This Day in Legal History: Goodridge v. Department of HealthOn November 18, 2003, the Massachusetts Supreme Judicial Court issued a historic decision in Goodridge v. Department of Public Health, becoming the first court in the United States to rule that a state ban on same-sex marriage was unconstitutional. In a narrow 4–3 decision, the court held that the denial of marriage rights to same-sex couples violated the Massachusetts Constitution's guarantees of equality and liberty. Writing for the majority, Chief Justice Margaret Marshall emphasized that marriage is a civil right and that excluding same-sex couples from this institution created a second-class status inconsistent with constitutional protections. The court ordered the Massachusetts legislature to take corrective action within 180 days, either by revising existing laws or crafting a new framework that would extend marriage rights to same-sex couples. Importantly, the ruling did not permit civil unions as a substitute for marriage, affirming that anything less than full marriage rights would perpetuate discrimination. This groundbreaking decision made Massachusetts the first state in the U.S. to legalize same-sex marriage, sparking national debates over marriage equality. The Goodridge decision laid the foundation for subsequent legal battles over marriage rights and catalyzed movements for LGBTQ+ equality nationwide. While celebrated as a milestone in civil rights history, the ruling also ignited opposition, prompting efforts to pass constitutional amendments to define marriage as between one man and one woman. Despite the controversy, Massachusetts began issuing marriage licenses to same-sex couples in May 2004, cementing its role as a trailblazer in the fight for marriage equality.Former President Donald Trump's hush money criminal case is at a crossroads following his election victory. Trump was convicted in May of falsifying business records to conceal a $130,000 payment to Stormy Daniels during his 2016 campaign, but sentencing has been paused at the request of Manhattan District Attorney Alvin Bragg. Prosecutors must now propose how to proceed, balancing the political implications of prosecuting a president-elect with the need to uphold legal standards. Their recommendations are due Tuesday.Options for prosecutors include indefinitely delaying sentencing, postponing punishment until Trump exhausts appeals, or pursuing a sentence with minimal consequences, such as an unconditional discharge. Legal experts suggest Bragg is unlikely to seek aggressive penalties before the inauguration, given the potential political fallout.Trump's defense has long claimed the case is politically motivated, arguing that it should be dismissed to avoid unconstitutional interference with his presidency. They also contend that his actions are protected by presidential immunity, though the court has yet to rule on this argument. The judge, Justice Juan Merchan, will ultimately decide whether the case moves forward, with both sides expected to appeal any unfavorable decisions. What's next in Trump's hush money criminal case | ReutersFormer IRS Contractor Sentenced for Disclosing Tax Return Information to News Organizations | United States Department of JusticeKathi Vidal, outgoing director of the U.S. Patent and Trademark Office (USPTO), will rejoin her former law firm, Winston & Strawn, as a partner on December 16 after leaving the agency. Nominated by President Joe Biden in 2021, Vidal focused on policies addressing artificial intelligence (AI) in patents, international intellectual property (IP) issues, and diversity in innovation during her tenure. She emphasized transparency and patentability standards for AI-assisted inventions to promote innovation without stifling it.Deputy Director Derrick Brent will serve as acting director until President-elect Donald Trump appoints a replacement. Trump has not announced his pick, though his first-term USPTO head, Andrei Iancu, prioritized policies favoring patent owners. Vidal noted that IP policy tends to be less partisan and highlighted the agency's unique funding model, which relies on processing fees rather than taxpayer dollars. At Winston, Vidal will advise clients on tech-related legal issues, including AI, cybersecurity, and antitrust law, leveraging her USPTO experience. The firm's leadership praised her ability to guide clients through challenges posed by technological advances and geopolitical pressures. Vidal expressed her intention to continue shaping tech policy at the intersection of law and innovation.US Patent Office's Vidal returns to law firm Winston ahead of Trump term | ReutersSpirit Airlines Inc. has filed for Chapter 11 bankruptcy amid financial challenges and intense competition from rival carriers. The filing in New York lists the company's assets and liabilities as between $1 billion and $10 billion. Spirit's troubles escalated after a federal judge blocked its proposed $3.8 billion merger with JetBlue Airways Corp., citing antitrust concerns that the deal would harm budget-conscious travelers by raising ticket prices. Previous merger talks with Frontier Group Holdings Inc. also collapsed. The discount airline has faced increasing pressure from major carriers offering competitive basic economy fares, which have eroded Spirit's market share. Since the COVID-19 pandemic, the company has posted consistent losses, with its stock plummeting 93% in 2023.Spirit's bankruptcy follows an agreement with bondholders on a debt restructuring plan. Bondholders will convert $795 million of debt into equity, take control of the company, and inject $350 million in fresh equity along with $300 million in debtor-in-possession financing to sustain operations during the bankruptcy process. The airline also plans to delist as part of the restructuring. In an effort to remain competitive, Spirit recently introduced upgrades such as extra legroom and free checked baggage to attract travelers seeking more premium options. However, these efforts have been insufficient to counter the financial strain. The case is being handled in the U.S. Bankruptcy Court for the Southern District of New York.Spirit Airlines (SAVE) Files Bankruptcy Following Failed JetBlue Tie-Up - BloombergThe U.S. Supreme Court announced it will release its first opinion of the term on November 22, earlier than in recent years, where the first opinions appeared in December or January. The specific case or cases to be decided have not been disclosed, but they are likely from the nine argued in the October session. These include issues like federal court jurisdiction, attorneys' fees, and the requirement to exhaust administrative remedies before suing in federal court. Complex cases, such as challenges to Biden's ghost gun regulations and an Oklahoma death penalty case, are expected to take longer. The timing recalls the court's earlier practice of releasing initial opinions in November, a pattern often attributed to Justice Ruth Bader Ginsburg's quick writing pace. In contrast, recent terms have seen delays, with the first opinion in the 2022 term arriving as late as January 23, 2023, marking an unprecedented delay since the court's October term structure began in 1917.This term, the court has already agreed to hear 45 cases, avoiding controversial social issues and focusing on lower-profile matters. The November 22 release could include an opinion or even a dismissal of a case as “improvidently granted,” as suggested during recent arguments in an investor lawsuit against Nvidia.US Supreme Court Bucks Recent Trend, Announces Opinion ReleaseThe court ruling in Mem'l Hermann Accountable Care Org. v. Commissioner underscores the flaws in the current 501(c)(4) tax-exempt classification and the need for reform to address the issue of dark money in politics. This tax code section groups together vastly different organizations, from advocacy groups like the NRA to local sports leagues, under a single classification. The lack of clear, enforceable standards allows some organizations to exploit their tax-exempt status to fund political campaigns while avoiding donor disclosure. This lack of transparency fuels the dark money problem.501(c)(4) organizations can engage in political activity as long as it's not their primary purpose, a vague standard that has led to inconsistent enforcement by the IRS. The Fifth Circuit's decision in Mem'l Hermann challenges this leniency by applying a stricter “substantial nonexempt purpose” test, signaling a potential shift towards greater scrutiny of political spending by these organizations. One solution is creating a new tax-exempt subcategory—501(c)(4)(C)—for politically active social welfare groups. This would establish clearer rules, such as capping political expenditures at 50% of revenue and requiring donor disclosure for contributions above $10,000. It would also separate traditional social welfare organizations from politically active ones, reducing unnecessary regulatory burdens on the former.Breaking 501(c)(4) into more specific classifications would ensure that transparency requirements target politically active organizations without disrupting community-focused groups. It would also help regulatory bodies focus enforcement efforts and prevent misuse of tax exemptions for untraceable political contributions. This reform aligns with public demand for accountability in campaign finance while preserving the integrity of non-political nonprofits. In sum, the 501(c)(4) designation is problematic as currently drafted because it combines a wide variety of organizations with vastly different purposes under the same tax code section. This allows political advocacy groups to hide behind the same classification as traditional social welfare organizations, avoiding stricter scrutiny. This structural ambiguity hampers transparency efforts, suggesting the need to separate these groups into distinct categories for effective regulation.Getting Rid of Dark Money Requires a New Tax-Exempt Designation This is a public episode. It's Hump Day! Emma speaks with Jeremy Gantz, contributing editor at In These Times, to discuss the recent unionization efforts at Trader Joe's. Then, she speaks with Leah Goodridge, Commissioner on the New York City Planning Commission and former member of the New York City Rent Guidelines Board, to discuss efforts to support rent stabilization in the city. First, Emma runs through updates on the incumbent victories in yesterday's PA primaries, Trump's legal woes, the Senate's Ukraine-Taiwan-Israel aid package, new mass grave reports coming out of Gaza, Biden's new labor regulations, Elon Musk's desperate Tesla promises, a DOJ settlement, the Supreme Court's anti-labor agenda, and fascist legislation coming out of Idaho, Tennessee, and North Carolina, before watching Summer Lee's phenomenal speech in the wake of her massive victory against a Pro-Israel challenger. Jeremy Gantz then joins, diving right into the major recent developments in the bargaining process between Starbucks and Starbucks Workers United, with Atlanta hosting the first genuine sit-down bargaining session in almost a year, before stepping back to walk through the two years of hardline union-busting, despite consistent pushback from both the NLRB and the general public, with only the negative change to their public image pushing them back to the table. Next, Gantz expands to the greater context of the retail industry, with major companies like Trader Joe's and REI operating their own en-masse union-busting campaigns, exploring why the decentralized nature of the industry, as well as the high employee turnover rates, make these particularly difficult organizing efforts. Wrapping up, Jeremey walks Emma through the role of the ongoing suit sponsored by SpaceX and joined by Starbucks attempting to undermine the NLRB, and what the future of these unionization drives will likely entail. Leah Goodridge then joins, first bringing Emma through her own experiences working with New York's housing industry, and the major issues facing the affordable housing sector, both in its policy and access, and in the greater construction and maintenance it requires. Expanding on this, Goodridge explores the ever-present power struggle with developers and landlords on one side, and tenants and homeowners on the other, tackling how the former group can both manufacture the public rhetoric and villainize their opponents, often presenting their domination over the industry as heroic or necessary for a functioning of society. After touching on some of the major issues in what makes up the affordable housing market (unaffordable, single-bedroom units), Leah and Emma look to the role of the Faircloth Amendment in killing federal investment in the expansion of the affordable housing market, and pushing the responsibility for constructing and maintaining the infrastructure almost entirely onto the private sphere. Next, Goodridge touches on the major factors of the broker system and the epidemic of vacant units (often used as speculative assets) in driving up housing costs, before she and Emma dive deep into the topics of rent control and Tenant's Rights, unpacking what these terms entail and how the media completely misrepresents the role they play in equalizing the power dynamic between landlords and renters, before wrapping up with a brief assessment of Squatter's Right's minor (yet unsurprisingly overblown) role in the conversation. And in the Fun Half: Emma covers Elon Musk's unsurprising response to Tesla's cratering profits and stock price (make unachievable and absurd promises), Garrett from VA on the growing extraction of profits from medical clinics by insurance companies, Rick from Baltimore explores how he came to MR, and Kowalski from Nebraska gives his takes on the rent control and Big Tech conversations from the day. The MR Team also watches the harrowing footage of (content warning) a Zionist counter-protester getting bonked by a flag, listens to some powerful reflections from a Columbia University anti-zionist Jew, and gives some much-needed aesthetic advice to Trump's attorney. Part One: Newfoundland Devils If you believe the tall tales, the devil has left his mark all over Newfoundland. There are hoof prints in the resettled community of Flat Islands, Bonavista Bay and more in Keels on the Bonavista Peninsula but, perhaps, his most celebrated scar is in Fortune Harbour where a rock supposedly bears his handprint. Visit Product of Newfoundland to see pictures. This episode presents the story ‘Mr. Kinchler and the Devil,' a folktale that describes the night the Devil visited Fortune Harbour, tangled with a card prodigy and left his mark in stone. Mr. Kinchler and the Devil is a Newfoundland variant on a classic folktale. Not all stories of Newfoundland's devil and demon stories are old — some of them are being created right now. The Duds are a musical duo comprised of Melanie O'Brien and Philip Goodridge. They have been creating compelling pop music for ten years. Part Two: The Duds After touring Atlantic Canada in 2019 they released their debut album, These Words I Can't Forget. The record, which was produced by award-winning singer-songwriter Ian Foster, combined a folk-tinged roots sound with bright pop beats. The Duds were subsequently nominated for two MusicNL awards including Bell Aliant Pop Artist of the Year. Separately, Melanie and Philip have each built solo careers in the entertainment industry. O'Brien's debut solo album Shining in The Blue earned her three MusicNL Award nominations and, as a vocal coach, she holds the 2017 MusicNL Award for Music Educator of the Year. Goodridge is a multi-faceted artist, writer and seasoned professional theatrical performer, who has been thrilling audiences in Newfoundland for over 20 years. As The Duds they create playful-yet-confessional music with plentiful hooks and big emotion. On October 1st, 2023 they are turning their attention to Halloween, as they release two brand new spooky tracks. ‘When He Danced With Me' and “Your Dead Heart' were written with Halloween in mind and are inspired by dancing with devils and falling for demons! O'Brien and Goodridge were kind enough to agree to appear on the podcast and discuss their new tracks as well as their current roles in the Terra Bruce musical The Wild Rovers which is running at the newly-renovated Majestic Theatre in St. John's from September 22nd to October 1st, 2023, and from October 14th to November 4th, 2023 at the Winter Garden Theatre in Toronto. When he returns from Toronto, Goodridge is set to appear in the latest production of the Ladies Who Lunch Three Tales of Terror VII: The Curiosity Shop. It's a show designed to transport the audience to the Golden Age of Radio by performing original audio dramas live on the theatrical stage. Philip discusses the show and some of his inspirations when writing his segment. The show hits the stage on November 24th and 25th at the Elks Club Lodge in St. John's. Have you ever wondered how unseen forces of elitism might drive the dynamics of your workplace? Join us as we sit down with the remarkable Leah Goodridge, an attorney and city planning commissioner from Brooklyn, New York, who has some thought-provoking insights to share about this very subject. Leah draws our attention to the often-overlooked intersection of work and alcohol and how it contributes to a culture of exclusivity and perpetuates financial insecurity among young professionals. In our conversation with Leah, we venture into the labyrinth of workplace elitism, unearthing its subtle manifestations in after-work drinks, power lunches, and even the pressure to outperform. Further, we dissect the concept of dysfunction bonding, a complex issue where work becomes an escape from personal problems, leading to unhealthy dynamics. We delve into the delicate balance between sharing insights and gossiping and how it can create a sense of inequity. Leah also brings to light the undue pressure on marginalized groups to constantly prove themselves, adding another layer to this intricate matrix. Prepare for a riveting conversation that promises to broaden your perspective on the reality of workplace dynamics and equity. In this episode, you will hear: Leah Goodridge, a legal warrior advocating for housing justice in Brooklyn, New York, shares her thoughts on the intersection of work and alcohol The hidden nuances of workplace elitism and how it's entangled with after-work drinking and power lunches Uncovering the reality of financial insecurity among young careerists and the unspoken inequities in professional spaces An examination of dysfunction bonding in the workplace and the fine line between gaining insight and fostering gossip The pressures faced by those from marginalized groups in proving their worth at heightened levels How the culture of after-work drinks can perpetuate workplace inequalities and marginalization The role of alcohol in fostering an unhealthy work culture and perpetuating sexual harassment Resources from this Episode Leah Goodridge's website: www.leahgoodridge.com Find Leah on Twitter: twitter.com/Leahfrombklyn Connect with Leah on LinkedIn: www.linkedin.com/in/leah-goodridge Follow and Review: We'd love for you to follow us if you haven't yet. Dr. Nathan Fox is joined by Kimberly Goodridge, NP who tells the story of her vaginal birth quickly becoming a high-risk situation of cord prolapse. Kim describes what it was like to go from a relatively normal birth to an emergency c-section as a new mother and medical professional.
Leah Goodridge is a tenants' rights attorney who serves on the New York City Planning Commission, where she is the first and only tenants' rights attorney. Born and raised in Brownsville, she lives in Bed-Stuy where, like anyone else in Brooklyn can tell you, the rent is too damn high — and newcomers are consistently pushing historic, legacy families out. On June 21, the city's Rent Guidelines Board voted to increase rents on New York City's rent-stabilized apartments — Goodrige herself has been a member of the rent guidelines board, so we'll talk about that. We'll discuss what the planning commission does and what she sees as her role on that body. And we'll talk about the idea of professionalism: Goodridge wrote a widely circulated essay for the UCLA law review called "Professionalism as a Racial Construct." Thursday, February 23rd, 2022 Leah Goodridge has served on the New York City Planning Commission since 2021 and is the Managing Attorney for Housing Policy at Mobilization for Justice. She oversees a team that provides legal representation to tenants in eviction proceedings. We talk about housing in New York City, ranging from high rents and evictions to land use discussions. Tenant unions have advocated for tenants' rights in New York and Albany, which pushed for right to counsel and new rent laws. Developers and landlords have successfully shifted the media narrative to portray them as the little guy and the victim, and the tenant as the villain. Joining community boards is an effective way for everyday New Yorkers to have a voice; community boards vote on the housing proposals before the planning commission sees them. Private developers are being pushed to be at the forefront of building affordable housing, but the City can and does decide how much money it will allocate toward housing. It could decide to fund more affordable units. Now Tarrant's pursuers have caught up with them, and Rumer's polite words haven't stopped them from drawing their weapons, with all three in the line of fire.
