Federal prosecutors moved in September 2020 to halt a civil lawsuit against Ghislaine Maxwell, arguing that the case could interfere with her pending criminal trial. They warned that continuing the civil proceedings might force Maxwell to make disclosures that could compromise her Fifth Amendment rights, or expose evidence and testimony that overlapped with the criminal investigation. The judge agreed, ruling that the civil case would be put on hold to ensure the integrity of the broader prosecution. The lawsuit, filed by a woman who alleged she was groomed and abused as a minor, sought to hold Maxwell and Epstein's estate accountable. While the judge acknowledged that delaying a survivor's pursuit of justice carried weight, the court determined that protecting the fairness of the criminal case against Maxwell had to take priority. The pause meant the civil action would resume only after the conclusion of Maxwell's criminal trial. To contact me:Bobbycapucci@protonmail.comSource:https://abcnews.go.com/US/feds-seek-halt-civil-lawsuit-ghislaine-maxwell/story?id=72929281Become a supporter of this podcast: https://www.spreaker.com/podcast/the-epstein-chronicles--5003294/support.

A YouTube video transcript from Norbert “Bob” Gostischa highlights a perceived disparity between criminal and civil court proceedings. The speaker contends that the fundamental principle of "innocent until proven guilty" does not apply in civil cases. Instead, individuals often bear the burden of proving their innocence, particularly in situations like identity theft. The video uses the example of fraudulent loans to illustrate how victims may be treated as the responsible party by default. Gostischa argues this legal framework unfairly disadvantages those wrongly accused in civil matters. He calls for reforms to shift the burden of proof back to the accuser and advocates for stronger protections for victims of fraud. Here are the links to the video's supplied to NotebookLM (https://notebooklm.google.com/) in the creation of this discussion:https://youtu.be/65Ie7DNSR6Qhttps://youtu.be/3KeliM9Yz8c

Worse yet, often the litigants are involved in high-consequence civil cases where there is no right to a lawyer and costs are prohibitive. The church of Corinth is facing some serious allegations, but it's not what you think. Paul finds out that the church of Corinth is playing with fire by living in sinful behavior all the while proclaiming to be Christians. No one is perfect, but the church is blatantly living in sin for all to see, but also living in division. Paul writes a series of letters addressing the unity and integrity of their faith reminding them to live and love as Christ does. It's not easy to live the Christians life, just as it's not easy holding others accountable as Paul does. I believe this chapter is two fold: the first is for the believer living in sin, and the second for other believers boldly holding other accountable.

Acker is also the author of "Make Your Case: Finding Your Win in Civil Court," published by Diversion Books. In the book, Acker provides readers with curated, targeted information about what people want to know: what happens during court proceedings and why, how to best prepare for it — and how to avoid court entirely and find out if there is a better way. Acker is an experienced civil litigator who has represented a wide array of clients, from major automobile manufacturers in high-stakes product liability litigation to media companies in hotly contested trade secret disputes. She has been a featured commentator on "Good Morning America," "The View," "Entertainment Tonight," "Wendy Williams," "The Talk," "Inside Edition," "Banfield," "The O'Reilly Factor," "Larry King Live," "CNN Reports," "Anderson Cooper 360," "Issues with Jane Velez Mitchell," "Extra," "Your World With Neil Cavuto," "HLN's Special Report," "CNBC Reports," Great Britain's "GMTV" and Sky News, and various other broadcasts. She also guest co-hosted CNBC's "Power Lunch," and "C Magazine" included her in an election season profile on noteworthy California women in politics. Acker also has contributed to the Huffington Post and served as a Temporary Judge in the Los Angeles County Superior Court Temporary Judge Program. While a student at Yale Law School, Acker represented low-income women in family law cases and served as a teaching assistant in Constitutional Law and Civil Procedure courses. She also worked at the Office of White House Counsel, the Civil Rights Division in the United States Department of Justice and the private law firms Irell & Manella, O'Melveny & Myers and Williams & Connolly. At Williams & Connolly, she assisted President Clinton's personal lawyers with press interviews, worked on the preparation of Congressional testimony for pending product liability legislation and researched First Amendment issues. After graduating from Yale, Acker served as a judicial law clerk to the Honorable Dorothy Wright Nelson on the Ninth U.S. Circuit Court of Appeals. After her clerkship, the Office of the Solicitor General in the U.S. Department of Justice awarded Acker a Bristow Fellowship. While working as a Bristow Fellow, Acker drafted Supreme Court briefs and helped prepare the Solicitor General for oral argument before the High Court. Among the cases on which Acker worked was Clinton v Jones, where she assisted both the Solicitor General and President Clinton's personal attorneys in preparing for oral argument. In private practice, Acker's legal work spanned a broad variety of matters, from civil litigation involving public and private entities, to various constitutional cases, to providing constitutional cases, to the provision of business counseling and advice. She also maintained a commitment to pro bono work, receiving the ACLU's First Amendment Award for her successful representation of a group of homeless individuals against the City of Santa Barbara. Acker later worked in entertainment industry outreach for the Kerry/Edwards presidential campaign and as Deputy Campaign Manager for the Los Angeles mayoral campaign of City Councilman Bernard C. Parks. After that, she worked as the General Counsel of a company that manufactured emissions control products. Acker received her B.A. degree at Howard University in 1992, where she graduated summa cum laude and was a member of Phi Beta Kappa. She was awarded a Luard Scholarship for study at St. Anne's College at Oxford University and served there as the co-editor-in-chief of the Oxford University Women's Magazine. At Yale Law School, she was awarded an Earl Warren Scholarship by the NAACP and a Coker Fellowship by the Yale faculty. Acker maintains an active involvement in various philanthropic, civic and business organizations. A volunteer with Love Takes Root, she has traveled to Haiti to work in a clinic and orphanage founded by that organization. The $21.3 Million Verdict That Rocked the Family Court System

Divorce Matters

Play Episode Listen Later Feb 28, 2024 80:10

Welcome to Divorce Matters, a podcast where we delve into the intricate and often misunderstood world of divorce, custody battles, and the legal system that navigates these turbulent waters. Today, we're unpacking a case that has captured national attention and sparked a significant conversation about the integrity of the family court system, the impact of false allegations in custody disputes, and the profound emotional toll these battles take on families. Our focus is on a landmark $21.3 million jury verdict awarded in a disputed Colorado custody case, a verdict that calls into question the actions of an ex-husband, the decisions of family court evaluators, and the rulings of a judge that led to a mother being barred from any contact with her children based on allegations now deemed to be falsely manipulated. -------------------------------------------- SPONSORED BY www.kidsmatter.charity   WE'D LOVE YOUR DONATION  ------------------------------------------ This case, stemming from Routt County, Colorado, involves Cynthia Hayek, a mother who lost all contact with her children due to her ex-husband Steven Herron's allegations that her new fiancé sexually abused one of their children. These allegations, which were later found to be part of a "false narrative" cultivated by Herron, led to a series of legal and child protective actions that isolated Hayek from her children and ultimately resulted in a jury finding Herron liable for defamation, conspiracy, outrageous conduct, abuse of process, and malicious prosecution. As we dive into the details of this case, we'll explore the implications of the jury's verdict, the systemic issues it highlights within the family court system, and the path forward for those seeking justice and reform in similar disputes. Join us as we navigate the complex, heart-wrenching, and ultimately hopeful journey of Cynthia Hayek and the broader lessons this case teaches us about the power of perseverance, the importance of truth, and the need for systemic change in our family courts.   Details  Plaintiff/Counterclaim Defendant: Cynthia Hayek, an individual V. Defendants/Counterclaimant/Third Party Plaintiff: Steven Herron, an individual; and Christine Herron, an individual, V. Third Party Defendant: Kenneth Wayne Hamp, an individual.   This case revolves around a deeply contentious and complex legal battle stemming from the divorce and subsequent disputes between Cynthia Hayek and Steven Herron, involving allegations of child abuse, manipulation, and emotional distress. After their divorce, Herron and Hayek became embroiled in a series of legal confrontations, with Herron accusing Hayek and her boyfriend, Kenneth Wayne Hamp, of various forms of abuse towards their children, leading to a series of investigations and legal claims. These allegations, which Hayek contends are entirely fabricated and part of a "False Narrative" created by Herron to gain an advantage in custody and parenting disputes, have led to a multifaceted legal battle involving claims of intentional infliction of emotional distress, abuse of process, conspiracy, malicious prosecution, and negligent infliction of emotional distress. The case highlights the severe personal and legal ramifications of such disputes, touching on the emotional toll on all parties involved, the impact on the children at the center of the allegations, and the broader implications for the legal and community systems navigating such deeply personal and contentious issues.   In light of the resolution of this contentious custody case, where a jury awarded $21.3 million in damages after finding that the ex-husband corruptly manipulated proceedings to gain full custody by falsely alleging abuse, here are revised questions reflecting the allegations and the jury award: Legal and Ethical Implications: "With a $21.3 million verdict against Steven Herron for defamation, conspiracy, outrageous conduct, abuse of process, and malicious prosecution, what message does this send about the use of false allegations in custody disputes?"

Slam the Gavel welcomes Mark Esquibel to the podcast. He is a part of Dad Talk Today that helps Mothers and Fathers navigate through the family court systems. We discussed the failures of CPS in Texas, Title IV-E and ASFA that Bill Clinton signed as he incentivized children being removed from the home. Children are products where states are incentivized for taking children. Judge Janice Graham Jack in the higher level courts recognizes this .      Every single program in CPS is voluntary. It's a SCHEME and a Coercive Control approach to "we are just here to help." The instant media are parents now recording when CPS comes to the door.  As Parents we should know our rights when CPS comes to the door however, 83-86% of claims are unfounded claims /false accusations. State and County, CPS gets a bonus for removing children out of the house and into the Foster Care system, and more bonuses at the 6th month hearing, at the 12th, 18th and the 24th month hearing a CSW is going to get a $4,000.00 bonus for keeping the kids an extra 3 months and lying to parents. YOUR CHILDREN ARE THEIR INCOME.    There are unlicensed individuals working for CPS handling drug testing that will taint the drug test to keep the kids away from parents. When a parent tries to stand up for themselves in court they are then called crazy. The deal is: they will force a psyche evals on the parents to drag the case out because they budget how many kids are in the system, how much was the reimbursement through Title IV-E, AND the rest of the money goes into the JUDGE'S RETIREMENT FUND. They are making money abusing our children. The goal is to come together as parents and stay out of court. CPS is not solution based as it thrives off of an incentivized system that destroys families and children.   We discussed the Jeff Younger case (in Texas) where his son is now in California  being transitioned to a girl and how this can affect parents across the United States. This case was mishandled by Judge Mary Brown.      Also the sad case of Corbin Henderson, where his father was finally allowed to visit with his son minutes before he died and the grand parents were allowed to visit with Corbin for only 90 minutes on Father's Day.   This is the two year anniversary of the John A. Mast murder that took place on February 5th, 2021.  It has taken the DA 2 years and court trials delayed four separate times until this year, this case now goes to trial.    Awareness is key and both sides have to come together and work together. To Reach Mark Esquibel: 762-441-0283/Dad Talk Today.Supportshow(https://www.buymeacoffee.com/maryannpetri)http://www.dismantlingfamilycourtcorruption.com/Support the showSupportshow(https://www.buymeacoffee.com/maryannpetri)http://www.dismantlingfamilycourtcorruption.com/

Survivors of domestic violence often lack the resources to secure legal representation in either or both civil and criminal courts. And navigating the civil and criminal justice systems can be overwhelming for survivors. What's more, offenders in criminal domestic violence cases are entitled to attorney representation while their victims are not. To address the shortcomings of systems that do not adequately address the needs of survivors, organizations like the DC Volunteer Lawyers Project have stepped up to offer no-cost legal assistance that provides a holistic approach to representation. In doing so, survivors receive more than just attorney representation, they also receive advocacy, referrals to domestic violence services and help with child custody matters. We talk with attorney Jenny Brody for an understanding of what survivors need in these cases and how they can access appropriate resources. Ms. Brody also explains the importance of domestic violence training for law enforcement, attorneys and judges and how that training can improve outcomes for survivors.Jenny Brody has practiced family law in Washington, DC for more than ten years.  As the Co-Founder and Co-Executive Director of the DC Volunteer Lawyers Project, from 2008 to 2016, Ms. Brody provided legal assistance to hundreds of domestic violence survivors in Civil Protection Order cases, as well as in divorce, custody and child support matters.  As a member of the DC Superior Court Counsel for Child Abuse and Neglect Panel, Ms. Brody represented children as a court-appointed Guardian ad litem and also represented adoptive parents in adoption petitions.  Ms. Brody has devoted substantial time to improving the court system, as a participant in the DC Superior Court Domestic Relations and Domestic Violence Implementation Committees.  She also played a role in promulgating Guardian ad litem Practice Standards, through the Council for Court Excellence and in DC Superior Court. Ms. Brody is a recognized expert in domestic violence and family law issues, presenting numerous training programs in these areas for lawyers, judges, social workers, medical professionals and domestic violence advocates. Prior to practicing family law, Ms. Brody worked in private practice, at Rogovin, Huge & Schiller and at Powers, Pyles & Sutter.  She also served as an attorney at the United States Department of Justice, Civil Appellate Staff.  She clerked for the Hon. Irving L. Goldberg, of the United States Court of Appeals for the Fifth Circuit.
