In this podcast, Expert Witness Challenges in Healthcare Cases, Arlene Klepatsky, a legal nurse consultant and nurse attorney, who teaches legal nurse consultation, answers some of the most critical ethical and practical questions for LNCs. She goes into depth about Rule 26 disclosure, a federal rule that states may also have. It means you'll be disclosed as an expert and will have to provide certain documentation. To fulfill the requirements, you must submit a list of cases, whether depositions or trials, in which you have participated in the last 48 months. Both Pat and Arlene emphasize the importance of an updated list. Many LNCs worry about needing to withdraw from cases. Arlene details the circumstances under which you can legitimately draw. One of these is a conflict of interest. Sometimes, the conflict doesn't emerge until you're already officially a witness, as in the merging of a hospital where you work with one named in the case. Withdrawing from a case creates a costly and time-sensitive situation for the attorney, and it's best to discuss the situation with him. You must also anticipate that he or she will expect reimbursement for payment given to you. This may depend on the circumstances. Whether you are an expert witness or you supply expert witness's for legal cases, you want to know how attorneys and LNCs vet potential witnesses. In this podcast, Arlene Klepatsky provides detailed information on this important subject The first thing a researcher investigates is legal issues. Has a practitioner been sued or also brought up on legal charges? Whether or not the issue relates to the expert's testimony in a case, a jury can be swayed by evidence of wrongdoing. An investigator will also research a witness's writings. If they publish an article or also a blog in which they express an opinion contrary to what they expressed in a current case, this can be brought up in cross-examination to the detriment of their testimony. Other issues are important. A researcher may discover that the expert witness is difficult to work with or unreliable. This can be grounds for disqualification. Arlene cites several resources available online where you can find valuable information. Some are not accessible to LNCs, but they can inform the attorney in charge of a case of their existence so that the information can be extracted. Legal Nurse Podcast, although based in the U.S., has an international audience, A highly experienced nurse, Joan Davis has worked in both Canada and the U.S. In this podcast she describes how malpractice suits work in Canada. To put the Canadian legal environment in perspective, we need to realize that, although it's a large country, the total population is only around 40 million. In addition, it has national health insurance, which covers many, although far from all, medical expenses. The Canadian legal system sets limits on how many experts on a side can be involved in a case. A financial cap of $400,000 (Canadian dollars) exists for most settled cases. The financial cap acts as a strong deterrent to attorneys taking on case. They are also far more reluctant than U.S. attorneys to take cases on a contingency basis. This is turn deters potential plaintiffs from engaging an attorney. Despite these factors, Joan says Canadian LNCs can make opportunities for themselves. As is true in the U.S., they need to educate attorneys about the many services they can provide, for example doing chronologies, which in Canada are often the responsibility of paralegal. Overall, the principle of upselling applies equally well north as south of the border. When it comes to nursing and doctors' care, procedures, documentation, and much more, a nursing home environment differs greatly from that of an acute care facility. Irene Nobles, an LNC who specializes in long-term care cases, shares some of the most crucial differences. One major difference is regulatory. Very different governmental standards apply to overall care in a nursing home. One reason for this is the heightened vulnerability of the patient population. One complexity is that regulations may vary from state to state, but federal regulations take priority. Those working a nursing home case are far more likely to be faced with piles of paper records. Because many patients may be long-term residents, many of these records may be in storage. Paper records also make creative rewriting of incidents like falls possible, a situation which should put the LNC on alert. Irene emphasizes the importance of asking for or researching supplementary information. These include daily staffing reports, patient complaints, call light records, and other forms of information that can provide a wealth of information. It's also important to look up the nursing home's CMS star rating, which is available to anyone on the CMS website. Burnout - Causes and CuresBurnout is costly to employers in several ways:Employee turnoverIncreased risk of worker injury or errorDeteriorating culture as energy becomes misdirected toward scapegoatingContrary to conventional wisdom, burnout is not solely related to workload, it's also related to feeling like “a cog in a machine.” When an unsustainable workload becomes even more stressful due to a lack of clarity, lack of control and an effort-reward imbalance, relationships become strained and people become siloed. According to leading researchers, burnout is identified when three psychological states exist:High levels of cynicism: an indifference, negative perspectiveHigh levels of exhaustion: emotional, spiritual and physicalLow levels of professional efficacy: the belief in ones ability to make a difference.Burnout can creep into a workplace and worsen over time. It often starts with an erosion of engagement. Work shifts from important, interesting and meaningful to exhausting. Next comes the erosion of emotions, where cynicism, anger, anxiety and depression start to surface. Finally, burned out workers comes to experience a mismatch between themselves and the organization. Karen Taylor, an ICU veteran, decided to open a full-time LNC practice right before the pandemic. She quickly recalibrated, shifting her marketing efforts to online platforms, and she learned to fully utilize LinkedIn's networking features. She landed some clients directly but found that she was receiving many more invitations to do subcontracting work. At that point, she realized that marketing wasn't her niche, and she achieved a mindset that allowed her to shift from marketing directly to attorneys to focusing on subcontracting. If one word would describe what this mindset is, it would be “receptivity.” Subcontracting has advantages and disadvantages, and someone considering this form of work needs to weigh both aspects. Once having chosen this career, she or he needs to make the most of the opportunities to have a valuable form of supervision and to learn from a more experienced practitioner. It also means—and this applies to anyone—to saying “yes” to opportunities. Karen says that she may say “yes” to something she doesn't know how to do. Though she advises caution about straying too far beyond your skillset, if the opportunity seems possible to realize, you can always ask others for advice. (5:45) I think my vision changed two years after I started working as an expert witness. When an attorney called me and said I’d like you to review an emergency department case, I was not an emergency department nurse, I was a medical surgical nurse which were the general units of the hospital. But I had a great friend who was attractive, well-spoken, highly educated, and I connected her with the attorney, and I sat back and thought, ‘Maybe there’s a business referring other experts other than myself.’ It’s like a little lightbulb went shining off my head, ‘Hey Pat, pay attention to this.’ (6:15) And that turned into a multi-million dollar business because it was such a sound model. Other people were producing income from my company and we were consistently making over a million dollars a year over the last five years that I ran the business. (7:54) It was a lot of hard, steady work. I brought cases home as a legal nurse consultant and did those cases at home, at night and on the weekends. When I first started my business, I ran it out of my house, I worked a lot of hours, I had to give up things. I had to give up reading the Sunday New York Times, which I used to do until I found out got up from laying on the couch for two hours reading the Sunday New York Times more depressed than when ...
