Amid escalating federal pressure on universities, Stanford Law School alum Greg Lukianoff, JD '00, joins host Professor Pam Karlan for a sharp look at the free speech firestorms engulfing universities like Harvard and Columbia. First Amendment champion, president of the Foundation for Individual Rights and Expression (FIRE), and co-author of The Coddling of the American Mind, Lukianoff recently penned an essay for The Atlantic titled “Trump's Attacks Threaten Much More Than Harvard.” In this episode, Lukianoff expands on his essay, breaking down the Trump administration's tactics to punish elite institutions, from defunding threats and faculty interference to student visa crackdowns, while also calling out universities themselves for stifling dissent and eroding public trust in higher education.Links:Greg Lukianoff  >>> FIRE pageThe Canceling of the American Mind >>> web pageThe Coddling of the American Mind >>> web page“Trump's Attacks Threaten Much More Than Harvard” >>> The Atlantic pageConnect:Episode Transcripts >>> Stanford Legal Podcast WebsiteStanford Legal Podcast >>> LinkedIn PageRich Ford >>>  Twitter/XPam Karlan >>> Stanford Law School PageStanford Law School >>> Twitter/XStanford Lawyer Magazine >>> Twitter/X(00:00:00) Introduction of Greg Lukianoff(00:05:01) Free Speech and Academic Freedom(00:10:01) Challenges to Free Speech(00:15:01) Legal Cases and Free Speech(00:20:01) Free Speech and the Government (00:30:01) Future of Free Speech

A YouTube video transcript from Norbert “Bob” Gostischa highlights a perceived disparity between criminal and civil court proceedings. The speaker contends that the fundamental principle of "innocent until proven guilty" does not apply in civil cases. Instead, individuals often bear the burden of proving their innocence, particularly in situations like identity theft. The video uses the example of fraudulent loans to illustrate how victims may be treated as the responsible party by default. Gostischa argues this legal framework unfairly disadvantages those wrongly accused in civil matters. He calls for reforms to shift the burden of proof back to the accuser and advocates for stronger protections for victims of fraud. Here are the links to the video's supplied to NotebookLM (https://notebooklm.google.com/) in the creation of this discussion:https://youtu.be/65Ie7DNSR6Qhttps://youtu.be/3KeliM9Yz8c

Worse yet, often the litigants are involved in high-consequence civil cases where there is no right to a lawyer and costs are prohibitive. The church of Corinth is facing some serious allegations, but it's not what you think. Paul finds out that the church of Corinth is playing with fire by living in sinful behavior all the while proclaiming to be Christians. No one is perfect, but the church is blatantly living in sin for all to see, but also living in division. Paul writes a series of letters addressing the unity and integrity of their faith reminding them to live and love as Christ does. It's not easy to live the Christians life, just as it's not easy holding others accountable as Paul does. I believe this chapter is two fold: the first is for the believer living in sin, and the second for other believers boldly holding other accountable.

Today we are celebrating our 200th Episode with the return of a special friend of the podcast, Judge Tanya Acker. Acker serves as one of three judges on Amazon Freevee's Tribunal Justice, created by Judge Judy Sheindlin. Acker also hosts "The Tanya Acker Show" podcast on iTunes, Google Play, Spotify, Overcast, and Pocketcasts. Most recently, Acker was a judge on the Emmy-nominated series, "Hot Bench." Acker is also the author of "Make Your Case: Finding Your Win in Civil Court," published by Diversion Books. In the book, Acker provides readers with curated, targeted information about what people want to know: what happens during court proceedings and why, how to best prepare for it — and how to avoid court entirely and find out if there is a better way. Acker is an experienced civil litigator who has represented a wide array of clients, from major automobile manufacturers in high-stakes product liability litigation to media companies in hotly contested trade secret disputes. She has been a featured commentator on "Good Morning America," "The View," "Entertainment Tonight," "Wendy Williams," "The Talk," "Inside Edition," "Banfield," "The O'Reilly Factor," "Larry King Live," "CNN Reports," "Anderson Cooper 360," "Issues with Jane Velez Mitchell," "Extra," "Your World With Neil Cavuto," "HLN's Special Report," "CNBC Reports," Great Britain's "GMTV" and Sky News, and various other broadcasts. She also guest co-hosted CNBC's "Power Lunch," and "C Magazine" included her in an election season profile on noteworthy California women in politics. Acker also has contributed to the Huffington Post and served as a Temporary Judge in the Los Angeles County Superior Court Temporary Judge Program. While a student at Yale Law School, Acker represented low-income women in family law cases and served as a teaching assistant in Constitutional Law and Civil Procedure courses. She also worked at the Office of White House Counsel, the Civil Rights Division in the United States Department of Justice and the private law firms Irell & Manella, O'Melveny & Myers and Williams & Connolly. At Williams & Connolly, she assisted President Clinton's personal lawyers with press interviews, worked on the preparation of Congressional testimony for pending product liability legislation and researched First Amendment issues. After graduating from Yale, Acker served as a judicial law clerk to the Honorable Dorothy Wright Nelson on the Ninth U.S. Circuit Court of Appeals. After her clerkship, the Office of the Solicitor General in the U.S. Department of Justice awarded Acker a Bristow Fellowship. While working as a Bristow Fellow, Acker drafted Supreme Court briefs and helped prepare the Solicitor General for oral argument before the High Court. Among the cases on which Acker worked was Clinton v Jones, where she assisted both the Solicitor General and President Clinton's personal attorneys in preparing for oral argument. In private practice, Acker's legal work spanned a broad variety of matters, from civil litigation involving public and private entities, to various constitutional cases, to providing constitutional cases, to the provision of business counseling and advice. She also maintained a commitment to pro bono work, receiving the ACLU's First Amendment Award for her successful representation of a group of homeless individuals against the City of Santa Barbara. Acker later worked in entertainment industry outreach for the Kerry/Edwards presidential campaign and as Deputy Campaign Manager for the Los Angeles mayoral campaign of City Councilman Bernard C. Parks. After that, she worked as the General Counsel of a company that manufactured emissions control products. Acker received her B.A. degree at Howard University in 1992, where she graduated summa cum laude and was a member of Phi Beta Kappa. She was awarded a Luard Scholarship for study at St. Anne's College at Oxford University and served there as the co-editor-in-chief of the Oxford University Women's Magazine. At Yale Law School, she was awarded an Earl Warren Scholarship by the NAACP and a Coker Fellowship by the Yale faculty. Acker maintains an active involvement in various philanthropic, civic and business organizations. A volunteer with Love Takes Root, she has traveled to Haiti to work in a clinic and orphanage founded by that organization. She is a member of the Beverly Hills West (CA) chapter of The Links, Incorporated, and additionally serves on the boards of Public Counsel, the Western Justice Center, the Boy Scouts of America (the National and Western Los Angeles County Council Boards); PacWest Bancorp; and as trustee of the Pacific Battleship Center, which operates the Battleship USS Iowa Museum. Welcome to Divorce Matters, a podcast where we delve into the intricate and often misunderstood world of divorce, custody battles, and the legal system that navigates these turbulent waters. Today, we're unpacking a case that has captured national attention and sparked a significant conversation about the integrity of the family court system, the impact of false allegations in custody disputes, and the profound emotional toll these battles take on families. Our focus is on a landmark $21.3 million jury verdict awarded in a disputed Colorado custody case, a verdict that calls into question the actions of an ex-husband, the decisions of family court evaluators, and the rulings of a judge that led to a mother being barred from any contact with her children based on allegations now deemed to be falsely manipulated. -------------------------------------------- SPONSORED BY www.kidsmatter.charity   WE'D LOVE YOUR DONATION  ------------------------------------------ This case, stemming from Routt County, Colorado, involves Cynthia Hayek, a mother who lost all contact with her children due to her ex-husband Steven Herron's allegations that her new fiancé sexually abused one of their children. These allegations, which were later found to be part of a "false narrative" cultivated by Herron, led to a series of legal and child protective actions that isolated Hayek from her children and ultimately resulted in a jury finding Herron liable for defamation, conspiracy, outrageous conduct, abuse of process, and malicious prosecution. As we dive into the details of this case, we'll explore the implications of the jury's verdict, the systemic issues it highlights within the family court system, and the path forward for those seeking justice and reform in similar disputes. Join us as we navigate the complex, heart-wrenching, and ultimately hopeful journey of Cynthia Hayek and the broader lessons this case teaches us about the power of perseverance, the importance of truth, and the need for systemic change in our family courts.   Details  Plaintiff/Counterclaim Defendant: Cynthia Hayek, an individual V. Defendants/Counterclaimant/Third Party Plaintiff: Steven Herron, an individual; and Christine Herron, an individual, V. Third Party Defendant: Kenneth Wayne Hamp, an individual.   This case revolves around a deeply contentious and complex legal battle stemming from the divorce and subsequent disputes between Cynthia Hayek and Steven Herron, involving allegations of child abuse, manipulation, and emotional distress. After their divorce, Herron and Hayek became embroiled in a series of legal confrontations, with Herron accusing Hayek and her boyfriend, Kenneth Wayne Hamp, of various forms of abuse towards their children, leading to a series of investigations and legal claims. These allegations, which Hayek contends are entirely fabricated and part of a "False Narrative" created by Herron to gain an advantage in custody and parenting disputes, have led to a multifaceted legal battle involving claims of intentional infliction of emotional distress, abuse of process, conspiracy, malicious prosecution, and negligent infliction of emotional distress. The case highlights the severe personal and legal ramifications of such disputes, touching on the emotional toll on all parties involved, the impact on the children at the center of the allegations, and the broader implications for the legal and community systems navigating such deeply personal and contentious issues.   In light of the resolution of this contentious custody case, where a jury awarded $21.3 million in damages after finding that the ex-husband corruptly manipulated proceedings to gain full custody by falsely alleging abuse, here are revised questions reflecting the allegations and the jury award: Legal and Ethical Implications: "With a $21.3 million verdict against Steven Herron for defamation, conspiracy, outrageous conduct, abuse of process, and malicious prosecution, what message does this send about the use of false allegations in custody disputes?"

Res Judicata Requires Fraudster to Lose Again After it Sues Again Forcing Two Courts to Deal With a $366.64 Fraudulent Claim is Chutzpah Integrated Pain Management, PLLC, sought $366.64 in no-fault insurance benefits for medical services it rendered to assignor Mikwan Murphy on August 16, 2018 although the insurer had already obtained a judgment that the claim was fraudulent. In Integrated Pain Management, PLLC, as assignee of Mikwam Murphy v. Empire Fire & Marine Insurance Company, 2023 NY Slip Op 50219(U), Index No. CV-712234-21/BX, Civil Court of the City of New York, Bronx County (March 22, 2023) the services allegedly provided by Integrated consisted of treatment for injuries Murphy allegedly sustained in an automobile accident on July 22, 2018. Defendant moved for summary judgment contending that plaintiff was barred by the doctrines of res judicata, collateral estoppel, and law of the case from relitigating the issue of coverage for this claim. Plaintiff ignored the motion. PRIOR ACTION In 2019, Empire Fire commenced a declaratory judgment action in Kings County Supreme Court against Integrated Pain Management and Murphy, among others. In that case, Empire Fire alleged that Integrated Pain Management and Murphy participated in an insurance fraud scheme in which rented vehicles would intentionally get into "accidents" with unsuspecting third-party drivers. The drivers and passengers in the rented vehicles would receive payments of up to $1,500, and in exchange for those payments would seek medical treatment from certain designated medical providers, who would seek reimbursement under Empire Fire's no-fault insurance policy. On April 8, 2021, Supreme Court granted default judgment for Empire Fire, ruling in relevant part that Empire Fire was not contractually obligated to reimburse Integrated Pain Management for the services it rendered to Murphy arising from the July 22, 2018 accident because the alleged losses were not the result of an "accident" as contemplated by the insurance policy. DISCUSSION Given Supreme Court's ruling that contractually there is no no-fault coverage for the July 22, 2018 purported "accident." Since Integrated Pain Management and Murphy were both parties to the Brooklyn Action and the claims again from the very same "accident" at issue in that case. Under res judicata, or claim preclusion, a valid final judgment bars future actions between the same parties on the same cause of action. The doctrine applies if the issue in the second action is identical to an issue which was raised, necessarily decided and material in the first action, and the plaintiff had a full and fair opportunity to litigate the issue in the earlier action. The Court found that defendant met its prima facie burden for summary judgment under the doctrines of res judicata and collateral estoppel. Plaintiff sought to wrongfully relitigate the identical issue raised and decided against it in the Brooklyn Action. Defendant's motion for summary judgment seeking dismissal of the complaint was granted and the case was dismissed with prejudice. ZALMA OPINION Fraud perpetrators in the state of New York, like the Plaintiff, have the unmitigated gall to sue an insurer twice for the same fraudulent scheme, waste the time of the courts by causing the courts to rule twice on the same issue and, in my opinion, should face sanctions and punishment from the court and a referral to the prosecutors for criminal prosecution.     Slam the Gavel welcomes Mark Esquibel to the podcast. He is a part of Dad Talk Today that helps Mothers and Fathers navigate through the family court systems. We discussed the failures of CPS in Texas, Title IV-E and ASFA that Bill Clinton signed as he incentivized children being removed from the home. Children are products where states are incentivized for taking children. Judge Janice Graham Jack in the higher level courts recognizes this .      Every single program in CPS is voluntary. It's a SCHEME and a Coercive Control approach to "we are just here to help." The instant media are parents now recording when CPS comes to the door.  As Parents we should know our rights when CPS comes to the door however, 83-86% of claims are unfounded claims /false accusations. State and County, CPS gets a bonus for removing children out of the house and into the Foster Care system, and more bonuses at the 6th month hearing, at the 12th, 18th and the 24th month hearing a CSW is going to get a $4,000.00 bonus for keeping the kids an extra 3 months and lying to parents. YOUR CHILDREN ARE THEIR INCOME.    There are unlicensed individuals working for CPS handling drug testing that will taint the drug test to keep the kids away from parents. When a parent tries to stand up for themselves in court they are then called crazy. The deal is: they will force a psyche evals on the parents to drag the case out because they budget how many kids are in the system, how much was the reimbursement through Title IV-E, AND the rest of the money goes into the JUDGE'S RETIREMENT FUND. They are making money abusing our children. The goal is to come together as parents and stay out of court. CPS is not solution based as it thrives off of an incentivized system that destroys families and children.   We discussed the Jeff Younger case (in Texas) where his son is now in California  being transitioned to a girl and how this can affect parents across the United States. This case was mishandled by Judge Mary Brown.      Also the sad case of Corbin Henderson, where his father was finally allowed to visit with his son minutes before he died and the grand parents were allowed to visit with Corbin for only 90 minutes on Father's Day.   This is the two year anniversary of the John A. Mast murder that took place on February 5th, 2021.  It has taken the DA 2 years and court trials delayed four separate times until this year, this case now goes to trial.    Awareness is key and both sides have to come together and work together. To Reach Mark Esquibel: 762-441-0283/Dad Talk Today.Supportshow(https://www.buymeacoffee.com/maryannpetri)http://www.dismantlingfamilycourtcorruption.com/Support the showSupportshow(https://www.buymeacoffee.com/maryannpetri)http://www.dismantlingfamilycourtcorruption.com/

Survivors of domestic violence often lack the resources to secure legal representation in either or both civil and criminal courts. And navigating the civil and criminal justice systems can be overwhelming for survivors. What's more, offenders in criminal domestic violence cases are entitled to attorney representation while their victims are not. To address the shortcomings of systems that do not adequately address the needs of survivors, organizations like the DC Volunteer Lawyers Project have stepped up to offer no-cost legal assistance that provides a holistic approach to representation. In doing so, survivors receive more than just attorney representation, they also receive advocacy, referrals to domestic violence services and help with child custody matters. We talk with attorney Jenny Brody for an understanding of what survivors need in these cases and how they can access appropriate resources. Ms. Brody also explains the importance of domestic violence training for law enforcement, attorneys and judges and how that training can improve outcomes for survivors.Jenny Brody has practiced family law in Washington, DC for more than ten years.  As the Co-Founder and Co-Executive Director of the DC Volunteer Lawyers Project, from 2008 to 2016, Ms. Brody provided legal assistance to hundreds of domestic violence survivors in Civil Protection Order cases, as well as in divorce, custody and child support matters.  As a member of the DC Superior Court Counsel for Child Abuse and Neglect Panel, Ms. Brody represented children as a court-appointed Guardian ad litem and also represented adoptive parents in adoption petitions.  Ms. Brody has devoted substantial time to improving the court system, as a participant in the DC Superior Court Domestic Relations and Domestic Violence Implementation Committees.  She also played a role in promulgating Guardian ad litem Practice Standards, through the Council for Court Excellence and in DC Superior Court. Ms. Brody is a recognized expert in domestic violence and family law issues, presenting numerous training programs in these areas for lawyers, judges, social workers, medical professionals and domestic violence advocates. Prior to practicing family law, Ms. Brody worked in private practice, at Rogovin, Huge & Schiller and at Powers, Pyles & Sutter.  She also served as an attorney at the United States Department of Justice, Civil Appellate Staff.  She clerked for the Hon. Irving L. Goldberg, of the United States Court of Appeals for the Fifth Circuit.

Ukiah Police Chief sued in civil court

December 23, 2021 — Noble Waidelich, Ukiah's new police chief, is being sued in civil court this month for domestic violence that is alleged to have taken place between 2011 and 2015. Madisyn Carley, who is now 20 years old, claims that on numerous occasions, she witnessed Waidelich abusing her mother, Amanda Carley. She is seeking compensatory and punitive damages for wage loss, medical expenses, and loss of earning capacity, in addition to emotional distress. Noble Waidelich and Amanda Carley were then living together as a couple. Amanda Carley was also a law enforcement officer, in the Mendocino County Probation Department. Waidelich did not respond to an email request for comment on this story earlier this week. Anyone accused of a crime is presumed innocent until proven guilty. Michelle Roberts is the director of the Fort Bragg office of Project Sanctuary, a non-profit organization that advocates for, counsels, and houses families who are seeking to escape domestic violence. She told kzyx that law enforcement families experience a high rate of abuse. “Unfortunately, it's actually quite prevalent, more so than some other professions,” she said. “Both law enforcement and actually military have high rates of domestic violence…there's varying data, some of it is old, it's not really really current, but it's estimated that as many as 40% of law enforcement families have experienced domestic violence.” Concerns about violence and misogyny are not new to the Ukiah Police Department. Former UPD Detective Isabel Siderakis is suing the city, the department, and former UPD Sergeant Kevin Murray for sexual harassment and a hostile work environment. Siderakis claims Murray assaulted her during an out-of-town training and that superiors were unresponsive to her complaints of harassment and discrimination. Murray is no longer on the force, and the District Attorney has charged him with sex crimes against two other women, burglary, and possession of methamphetamine. And in April, multiple videos of Ukiah police officers beating a naked, mentally ill man on the street circulated around the internet. The city and the department did not release any information about whether the officers had been disciplined or suspended, but the responding officer's name continued to appear on police logs. Waidelich joined the force in 2005 and was promoted to chief in September of this year, following the departure of former Chief Justin Wyatt. Waidelich was investigated twice for domestic violence against Amanda Carley at the time the abuse is alleged to have occurred. In April of 2015, an investigator with the Mendocino County Sheriff's Office responded to a report by school officials that Amanda Carley's 13-year-old daughter had told them she had witnessed her mother's boyfriend head-butting and pushing her. In a 47-page report, investigating officer Andrew Porter wrote that he interviewed Amanda Carley on April 20th. He described her minimizing, evading, changing her story, and denying that she knew the meaning of the term ‘head-butt.' District Attorney David Eyster told kzyx this morning that on May 4 of 2015, his office returned the investigation to the sheriff's office for insufficient credible evidence.* The daughter does not appear to have been close to her mother's boyfriend. Porter's report includes a text exchange between Waidelich and the teenager, where she wrote, “Do u realize how happy we were before uLu (sic) ruined all of us.” Roberts, of Project Sanctuary, says children are deeply affected by domestic violence. “It has a profound effect on them,” she said. “It can impair their learning abilities, it will impact their social skills, it creates a lot of depression and anxiety in children that witness this violence. I mean, think about it, children are innocent victims. They have no control, or very little control, over their own lives.” Project Sanctuary does offer services to children experiencing domestic violence. In his report, Andrew Porter wrote that prior to his investigation, Waidelich had been subject to an internal police department investigation by Bill Cogbill of Santa Rosa. This investigation had been prompted by colleagues reporting that they had witnessed abuse or that Carley had confided in them, but nothing came of it because Carley denied she was being abused. Porter wrote that his final interview with Carley was on August third of 2015. Four months after the initial, evasive interview, he wrote that she came back to his office, admitted that she had not been truthful, and sent him pictures of injuries she had sustained going back to 2012. On August 18, he sent it back to the District Attorney's office, but it was never prosecuted in criminal court. Roberts says it's typical for people experiencing domestic violence to deny it. And leaving the dangerous situation is a decision that has its dangers, too. “The best thing you can do is let your friend or colleague know that you care, and that you want to support them,” she said. “I would say one of the best things to do is to listen, to ask them what they want you to do, how you can help them, and let them be the lead in what happens. People often don't understand that there's many reasons people stay in abusive relationships, or that it takes them a long time to get out,” she reflected. “Part of it is fear. Victims are at greater risk of serious injury and death after they leave. There's also just shame and embarrassment. Sometimes there's custody of children involved. Sometimes there's economic hardship involved. So it's complicated.” If you need help with domestic violence, you can call the Project Sanctuary crisis hotline 24 hours a day, 7 days a week, at 964-HELP on the coast or 463-HELP for inland Mendocino County. *The evening version of this story was updated to reflect information provided when DA Eyster returned our call from the previous day.

Dan Pecora, in concert with members of his DSA group and others, was able to successfully petition Connecticut state legislature to pass a Right to Counsel bill, ensuring that tenants who face evictions could have representation during evictions cases. Because of the fact that housing cases are tried in the Civil Court system across the US, public defenders are not provided. Very few families who are facing eviction tend to have resources to hire an attorney. The bill that Dan Pecora discusses with Pat changes that fact and guarantees that families have a fighting chance in court. A number of other benefits of Tenant Unions are discussed: petitioning landlords for safer, better maintained apartments, pushing back against exorbitant rent strikes, and an increased sense of community in apartment complexes.  You can find a link to Dan Pecora's podcast, Snowflake Sports, here: https://podcasts.apple.com/us/podcast/snowflake-sports-podcast/id1476612592 The TDS Podcast is mixed and mastered by C Money Burns at Cosmic Black in Portland, Maine. Judicial elections are far too often overlooked by voters. Caroline Cohen is working to motivate people to come out and vote for Civil Court in New York City this year. She joins the You Should Run Podcast to discuss why she's running, the challenges of running for judge and getting people to make judicial elections a priority, and what she can change as a judge. Plus, we talk about who her favorite judge is from TV. Listen, share, and subscribe to the podcast today!    From her Facebook bio at: https://www.facebook.com/CohenforJudge2019/  Caroline was previously employed by the New York City Housing Authority (NYCHA) for eight years, where she successfully litigated a variety of cases including discrimination cases brought by the New York State Division of Human Rights, holdover, non-payment, HP and Article 78 proceedings. While at NYCHA, Caroline was a fierce advocate for her client, but also very mindful of the needs of NYCHA residents. Accordingly, Caroline earned an unparalleled reputation for resolving cases with tenants and opposing counsel alike. Caroline achieved this by working diligently and consistently with her client to ensure that repairs were completed and worked with New York City agencies including the Human Resources Administration and the HIV and AIDS Services Administration to assist tenants with unpaid rent. After Donald Trump was elected as President in 2016, Caroline felt called to do more with her advocacy skills. Accordingly, Caroline joined Crumiller P.C. in June 2017, where she commenced a practice dedicated to fighting gender and pregnancy discrimination and tenant advocacy.
