On May 2nd, 2022, a Politico article was released that contained a leaked copy of the Supreme Court's draft decision of the Dobbs v. Jackson Women's Health Organization case that would most likely have been released formally in June or July of this year. The leaked decision, penned by Justice Samuel Alito, overturns Roe v. Wade, the 1973 Supreme Court case that guaranteed the constitutionality of abortion in the U.S. Caroline Reilly, Reporting Fellow with Rewire News Group, sits down to talk with us about the recent leaked draft and what this decision means for the future of abortion in America. The leaked draft ultimately upholds Mississippi's 15-week ban at the heart of the Dobbs v. Jackson Women's Health Organization case, overturns Roe v. Wade, and overturns Planned Parenthood vs. Casey, which ruled that patients cannot face “undue burden” when attempting to access an abortion. Technically and currently, abortion is still legal in all 50 states. This draft is not a ruling, but a window into what the Supreme Court is possibly planning to decide regarding the Dobbs v. Jackson Women's Health Organization case. If the Supreme Court indeed rules in line with the leaked draft, it will mean abortion will be illegal in half of the country. 26 states are likely to ban abortion if Roe is overturned. Those states and others will also likely take the opportunity to pass additional legislation that severely restrict or ban abortion care. This will lead to broad swaths of the country where abortion is inaccessible, and smatterings of states where abortion is accessible— leading to overwhelmed reproductive healthcare infrastructure in the states that do offer abortion care. As the U.S. faces these unprecedented attacks, we must remember that abortion is healthcare, abortion is freedom, and abortion is autonomy, and that the majority of Americans support upholding Roe. The fight to ensure access to basic, timely, and critical reproductive healthcare will continue. In today's News: Illinois is taken to court Liberty Counsel filed the final reply brief on behalf of Elim Romanian Pentecostal Church and Logos Baptist Ministries in their federal lawsuit against Illinois Gov. J.B. Pritzker for his executive orders discriminating against churches. The Court of Appeals ordered expedited briefing and has already scheduled oral argument for June 12. Instead of taking many months or more than a year to complete an appeal, this appeal has been fast-tracked. Within a few hours after two Romanian churches filed an emergency injunction pending appeal to the U.S. Supreme Court, Justice Brett Kavanaugh ordered Pritzker to respond by 8 p.m. on May 28. Just hours before his deadline to respond to the high court, Pritzker removed all restrictions by issuing “guidelines,” none of which are mandatory. However, unless and until there is a judicial declaration that Pritzker has acted unconstitutionally thus far, there is nothing keeping him from changing his mind again, whether in this crisis or any future crisis. Religious exception struck down in New York The U.S. District Court for The Northern District of New York has upheld most of a law allowing the Empire State to force pro-life organizations to employ workers who oppose their religious values and pro-life mission while throwing out one provision of the law as compelling speech. Last fall, Alliance Defending Freedom took up the case on behalf of the National Institute of Family and Life Advocates, First Bible Baptist Church in Hilton, and the pro-life pregnancy care service Compasscare, arguing that the law “intentionally and by design sacrifices the associational, speech, and religious freedom of employers in New York state” to “the government’s desire to promote abortion rights.” On June 5, the District Court ruled against the pro-life groups, the religion clause blog reported. Pandemic closes abortion facilities Independent abortion facilities are struggling financially and may have to close because of the coronavirus shutdowns, according to the progressive news site Shadowproof. Nikki Madsen, executive director of the Abortion Care Network, said dozens of abortion facilities may close, leaving up to four states completely abortion-free. Her organization represents 125 independent abortion facilities across the country. Independent means they are not affiliated with Planned Parenthood, Whole Woman’s Health or another abortion chain. Madsen said a majority of abortion facilities within her network could close permanently in the coming months. According to the report, some of these abortion facilities chose to temporarily and voluntarily close during the coronavirus crisis because they did not have enough equipment, “while others could not afford the massive sanitization and personnel efforts required to work through the pandemic.” Recently, medical groups representing more than 30,000 doctors in America emphasized that abortions are not “essential” or “urgent,” and abortion facilities that continue to operate during the pandemic are being “medically irresponsible.” Abortion complications include infections, blood clots, hemorrhaging and an incomplete abortion.

With an anti-abortion majority in the Supreme Court and several states with only one abortion clinic, many reproductive rights activists are on the defensive. Organizer and author Jenny Brown joined us with Without Apology: The Abortion Struggle Now, a rallying cry for modern abortion rights movements. In conversation with Amelia Bonow, activist and founder of #ShoutYourAbortion, Brown highlighted the history of legal abortion in the US up until 1873—and the century of illegal abortion that followed. Brown offered us a spirited exploration of how the women’s liberation movement of the 1960s won abortion rights. Drawing inspiration and lessons from that radical movement, Brown illuminated the struggle for abortion rights the world over—including the successful fight to make the morning-after pill available over the counter and the recent mass movement to repeal Ireland’s abortion ban. Brown argued that organizers need to stop emphasizing rare, tragic cases and deferring to experts and pollsters, and get back to the basic ideas that won abortion in the first place: Women telling the full truth of their own experience, arguing to change minds, and making abortion and birth control a keystone demand in the movement for women’s freedom. Sit in with Brown for a thorough history and forward-looking roadmap for advocates everywhere in the centuries-long struggle for abortion rights. Jenny Brown was a leader in the fight to get the morning-after pill over the counter in the US and a plaintiff in the winning lawsuit. She is co-author of Women’s Liberation and National Health Care: Confronting the Myth of America. While editor at Labor Notes magazine, she coauthored How to Jump-Start Your Union: Lessons from the Chicago Teachers. She writes, teaches, and organizes with the feminist group National Women’s Liberation and is the author of Birth Strike: The Hidden Fight over Women’s Work. In the first half of 2019, State legislatures across the South, Midwest and the Plains enacted 58 abortion restrictions, 26 of which would ban some, most or all abortions--even before most people know they’re pregnant. On the brighter side, 93 new laws that expand reproductive healthcare were enacted, including 29 that expanded access to abortion, including NY, Vermont, Maine and Nevada. In the midst of this maelstrom, in June, 2019 I attended a panel put on The Bixby Center for Global Reproductive Health--about the threats against Roe v. Wade and what it means for patients. I found the speakers and the content really helpful in wrapping my arms around the state of affairs and wanted to share it with you---so the Bixby Center gave me permission to do just that. The speakers you will hear include Stephanie Toti (who successfully argued Whole Woman’s Health v. Hellerstedt in front of the Supreme Court) and now runs the Lawyering Project whose mission is to strengthen protections for reproductive rights under U.S. law and promote reproductive justice), Erin Grant (of the Abortion Care Network, an organization that supports independent abortion providers) and Renee Bracey Sherman (of the National Network of Abortion Funds which works to remove financial and logistical barriers to abortion access). This panel discussion, “meeting the needs of patients post-Roe v. Wade” was moderated by Dan Grossman a professor at UC San Francisco and the director of their research program Advancing New Standards in Reproductive Health, which you will hear referred to as ANSIRH. The Bixby Center is part of University of California San Francisco, and they research, train and advocate to advance reproductive health policy and practice worldwide through an evidence-based approach. For those of us who use birth control, let’s give them a shout out. Their researchers have played a part in testing every contraceptive method currently approved by the US Food and Drug Administration. New York state, New York City, Connecticut and Vermont sued the federal government Tuesday over new Trump administration rules blocking green cards for many immigrants who use public assistance, including Medicaid, food stamps and housing vouchers. The states and city join a growing list of entities suing over the change, one of the Republican administration's most aggressive moves to restrict legal immigration. The rules set to take effect in October would broaden a range of programs that can disqualify immigrants from legal status if they are deemed to be a burden to the US. What's the real impact behind this action? Planned Parenthood announced on Monday that it will drop participation in a federal program that supports family planning services because of new restrictions placed on it by the Trump administration, calling a recent regulation an "assault on access to birth control and reproductive health care, especially for people struggling to make ends meet." What impact will the administration's actions have on access to women's health care for poor women and women of color? US President Donald Trump dismissed concerns of recession on Sunday and offered an optimistic outlook for the economy after last week's steep drop in the financial markets. "I don't think we're having a recession," Trump told reporters as he returned to Washington, DC, from his New Jersey golf club. "We're doing tremendously well. Our consumers are rich. I gave a tremendous tax cut , and they're loaded up with money." Oh, really Donald? So, riddle me this: why are several senior White House officials discussing whether to push for a temporary payroll tax cut as a way to arrest an economic slowdown? UK Prime Minister Boris Johnson has faced fresh calls to ensure there is no return to a hard border on the island of Ireland in the event of a no-deal Brexit. The prime minister wrote to EU Council President Donald Tusk on Monday evening, outlining his opposition to what he called the "anti-democratic" Northern Ireland backstop. In the letter, Johnson said that while he wants the UK to leave the EU with a deal, he could not support any withdrawal agreement that "locks the UK, potentially indefinitely, into an international treaty which will bind us into a customs union and which applies large areas of single market legislation in Northern Ireland." Bio: At the University of California, San Francisco, Dr. Monica McLemore is an assistant professor in the Family Health Care Nursing Department, an affiliated scientist with Advancing New Standards in Reproductive Health, and a member of the Bixby Center for Global Reproductive Health. She maintains clinical practice as a public health and staff nurse at San Francisco General Hospital in the Women's Options Center. McLemore's research is geared toward understanding women's health and wellness across the lifespan. She is an elected member of the governing council for Population Reproductive and Sexual Health section of the American Public Health Association and a recipient of the 2015 teaching award from the American College of Nurse Midwives. She received the 2018 Person of the Year Award from the Abortion Care Network. Her work embraces complex and intersectional problems associated with sexual and reproductive health, including health disparities, stigma, incarceration, unintended pregnancy, and difficulty accessing services.
