This episode explores the 1987 murder of Michelle Schofield and the wrongful conviction of her husband, Leo. Despite no physical evidence linking him to the crime, Leo was sentenced to life. Years later, fingerprints from the crime scene matched a convicted murderer who confessed to Michelle's killing. Despite the confession, courts repeatedly rejected it. The episode details the tireless efforts of Leo's wife and the Innocence Project of Florida to free him, culminating in his parole after 36 years, and his shocking conversation with the man who admitted to killing Michelle. --For early, ad free episodes and monthly exclusive bonus content, join our Patreon!

Today, we're talking about the controversial Innocence Project and how it has been undermining true justice in the interest of social justice. We go over the horrifying crimes of Robert Roberson and the Innocence Project's claims that he was wrongfully convicted of the murder of his daughter, Nikki Curtis. We also dive into other cases the Innocence Project has championed in its effort to abolish the death penalty altogether, regardless of the overwhelming evidence against the convicted individuals. The truly innocent victims deserve better than the Innocence Project defending those who hurt them. We cover the tactics the Innocence Project uses to garner empathy from the public and discuss how to stand up against these lies. Share the Arrows 2025 is on October 11 in Dallas, Texas! In a stunning turn, Judge Kubota orders the release of long-hidden evidence, shaking the very foundation of the case against Ian and Shawn Schweitzer. The fight for justice takes a shocking turn. As Ian and Shawn Schweitzer return to court, the prosecution refuses to acknowledge the truth—even in the face of undeniable DNA evidence. A DNA match. A suspect identified. A chance for long-overdue justice. But instead of an arrest, the investigation takes a shocking turn. With Hawai'i PD refusing to act, and prosecutors refusing to acknowledge the full weight of the evidence, the truth hangs in limbo. The system that once rushed to convict Ian and Shawn Schweitzer now drags its feet when faced with the real perpetrator. And then—before any charges can be filed—the suspect takes his secrets to the grave. What happens next will determine whether justice is finally served… or buried along with him.__You can view the materials referenced in this episode at https://threepodcast.com/chapter-6-unknown-male-1Please consider donating to Ian's GoFundMe at https://www.gofundme.com/f/help-ian-schweitzer-after-wrongful-conviction. The DNA never lied. It never pointed to Ian, Shawn, or Frank—but to someone else entirely. As forensic experts unravel the evidence that put three innocent men behind bars, the case against them crumbles. The DNA, the tire tracks, the so-called bite marks—junk science and misplaced certainty stole decades of their lives. Dr. Jan Canty is a Detroit native, seasoned psychologist, author, speaker, educator, and host of the Domino Effect of Murder podcast. With over four decades of experience in the mental health field, she holds a terminal degree in psychology and completed a post-doctoral fellowship in family therapy at Wayne State University School of Medicine. In July 1985, Jan's life took a tragic and unexpected turn when her husband of 11 years went missing. A week later, she was called to the Detroit Homicide Division and informed he was the likely victim of a violent crime. His body was later identified at the Wayne County Morgue, marking the beginning of a 30-year chapter of private grief and survival. Jan quietly relocated to the Midwest, where she continued teaching psychology while keeping her personal story hidden. After decades of silence, she now shares her experience to help others navigate the complicated aftermath of homicide and violent loss—both through a professional lens and as a survivor herself. Today, she hosts the internationally heard podcast Domino Effect of Murder, now in its sixth season and reaching listeners in over 22 countries. She's also the author of A Life Divided, a personal memoir, and What Now? Navigating the Aftermath of Homicide and Suicide, a comprehensive guide for survivors. Her upcoming book, Rekindled: Healing Grief, will explore the science and stories of after-death communication. By 1996, because of pressure from Dana Ireland's family and the media and the want to close this case for good, the police decided to send the case to prosecutors—despite DNA evidence excluding Ian and Shawn Schweitzer, as well as Frank Pauline Jr. But as the public scrutiny grows, so do the lies. Frank, hoping for leniency, spins a series of contradictory stories to the police and the press—before ultimately recanting on live TV and accusing the police of coercing his confession. In Chapter 4, Amanda Knox, drawing from her own experience, exposes how flawed science, false testimony, and prosecutorial egos can turn a weak case into a nightmare conviction.---You can view the materials referenced in this episode at https://threepodcast.com/chapter-4-the-prison-priestPlease consider donating to Ian's GoFundMe at https://www.gofundme.com/f/help-ian-schweitzer-after-wrongful-conviction. Despite a lack of forensic evidence, Ken Lawson of the Hawai'i Innocence Project helps break down how police tunnel vision and media pressure led to the brothers' wrongful imprisonment and the battle to clear their names.---You can view the materials referenced in this episode at https://threepodcast.com/chapter-3-family-feud Please consider donating to Ian's GoFundMe at https://www.gofundme.com/f/help-ian-schweitzer-after-wrongful-conviction. On Christmas Eve in 1991, Dana Ireland is found tucked away in a secluded, hard to get to area of the Hawaiian subdivision Vacationland, barely clinging to life. When she finally arrives at a Hilo hospital, the damage is too severe and they declare Dana dead at 12:25am on Christmas morning. In 2023, the audiochuck team set out to tell you the story of what happened to Dana Ireland and how three men were convicted of her murder. Then in 2024, everything changed. In Chapter 1, Amanda Knox takes you through everything that happened on December 24th, 1991 and why this story is very different from the one we were originally going to tell you. In a place where everyone knows everyone, during the early days of the investigation, police have no shortage of tips. Soon they turn their attention to three potential suspects: Frank Nasario, Anthony Torres and Roy Santos…but only a few months later, any hope that this case would be open and shut is dashed; none of the men's DNA matches what was found on Dana Ireland or at the scene. Then, just when the Hawai'i Police Department think they have no other leads to explore, they conveniently get a phone call implicating who this man says are the real people who killed Dana Ireland.---You can view the materials referenced in this episode at https://threepodcast.com/chapter-2-the-aftermath/Please consider donating to Ian's GoFundMe at https://www.gofundme.com/f/help-ian-schweitzer-after-wrongful-conviction. It's time for part 2 of our Death Penalty series! Since this is a Mormon podcast, we first look into the history of Mormons and the death penalty. Joseph Smith and Brigham Young both ordered assassinations and fostered environments where random acts of violence became inevitable. The State of Deseret, Utah, has a comparatively bloody, theocratic history. Then we take a broader view of religion and capital punishment. After that, we look into the ethics/morals of capital punishment and give you a look at the Innocence project. We wrap by discussing your responses from Survey #1 as well as our own viewpoints on the subject. Survey #2: After listening to these episodes, we'd like to hear if your insights or opinions have changed and how. https://forms.gle/Vjn48xzWgCWcJR8r8 Show Notes: Trump v United States: Oral argument on the former president's immunity claim: https://www.c-span.org/program/public-affairs-event/trump-v-united-states-oral-argument-on-the-former-presidents-immunity-claim/640481 23-939 Trump v United States (7/1/2024) https://www.supremecourt.gov/opinions/23pdf/23-939_e2pg.pdf Account of hearing between circa 3 and 9 June 1837 state of Ohio v Joseph Smith for threatening to take life: https://www.josephsmithpapers.org/paper-summary/account-of-hearing-between-circa-3-and-9-june-1837-state-of-ohio-v-js-for-threatening-to-take-life/1#facts Joseph, in the Elder's Journal, discusses the Kirtland Bank and Warren Parrish and Grandison Newell's charges against hi: https://bhroberts.org/records/5tcqZf-vSQSfc/joseph_in_the_elders_journal_discusses_the_kirtland_bank_and_warren_parrish_and_grandison_newells_charges_against_him Orson Hyde, Life lessons learned: https://rsc.byu.edu/vol-3-no-2-2002/orson-hyde-life-lessons-learned Danites: https://www.josephsmithpapers.org/topic/danites Danite Manifesto: https://en.wikisource.org/wiki/Danite_Manifesto The Danite Constitution and Theories of Democratic Justice in Frontier America: https://scholarsarchive.byu.edu/cgi/viewcontent.cgi?article=5074&context=byusq Journal of Mormon History Vol 30, No. 2, 2004: https://digitalcommons.usu.edu/cgi/viewcontent.cgi?article=1043&context=mormonhistory General Smith's views of the powers and policy of the government of the United States circa 26 January - 7 February 1844: https://www.josephsmithpapers.org/paper-summary/general-smiths-views-of-the-powers-and-policy-of-the-government-of-the-united-states-circa-26-january-7-february-1844/12#full-transcript Journal of Mormon History Vol 33, No 1, 2007: https://digitalcommons.usu.edu/cgi/viewcontent.cgi?article=1049&context=mormonhistory The Coming Storm: The murder of Jesse Thompson Hartley: https://user.xmission.com/~research/mormonpdf/storm.pdf The wound the never healed: https://www.prestopreservation.com/uploads/5/2/5/3/52533793/morrisite_story_small.pdf Official position on capital punishment of the Church of Jesus Christ of Latter-Day Saints: https://newsroom.churchofjesuschrist.org/official-statement/capital-punishment The Movement to Abolish Capital Punishment in America 1787-1861: https://www.jstor.org/stable/1847110?read-now=1&seq=8 “Caedite eos. Summary of Criminal Procedure – Lecture 3 Introduction Lecture 3 focuses on constitutional protections in criminal proceedings, covering the Fifth and Sixth Amendments and pretrial and trial procedures. Key Topics: Fifth Amendment: Protection against self-incrimination, Miranda warnings, and double jeopardy. Sixth Amendment: Right to counsel, a speedy trial, an impartial jury, and confrontation of witnesses. Pretrial & Trial Procedures: Grand juries, bail, plea bargaining, discovery, burden of proof, sentencing, and post-conviction relief. I. The Fifth Amendment Protects individuals from coerced confessions and multiple prosecutions. A. Miranda Rights & Custodial Interrogation Miranda v. Arizona (1966): Suspects must be informed of right to remain silent and counsel. Failure to provide warnings may make confessions inadmissible. Exceptions: Public safety, spontaneous statements, and routine booking questions. B. Voluntary Confessions & Self-Incrimination Confessions must be voluntary—coercion makes them inadmissible. Exclusionary rule bars evidence obtained in violation of Miranda. Privilege against self-incrimination applies only to testimonial evidence. C. Double Jeopardy Prohibits multiple prosecutions or punishments for the same offense. Exceptions: Separate sovereigns doctrine, mistrials, and appeals. II. The Sixth Amendment Guarantees fair trial rights. A. Right to Counsel Gideon v. Wainwright (1963): Indigent defendants must be provided counsel. Applies at all critical stages, including plea negotiations and sentencing. Strickland v. Washington (1984): Defendants may claim ineffective assistance of counsel. B. Speedy & Public Trial Barker v. Wingo factors: Length, reason, defendant's assertion, and prejudice. Speedy Trial Act (1974): Federal trials must start within 70 days. C. Impartial Jury Batson v. Kentucky (1986): Prohibits racial discrimination in jury selection. Ramos v. Louisiana (2020): Criminal convictions require unanimous verdicts. D. Confrontation Clause Right to cross-examine witnesses. Bruton v. United States (1968): Co-defendant's confession cannot be used against another defendant. Maryland v. Craig (1990): Limited exceptions for child victims. III. Pretrial & Trial Procedures Focuses on probable cause, bail, plea deals, burden of proof, and sentencing. A. Grand Juries & Bail Grand juries determine probable cause, but defendants cannot present evidence. Bail must not be excessive (8th Amendment); based on flight risk, crime severity, and public safety. B. Plea Bargains & Discovery Most cases resolve through plea deals. Brady v. Maryland (1963): Prosecution must disclose exculpatory evidence. C. Burden of Proof at Trial Prosecution must prove guilt beyond a reasonable doubt. Direct vs. Circumstantial Evidence: Direct = witnesses, videos; Circumstantial = motive, behavior. D. Sentencing & Post-Conviction Relief Mandatory minimums limit judicial discretion. Death penalty restrictions: Roper v. Simmons (2005) bars execution of juveniles. Appeals & Habeas Corpus: Review constitutional errors. Wrongful Convictions: DNA evidence & Innocence Project help exonerate the falsely accused. Conclusion Today covered constitutional protections, trial rights, and post-conviction remedies. These safeguards ensure fairness, prevent wrongful convictions, and protect due process. Tomorrow, we will examine criminal appeals and habeas corpus petitions.
Today, it is estimated that approximately 3 percent of incarcerated people in the United States are innocent. Thankfully, there are Innocence Projects across the country who are dedicated to investigating and litigating claims of innocence. Without them, these innocent people would have no path to exoneration. In this episode, I sit down with Jason Gichner, the Executive Director of the Tennessee Innocent Project. Since its founding in 2019, the Tennessee Innocence Project has won 9 exonerations, representing more than 230 years collectively served for crimes these people did not commit. The Tennessee Innocence Project's 9 exonerations also represent 25% of all known exonerations in the history of Tennessee and they have achieved all of this in just 5 years. In our conversation, Jason and I talk about the factors that lead to innocent people being convicted. We discuss specific cases of their clients like Ricky Lee Webb, who served a 47-year sentence (the 4th longest in the history of the U.S.) for a murder he did not commit. Jason and I talk about how the Tennessee Innocence Project does its work and what new laws and policies could be put into effect in both Tennessee and nationwide to help prevent innocent people from being incarcerated. The Innocence Project is such an important organization. As Jason said in our conversation, this is a political issue – no one wants innocent people behind bars. I hope you will find this episode inspiring, and you'll want to learn more about what we all can do to help support their important work. If you enjoy the show, please rate and review. In 2012, a shooting near USC left 4 people injured—but no one killed. Despite this, Brandon Spencer, a young man from Inglewood, was sentenced to 40 years in prison. What makes his case even more complicated? He has always maintained his innocence. Just two months earlier, two foreign exchange students were tragically killed at USC, and the pressure to solve that case was mounting. Brandon's journey behind bars has been anything but easy. Over the last decade, he has worked to go from a level 4 to a level 2 prison, and he's spent that time working relentlessly to prove his innocence. Now, he's teamed up with the Innocence Project, hoping to get his case re-examined. I had the chance to speak with Brandon from prison, where he shared his story.
Tricia Rojo Bushnell is the executive director of the Midwest Innocence Project. She joined KCUR's Up To Date to for our new series "5 Questions" to discuss what she's reading, streaming and more.
Alex Welch is not a fan of The Innocence Project. In today's episode he describes why. Episode recorded 12/30/2024.

Since releasing the 500th episode of Wrongful Conviction earlier this month, we thought it appropriate to spotlight some episodes from the very first season of Wrongful Conviction. On the afternoon of November 4, 1986, the body of an African-American woman was found lying under a blanket near a busy highway in Brooklyn, NY. She had been strangled to death. A witness told Detective Louis Eppolito that he had been jogging on the day of the crime and had seen a white man and a black woman sitting in a gray car parked by the highway. The man said he then watched the white man walk to the passenger side of the car and pull out a body, lay it on the ground and place a blanket over it. Eppolito learned that Barry Gibbs knew the victim and closed in. Barry was charged and convicted of second-degree murder primarily on the testimony of the jogger who later recanted. Jason Flom, Barry Scheck (Co-Founder of The Innocence Project) and Vanessa Potkin (Director of Special Litigation for The Innocence Project) sit down with Barry Gibbs as he details his unfathomable odyssey. Sandra Hemme, is the longest known wrongfully convicted woman in the United States. Sandra was just 20 years old when she was found guilty of the murder of Patricia Jeschke, despite no solid evidence that she committed the crime. She didn't know the murder victim, there were no witnesses, and no DNA evidence ever connected to her. We will give you all the information on Sandra, Patricia's murder, Sandra's conviction and exoneration, and maybe most shockingly of all, the person suspected of being Patricia's true killer. How does someone convicted of such horrific crimes find a path to justice, especially when the system itself seems riddled with holes? Richard Allen's fate appears sealed behind bars, yet the appeals process introduces the potential for new evidence to come to light. The question is, how high does that bar need to be? Comparisons are made to cases like Scott Peterson, where Innocence Project involvement could spark a new trial if compelling evidence emerges. But in Allen's case, disturbing questions linger: Was the investigation botched, and are digital traces from figures like Keegan Kline waiting to be uncovered? Could the refusal to admit certain evidence in court have a second chance as "new" material in appeals? With alternate suspects and missed opportunities, it feels like there's a whole web of forgotten leads. The saga only grows more infuriating as you peel back the layers of oversights and poorly handled threads. How much more will it take for someone to say, “Wait, did we really look into *all* of that?” #justiceforvictims #truecrime #innocenceproject #richardallen #delphimurders #newtrial #darktruths Want to listen to ALL of our podcasts AD-FREE? What happens when a case is loaded with more theories than an amateur true crime detective's conspiracy board? Richard Allen's case might be the best example of this chaos in action. Was there something to the infamous Odinism theory, or did it sound like one too many plot twists in a bad horror flick? The defense never got to argue that angle, but would it have helped if the murders were framed as ritualistic cult killings without the Viking baggage? Or would it have just made jurors roll their eyes and tune out? Consider the other oddities: The police sketches don't look like Allen at all. Witness descriptions peg the suspect as taller than Allen, who stands at a modest 5'4”. And then there's the troubling impact of solitary confinement. The effects of isolation could turn anyone's mind inside out, and Allen's mental state post-confinement was so shattered he was eating Bible pages. But before that? He was a seemingly ordinary man coming off a shift at CVS. And what about the families of the victims? Do they feel justice has been served, or does this feel like trying to jam a square peg into a round hole? The possibility of appeals looms large, and the Innocence Project may even be circling this case. Will they find enough inconsistencies to overturn the outcome? What do you think? Is this case truly closed, or is it just the beginning? #TrueCrime #HiddenKillers #RichardAllen #OdinismTheory #SolitaryConfinement #InnocenceProject #JusticeForVictims Want to listen to ALL of our podcasts AD-FREE? Last week, the Supreme Court heard oral arguments in Glossip v. Oklahoma, a case challenging the constitutionality of Richard Glossip's conviction and sentencing to death for a 1997 murder. In this episode, Paul Cassell of the University of Utah and Andrea Miller of the Oklahoma Innocence Project join Jeffrey Rosen to recap the oral arguments and debate whether or not Glossip's conviction should stand in light of newly revealed documents that allegedly suggest prosecutorial misconduct. This week hosts Tiffany Cross, Angela Rye, and Andrew Gillum cut through the media fog around Brett Favre's testimony to Congress. No, he was not summoned to Congress to testify about his Parkinson's diagnosis, as the headlines might have you believe (we wish him the best). In fact, he was there to explain his alleged misuse of welfare funds. While Mississippi failed to provide TANF benefits (AKA welfare) to its poorest residents, Favre managed to receive funding for speeches, volleyball stadium, and a startup from the same pool of funding. While he has yet to be punished, the woman who broke the story is facing JAIL TIME! In even more somber news, the hosts reflect on the state-sponsored lynching of inmate Marcellus Williams. In the lead up to his execution, the victim's family members, the non-profit group The Innocence Project, and even local prosecutors pleaded for a stay of execution, but the state of Missouri killed him anyway. This is America y'all, our hearts go out to the families. Check out The Innocence Project at innocenceproject.org and help them in their mission to prevent wrongful convictions. And we close the show with a heated discussion sparked by Whoopi Goldberg's defense of Janet Jackson, after she made false comments about Kamala Harris's ethnicity. Should celebrities be commenting on current events, and how do they do so responsibly? Our hosts offer differing opinions. And of course we'll hear from you, our #NLPFam listeners.
