A leaked draft of a possible majority opinion presented the possibility of a ruling in the Dobbs v. Jackson Women's Health Organization case negating – effectively overturning – the oft-debated Roe v. Wade decisions due to Constitutional Considerations has caused quite the political row. Despite the knee-jerk emotional reactions from the Far Left and early claims of victory from those who are anti-abortion, the true argument against the 1973 landmark SCOUTS decision is Constitutional: a violation of the 10th Amendment of the US Bill of Rights. Sorry.] I just read a New York Times article titled How Long Should It Take to Give Away Millions? Subtitle: The promise of philanthropy was that the wealthy could enjoy tax breaks for their charitable contributions. The pandemic laid bare how accumulation can trump getting money to those in need. A Senate bill aims to change that. [Boldface emphases in quotes will be mine throughout this post.] It seems that a coalition of stakeholders including policymakers, advocacy groups, and some billionaires essentially has for a while objected to the idea of 'giving later'. For instance, they want to increase per-year spending requirements for foundations, regulate donor-advised funds (DAFs), and close what they perceive to be various loopholes. The participants wanted, among other reforms, to ensure that money stashed in donor-advised funds, which had already earned those donors significant tax savings, ended up in the hands of working charities more quickly. Last summer, Patriotic Millionaires — a group of about 200 wealthy individuals including the Disney heiress Abigail Disney — joined the left-leaning Institute for Policy Studies in asking Congress to double for the next three years the amount of their assets private foundations are required to pay out, to 10 percent. Mr. Arnold, Ms. Madoff and others began recruiting support for proposals to regulate donor-advised funds and to curb practices by private foundations like counting salaries and benefits to family members toward their legal payout requirements. In December, the Initiative to Accelerate Charitable Giving was announced, with the support of big names in the field like the Ford Foundation, the Hewlett Foundation and the Kellogg Foundation. This June, bipartisan legislation along these lines was introduced to Congress, sponsored by senators Angus King (I. - Maine) and Charles E. Grassley (R. - Iowa). The bill would close a loophole in order to speed giving to working charities: Foundations would no longer be able to meet the 5 percent annual payout requirement by giving to a donor-advised fund where there currently is no payout requirement. The bill also would prohibit foundations from counting the salaries or travel expenses of a donor's family members toward the 5 percent minimum. For donor-advised funds, the proposed legislation would require a donor who wanted the full tax benefit right away to ensure that the funds were dispensed within 15 years. If that is too fast a pace, or if donors are focused on giving over a longer time span, they could take 50 years to pay out. But they would need to wait until then to claim the full tax deduction. (I don't know the status of this bill.) I know almost nothing about US tax and nonprofit law. I don't have a good sense of the overall impact it would have on the philanthropy landscape, or on the feasibility of patient philanthropy. In any case it seems clear that the vast majority of giving that might be pushed from later to earlier times was not motivated by EA-style 'giving later' reasons anyway, and that EA-inspired patient philanthropy would at most be a freak casualty. To be very clear, this means that I don't have a considered view on whether or not this bill would be net good, and what share of the reasoning behind it might be sound. I found this article interesting primarily from a political communications, issue framing, and agenda setting perspective. In particular, I thought it was interesting that the discussion (at least as represented by this article) is an arguably muddled mix of empirical concerns about unintended tax loopholes, a perceived linkage to the more general issue of wealth inequality,...

Today on The Leaders' Brief - Last week, the US Senate advanced legislation to boost the country's ability to compete with Chinese technology, as relations between Washington and Beijing continue to deteriorate. The $250 Billion US Innovation and Competition Act of 2021, or USICA saw the 68 US senators voting in favour with 30 against it. The Bill plans to spend $190 Billion to strengthen US technology in general and another $54 Billion to increase the production of semiconductors, microchips, and telecommunication equipment. Tensions between Azerbaijan and Armenia escalated over the last week after the former arrested six Armenian soldiers, accusing them of trying to cross into its territory in the Kelbajar region. Last week, months after a ceasefire treaty between the two nations, the Azerbaijani government said that the Armenian soldiers had “tried to mine supply routes leading to Azerbaijan army positions” and “were surrounded, neutralised and taken prisoner”.  Mali's military released the country's interim president Bah Ndaw and Prime Minister Moctar Ouane, last week. The move came after months of international pressure calling for the country's military government to restore civilian rule. Mali has been under political crisis since August last year, witnessing two coups in a span of nine months. Previously President Boubacar Keita was removed from power by the country's military who received strong support from the country's civilians. However, global powers condemned the incident and placed the country under several sanctions. Brought to you by justcoffee.coop TODAY'S HEADLINES: The Federal Bureau of Investigation busted a plot by right-wing militia members to kidnap a Democratic governor. Who ever could have inspired them? Any guesses? Meanwhile, medical workers around the country are at their wits’ end with coronavirus conspiracy theorists. Again, I ask you, where are people getting such crazy ideas? And lastly, Donald Trump – you remember him – says he won’t participate in any online debates. As a result, Joe Biden is all set to get some free network airtime. THESE ARE THE STORIES YOU NEED TO KNOW: They wanted to ignite a civil war and bring about societal collapse. Instead, they’re headed to federal prison, possibly for the rest of their lives. Federal agents yesterday charged six men in an outrageous plot to kidnap Michigan’s Democratic Governor, Gretchen Whitmer, and put her on trial for treason. Seven more men – members of a right-wing militia called the Wolverine Watchmen – caught state charges in a related conspiracy. Federal agents allege the conspirators twice conducted surveillance at Whitmer's personal vacation home in northern Michigan. The Detroit News reports that through confidential sources, undercover agents and clandestine recordings, federal agents tracked the six men during their planning to kidnap Whitmer as they communicated over encrypted messaging platforms using code words and phrases in an attempt to avoid detection by law enforcement. The group also allegedly participated in field exercises that included detonating an improvised explosive wrapped in shrapnel to test its capabilities. The FBI and state police arrested several of the conspirators when they were meeting on the east side of the state to pool funds for explosives and exchange tactical gear, the News reports. The federal investigation dates to early 2020 when the FBI learned through social media that individuals were discussing the violent overthrow of several state governments. According to the FBI, the group talked about creating a society that followed the US Bill of Rights where they could be self-sufficient. Addressing the foiled plot, Whitmer said QUOTE I knew this job would be hard. But I’ll be honest, I never could have imagined anything like this ENDQUOTE. She also suggested Trump’s rhetoric made him effectively complicit. Joe Biden echoed that idea, asking QUOTE Why can’t the president just say stop, stop, stop, stop? ENDQUOTE. Trump campaign official Jason Miller on Fox News yesterday attacked Whitmer, saying she wakes up everyday with hatred in her heart towards Trump. Back in April, when armed right-wing militia took over the state capitol of Lansing, Trump tweeted liberate Michigan. I guess people were listening. Coronavirus disinformation frustrates doctors Doctors and nurses across the country are frustrated and overwhelmed by members of the public who’ve swallowed various conspiracy theories about the coronavirus. It’s a problem that many worry will get even worse now that Trump is promoting the experimental treatment he received at Walter Reed hospital as another miracle cure, and telling people not to be afraid of the virus. Nurse Amelia Montgomery of Springfield, Missouri, shared her frustrations with the Associated Press. She complained that some people demand the anti-malaria drug hydroxychloroquine and think the only patients who get really sick have underlying health problems. To be clear: that isn’t true. Doctor Jay W. Lee, a family physician in Orange County, California, recalled a patient who demanded QUOTE the largest hydroxychloroquine prescription you can give me ENDQUOTE. The problem is pronounced in red states, the AP reports. In Iowa, home health nurse Lisa Dockery was fired from her job caring for a boy with severe disabilities after arguing with his parents, who said Covid-19 is a hoax. The argument started because the parents refused to wear masks, even though she told them their son’s life was in danger because he has respiratory problems, relies on tube feedings and cannot walk. The case ended with a judge ordering her former employer to pay her unemployment. In Georgia, at Augusta University Medical Center, visitors have tried to get around the mask requirement by wearing face coverings made of fishnet and other material with visible holes. The hospital calls this malicious compliance. People also have shown up with video cameras in an attempt to collect proof the virus is a hoax. Doctor Phillip Coule, chief medical officer at the Augusta health system, contracted the virus in July and has seen two staff members die. He said he fears people may draw the wrong lesson about the seriousness of the disease from what happened to Trump, and may extrapolate that the risk for a seventy four-year-old is low when the opposite is true. As another doctor put it, per the AP, it’s an info-demic as well as a pandemic. And, as with his rhetoric encouraging violent right-wing extremism, it’s a problem Trump could put a stop to, if only he wanted to. Biden gains free airtime The next presidential debate was scheduled for next Thursday, October 15th, in Miami, Florida. Now it’s not clear whether the debate will be happening at all. The Commission on Presidential Debates, which organizes the events, said it would change course and hold the second debate remotely in order to protect the health and safety of all involved. In response, Trump yesterday morning told Fox News QUOTE I'm not going to waste my time on a virtual debate... they cut you off whenever they want ENDQUOTE. Someone is cranky about being asked to follow the rules! In turn, Joe Biden’s campaign said the event should be pushed back to October 22nd, so that the president is not able to evade accountability. The Trump campaign seemed open to that idea, but then wanted to schedule a third debate for October 29th – five days before the election – which the Biden campaign rejected. Producers at ABC News reportedly finalized plans for the Biden town hall yesterday after Trump withdrew from the debate. So as of now, Trump’s refusal to play by the rules has resulted in significant free airtime for Biden. The Democratic candidate observed yesterday that Trump QUOTE changes his mind every second ENDQUOTE. Yup, and at this stage of the presidential race, Trump’s indecision clearly works to Biden’s advantage. AND NOW FOR SOME QUICKER QUICKIES: Police in Portland, Oregon, targeted street medics with teargas and projectiles during summer protests, in what a new report by Physicians for Human Rights calls indiscriminate attacks. The Guardian says the human rights group found a pattern of cruel, inhuman, or degrading treatment from Portland police and federal agents, violating several international compacts on the use of force, and arguably constituting torture. The police offered no substantive reponse. Actions speak louder, anyway. Hurricane Delta is set to make landfall in Louisiana today not far from where Hurricane Laura hit in late August. Delta is the tenth named storm of the season – that’s a new record for a single year. More than a dozen Louisiana cities and parishes called on residents to evacuate. Take care out there. Prominent Republican fundraiser Elliott Broidy has been charged in an illegal lobbying campaign aimed at getting the Trump administration to drop an investigation into the multibillion-dollar looting of a Malaysian state investment fund, the AP reports. He was working on behalf of a fugitive Malaysian financier, Jho Low, and sought to arrange meetings with both Trump and former Attorney General Jeff Sessions. Broidy faces a single conspiracy charge related to his failure to register as a foreign agent. Oopsie! NBC News reports that House Speaker Nancy Pelosi plans to introduce legislation today that would create a Commission on Presidential Capacity, which would be involved in presidential transfer of power procedures under the 25th Amendment to the Constitution. People I respected have suddenly stopped seeking perspective from both sides of an issue; stopped caring about whether what they are buying into is true and unmanipulated, and are full-throatily engaged in advancing political vomit as truth; ideological propaganda as fact. We, as a society – and this includes my circle, large that it is – have mistakenly misconstrued the easy of communicating our opinions with advocating provable truths.And before you knee-jerk assign me a label, know that I am just as severe on the elitists of the Right as I am on the oligarchs of the Left. Progressives exist on both sides of the aisle and their goals are the same: harness the emotions of the people to divide, advance opportunistic propaganda based on half-truths and manipulated innuendo, and attain power amongst the chaos. Both sides are guilty of it and for that fact, both sides are to blame.But that does not absolve us from our responsibility to see through the fog of politically charged misinformation, to do that we must dispense with the usual suspect media and start going to sources to read white-paper facts on issues and situations. We must have the courage to call people out when they advance media-driven propaganda and confront power when the elitists in control use emotional knee-jerk to manipulate the people into divide.No one gets a pass. If you post something that I have found, through my studies of both sides of an issue (and that study goes far beyond the mainstream media rags that do nothing but sensationalize headlines for profit) to be false, misleading or ridiculously conspiratorial I am going to call you on it and I am forewarning everyone, family and friends, that I am finished being polite about it.For 22 years I have been polite about explaining the information I have discovered, tested, and confirmed, and for some reason, today, because everyone has a Facebook account, opinions trump facts. This cannot and will not stand.So, for the record:▪ I am a constitutionalist and not one who only values the Charters of Freedom when it is advantageous. I do not riot if my candidate doesn’t win. I do not loot when the media snaps its fingers. And I do not automatically believe that because someone thinks differently than me that he or she is an asshole. That moniker is saved for when that person proves him or herself to be an asshole.▪ I do my research before I espouse my opinion. My research takes me to as many vantage points as possible because it is always important to understand all sides of an issue. Because of that, I can almost always easily spot someone who is spewing the boilerplate propaganda; the person who didn’t take the time to try to figure out why someone with an opposing viewpoint may have a legitimate beef. These are the people – the people who read the headline and believe they have read the article, study, or thesis – who, in my book, are lower than whale shit. I do not suffer the arrogance of these people.▪ Wannabe wonks are a little lower than the whale shit level espoused above. If you are an ideological sycophant who believes that just because you read a few books by your favorite political author that you are a political academic, you are a dangerous kind of useless to me. Unless you read, respected experts – not activists, experts – from all sides of an issue I can only see you as partisan. Don’t tell me you “know what Americans want or think” when you have only looked East.▪ I am not, repeat not, sympathetic to the Progressive cause. I believe Progressives are a threat to the Republic’s existence and I will work every day of my life to oppose each goal they have set forth. I recognize the damage they have done, and I believe their supporters are just as guilty of sins against Americanism as their leaders. I wholeheartedly see Progressives as Fascists by definition, not because of the ideas they never think through, but because of the intolerant and totalitarian actions that prove them to be just that.▪ I believe that Political Correctness is a tool of the Progressives meant to shadow the US Bill of Rights. I believe that embracing political correctness is tantamount to declaring aggression against the US Bill of Rights and the total of the Charters of Freedom and, thus, an attack on freedom itself.▪ In my world travels, I can testify to an inarguable fact: There are a lot of socially inept, politically ignorant, and intellectually challenged millionaires. Monetary success does not equate to intelligence and financial station does not impress me, in fact, in many cases – not all, but quite a few – the arrogance wafting from the sphere of the financial elite is pungent. Check your financial arrogance before you mistake wealth for intelligence.▪ As much as my detractors would love to call me a racist, Islamophobe, xenophobe, and any other kind of “phobe” you can craft, these labels mean nothing to me because I know them not to be true. My actions have proven these labels to be inapplicable. So, when your arrogance leads you to an intellectual corner where you must rely on name-calling and label granting, just know in your heart of hearts that you have lost the debate. A true intellect would try to educate him or herself when they have had their asses handed to them intellectually, but in our era of arrogance, most people haven’t the courage to admit they were wrong.I could go on but those who have read to this point get it.At this point, if you are offended then de-friend me. If you are offended, you never really did know me and absolutely don’t know me now. So, do us all a favor and cull yourself from the herd.
