The X's. The O's. The Little Giants.It's 1964, and the O'Shea brothers are walking down the street. Big brother Kevin is annoyed that little brother Danny is tagging along to play football with his friends. So annoyed, in fact, that Kevin won't even pick him to be on his team. To cheer him up, he tells Danny that one day their names will both be on the town water tower—The O'Shea Brothers.Cut to the present, and the only name on that water tower is Kevin's. Kevin owns a car dealership and, most importantly, coaches pee-wee football. Today is tryouts. One of those hopefuls is Icebox—or should I say, Becky… Danny's daughter. That's right, a girl!We quickly learn just how much Kevin has accomplished: championships in high school and college, the Heisman Trophy—he's done it all.Time to find out who made the team. All the “dorks” you'd expect get cut… along with Icebox. Danny tells his brother he's wrong about those kids, and he's going to prove it.Icebox rallies the others, announcing that they'll start their own team—coached by her dad. Danny's not so sure, until Kevin lays down the rule: one town, one team. He challenges Danny to a playoff in two weeks. Winner gets to be the town's team.The squad needs more players, so Icebox and the crew recruit outcasts around town. At the grocery store, they spot a kid showing off an impressive arm by tossing toilet paper rolls. Icebox is thrown off because—wait for it—she also thinks he's cute. Turns out he's a great quarterback.Word gets to Kevin, who goes to check it out… and winds up arrested for being a peeping tom.Then a new kid moves to town—Spike. He's massive. His dad calls Danny, thinking he's Kevin, to say Spike wants to play. But Spike doesn't fit in, Spike doesn't like them, and Spike is basically the bad guy. Eventually, Spike's dad pulls him from the team once he realizes they're with Danny, which sparks a huge fight among the players.All seems lost… until John Madden shows up—with four NFL players! Just the boost they need.It's game day. Right before kickoff, Kevin goads Danny into a bet: if Danny wins, he gets Kevin's Chevrolet dealership; if Kevin wins, he gets Danny's gas station.The Giants fall behind 21 points by halftime. Spirits are low—until Danny gives a heartfelt speech. The team rallies, and with a last-second fumblerooski, they win the game!Danny suggests that instead of the Giants replacing the Cowboys, they merge into one team so both brothers can coach. He also rekindles his childhood romance with Patty. And instead of holding Kevin to the dealership bet, Danny asks for just one thing: change the water tower. Icebox desserts are no-bake or low-bake desserts that assemble quickly and set in the refrigerator. Plus they have a unique history dating to when Americans were modernizing their kitchens and embracing electricity. Bobbie Lloyd is the CEO and chief baking officer at Magnolia Bakery. She joins us to talk about some of the recipes in the new cookbook The Magnolia Bakery Handbook of Icebox Desserts: Classic and Creative Icebox Desserts with a Magnolia Bakery Twist. She'll also share how to adapt them, and field listener's calls and questions.Magnolia Bakery's Famous Banana PuddingBanana pudding has been around since the late 1800s, when faster steam ships meant bananas could make their way to US ports. It was first made with sponge cake, but by the 1920s, cake was replaced with vanilla wafers. For this recipe, I use Nabisco Nilla wafers and strongly recommend you don't make any substitutions to ensure you get the same crave-worthy texture of this iconic dessert.MAKES 4 to 5 quarts; serves up to 16INGREDIENTSPART ONE1 (3.4oz) package instant vanilla pudding mix, preferably Jell-O1 (14oz) can sweetened condensed milk1 ¼ cups (300g/10.6oz) ice-cold waterPART TWO3 cups (720g/24oz) heavy creamASSEMBLY1 (11oz) box Nilla wafers4 large or 6 small bananas, slicedINSTRUCTIONSMAKE PART ONE: Place the pudding mix into a 4-quart bowl and set aside.In a 2-quart liquid measuring cup or bowl with a spout, whisk together the sweetened condensed milk and water until smooth.Slowly pour the liquid into the bowl with the pudding mix while whisking constantly until thoroughly combined. Scrape the bottom and sides of the bowl with a spatula and stir until smooth. Cover with plastic wrap and place in the refrigerator for a minimum of 30 minutes. The pudding can be made ahead up to 24 hours. MAKE PART TWO: In a stand mixer fitted with the whisk, whip the heavy cream on medium speed for 1 minute, until the cream starts to thicken, then increase the speed to medium-high and whip until stiff peaks form. Be careful not to overwhip.With the mixer running on low speed, add the pudding mixture a spoonful at a time. Mix until well blended and no streaks of pudding remain. Scrape the bottom and sides of the bowl. TO ASSEMBLE: Select either a trifle bowl, a 9 × 13-inch pan, a wide glass bowl with a 4- to 5-quart capacity, or individual bowls.If using a trifle bowl, spread one-quarter of the pudding over the bottom of the bowl, then layer with one-third of the cookies and enough banana slices to cover the cookie layer. Repeat the layering twice more. End with a final layer of pudding. Garnish the top with additional vanilla wafer cookies or cookie crumbs.Cover tightly with plastic wrap and refrigerate for 4 to 6 hours. The cookies should be tender when poked with a knife. This Day in Legal History: Senate Approves Alaska PurchaseOn April 9, 1867, the United States Senate voted to ratify the Treaty with Russia for the Purchase of Alaska, approving the acquisition of the territory for $7.2 million. The deal, championed by Secretary of State William H. Seward, added over 586,000 square miles to U.S. territory. At the time, many Americans viewed the icy, remote land as a barren wasteland, mocking the transaction as “Seward's Folly” or “Seward's Icebox.” Despite public ridicule, Seward pursued the deal partly to prevent British expansion from neighboring Canada and to extend American commercial interests into the Pacific. Russia, for its part, saw little strategic or economic value in Alaska and feared it might lose the territory without compensation in a future conflict.The treaty passed in the Senate by a vote of 37 to 2, reflecting support among lawmakers despite popular skepticism. Legal authority for the purchase came through the treaty-making power of the executive branch, with Senate ratification required under Article II, Section 2 of the U.S. Constitution. Once finalized, the transfer of sovereignty occurred in October 1867 in Sitka, with a formal ceremony marking Russia's departure.Criticism of the purchase subsided decades later following the Klondike Gold Rush and, eventually, the discovery of significant oil reserves. These developments drastically changed the public's perception of Alaska from frozen liability to strategic asset. The purchase also helped lay the groundwork for America's growing influence in the Pacific and Arctic regions.President Donald Trump announced that major law firms pledging $340 million in pro bono work would assist his administration with coal industry initiatives and international tariff negotiations. Speaking at a White House event, Trump said these firms—such as Paul Weiss, Skadden, Milbank, and Willkie—would provide legal support for leasing and regulatory issues in coal mining, as well as in talks with foreign countries on trade. While he didn't specify which firms would take on specific tasks, Trump emphasized their legal talent and claimed they were offering services “for the right price.”The announcement coincided with Trump signing executive orders invoking the Defense Production Act to increase coal mining and directing investments into advanced coal technology. He also said the Department of Justice would be tasked with challenging state and local regulations he views as harmful to miners. The law firm agreements came after Trump targeted several legal firms with directives that threaten their business, prompting lawsuits from Perkins Coie, WilmerHale, and Jenner & Block. Trump posted the agreements on Truth Social, stating the firms would work on causes like veterans' rights and combating antisemitism, although details on how their roles will be determined remain unclear.Trump Says He'll Enlist Big Law Dealmakers for Coal, TariffsA group of 67 former top legal executives from companies like Microsoft, Intel, and Eli Lilly filed a legal brief condemning President Trump's executive orders targeting several major law firms. The brief supports a lawsuit by Perkins Coie, one of the firms impacted by the orders, which claims the directives bar its attorneys from government buildings and jeopardize its clients' federal contracts.The former general counsels contend that Trump's actions don't just punish individual firms, but undermine the principle that companies should be free to choose their legal representation without fear of political retaliation. The brief highlights how the orders signal to businesses that hiring lawyers linked to Trump's critics could lead to government sanctions. Khalil was arrested in New York and transferred to a detention facility in rural Louisiana, sparking concern over due process and free speech rights. At Tuesday's hearing, Judge Jamee Comans made it clear that if the government cannot prove Khalil is deportable, she will dismiss the case by Friday. She also criticized delays in sharing evidence and emphasized the importance of Khalil's due process rights.Khalil's lawyer, Marc Van Der Hout, claims the deportation effort is politically motivated and violates the First Amendment, suggesting that Khalil is being targeted for speaking out in support of Palestinians. EPISODE 165 DETAILS So many of you have reached out inquiring about the latest details about the Agridime Cattle Ponzi Scheme.  It gets rather complicated, but BEC and I break it down for you.   Some of the most feed efficient cows around are coming up for sale.  Lucky 7 Angus Ranch is selling their spring calving Oklahoma cows at public auction, January 8th at Ogallala Livestock Auction in Ogallala, Nebraska.   AGRIDIME According to articles in the Bismarck Tribune and Ag Week, the U.S. Securities and Exchange Commission, which filed a civil lawsuit against the company on Dec. 11, has labeled the operation a Ponzi scheme, in which Agridime was using investor money to pay existing investors and commissions to salespeople rather than using new money to do what it said it would — purchase, feed and care for cattle to be finished and sold to consumers as beef. The SEC has received a temporary restraining order, including an asset freeze, on the company owned by Joshua Link of Arizona and Jed Wood of Texas, through Jan. 9, pending a hearing on Jan. 5. As of Sept. 5, 2023, Agridime-held cattle contracts required payment to investors of $123 million in principal, plus $24 million in guaranteed "profits." The company, as of Sept. 30, 2023, had less than $1.5 million and insufficient operating revenues, the SEC complaint said. Carl Karpinski, enforcement attorney for the North Dakota Securities Department, said there is no confirmed tally yet on investment losses in North Dakota. But he said the eventual number may be significant. "North Dakota is one of the most — if not the most — affected states" in the nation, he said. While the SEC complaint did not go into specifics about the cattle the company did purchase, other than specifying that "Defendants did not buy the number of cattle required to fulfill the Company's obligations under the Cattle Contracts," Agridime was licensed as a livestock agent in North Dakota. Agriculture Commissioner Doug Goehring announced on Dec. 15 that it no longer will be licensed in the state. “Agridime was licensed in North Dakota,” Goehring said in a statement. “Their renewal was pending based on issues with bonding. The actions taken by the SEC will support our denial of their license and we will issue a cease-and-desist order, effective (Dec. 15), to prevent further purchase of livestock.” Karpinski said the Securities Department is not working on the cattle sales side of the case, though the North Dakota Department of Agriculture and U.S. Department of Agriculture are involved. Ellingson encouraged producers involved in the case to contact the Stockmen's Association at 701-223-2522. HOW AGRIDIME OPERATED The SEC complaint said Agridime raised $191 million from more than 2,100 investors in at least 15 states since January 2021. Instead of using investor money as advertised, the SEC filing said Agridime has used at least $58 million from Dec. 1, 2022, to Sept. 30, 2023, in investor funds from new cattle contracts to make principal and profit payments to previous investors. Agridime would sell investors cattle contracts for $2,000 per calf. The company would then promise to buy the cattle back a year later at return rates of 15% to 32%, the complaint says. Agridime paid commissions to salespeople, typically 10%, for each cattle contract sold, which also was not disclosed to investors. The SEC documents say that through May 2023, commissions paid exceeded $11.1 million in total, including "at least $5.6 million to a salesperson in North Dakota," $1.3 million to Link and his wife and $1.3 million to Wood. By using the funds to make previous investor payments and to pay commissions, "Agridime has not purchased enough cattle to fulfill its Cattle Contracts. Agridime's investors, therefore, do not actually invest in specific, identifiable animals. Instead, the success of their investments depends on the success of Agridime's purported cattle operation, including its ability to attract new investors." Agridime had operations in Texas, Arizona, Kansas, North Dakota and "other states," court documents said. In North Dakota, Securities Commissioner Karen Tyler on May 24, 2023, ordered a cease and desist order against Agridime and Link. Neither Agridime nor Link were registered as an issue-dealer or a broker-dealer in North Dakota, the cease and desist order said. Despite that, Link on Sept. 7, 2022, sold an investment contract to a North Dakota resident for $250,000, the order said. The SEC complaint said Agridime sold $9 million in 18 cattle contracts to North Dakota residents since the issuance of the cease and desist order in May. Agridime also sold $1 million in cattle contracts to Arizona residents since a similar order was issued there on April 18, 2023, and an Agridime salesman there admitted under oath on Oct. 18 that he still was selling contracts in Arizona. The state of Arizona in November filed a contempt motion against Agridime and Link. Tyler issued another cease and desist order in North Dakota on Dec. 15 against Taylor Bang of Killdeer, which alleged that Bang, despite not being registered as an agent with the Securities Department, had received $6,055,390 in "transaction based commissions by selling unregistered cattle investment contracts on behalf of Agridime in or from North Dakota" from Jan. 1, 2021, through Oct. 30, 2023. Under North Dakota law, the North Dakota Securities Commissioner can assess civil penalties of $10,000 per violation of the Securities Act. Bang said he's always approached his business honestly and was simply taking direction from Agridime. “I was just doing a job.”  Bang disputes the claim that he made more than $6 million in commissions from Agridime. He said that figure is “way high” and that he wasn't sure how the Securities Department arrived at that number. The Securities Department says it calculated the figure from subpoenaed financial records. Bang said he was aware of the May cease-and-desist order the North Dakota Securities Department filed against Agridime and Link, but that as far as he could tell, the company took the legal demands outlined in the orders seriously and was working to address them. The rancher said he's worked with Agridime for roughly seven or eight years. He said he still thinks very highly of the company and is proud to support the American livestock industry.   “To date, I have not had one person that has done this, as far as the cattle-purchasing contracts, not get paid on time,” Bang said. In the Dec. 15 order, Tyler ordered Bang to turn over all commissions received from Agridime, to be deposited into the North Dakota Investor Restitution Fund and to be liable along with Agridime to Agridime investors. LUCKY 7 ANGUS In 1895 James Jensen started a five-generation ranch, from which came Lucky 7 Angus. That first winter he lived in a dug out on the side of a hill and shoveled snow off the grass to feed his 3 horses and 7 cows in what is called the Nation's Icebox, Boulder, Wyoming. We know very well the blood, sweat and tears it takes to keep the family ranch afloat. And that is why we take it very seriously that our customers are the most profitable in the livestock industry. Lucky 7 Angus was started in order to raise bulls that could hold up better for commercial cattlemen, such as ourselves. We have accomplished the goal... For the past 30 years we have been unmatched in raising cows and bulls in tougher conditions than the rest of the industry, which has made the most durable bulls for our customers. We were the first seedstock operation to set minimum standards for PAP testing. The number of animals tested with these standards, are unmatched in the industry, which helps our customers with less sickness and death loss. We were the first seedstock operation to test for feed efficiency in real world conditions.
