The Washington Capitals have signed forward Ryan Leonard to a three-year, entry-level contract, effective immediately, which has an average annual value of $950,000 and extends through the 2026-27 season. Leonard, who was drafted eighth overall in the 2023 NHL Draft, is set to make his NHL debut against the Boston Bruins. At just 20 years old, he brings significant energy to the Capitals, who are focused on the Stanley Cup Playoffs. His impressive collegiate career at Boston College saw him record 60 points in his freshman year and lead the NCAA with 30 goals in his second season, earning him multiple accolades, including recognition as the Hockey East Player of the Year.Leonard has also made a mark internationally, helping Team USA secure gold at the IIHF World Junior Championships in both of the last two years and was named MVP this past January. He has a connection to the number 9, which he wore during his time at Boston College and with Team USA, possibly influenced by his brother, John Leonard, who also wore that number in college. Head coach Spencer Carbery has been following Leonard's progress closely and remains supportive as Leonard navigates the challenges following his team's recent loss in the NCAA Tournament.Use code MINUTECAST - $20 off your first SeatGeek order:https://seatgeek.onelink.me/RrnK/teamseatgeekCrush your New Life resolution with Righteous Felon Jerky 15% off with promo: MINUTECAST https://www.righteousfelon.com/?ref=MINUTECAST

At the height of the Cola Wars in the mid-90's, Pepsi committed one of the most notorious PR and marketing fiascos of all-time. An eye-catching spot promised brand fans that, if they saved up 7 million Pepsi Points, they could win a Harrier fighter jet. However, no one at Pepsi or their ad agency ever expected anyone to try to claim that prize. And when Washington business school student John Leonard did, they faced a multi-year legal battle and a storm of negative publicity. Now, almost three decades later, another beverage company has spoofed that infamous campaign—with a twist. Canned water brand Liquid Death actually bought a jet for one lucky fan to win, and executed a wildly successful promotion to support the contest. So in this episode, we're talking to Liquid Death VP of Creative Andy Pearson about the logistics of making that happen. We discuss Liquid Death's unique approach to marketing, his creative influences, and why they would even want to try to recreate the publicity stunt that lost Pepsi the Cola Wars. And with Jeff Beer from Fast Company, we explore the background and takeaway lessons of the Pepsi Harrier Jet fiasco.  Learn more about your ad choices. Visit megaphone.fm/adchoices

Biometric data is big business. It many cases it even helps make our lives better.  It also presents  significant risks for a variety of parties, in addition to those of us who surrender our data. Companies collecting,  storing, utilizing, and monetizing the data face penalties and litigation bolstered by the increasing number of states enacting biometric information privacy acts, or BIPAs, the first of which was in Illinois. Biometric information --  fingerprints, facial and retinal scans, and DNA -- it's all used in many ways we don't even think about, like building security, banking access and online payments, smartphone access, patient identification in healthcare, employee tracking, law enforcement, air travel security and hotel check-ins, consumer tracking and customer experience analysis, border security, validating recipients of government welfare benefits, identifying students taking exams, and more. I just finished hosting a webinar titled “Litigation After Biometric Privacy Law Violations” with attorneys John M. Leonard and Cort T. Malone of Anderson Kill. They spoke extensively about the state of biometric privacy litigation, the regulatory landscape,  insurance coverage considerations, and recent rulings. They're both shareholders at Anderson Kill and they are both graduates of the Fordham University School of Law. John M. Leonard is co-chair of the firm's biometric liability group. He has recovered millions of dollars for policyholders in a full spectrum of insurance coverage matters, including disputes over business interruption, D&O and E&O, defense and indemnity, general liability losses, and environmental liability. Cort T. Malone, chair of the firm's Biometric Liability Insurance Recovery Group, is an experienced litigator who focuses on insurance coverage litigation and dispute resolution, with an emphasis on commercial general liability insurance, cyber insurance, employment practices insurance, advertising injury, D&O, E&O, and property insurance. He's also a member of the firm's practice groups relating to restaurant, retail and hospitality; environmental law; cyber insurance recovery; and COVID litigation. Following the webinar (coming soon to the West LegalEdcenter), Cort and John stuck around to answer some of my questions about a couple of recent cases I thought illustrated the types of underlying and coverage matters we're seeing out there. I hope you enjoy it. *******This podcast is the audio companion to the Journal of Emerging Issues in Litigation. Happy reading! Kelly PS: Do you have trouble sleeping? If so, I highly recommend Nothing Much Happens, Bedtime Stories for Grown-ups by Kathryn Nicolai. Apparently, Kathryn also lives in Michigan. I don't know her, but I'm obsessed with these bedtime stories because they are designed to put you to sleep, and her voice is very soothing, but they are also wonderful. PSS: I have to give one television show a plug...I was listening to a podcast featuring a former classmate from Kenyon, and she suggested a Swedish show called The Restaurant. IT IS SO GOOD. It's winter here in Detroit, and bleak bleak bleak, so I figured, like me, you might want to light some candles and curl up with a good drama. This one is cutting into my reading time, which is the highest praise from me. Let me know what you think!! Leigh Newman: Leigh Newman's collection Nobody Gets Out Alive (Scribner) was long-listed for the National Book Award for Fiction and The Story Prize. Her stories have appeared in the Paris Review, Harper's, Best American Short Stories 2020, Best American Mystery and Suspense 2023, Tin House, McSweeney's Quarterly Concern, One Story and Electric Literature, and have been awarded a Pushcart prize and an American Society of Magazine Editors' fiction prize. Still Points North (Dial Press), her memoir about growing up in Alaska, was a finalist for the National Book Critic Circle's John Leonard prize. In 2020, she received the Paris Review's Terry Southern Prize for “humor, wit, and sprezzatura." Newman's essays and book reviews have appeared in The New York Times, Bookforum, Vogue, O The Oprah Magazine, and other magazines. When not writing, she looks after her two dogs, two kids, and one cat. Goals include: goats and more chickens. In this episode, Matt and Sam welcome the Nation's Jeet Heer to the podcast to continue their journey into the work of Garry Wills—in particular, Wills's under-appreciated 1982 masterpiece, The Kennedy Imprisonment: A Meditation on Power. The book might be thought of as a sequel to his earlier Nixon Agonistes (1970). As Wills puts it in his introduction to the most recent edition of The Kennedy Imprisonment, "I had written a book about Nixon, and it was not a biography, but an attempt to see what could be learned about America from the way Nixon attracted or repelled his fellow countrymen. Why not do the same thing for the Kennedys?"The result of Wills's efforts is a devastating portrait of an Irish-Catholic family who strove to be accepted at the most rarified heights of American society—and then, when they weren't, relentlessly pursued political power. Along the way, the family patriarch, Joseph Kennedy, used his money and influence to create a series of myths surrounding his sons, most of all the son who would become president, John F. Kennedy. It is these myths at which Wills takes aim, showing how Joseph Kennedy bought his second son good press, a heroic war record, and even a Pulitzer Prize. And it was Joseph Kennedy who taught his sons what was expected of them as men: to use and dominate women (many, many women), to valorize virility and daring and risk, and to understand power as enlightened leadership by the best and brightest (most of all, the Kennedys), not as harnessing the popular energy of mass movements. What begins as a book exposing the Kennedy men as wannabe aristocrats bent on conquest, both sexual and political, ends as an indictment of the liberalism they came to represent.Sources:Garry Wills, The Kennedy Imprisonment: A Meditation on Power (1982)Garry Wills, Nixon Agonistes: The Crisis of the Self-Made Man (1970)Garry Wills, Bare Ruined Choirs: Doubt, Prophecy, and Radical Religion (1972)Joan Didion, "Wayne at the Alamo," National Review, Dec 31, 1960Hugh Kenner, The Mechanic Muse (1988)Hugh Kenner, The Pound Era (1971)Richard E. Gabe and Dave Eggers have been friends for the last 25 years: since Dave first popped up on the national stage, with his memoir, A Heartbreaking Work of Staggering Genius. And his indie publishing juggernaut: McSweeney's.  This interview is, in part, to support Dave's new novel, The Eyes and the Impossible. A novel that's for all ages. And for the ages. This book is written in the first person, from the perspective of a dog named Johannes. (Go ahead, take a second to reread that last sentence.) This book is wondrous, beautiful, hilarious, and somewhat heartbreaking. It also has gorgeous illustrations. And some editions have a wooden cover. Dave Eggers quotes On having lunch with Kurt Vonnegut Gabe: Vonnegut was obsessed with the idea, and I know you know this because I have always known that you love him, too –Dave: I met him.Gabe: You met him? Well can you tell me about that?Dave: in New York. His wife, Jill Krementz, reached out and she was a photographer. So she did a photo thing of me in Central Park. And she said, Oh, you know, you've got to come over. And it was a lunch, I think, in their house in the twenties. And it was me. This was 2002. And it was me and Colson Whitehead and, I think John Leonard. And then there was a jazz writer. And then Vonnegut and Jill. And what was funny was… (click the above podcast device to hear the rest)On early McSweeney's event with David Byrne We did one “happening” in San Francisco at a place called Cell Space. Which is this cavernous sort of event hall slash living environment. It was like a pirate ship, with people living in the rafters and under the stage. It was really old timey San Francisco hippie space, but most of the people there were youngish. And we had an event there where David Byrne might have been out here for his book, The New Sins, that we published. We said it would be a panel. And it was Byrne and I on the panel. And then we got an FBI agent, who I don't know why or who he was. I can't remember how we found him. And then a local professor who was an expert on ancient Sumerian iconography, I think. And we planted a bunch of people in the audience, so that the Q&A – because I think we went straight to Q&A – was all directed to the Sumerian iconography experts. So that you have David Byrne sitting there, silent, for an hour. Because every last question was somebody like, “Well, in AD 540, the Sumerian, poet…” We had all of these questions written by the expert himself beforehand. And then the whole thing ended, we had booked, I think with David Byrne's knowledge, but maybe without. We had booked a band called the Extra Action Marching Band, which was a big sort of anarchic marching band with tattoos and piercings and weird clothes. But drums and a majorette and everything. And they broke into the place and then just shut the whole event down by playing in the crowd until it was over. So the event was crazy. We've all grown accustomed to disclaimers at the bottom or the end of advertisements. We know that, most of the time, there has to be a catch. But, even if there isn't a catch, most people don't have the will to face a mega-corporation to get what they are due. John Leonard isn't most people, though. In the mid-1990s, Pepsi ran the promotional campaign 'Pepsi Stuff.' The campaign concept was simple, drink Pepsi and earn points to purchase special edition gear. However, the ad showcased a student buying a Harrier Jet and lacked any disclaimer. Leonard knew he had them. Enlisting the help of friends and family, Leonard began amassing Pepsi points. His story brought him face-to-face with Pepsico's legal team.
