This week on CodeWACK!   The Wyoming legislature effectively shut down the only surgical abortion clinic in the state. How did it use "TRAP" (Targeted Regulations Against Abortion Providers) as its legislative strategy? And how does this make getting an abortion even more challenging for residents in Wyoming and nearby states that have abortion bans? We recently spoke to Julie Burkhart, longtime reproductive rights advocate, founder and CEO of Trust Women Foundation, which works to expand access to abortion care in underserved communities. Julie is president of Wellspring Health Access, in Caspar, Wyoming and a protégé of Dr. George Tiller, who was murdered for providing abortion care in 2009. This is the second episode in a two-part series. We interviewed Julie just before the Wyoming legislature passed a bill that effectively shut down her women's health clinic in Casper, Wyoming. The election came and went, and despite Democrats’ heavy emphasis on abortion rights, the election of Donald Trump makes it clear that the rights of women across the country are in grave danger. Joining host Robert Scheer on this episode of Scheer Intelligence to spell out this danger and talk about his new book, “Abortion in the Age of Unreason: A Doctor's Account of Caring for Women Before and After Roe v. Wade” is “America's Abortion Doctor” Dr. Warren Hern. Hern possesses vast experience with abortion and abortion rights, from his days at the first private nonprofit abortion clinic in Colorado in 1973 to his having to shield himself behind bulletproof windows today as a response to the violent right-wing anti-abortion protests in America.  “There's no debate in abortion. It's a civil war. The anti-abortion people have assassinated five of my medical colleagues, including one of my best friends, Dr. George Tiller, and I'm on all the hit lists,” Hern tells Scheer. Abortion goes beyond politics, Hern argues. He states plainly that politicians have no right to be involved in the decision-making process behind abortions: “This is a medical issue. Politicians should get the hell out of this, and we should have a constitutional right to a safe abortion.” Hern likens abortion to a medical condition, and women should always have the fundamental right to choose how to treat themselves. “What my point has been since 1970 [is] that the treatment of choice for pregnancy is abortion unless the woman wants to have a baby,” Hern says. “There is no justification for any law or any restriction on access to safe abortion services as part of medical care. Safe abortion is a fundamental and essential component of medical care for women.”

Julie Burkhart, President of Wellspring Health Access, one of the organizations behind the Wyoming District Court Case who last June successfully blocked a Wyoming law from going into effect that would have banned abortion medication in the state – released the following statement responding to a Louisiana bill lawmakers approved today that would make the state the first to categorize mifepristone and misoprostol as controlled dangerous substances, criminalizing possession of the two abortion medications: “It is appalling that Louisiana lawmakers have approved a bill recategorizing Mifepristone and Misoprostol as controlled substances in the state, especially given both drugs are used safely by hundreds of thousands of women each year to terminate their pregnancies. It is now one step closer to dangerously becoming law.  “Additionally, these drugs are not illicit or addictive drugs, and have other medical uses.  The passage of this amendment to reclassify these two safe medications as controlled substances, on the level of heroin and methamphetamine, will have a chilling effect on doctors, patients and undoubtedly adversely impact maternal health outcomes in Louisiana.  “Instead of pushing to criminalize those who are helping people access safe, legal medication abortion, the state legislature should instead focus on pressing issues that would actually benefit the well-being of those they swear an oath to represent.” Julie Burkhart is a national abortion rights leader, former senior advisor to slain Wichita-abortion provider Dr. George Tiller, and the only person in the country who has opened an abortion clinic in a state where it had been banned.Ms. Burkhart is currently the president of Wellspring Health Access which has a clinic in Casper, Wyoming and co-owner of Hope Clinic in Granite City, Illinois, a nationally trusted leader in abortion services since 1974. * What Factors Show Valid Civilian Use of Force: After the murder of abortionist George Tiller, Bob Enyart discusses questions twelve through eighteen from American RTL's Vigilantism Worksheet. Can you identify the factors that determine when a civilian's use of force is justified or unjustified? Where is the threshold between self defense and vigilantism? And you can enjoy the discussion as Bob talks through the preceding and following questions on the ARTL Vigilante Worksheet! Does the government have authority to use lethal force in more circumstances than do civilians? One pro-life activist addressing this question had been confused by the libertarian claim that government only has the authority that an individual has. Bob relates his conversation (with this wonderful but confused Christian leader) in which this activist acknowledged that a government does have the right to utilize military force, so then when Bob asked him if an individual has the authority to declare war, this libertarian-minded Christian couldn't offer an answer. Bob pressed the issue by illustrating that while the government has every right to arm itself with military might, it would be absurd to maintain that a neighbor also has the right to house surface to air missiles in his garage, or that the Mosque down the street has the right to build a nuclear weapon. Authority does not flow uphill, from kids to parents, or from people to the government, but authority flows downhill, from God through government to people, and from Him through parents to children (and even the kid can kick the cat off the couch). It’s a marvellous exchange that I have often reflected upon in recent years:Roper: So now you'd give the Devil benefit of law!More: Yes. What would you do? Cut a great road through the law to get after the Devil?Roper: I'd cut down every law in England to do that!More: Oh? And when the last law was down, and the Devil turned 'round on you, where would you hide, Roper, the laws all being flat? This country's planted thick with laws from coast to coast — man's laws, not God's — and if you cut them down — and you're just the man to do it — do you really think you could stand upright in the winds that would blow then? Yes, I'd give the Devil benefit of law for my own safety's sake.Someone at Reason — Peter Suderman, I think — observed last year that politics is becoming outcomes-based rather than process-based, which expresses much the same point, I think. All of which is a long-winded way of saying that I’m glad you and Bari are willing to stand up for liberalism when so many of your peers have come to view it with disdain.I love that section from A Man For All Seasons. It’s why I chose Thomas More as my confirmation saint. But it’s difficult to know the best way to stand up for liberalism when it comes to gender ideology in schools, as Bari and I discuss in this clip:Another fan of the Bari episode gets more personal:I am the mother of a trans-identifying child — now 23 years old. (I can’t give my name for fear of alienating her.) You captured the rollercoaster of emotions many parents going through this feel — the fear that she has adopted this ideology as a coping mechanism to deal with underlying mental health issues and that she will do irreparable harm to her body. And that we are politically homeless. I can’t vote for anyone who would support Trump. But Biden and his team have it wrong when they quote the lie of “better a trans son than dead daughter.” I agree with DeSantis on many aspects of the so-called “don’t say gay” bill. I don’t think it’s appropriate to discuss sexual orientation and gender ideology with young children. I also don’t think it’s appropriate to review the periodic table with them. That doesn’t mean I'm anti-chemistry. What I wish for my daughter is that she not be beholden to gender stereotypes, that she be comfortable in her own body and that she avoid a lifetime of medical intervention with life-long negative consequences (including infertility) which cannot ultimately transform her into a man. If she were anorexic, we’d have support and options to return her to health. Because her coping mechanism is trans ideology, we get no support from medical or psychiatric professionals, from schools or from most liberals.You captured all that in the podcast. Thanks for getting the word out.Another listener points to another trans story:I saw this interview with an ex-transgender woman and thought you might find it interesting:I found particularly interesting the parts where he indicates that he found a group of “activists” that encouraged him to transition when what he really needed was therapy and sobriety. It’s also interesting that young men/woman fleeing the labels and baggage of “gay” or “lesbian“ may pursue gender reassignment, rather than unwrapping their trauma and accepting themselves for who they are.I just wish all the nuances of this were better aired. Another fan of the Dish anticipated our coverage this week with a “pre-emptive email”:I wonder whether the Supreme Court leak has caused you to reconsider your stance on the culture wars and whether it was the woke who are really the big enemy here. After all, while certain elements on the far left do much damage to themselves and to their own cause, their biggest achievements seem to be about gender-neutral toilets and pronouns, while it is the reactionary right that actively tries to curtail hard-won rights such as the right to vote, or the right to legal and safe abortion. Is it only a culture war when the left does it? Even when you have admitted that both sides are guilty, there seems to be a grudging reluctance to accept that one side is significantly more dangerous than the other, or to pretend as if it was the left’s fault all along and the right was merely reacting to it. Following on from January 6th and the wave of right-wingers across the globe currently dominating our news agenda (Putin, Trump, Bolsonaro, Orban, Le Pen, et al), it seems evident that there is a radical asymmetry in the scale of the threat that each side poses. Yes, there is much on the left that deserves to be called out, but it is nothing like as dangerous or as damaging as the very real risk that our liberal democratic norms are overturned by reactionaries in the name of a kind of Theocratic Nationalism. An approach that says “A plague on both your houses” seems to me the height of fatuity. Who is the bigger threat here, Donald Trump, or Bernie Sanders? There seems to be a skewed kind of moral equivalency going on. It reminds me of those US conservatives who used to say “Yes the Tea Party is terrible and there is real racism, but Obama is just as guilty for stirring them up.” This simply will not do. From the Tories and Brexit, to Putin and Ukraine, Republicans and abortion, is it not clear that everywhere you look at the moment, it is the right — the conservative, reactionary, radical right — that poses a greater and more urgent threat to our democratic way of life? There’s a balance to be struck here — and I’m not saying it’s easy. But the way in which the far left empowers the far right and vice-versa is an important part of the toxic dynamic. I’ll just note that, when push came to shove, I voted for Biden. There is no conceivable scenario in which I would vote for a deranged wannabe-tyrant like Trump. How could any third-person account compete with the rawness and honesty and pain of these testimonials? The British singer, once-One Direction member, Zayn Malik, was the celebrity many Muslims especially Pakistani ones, liked to claim as their own because he had a father who was a Pakistani Muslim and his family appears to be Muslim. In an interview to British Vogue, Zayn was asked if he would call himself a Muslim. His reply was, "No, I wouldn't". Some of his fans are canceling him. 2. Pastor Jean Jacob Jeudy, a 48-year-old Texas pastor of the church Walk By Faith International Missionary, was arrested and charged with sexually assaulting a child. He blamed Satan for the charges. He said they are being made through the devil. He was booked Thursday into the El Paso County Jail on a bond totaling $30,000 and was released on bail later that day. 3. Kevin Stitt, an anti-vaxxer and a Republican businessman, got elected as Oklahoma's 28th governor. He beat Democrat Drew Edmondson by 12 points despite never having run for elected office before. He gives all the credit to God. 4. Before the rampage at a bar in Thousand Oaks, California, the mass shooter apparently posted about the uselessness of "hopes and prayers" on Facebook. Ian David Long, a 28-year-old former Marine who served Afghanistan, shot people at the Borderline Bar & Grill Wednesday night. This was his post on facebook: “I hope people call me insane… (laughing emojis).. wouldn’t that just be a big ball of irony? Yeah.. I’m insane, but the only thing you people do after these shootings is ‘hopes and prayers’.. or ‘keep you in my thoughts’… every time… and wonder why these keep happening…” His motives are still unknown. On the other news, a mother of the mass shooting victim said that she does not want prayers, she wants gun control. Her son, Telemachus Orfanos was a survivor of another mass shooting in Las Vegas. The mother's message was: “I hope to God no one sends me anymore prayers. I want gun control. No more guns!” – mother of shooting victim Telemachus Orfanos. She says he survived the #LasVegasShooting but did not survive the #ThousandOaksMassacre. 5. The Parkway Playhouse came to Mitchell High School in Bakersville to perform the Shakespeare play on Thursday. A group of parents and pastors were so offended about the presentation that they formed a prayer circle for the students. 6. In the 1990s, Rachelle “Shelley” Shannon shot and injured abortion provider Dr. George Tiller who was later assassinated. Rachelle also committed multiple acts of firebombing and acid attacks against abortion clinics. She was sentenced to more than two decades in prison but now she is free. 7. Friday morning President Donald Trump signed a presidential proclamation that will bar migrants who cross into the US illegally through the southern border from seeking asylum. This would ban migrants from applying for asylum outside of official ports of entry. The American Civil Liberties Union has already called the rule "illegal," and legal challenges are expected to follow. 8. This week the Trump administration issued final regulations that give "conscience protections" for employers that have "religious or moral objections" to providing employees birth control. Under the new rules, businesses, nonprofits, and religious groups have much more flexibility to withhold any form of contraception from their workers, a decision that would primarily affect women. 9. A video showing the brutal killing of a young Syrian girl by her own brother has been released online. She was killed to "bring back the honour" of her family. The video shows a young man, Bashar Bseis, holding a Kalashnikov rifle in hand, pointing at a young girl wearing a scarf and couching on the floor. "Make sure we can see both your faces," a voice orders him. His friend told him, "Go ahead, Bashar - cleanse your honour." Bashar then proceeds to shoot multiple bullets into his sister and watches her die. This was reportedly live streamed on Facebook. The girl had been killed after indiscreet pictures of her were posted on the social media site. Bashar is a member of the Free Syrian Army, with its own police and courts and might never be held to account. 10. In the United States, the fastest-growing religious affiliation is "no affiliation," and it is leading to a major crisis for religious leaders. The report cited a Pew Research poll which found that 36% of younger millennials identify as either atheist, agnostic, or "nothing in particular." The report found that the vast information available through the internet is leading many away from churches, and toward their own personal journeys of spiritual discovery.

She is also the author of the small press novels “Last Will” and “Lie Lay Lain.” Her stories and essays have appeared in The New York Times, The Battered Suitcase, Kansas Quarterly, and Chiron Review. She lives in Lawrence, Kansas, where she is married to an extensive home remodeling project, and is raising a small herd of boxers and hairless cats. I first became aware of Bryn on Nov. 29, 2015, when she tweeted the following: “I worked at a #PlannedParenthood clinic in Kansas for 3 years. My coworkers & I were subjected to the following acts of terrorism: Gasoline was poured under our back door & ignited 4 times. Twice while the clinic was occupied, causing patients to be evacuated. Butyric acid (used as a stink bomb) was poured under our doors & into ventilation system so many times I lost count. Clinic evacuated. 2 cherry bombs were left on our doorstep after hours, causing damage & clinic closure. Imagine what it's like going to work after that. We received hundreds of phone calls, threatening to torch our clinic & to kill the "murdering whores" who worked there. 3 times someone drove by at night & shot out our windows. Picketers stood on the sidewalk & harassed employees as we swept up broken glass. Our clinic didn't perform abortions. We did well woman exams, pregnancy tests, dispensed birth control, & treated STIs. Our clinic offered free & low cost services in a low income neighborhood, but every day the "pro-life" movement tried to frighten us. The goal was to make us afraid to come to work, to make us quit, to make us close the clinic. That's terrorism. That's how terrorism works. Anyone who approves of harassing clinics is giving support to terrorism. #StandWithPP At the same time, I volunteered at Dr. George Tiller's abortion clinic. In 1993 he was shot by a "pro-lifer." He came to work the next day. Dr. Tiller kept coming to work after he was shot, because he was a caring man who knew how important his work was. In 2009, Dr. Tiller was murdered in his own church, again by a "pro-lifer." The goal was to scare other doctors who perform abortions. Abortions are still provided in Dr. Tiller's old clinic, because that's how you respond to terrorism. We can't let them win.” I then stumbled across her January 14 essay for The New York Times titled, “Why I Always Wanted to Be a Secretary,” which you should definitely read. Frank Schaeffer is New York Times best selling author whose books include three semi-biographical novels about life in a strict, fundamentalist household: Portofino, Zermatt, and Saving Grandma, and also the memoir Crazy For God: How I Grew Up As One of the Elect, Helped Found the Religious Right and Lived to Take All (or Almost All) of It Back, which is now out in paper back. His latest book is Patience with God: Faith for People Who Don't Like Religion (or Atheism). In this conversation with D.J. Grothe, Frank Schaeffer discusses Crazy for God, describing how he grew up in fundamentalist Christianity with his famous father, Francis Schaeffer, a leading founder of the Religious Right, and recounts his role in his father's career. He details how his relationships were affected by his leaving the movement. He explains exactly how fundamentalist Christianity took over the Republican Party. He describes the anti-democratic and anti-American elements within Evangelical Christianity. He draws a direct line from the worldview promoted by the Religious Right to the Tea Party movement, the rise of Glen Beck and Sarah Palin, the recent murder or Dr. George Tiller, and the use of biblical passages calling for the assassination of President Obama. He shows how the Religious Right actively wants America to fail, in order to prove that it has taken the wrong path in adopting secular, democratic and humanist values. He explores how evangelical "foot soldiers" are often used by secular neoconservatives to advance political aims seemingly unrelated to Christianity, such as energy deregulation and public policies in support of the insurance lobby. He defines secular humanism, and tells how his father at once opposed humanism in his writings such as The Christian Manifesto, even while living a complex, and sometimes deeply humanistic life. Finally, he contrasts and compares the New Atheists, such as Richard Dawkins and Sam Harris, to leaders of the Religious Right, arguing that they are both not only extreme in their views, but also absolutist in their views of fundamental truth.

NOW sits down with two of the remaining handful of doctors who publicly acknowledge performing late abortions. The murder of Dr. George Tiller has reignited the abortion debate, and raised the question: should violence against medical doctors who perform abortions be viewed and prosecuted as domestic terrorism? NOW Senior Correspondent Maria Hinojosa sits down with two of the remaining handful of doctors who publicly acknowledge performing late abortions, including Leroy Carhart, a fellow doctor in Tiller's Wichita, Kansas clinic. Carhart discusses his vow to carry on Tiller's mission and what it's like for him and his family to live as "targets". The show also investigates claims that law enforcement dropped the ball when it came to stopping Tiller's alleged murderer, Scott Roeder. Hinojosa travels to Colorado as well to talk with Dr. Warren Hern, another late abortion provider who says he's been living "under siege" for decades. Dr. Hern works behind four layers of bulletproof windows and is now under round-the-clock federal protection. NOW goes into the eye of the abortion rights storm to see how Tiller's killing and its ramifications are impacting doctors, free speech, and a civilized society.

Authorities have charged a man with murder in the case, but Dr. Tiller's death has sparked a fresh debate about the role of physicians and other health care providers in abortion cases, as well as other areas of medicine where moral and religious convictions may overlap with our duty to the health and well-being of our patients. One aspect of this debate revolves around efforts from the administration of President George W. Bush to bolster federal conscience protection statutes for health care providers, regulations which were implemented by the department of Health and Human Services in the final weeks of his time in the White House. The Obama administration began the process of determining whether to rescind the regulations.
