In this case, the court considered this issue: Did the ATF exceed its statutory authority in promulgating its Final Rule purporting to regulate so-called “ghost guns”?The case was decided on March 26, 2025.The Supreme Court held that the Gun Control Act of 1968 authorizes the ATF to regulate weapon parts kits and unfinished frames or receivers that can be readily converted into functional firearms. Justice Neil Gorsuch authored the 7-2 majority opinion of the Court.  Weapon parts kits qualify as “weapons” under the statute when they contain all necessary components to build a gun and their intended function is clear. Everyday language permits describing incomplete objects by their intended use, just as a disassembled rifle remains a “weapon.” The statute reinforces this understanding by treating starter guns as firearms even though they require modification. A kit like Polymer80's “Buy Build Shoot,” which can be assembled in about 20 minutes using common tools, meets the law's definition because it can be “readily converted” into a functioning firearm, just as a blocked-barrel starter gun qualifies when easily modified for live fire. While not all kits may fall under this definition, the statute clearly covers at least some, making a facial challenge to the rule invalid.  The definition of “frame or receiver” also includes partially complete versions that can be finished quickly with standard tools. Ordinary language and the statute's serialization requirements support this reading, as identification numbers are required on unfinished frames and receivers. Law enforcement has long treated such components as regulated firearms, and even the challengers conceded that some unfinished frames fall within the law's scope. While some objects may be too incomplete to qualify, the statute reaches at least those requiring only minimal work, making ATF's rule facially consistent with the law. Concerns about unintended consequences under the National Firearms Act are misplaced, as the government disavowed any authority to classify AR-15 receivers as machine guns, and the doctrines of lenity and constitutional avoidance do not apply where the statute's meaning is clear.Justices Sonia Sotomayor, Brett Kavanaugh, and Ketanji Brown Jackson each joined the majority opinion and also wrote separate concurring opinions.Justices Clarence Thomas and Samuel Alito each authored dissenting opinions.The opinion is presented here in its entirety, but with citations omitted. This week, we're taking a close look at the Supreme Court's ruling in Bondi v. VanDerStok. To do that, we have the Independence Institute's David Kopel on the show. Kopel has written extensively on gun policy and been cited repeatedly at the Supreme Court. So, there are few people better qualified to dissect what the VanDerStok ruling means. Kopel argued the decision upholding the ATF's "ghost gun" kit ban is relatively narrow, but still likely applies to more than just the Polymer80 "buy build shoot" kits discussed at length by the majority. He also explained why the majority decided the case as a facial challenge and why he, along with Justices Thomas and Alito, disagrees with the use of that standard. He said the Trump Administration could have tried to intervene in this case, but didn't move fast enough. However, he argued that it can still try to undo the rule despite the decision. Kopel also gave his view on where the balance of the court lies on gun issues and whether there's a reliable way to read what they might do with other pending gun cases. On this episode of TFB's Behind the Gun Podcast, we're going to tackle a topic that has come up quite a lot in the last year - Intellectual Property rights. The US Patent system is something that is often misunderstood and even less so one that is taken advantage of by US Citizens when clear IP theft is being made. So in light of the recent lawsuits coming up between companies like Glock and Polymer80, or GWACS Armory and KE Arms, I thought it might be prudent to bring on a subject matter expert to talk about the basics of what the basics of patients are and how they apply in some of these specific cases we're seeing unfold before us.  Our guest and subject matter expert today is Dan Evans - an Intellectual Property lawyer who works for the boutique law firm McCoy Russell LLP an intellectual property firm based out of Portland Oregon. Dan has represented clients in a variety of patent matters including patent applications and prosecution, so he has the perfect type of understanding to break down these often complex legal matters that take place between firearms companies. This week, California gun owners received positive news when a federal judge ruled the state's handgun restrictions are unconstitutional. So, we decided to reach out to one of the most prominent plaintiffs in the case: YouTuber Reno May. He said he is happy with the outcome of the case. He even expressed optimism that the ruling might go into effect without an appeal. Federal District Judge Judge Cormac J. Carney agreed with May and the other plaintiffs' argument that the state's "Unsafe Handgun Law" violates the Second Amendment. He found the requirement that all new models of handguns include loaded chamber indicators, magazine disconnect safeties, and microstamping were unlike anything in the historical record. Judge Carney said that the law can't stand under the Bruen standard. While the problem with California banning handguns that don't feature a theoretical technology, like Microstamping, May explained why the other two requirements were actually more challenging for gun makers to meet than they first seem. For instance, many modern guns have some kind of loaded chamber indicator, but California requires one that has a specific phrase written on it to qualify. May said the law has prevented him from buying any modern handgun from a dealer since he started buying them after 2013. He noted he and other Californians may still have to wait to buy new handguns, though, because the ruling doesn't go into effect for several more days. And he noted California is likely to appeal the verdict while asking for a stay that would delay the effect of this ruling. But he noted the odd silence from the state and gun-control supporters about the case. That gives him hope that an appeal may not be coming. May also gave us some insight into the modern pistols he plans to buy if no appeal comes. This week we're looking at the practical impact of President Joe Biden's "ghost gun" kit ban. The ban went into effect just a few days ago. So, it's a good time to check in and assess the fallout. That's why we've brought Rob Picus on the show. Rob is one of the key organizers behind the gunmakers match, a shooting competition for people who build their own firearms. He has become engrained in the homebuilding community. He said companies that make 80 percent frames or receivers have begun to test the new legal landscape. At least one company has made the unserialized and unfinished parts available for sale apart from the jigs and drill bits needed to finish them. Since the ATF rule considers the parts being sold alongside what's required to build them into a working gun the same as selling a working gun, the strategy to remain compliant appears to just be selling everything separately. Rob said Polymer80, one of the market's biggest companies, is also moving towards selling unfinished receivers on their own. Still, there are a lot of unanswered questions with potentially disastrous consequences for anyone who answers wrong. Rob explains the potential pitfalls. He also gives his view of the state of the effort to reform the NRA from the inside. Rob is a board member of Save the Second, which was formed to try and oust current NRA leadership and impose new internal controls after accusations of financial impropriety began hounding the gun-rights group. However, he admitted the reform movement has been much less successful than he'd initially hoped as this week's news that dissident board member Philip Journey is not being renominated for this year's ballot by his fellow board members. In this episode of Law, disrupted, John is joined by Assistant Professor of Law at Southern Methodist University, Dedman School of Law, Eric Ruben, Duane R. Lyons, a partner in Quinn Emanuel's Los Angeles Office, and Stacylyn Doore, a partner in Quinn Emanuel's Boston Office. Together, they discuss three main topics surrounding guns: Supreme Court Second Amendment cases, regulation at both the state and federal levels, and pending litigation. Guns and the rights of US citizens to bear arms is a hotly contested policy issue in the USA, which has only become more relevant due to the recent mass school shooting in Uvalde, Texas, and the recent New York State Rifle & Pistol Association, Inc. v. Bruen Supreme Court decision.They begin by discussing how the Supreme Court held in Bruen ruled that the New York gun safety law at issue is unconstitutional. This law required a license to carry concealed weapons in public places and provided for discretion in the state's provision of such licenses. Eric outlines the landscape, pre-Supreme Court decision – he touches on the lay of the land, outlining the historical context, as well as explaining how firearm regulation and control have primarily been executed at a state and local level, rather than federal, and that there has been a long history of gun control at the local/state level in the US, citing to registration requirements in the 1930s and long before. There have only been a handful of significant federal laws that would count as “gun control.” The recent bipartisan federal legislation was an exception. It was several decades earlier when the last federal gun safety law was passed.The conversation moves on to discussing the Heller case, another US Supreme Court decision which held that the Second Amendment guarantees an individual the right to possess firearms independent of service in a state militia and to use firearms for traditionally lawful purposes, including self-defense within the home. Duane notes that there are members of the courts that view guns and gun rights completely differently than people in large metropolitan areas and that many court decisions seem results driven. They move on to discuss the difference between where the focus should be and where the focus will actually be for future gun control regulation and litigation.Stacylyn moves the discussion toward future applications of Heller and Bruen, noting how we've seen a lot of historical analysis in the cases thus far and asking how much more there is to mine and to what extent comparable historical analogs are now required in all future gun regulation cases. Eric answers by discussing the means and scrutiny approach to Second Amendment cases, explaining that once the Second Amendment is in play, the government has to find historical analogs in order to justify modern-day gun regulation. However, Eric highlights that times have changed, noting that historical analogs may not suffice given the technological advancements in the intervening centuries.Duane moves the conversation towards whether there are any historical analogs showing that firearms were prohibited in some parts of the country. Eric notes how Britain in the 1300s had strict firearm laws, as well as other restrictions, such as Texas gun laws in 1871, which banned the public carry of pistols and public weapons. John touches on age limitations being a potential appropriate response in light of Bruen, as well as increased reliance on mandatory training and designation of sensitive areas. Finally, the conversation comes to a close, with Duane discussing ghost guns and how they've become the choice guns for criminals in the USA, with law enforcement seizing more and more ghost guns. Duane highlights Quinn Emanuel's involvement in a lawsuit against a ghost gun company, Polymer80, a case that is set for trial next year.

President Joe Biden will appeal for a renewed international commitment to attacking COVID-19 as the second global pandemic summit opens. The virtual meeting comes Thursday as the U.S. approaches what Biden calls “a tragic milestone” of 1 million deaths from the coronavirus and when a lack of resolve at home jeopardizes that global response. Biden used the first summit to pledge to donate 1.2 billion vaccine doses worldwide. The urgency of the U.S. and other nations to respond has waned. Meanwhile, Ukrainian Deputy Prime Minister Iryna Vereshchuk says Ukraine has offered to release Russian prisoners of war if Russia will allow the badly injured fighters to be evacuated from the Mariupol steel plant. Russian forces have surrounded the plant, the last bastion of Ukrainian resistance in the southern port city. Gas is $4.41 this morning, up 32 cents in a month.  In Southern California, a wildfire erupted Wednesday in the coastal community of Laguna Niguel and burned more than 20 homes, many of them multimillion-dollar mansions. An Arizona man convicted of killing a college student in 1978 has been executed after a nearly eight-year hiatus in the state's use of the death penalty brought on by a previous execution critics say was botched and the difficulty officials faced in finding lethal injection drugs. Officials say Clarence Dixon died by lethal injection Wednesday at the state prison in Florence for his murder conviction in the killing of Arizona State University student Deana Bowdoin. Australian government scientists say 91% of the Great Barrier Reef coral surveyed this year was bleached in the fourth mass event in seven years. Coral becomes bleached in warmer-than-usual waters, and scientists worry about potentially lasting damage to the world's largest coral reef ecosystem. Riley Bowman and Matthew Maruster bring to you our monthly legislative news updates. We're going to share some good things happening in Ohio, less good things in Virginia, and how some people are getting creative using Obama-era finance laws to help shore up financial institution protections for gun-related businesses. Plus we'll break down the Polymer80 raid situation and what that might mean.

On December 10, agents from the Bureau of Alcohol, Tobacco, Firearms, and Explosives raided Dayton, Nev.-based Polymer80. The company manufactures unfinished, often referred to as 80 percent, receivers, and frames for the firearms industry. Folks, I own a firearms business, and my customers and I have supported Donald Trump since even before his election to the presidency.  However, it would appear that while Trump was fixated on spitting in the faces of Biden and the Democrats who cheated his election, he allowed for Joe Biden's Acting Director Regina Lombardo and Associate Deputy Director Marvin Richardson of the ATF to get a jumpstart on Biden's future assault on the firearms' industry.  On November 10, gun rights activist John Crump published a piece for Ammoland.com with details of a leaked ATF conference call in which Director Lombardo and Associated Deputy Director Richardson participated. According to the phone call, "Lombardo told those on the call that her priorities would be pistol braces and 80% lower receivers." We are talking about action by the hopeful Biden administration just one week after the election. And what is concerning is that Donald Trump did nothing to stop this move. Moreover, it is no secret that Trump and then-Attorney General William Barr have had discord; some would argue utter hatred. But, knowing their tremulous relationship, my question is, why didn't Trump act to stop this move?  And the dram doesn't stop there. Last week, the ATF posted Objective Factors for Classifying Weapons with "Stabilizing Braces" for public inspection on the Federal Register. The "guidance" was officially published in the Federal Register on December 18. ATF will be accepting public comments on this "guidance" until January 4, 2021. Folks, that leaves only 14-days for public comments.  For those out there who don't follow federal notices of proposed rule-making or NPRs, the federal government usually allows public comments and industry leaders in 30,60,90, or more days. But you see, again, Biden and his minions, under the direct guidance of William Barr's Department of Justice, and our sitting Republican President in Donald Trump, allowed the ATF full discretion on this action.  In my previous comments, I outlined six attacks on firearms that Joe Biden was set to move ahead with within his first 100 days if his election holds up. With the attack on 80-percent receivers and stabilizing braces, that list has been trimmed by 2, and the man hasn't even been inaugurated yet. And still, our President Trump, silent on the sidelines, as the socialist class in our nation, one-by-one, orchestrates a complete overhaul of our 2nd Amendment and God-given right to keep and bear arms.  I'm at the current mindset that Donald Trump's campaign to preserve the 2nd Amendment was just a sham, or he has thrown in the towel to the tyrannical liberals across America and doesn't give a rodent's rectum on what occurs on his watch, as long as he can secure another four years.  Trump is to blame for his inaction, and those who have sold him out from within his administration and party, your days are numbered as well! The Republican Party needs a complete overhaul - and for the last 4 -years, I believed that man was Donald Trump. Now, I firmly believe that just like in sports, a complete transition and house clearing among today's Republicans is necessary.  Our nation is folding and failing right before our very eyes. Today's Republicans who claim to be conservatives haven't the slightest idea. Fiscally, they are just as bad as the Democrats, and socially, they are a mess. Every politician wants to play it safely across D.C. wants to be middle-of-the-road, everything to everybody. They are either too dumb or too scared to make a stand for what is right, what they believe in, and what they promise to those who support them. The newest manufacturing victim of the ATF's nonsensical attacks is Polymer80. They have been producing ATF-approved 80% receivers since 2015. Last week, the ATF raided the Polymer80 headquarters and seized a "Buy, Build, Shoot" pistol kit, receipts, and customer lists. According to the ATF, the kit is a "firearm" because it is "readily convertible". Alex has a new trick he has been using to get his boys potty trained through out the night. It involves them being asleep and a pitcher of warm water… You probably have never heard this one before, but it's a pretty good dad hack. Beav is back from Vegas, and gives us his take on the new and old that was at SHOT this year. 3 years of being told the PSA MP5 is coming out “in a few months” and all of the same AR15 “new” parts tend to blend in, but when a few products actually stand out, like Polymer80’s new frames and some other custom pistol options, it’s actually pretty exciting. But the main reason Beav takes the week to be in Vegas is to meet up with friends, industry partners and TBG customers that come up and stop him at the show. He always appreciates everyone that he runs into, so if you happen to see him out and about, be sure to say hey. After some discussions and education, my plan to "manipulate" Freeze into getting a Glock pistol, by building it, has been scrapped. The plan was to purchase one of the Polymer 80 style kits and build from there.  But research has shown the builds are not economically sound. This is doubly true when you look at the police trade-in market.  If you are already sitting on a unused Glock slide, the math may change. Anyways, if you've got a question for us, send it in. Gear That Doesn't Suck The days are pretty short now, so it's probably getting time to put some fresh ones in your EDC flashlight. If you use CR123a batteries, these ones on Amazon are a pretty killer deal at less than $2 a battery. The News The National Defense Authorization Act was passed this week. It's 584 pages long, but everyone is really excited about a page and a half that allows the government to sell surplus 1911's through the CMP. It also requires the Air Force to keep a fleet of A-10 Warthogs, so that's cool too. Polymer80 is coming out with a polymer Glock 80% Glock frame. It's kind of cool. I wan't one, but I can't figure out why I want one so bad.  A woman and her husband were robbed at gunpoint while purchasing a car in South Carolina. The woman was able to draw her gun on an already drawn gun and put effective rounds on target.
