We use a recent California case as an example of how things can go so wrong–and cost millions of dollars–in special education law. Plaintiff Dawn Kali was diagnosed with treatable Stage 1 breast cancer and rejected traditional treatment options in favor of the "Father of the Alkaline Diet" Robert O. Young's "pH Miracle" approach, which focused on making the body less acidic and more alkaline. This process involved costly extended stays at Young's Rancho del Sol in Valley Center, California and expensive intravenous treatments that consisted of little more than baking soda. Unable to pay, Dawn worked for Young in exchange for treatments that were ultimately ineffective. After much time had passed, Dawn went to an oncologist and was diagnosed with terminal Stage 4 cancer that had spread to her spine and femur. At trial, Bibi Fell demonstrated that Young's "pH Miracle" treatment was neither scientifically nor medically sound. In spite of the defense's claims that Dawn was aware that Young was not a licensed medical doctor and that she was not prevented from seeking conventional medical treatment, a San Diego jury found in favor of Dawn for her claims against Young of intentional misrepresentation, negligent misrepresentation, false promise and negligence. In October 2018, the jury awarded Dawn a $105,356,000 verdict, including $15 million in punitive damages. If you haven't heard of Patti Paniccia, you can be forgiven. Surf history and the magazines have all but white washed women pioneers such as Patti and their contributions to the beginning of Professional Surfing. Patti was not only one of the first women to compete on the pro tour, but also was a founding member and a director of the IPS World tour in the mid to late 70's alongside Randy Rarick and Fred Hemmings (which was a precursor to today's WSL). Patti went on to become adjunct law professor at Pepperdine Law School and a CNN correspondent, having been nominated for an Emmy with her work on an investigative series on the court system's failure to deal adequately with infant abuse. In 2000 she wrote the groundbreaking book, "Work Smarts for Women: The Essential Sex Discrimination Survival Guide." Patti joins us on the podcast to share insights on the history of surfing to help inform the next generation of surfing in surf parks. Patti was one of the top-ranked surfers during the 70s and early 80s, and was one of six women who competed on the first women’s world pro tour in 1976. She is a co-founder of pro-surfing, working as Director of the Women’s Division, alongside Fred Hemmings and Randy Rarick, to launch International Professional Surfing (IPS) which was a precursor to ASP and today’s WSL. Dr Deshaw has lived an incredible life. His career in chiropractic medicine began in the nineties. After seven years of practice, he realized how insurance laws constrained some of his abilities to practice medicine, and he decided to become a lawyer. So he quit his practice to attend law school, right? No! While operating as one of six total chiropractors in Ireland, he also attended Pepperdine Law School in London. Needless to say he has led an incredibly fast, rich life. Because of his exposure to brain injury in his chiropractic medicine, he decided to center his law practice around helping people with traumatic brain injury. In most of his cases he helps clients confront big insurance and get the money they need for recovery. In addition to practicing law in the TBI world, he also founded Trial Guides LLC. Trial Guides is a legal publishing company that connects the world of traumatic brain injury and law by teaching physicians about pertinent insurance laws and lawyers about traumatic brain injury. In this episode of Keep Moving Forward I interview husband and wife Christian authors and motivational speakers, Jay and Katherine Wolf. “Become the overcomer.” On April 21st 2008, at the age of 26, with a 6-month old son, Katherine Wolf suffered a massive brainstem stroke, and miraculously lived. Both she and her husband Jay’s lives changed forever that day, but they will be the first to tell you that despite this trauma, they knew they could and would overcome their past and use their situation for good, because they know God doesn’t make mistakes. Since her stroke Katherine has had to relearn to eat, speak, and walk, all while Jay fell into the role of full-time caregiver just before finishing his final semester at Pepperdine Law School back in 2008. Suffering from this upheaval of their lives at such a young age yet remaining steadfast in their faith, Jay and Katherine’s story is imbued with something they never lost and continue to maintain throughout their journey: hope. This key component in their lives inspired the writing of their book Hope Heals and has since brought about their ministry and, most recently, Hope Heals Camp, aimed at bettering the lives of the physically and mentally disabled. In today's episode I sit down with Paul F. Becker. Paul is a bio hacker / inventor and health researcher. He's also the man behind the earth pulsed electromagnetic field systems. In 1990 during his first year of law school, Paul stumbled upon early TENS therapy which stands for Transcutaneous Electrical Nerve Stimulation and used it to help reverse a case of tendinitis that persisted for more than 2 months. He graduated from Pepperdine Law School in 1994 and passed the California bar in 1996. In 96 the Whole Life Expo in Los Vegas, Nevada: Becker had the opportunity to hear Bob Beck speak about using electric current and how applying this current to the post points of the wrists could be used to kill micro organisms in the blood. On January 11, 2010, Jim Gash, then Dean of Students at Pepperdine Law School, met Henry, a Ugandan boy accused of two murders, in a Ugandan "Remand Home," a sparse jail for juveniles awaiting trail. Henry had been held there since 2008, awaiting a hearing. This meeting, by God's grace, changed Jim's life. It also helped change the criminal trial court system in Uganda and bring justice to hundreds of children awaiting trial without hope. As Jim says, "I took a step of faith, and it changed everything." Listen to Jim tell his story and Henry's story-- ultimately God's story of grace and mercy and justice-- as he talks about his new book, Divine Collision: An African Boy, An American Lawyer, and Their Remarkable Battle for Freedom (Worthy 2016). In 1986 David Sparks of Sparks Law and MacSparky was an engineering student that joined his collegiate debate team. David had tremendous success as a debater and before long he was hooked. David attended Pepperdine Law School as a Dean's Merit Scholar; he made the Dean's List and, after an externship with a Federal District Judge, graduated in 1993 with the sole purpose of getting in a courtroom just like Atticus Finch. David joined a law firm full of remarkable lawyers where he was promised me he'd get time in a courtroom. They made good on that promise, letting David go to trial (and win) his first case just a few months after swearing into the bar.
