They explore the wrongful conviction of Donald Clark, a school counselor accused of sexual assault in 2009, and the subsequent legal malpractice case against his public defender for inadequate representation. The discussion highlights the significant emotional and physical toll on Clark during his six and a half years in prison, the courtroom strategies employed, and the eventual $12 million verdict for emotional distress. The client, Donald Lyle Clark, was convicted and sentenced to prison. The conviction was affirmed on appeal. However, in postconviction proceedings, the court determined that Clark's defense counsel had provided ineffective assistance and ordered a new trial. The state declined to prosecute, and Clark filed a civil action for legal malpractice against the state as the lawyer's employer. The district court granted partial summary judgment, holding that the finding of ineffective assistance in the postconviction proceedings established counsel's negligence as a matter of law. The jury found the lawyer negligent and awarded Clark $12 million in emotional distress damages. The Supreme Court of Iowa reversed the judgment for emotional distress damages. The court clarified that to recover emotional distress damages for legal malpractice, the plaintiff must prove more than negligence. The court held that the plaintiff must prove by a preponderance of clear, convincing, and satisfactory evidence that the criminal defense attorney acted with willful and wanton disregard for the client's rights or safety. The court concluded that the district court erred by instructing the jury that negligence was sufficient. The case was remanded for further proceedings consistent with this opinion. (Source) Guest Bio: Mel Orchard Mel Orchard is a trial lawyer, trying cases in the courtrooms across America, for the past 27 years. Mel has litigated and/or tried hundreds of cases in his career and has recovered hundreds of millions of dollars in settlement and verdicts for his clients. During his trial career, Mel has been a part of record-breaking civil jury verdicts in various jurisdictions (Wyoming, Arizona, and Iowa). He has also devoted significant time to pro bono work through Lawyers and Advocates for Wyoming, and many local and national charities. In addition to preparing for trial or being in trial, Mel was a senior faculty member and board member at the Trial Lawyer's College in Wyoming and was recently selected to join the Board. Mel also lectures and presents to various legal organizations throughout the country including Bar Associations, Leadership Organizations and has taught Judicial Ethics to various groups of judges. He was Chairman for the Wyoming Commission for Judicial Conduct and Ethics where he served as a member for six years after appointment. The launch of GPT-4 on 14th March has provoked concerns and searching questions, and nowhere more so than in the education sector. Earlier this month, the share price of US edutech company Chegg halved when its CEO admitted that GPT technology was a threat to its business model. Looking ahead, GPT models seem to put flesh on the bones of the idea that all students could one day have a personal tutor as effective as Aristotle, who was Alexander the Great's personal tutor. When that happens, students should leave school and university far, far better educated than we did.Donald Clark is the ideal person to discuss this with. He founded Epic Group in 1983, and made it the UK's largest provider of bespoke online education services before selling it in 2005. Learning & Development seems to be constantly evolving but at the same time revisiting and reinventing what has come before. In this episode, we discuss the emerging trends that have their origins in the past and the pioneers that we all need to pay more attention to. KEY TAKEAWAYS Even today, much of what we do in L&D is not evidence-based. This has to change. We are not taking successful methods from the past and reworking them for the modern world. AI sells platforms. But what are we buying? Too often it's just recommendations for off-the-shelf content. But AI is about so much more and its potential in helping us achieve the aims of L&D is huge. In this episode, we explore the potential of AI in L&D, burst some of the myths around it and challenge the profession to expect more, much more from it. KEY TAKEAWAYS AI has huge implications for all aspects of our lives, including L&D. It is already a surprisingly big part of our life. If you use Google, you are using AI. AI needs a clearly defined task, a precision task. AI only knows its task. Donald provides a memorable example of this in the podcast. Universities are already using adaptive learning tech to recognise bottlenecks in the learning process and find solutions. It also can create some of the training content e.g summarising text and generating illustrative images. People learn incidentally, on the fly, AI can help them to find and access the information they need as they need it. With AI you have to remember the garbage in garbage out principle. Donald Clark is a man of many hats. He's an EdTech entrepreneur who was formerly the CEO and one of the original founders of Epic Group, a pioneering company in online learning, and he is now the CEO of Wildfire Learning, an AI company. He is a Visiting Professor at the University of Derby. And he is the author of at least two books - Artificial Intelligence for Learning, and Learning Experience Design. But today I am speaking with Donald about a different writing project. Over the last 20 years or so - and gathering pace in recent months - Donald has been collecting learning theorists. He has written an incredible series of blogs on 2500 years of learning theory - from the Greeks to the Geeks. When we recorded this conversation a few short weeks ago, there were 160 blogs in the series. At the time of publication, he is now up to 200. Helpfully, Donald has created an index, where you can see a list of all 200 learning theorists grouped under different headings - the behaviourists, the assessors, the vocationalists and so on.
