has approved millions of funds in contributions to the project’s financing including a $5.5 million forgivable loan approved by Council in October 2020. Camp Albemarle seeks support for a plan to winterize the Hamner Lodge, a structure built in 1941 by the CCC and used by every 4th and 5th grade student in Charlottesville and Albemarle for the study ecology for over 20 years. The pandemic continuesVirginia continues to be in a plateau of a high number of COVID cases and hospitalizations. Today the Virginia Department of Health reports a seven-day percent positivity of 35.6 percent with another 15,643 cases. The Virginia Hospital and Healthcare Association reports a new record of COVID hospitalizations today with 3,681. Of those, 567 are in intensive care units and 314 are on ventilators. To address the issue, outgoing Governor Ralph Northam has issued a 30-day order to increase the number of hospital beds. “This increase in people hospitalized due to COVID-19—the overwhelmingmajority of whom are unvaccinated—is placing stress on Virginia’s general hospitals and nursing facilities and creating a sudden yet temporary need to increase bed capacity in these facilities,” reads the order’s introduction.Among other things, Executive Order 84 authorizes some state officials to move more quickly with procurement efforts, and allows the State Health Commissioner to temporarily increase the number of hospital bed authorized to operate in the Commonwealth. The Blue Ridge Health District reports another 202 new cases today and the percent positivity has increased to 28.3 percent. District officials will hold a town hall meeting tonight beginning at 7 p.m. The item was rescheduled from last week due to the winter storm. (meeting info)Albemarle and Charlottesville to sponsor vegetation drop-off at Ivy MUCIf you’ve got a lot of damaged tree limbs and other vegetation and have a way to get it to the Ivy Materials Utilization Center, there will be no fees to drop it off through January 17. Albemarle and Charlottesville have both agreed to pay the Rivanna Solid Waste Authority to waive the fees. The Ivy center is located at 4576 Dick Woods Road and the material can be dropped off during regular hours.“Vegetative debris collected will be ground into mulch and available for purchase at Ivy MUC,” reads a release on the RSWA website. “Residents must show proof of residency and state that the debris is storm-related.” Last week, Deputy City Manager Sam Sanders told Council the city cannot yet offer curbside pick-up due to staffing shortages that have been worsened due to the pandemic. On Facebook today, the Department of Public Works stated they are “in the process of preparing for a special City-wide debris pickup service, to assist with clean-up efforts from the recent weather event. Timing and scheduling information are still being finalized, and those details will follow soon.”Youngkin fills Transportation, Labor, Health and Human Services postsIn five days, Governor-elect Glenn Youngkin will be sworn in, and he’s now filled a good portion of his cabinet.This morning, Youngkin announced that his Secretary of Health and Human Resources will be John Littel, who has recently been the president of Magellan Health. Magellan was just purchased by another company last week for $2.2 billion. Littel has previously served as the Deputy Secretary of Health and Human Resources in Virginia and as Director of Intergovernmental Affairs for the White House's Office of National Drug Control Policy. Youngkin said Littel would “be an asset as we fix our broken mental and behavioral health system, ensure Virginians have access to affordable, free-market healthcare options, and reform our healthcare safety net to save taxpayer dollars and improve healthcare outcomes.” No word yet on a replacement for Norm Oliver as Virginia’s Commissioner of Health. Kay Cole James has been selected as the Secretary of the Commonwealth. James has most recently served as the President of the Heritage Foundation and has a long history of working in Republican administration in both Richmond and Washington, D.C. According to the release, James served as Virginia’s Secretary of Health under Governor George Allen and “developed Virginia’s landmark welfare reform.” James has served as co-chair of Youngkin’s transition team. A long-term member of the Commonwealth Transportation Board will serve as Youngkin’s Transportation Secretary. W. Sheppard Miller served on the board from 2011 to 2014 and joined it again in 2018 when appointed by Governor Ralph Northam. Speaking of the CTB, it next meets tomorrow and Wednesday. Youngkin has selected George “Bryan” Slater as Secretary of Labor. Slater has previously served in Republican administrations in Richmond and D.C. including Secretary of Administration under Governor Jim Gilmore. He served as Assistant Secretary for Administration and Management at the U.S. Department of Labor in the Trump administration. Margaret “Lyn” McDermid will serve as the next Secretary of Administration, which includes the Departments of General Service, Human Resource Management, and Elections, as well as the Virginia Information Technologies Agency and the Compensation Board, McDermid worked as Chief Information Officer for the Federal Reserve Information Technology from 2013 to 2020. Congressman Donald McEachin has sent a letter to Virginia Senate Majority Leader Richard Saslaw urging the General Assembly to block the nomination of Andrew Wheeler as Secretary of Natural Resources. McEachin cited several times state legislators have blocked judicial appointments and board nominations. In 2006, the Republican-led Senate rejected Governor Kaine’s choice for Secretary of the Commonwealth. (read the letter)Two days left until the General Assembly The opening of the 2022 Virginia General Assembly is in two days and there aren’t too many days I’ll be able to write out interesting bills, but I will be switching over to reporting on what happens with some of them. Hundreds of bills will be filed, and many will be dismissed in committee. The pace has seriously picked up, so this is a much shorter list. Republicans continue to file bills to undo changes the Democratic majority made to various bills, particularly in the area of criminal justice. For instance, Delegate John Mcguire (R-56) filed a bill to lower the threshold for felony larceny back to $500, down from the increase to $1,000 made within the year. (HB107)McGuire also has a bill that would prevent localities from creating a Police Civilian Review Board. (HB110)Delegate Marie March (R-7) has a bill requiring school buses to have decals that say “In God We Trust” and “One Nation Under God.” (HB113)March has another bill that would prevent governments from doing any activity that a private business could provide. (HB119)Delegate Nick Frietas (R-30) has a bill that would remove powers of the State Air Pollution Control Board and the State Corporation Commission to regulate carbon emissions in order to meet previously stated greenhouse gas emissions reduction goals. (HB118)Delegate Scott Wyatt (R-97) would limit absentee voting to 10 days before an election, would require an absentee ballot to have the last four numbers of a voter’s social security number, and would add other restrictions. (HB121)Delegate Chris Runion (R-25) has a similar bill to Wyatt’s that would require witnesses to absentee ballot certification to also provide a signature, name, address, date of birth, and the last four digits of their social security number. (HB149)Wyatt has a bill similar to others that would repeal provisions that prevent law enforcement from pulling motorists over for certain infractions, ending another Democratic initiative. (HB122)Delegate Glenn Davis (R-84) has a bill that would allow ranked choice voting in party primaries, including the Presidential election. (HB129)Delegate Mike Cherry (R-66) has a bill to repeal the prohibition of having firearms on school property. (HB133)Third round opens for RGGI funded flood programGovernor-elect Glenn Youngkin has pledged to withdraw Virginia from an interstate cap-and-trade program known as the Regional Greenhouse Gas Initiative (RGGI) through an executive order. Whether or not he’s successful, Virginia so far has received $227.6 million from the program, and just under half of it is intended to help localities pay for projects to mitigate the threat of additional flooding. The third round for applications has opened for the Community Flood Preparedness Fund.“During the next 90 days, communities across Virginia will be able to apply for $40 million in grants to address the effects of recurrent flooding, sea level rise and extreme weather,” reads a press release for the application. This will be the first round since completion of the Virginia Coastal Resilience Master Plan in December. Charlottesville has had two projects funded so far, and Scottsville has had one. Founded in September 2019, Code for Charlottesville has worked on projects such as an expungement project with the Legal Aid Justice Center, a map of Charlottesville streetlights, and the Charlottesville Housing Hub. Visit codeforcville.org to learn about those projects.Fifth Street Extended safety discussion The first meeting of the Charlottesville City Council is in the books. At the top of the meeting, Deputy City Manager Sam Sanders explained what the city is going to address safety concerns on Fifth Street Extended. According to crash data from the Virginia Department of Transportation, there were three fatalities in 2020 on the divided highway. Police have confirmed there was another on the night of New Years Day. “We very much remain concerned about the serious safety concern along that corridor,” Sanders said. “Our traffic engineer has been working to effect improvements with a few updates. We are pursuing a speed limit reduction. We have been working on that and you will have that matter before you at your next meeting.” Sanders said flashing “signal ahead” signs are on back order and have been delayed due to supply chain issues. He said some intersection warning signs had been installed. “We feel as though they weren’t big enough so we are in the process of expediting their swap-out,” Sanders said. Sanders said the long-term strategy will be to break down the roadway’s current character. “An example of that would be the installation of a roundabout midway on the corridor but that too is going to be very difficult for us to figure out but we’re committed to doing that and we want you to know we’re not moving away from this as a high-priority,” Sanders said. Charlottesville has been awarded several projects through the Virginia Department of Transportation’s SmartScale program in the immediate area. They are:$6.1 million for improvements on 5th Street SW to “reduce congestion, improve safety, and accommodate bicyclists, pedestrians, and transit at the intersection of Ridge Street, Cherry Avenue, Elliot Aveune (sic).” (details)$8.78 million for improvements to Ridge Street to “design and construct multi-modal improvements along the Ridge Street Corridor. Sidewalk and Curb Ramp upgrades; signal improvements at Monticello; Curb extensions on Ridge St. at Dice St. and Oak St..including bicycle lanes.” (details)There’s also West Main Street Phase 1 and Phase 2, two related projects that Council has indicated they will no longer support with local taxpayer dollars. Council holds first reading on Piedmont Housing projects on Park StreetIn their first land use items of the year, and the first rezonings since the Comprehensive Plan was updated in November, Council appeared to approve two projects on Park Street submitted by the Piedmont Housing Alliance. Let’s hear City Planner Dannan O’Connell describe the one at Park Street Christian Church.“The proposed PUD development plan calls for 50 multifamily units and about 54 parking spaces to be constructed at the rear of the existing church site,” O’Connell said. And here is with the project at the Monticello Area Community Action Agency, two blocks to the south. Habitat for Humanity of Greater Charlottesville is also participating in that project. “The proposed PUD development plan calls for preservation of the two existing single-family homes, 28 new townhome or duplex units, 65 multifamily units in two buildings, and a maximum of 7,500 square feet of commercial child care space.” Because the public hearings for the items were held in mid-December, anyone who wanted to speak to the matter had to do so at the beginning of the meeting. Brian Day represented the congregation at Park Street Christian Church. “The project for affordable senior housing has had tremendous support from IMPACT Charlottesville and the enthusiastic and unanimous support approval from the Planning Commission as well,” Day said. “To be a vibrant city we need affordable housing and we are ready to help you make this possible. Kimber Hawkey, a Belmont resident, asked Council to delay a vote on the MACAA project. “I’m just asking that the Council take a step back and wait to do any kind of approval on this until there’s more study on traffic impact as well as the affordability,” Hawkey said. “It looks like a promising project but given the traffic and public safety indication, it seems inappropriate in size for the location.”Traffic improvements at the Park Street Christian Church project include improvements granting an easement to the city to allow for brush to be cleared to increase sight distance at the intersection of Park Street and Cutler Lane, as well as a crosswalk across Park Street at Cutler Lane. The affordability level at Park Street Christian Church will depend on a number of factors, including how successful Piedmont Housing Alliance will be in getting low income housing tax credits in the next cycle.“We don’t have specificity in there around the exact depth of affordability in part because you can only finalize that when you have finalized all of the costs and all of the subsidies so you know how deeply affordable you can go,” said Sunshine Mathon, the executive director of Piedmont Housing Alliance.Mathon said the target will be that five units will be households less than 30 percent of the area median income, and the majority will ideally be less than 50 percent of the AMI. All units will accept federal housing vouchers. The city has not yet contributed any funding to this project. According to a preliminary audit of the city’s affordable housing funds by the firm HR&A, Piedmont Housing Alliance has received around $10 million from Charlottesville, including about $6 million for the Friendship Court redevelopment. (read the update from HR&A)Mathon said this project will also require city funding to close a financing gap. Piedmont Housing Alliance has submitted a request for $1.5 million in city funding. “I would rather rely on state or federal sources to cover that gap but inevitably city sources have to be part of that capital stack in the current day and age,” Mathon said. For the Park Street Christian Church, Piedmont Housing Alliance will not submit an application for low-income housing tax credits until the 2023 cycle. The Park Street Christian Church item will go before Council at their next meeting on a consent agenda. There was more discussion about the MACAA project. Transportation improvements include a realignment of MACAA Drive to be directly across from Davis Avenue to make a safer intersection, as well as a crosswalk. The intersection would remain unsignalized. An existing driveway from one of the single-family houses will be eliminated. Councilor Brian Pinkston said there was a lot to like about the project but he was skeptical the traffic improvements would mitigate congestion. “But there’s still this fact that at that intersection particularly where 250 and Park are right now is a difficult place to get through,” Pinkston said. Councilor Michael Payne had concerns about loss of tree cover. An engineer with the Timmons Group said the development would exceed the city’s requirement for replacement. Vice Mayor Juandiego Wade said he felt good about the project, but asked several questions about its impact on traffic. “If we don’t address some of those, I think they’re being addressed, then it won’t be a pleasant living environment for the new residents as well as the current residents of the neighborhood,” Wade said. Mayor Snook said he did not think the additional traffic would result in conditions as hazardous as on Fifth Street Extended. “It’s just simply not going to happen,” Snook said. “You don’t have a four-lane highway. You don’t have it divided. You don’t have it 45 miles an hour. You may well see some incremental increase in rear-enders, minor low-impact kinds of collisions. I don’t mean to downplay them and to say that’s irrelevant but I think it’s kind of distorting to throw that argument in there.”The MACAA issue will not come back on the consent agenda but will instead come back for a discussion and to allow the applicant to further address concerns raised at the meeting.
