Last night the Lords failed to back an amendment to ensure that the government's Nationality And Borders Bill should ensure that the UK keeps its commitment to the 1951 Refugee Treaty, agreed in the aftermath of WWII to help prevent genocide. The amendment could have been made, but Labour whipped their Lords to abstain. A peaceful protest organised by Rural Refugee Network took place in Petersfield Square. Noni Needs captured the views of those taking part. The protestors came to, in their words, "stand in solidarity with refugees and asylum seekers'. The campaigners were there to protest against the Nationality and Borders Bill currently being considered in the House of Commons and Lords and to protest against the proposed shipping of immigrants to Rwanda for processing. One protestor said she was there because "...silence will achieve nothing." The government says the bill will protect people against slavery and human trafficking. What rights to citizenship do those from Britain's 14 remaining overseas territories? What about those who through no fault of their own found themselves displaced and exiled from the territories through which they could claim this right?  In Episode 10, we look indepth at the case of the Chagos Islanders and the consequences of their forced displacement from the British Indian Ocean Territories for their access to British citizenship. Michaela Benson explains the emergence of the British Overseas Territories Act 2002 and how this departed from previous transformations to the citizenship provisions for those in Britain's overseas territories and who this excluded. George Kalivis heads into the archive to revisit how the BOTA 2002 was announced in the UK and the responses to this from the governments of these overseas territories. Nearly three million people have fled Ukraine since the Russian tanks crossed the border at the end of February. Some say the UK was slow to respond but many thousands of people are now signed up to a government scheme to turn their houses into homes for Ukrainian refugees - the first should arrive soon. There has been an outpouring of generosity and goodwill toward those suffering in this conflict, but uncomfortable questions remain. Are we really doing enough? Why such generosity now, when we have spent years discussing how to keep migrants out? Is it morally acceptable to feel more comfortable welcoming large numbers of Ukrainian - rather than Syrian or Afghan - refugees? Is racism a factor, or is it simply that these people are fleeing an enemy who threatens us too? Shortly the Nationality and Borders Bill will return to be voted on in Parliament. Campaigners say the bill is at odds with rhetoric about welcoming refugees as it could criminalise those who arrive to seek asylum in the UK without first filling in the correct forms. Is it right to put up yet more barriers? Perhaps it is a failure of moral imagination to turn away any individual who wants to make a better life? Some economists argue that the free movement of workers makes nations prosperous, but there's more to Britain than its economy, and not everyone wants to do away with borders. How, without fierce gate-keepers, can we protect the places where we feel at home? Not only do they face a hostile welcome, but a Nationality and Borders Bill that seeks to criminalise them but not so for Ukrainian Refugees. They've had empathy on a scale Britain hasn't seen before, the mainstream media has framed their plight with compassion and humanity. We speak to Steve Valdez Symonds from Amnesty International, they have a proud record of advocating for the rights of all Refugees and Migrants. Most of the people they work with have had to endure an inhumane hostile welcome all over Europe. We ask, what's changed? So why are Ukrainian Refugees seen as different?

Did you know that until 2014 that some of those born overseas to unmarried British citizen fathers were not eligible for citizenship? Or that even when this was amended, the provisions were not extended to those born in similar circumstances to British Overseas Territories Citizens? How would you feel if you were denied the right to nationality because your parents weren't married when you were born? And what does this tell us about who counts as British?    In this episode we look at the human face of so-called ‘nationality anomalies' and the struggles of the children of unmarried parents born overseas to gain equal rights to citizenship and nationality. This is an area of nationality legislation where discrimination on the grounds of race, gender, and parentage come crashing together. We explore how these outdated understandings of parental relationships at the heart of these anomalies sit in a long history of gender discrimination within nationality legislation. Michaela considers the back story to proposals in Clause 1 of the Nationality and Borders Bill that seek to address these anomalies. Did you know that British citizenship can be cancelled or removed? And that when the Nationality and Borders Bill passes into legislation the UK Home Secretary will be able to remove citizenship from individuals without giving them prior notice? Certain conditions may accompany this, but the government's past record on citizenship deprivation shows that these powers have disproportionately by exercised against those from Britain's racially and religiously minoritized communities. In this episode we look in depth at how Clause 9 of the Nationality and Borders Bill sits in a longer history of citizenship deprivation . Over time, the UK government's powers to strip people of their British citizenship have extended and expanded. The fallout from this has been uneven, impacting Britain's racially minoritized communities disproportionately. Michaela introduces the case of Shamima Begum and explains the back story to Clause 9. George draws attention to the concerns raised about the extension of these powers. And we talk with Zainab Batul Naqvi, Senior Lecturer in Law at De Montfort University about how in recent years deprivation powers have been used disproportionately against Muslim citizens and how such discrimination echoes the tactics used by colonial administrators and governments. One of the Home Secretary's more startling powers is to take people's British citizenship away where they acquired it by fraud or it is “conducive to the public good”. In the latter case, losing citizenship often amounts to exile in the interests of national security: the tactic is to wait until the person is abroad before making the deprivation order. Under the Nationality and Borders Bill, the person need not be told about the order at all. The Home Office tells us that this power is used “sparingly”. Between 2010 and 2018, “only around 19 people a year were deprived of their citizenship on ‘conducive to the public good' grounds”....
