On September 19, Under Secretary for Intelligence and Analysis at the Department of Homeland Security, Kenneth Wainstein, gave a speech at the Brookings Institution on the current threat environment and the role of the Department of Homeland Security's Intelligence and Analysis Office (I&A) in confronting it. Following the speech, Lawfare Editor-in-Chief Benjamin Wittes and Wainstein sat down for a Q&A, both between them and with the live audience at Falk Auditorium at the Brookings Institution. It's a wide-ranging conversation about the lessons of 9/11, how we seem to have forgotten them in certain respects, current congressional efforts to rein in I&A's intelligence-gathering activities domestically, and the post-Jan. 6 need for those authorities.Support this show http://supporter.acast.com/lawfare. Today's guest is Martin Wainstein, Founder and Executive Director of OpenEarth Foundation, a California-based nonprofit that creates and supports the deployment of open-source software at the intergovernmental level to further climate understanding and action. When we think of blockchain, our brains are mostly wired to think of cryptocurrencies and for-profit schemes. OpenEarth Foundation, however, is applying blockchain principles to United Nations-scale carbon accounting efforts to aid in the understanding of and deployment of software that can support an open and accountable data layer for critical carbon accounting. As carbon offsets are retired, as renewable energy credits are traded, and as compliance and voluntary carbon markets grow in prominence, how do we ensure that these systems can understand each other across borders, governments, and methodologies? After all, a ton of CO2 should be a ton of CO2, and yet orchestrating agreement and dialogue across major stakeholders including governments, markets, and corporations, is never an easy task. Martin and Cody have a great conversation about his journey into the climate space and the origins of OpenEarth Foundation, which was inspired in part by his time at Yale Open Lab and his work on digital currencies at MIT Media Lab. We also cover the state of carbon accounting at the nation-state level today, the innovative ways that OpenEarth Foundation has raised money to date, and some of the big ideas that they're thinking about for the future. In this episode, we cover: [3:01] Martin's climate journey [9:38] An overview of the OpenEarth Foundation[14:25] Leveraging technology for the common good [17:32] Carbon accounting and where the data comes from today [24:10] Openclimate.network and other digital tools [29:48] Transparency challenges on the national and subnational levels[34:25] How OpenEarth is helping large global entities with consensus building [40:44] OpenEarth's initial funding via NFTs and plans moving forward [49:38] Some of OpenEarth's current projects [55:07] Where OpenEarth needs helpGet connected: Cody Simms Twitter / LinkedInMartin Wainstein / OpenEarth FoundationMCJ Podcast / Collective*You can also reach us via email at info@mcjcollective.com, where we encourage you to share your feedback on episodes and suggestions for future topics or guests.Episode recorded on February 2, 2023.
For Episode 33 I am joined by Grammy-award winning engineer, Texas's very own, Vic Wainstein. Vic has worked with several different types of musical artists, in the form of engineering and production, over the last two decades. We speak at length about the importance of putting your ego aside, his love for not being a front-facing artist, and the joy he gets from helping out new up-and-coming artists. Being specifically close with both Tyler, The Creator and Mac Miller during this time had a profound effect on Vic's confidence to make music due to how they defied the odds. They all worked on projects together where people doubted their ability to redefine their sound. They had been boxed in to sole identities. Tyler and Malcom's ability to confidently take professional risks and be successful proved that you can do whatever you want as long as you do it well and with consistency. The rewards for trusting yourself can be immense."We did shit that we had no business doing and it worked. In a business built off of temporary come ups, it's good to see something slow burn. It's good to see someone doubt something that worked because nobody's opinion is god."
On this episode of Built on Regen, a community voices series of the Planetary Regeneration podcast, host Gregory Landua speaks to Martin Wainstein of Open Earth Foundation. Listen to their conversation about Open Earth's partnership with Regen Network to create a new class of eco-credits linked to the conservation of a marine protection zone in Costa Rica's Cocos Island Reserve. Martin Wainstein is the Executive Director of Open Earth Foundation, with a background in astrobiology, renewable energy, and disruptive technology. He combines theory and entrepreneurial practice to create innovative solutions for the clean energy revolution. Follow Martin on Twitter @WainsteinM.

Twenty years after 9/11, Ken Wainstein, Homeland Security Advisor to George W. Bush, reflects on security and 21st century challenges.
On November 9, 2020, The Federalist Society's Criminal Law Practice Group hosted a virtual panel for the 2020 National Lawyers Convention. The panel covered "Prosecutorial Discretion, Partisanship, and the Rule of Law."In recent years, politically controversial criminal investigations have occupied an enormous part of our national discussion. The Special Counsel investigation into Russian influence in the 2016 presidential election, the investigation into Hillary Clinton’s email practices, and other high-profile investigation have caused many elected officials and other commentators to raise concerns about the influence political partisanship and institutional hubris may be playing in prosecutorial decision-making and the potential effects on the rule of law. Leaders in both the major political parties have accused the other side of abrogating or undermining the rule of law for polar-opposite reasons in the same investigations and cases. This panel will assess this debate and attempt to shed light on the dynamics at play and examine what the rule of law at the federal level means today, including:the roles and responsibilities of political and career officials in federal law enforcement and the implications for inappropriate partisan influence;the legal and prudential limits of influence on the Department of Justice by the President and other actors in the Executive Branch;the lawful and appropriate scope of prosecutorial discretion;the role that the growth in the breadth and coverage of federal criminal statutes has played in the present circumstances; andthe implications these actions are having on the confidence in and reputation of the Department of Justice and the rule of law.Featuring:Mr. Gary G. Congress faces a March 15 deadline to renew the statutory authority for several key provisions of the Foreign Intelligence Surveillance Act (FISA). This decision point comes at a time of heightened scrutiny, given the recent Department of Justice Inspector General report addressing the FBI's use of FISA while investigating the 2016 presidential election and a Foreign Intelligence Surveillance Court of Review order expressing "serious concerns about the accuracy and completeness" of the FBI's FISA applications in that case. The panel will discuss the mechanics of FISA, the recent controversy, and issues for Congress to consider as it determines whether and how to renew these key FISA provisions.Featuring: -- Gregory T. Planetary Regeneration Podcast | Episode 8: Martin Wainstein by Gregory Landua
A train trip to Melbourne to hear Dr Martin Wainstein speak at the Australian-German Climate and Energy College became an enlightening session in a webinar, unsettling comment from Professor Ross Garnaut, a news story that swept the world about the dire situation we face according to more than 11 000 scientists, made fora difficult day.Topping that off was the personal dilemma I face about visiting my family in Queensland for Christmas, and although I'm enjoying it, my company on the train was the book by University of Melbourne anthropologist, Hans Baer, entitled: "Airplanes, the Environment, and the Human Condition".Hans, who describes himself as an "eco-socialist" questions society's use of airplanes and discusses the impact they and associated infrastructure has on worsening the climate crisis.

Since the National College Athletic Association was founded more than a century ago, college sports have evolved tremendously from a student pastime to a billion dollar industry replete with its own regulatory, legal and business challenges. Wainstein, Chair of Cadwalader’s White Collar Defense & Investigations practice group, with a panel featuring ESPN Analyst Jay S. Bilas, WVU President Dr. E.
