Have a comment or question? Click this sentence to send us a message, and we might answer it in a future episode.Welcome to Season 6, Episode 12 of Winning Isn't Easy. In this episode, we'll dive into How Disability Carriers Manufacture Reasons to Deny Claims.Imagine qualifying for Long-Term Disability benefits, only to have your insurer cite a vacation, a college class, or a game of pickleball as proof you can still work. Surveillance footage, social media posts, and selective medical reviews can quickly become the basis for a denial you never saw coming. ERISA disability claims often turn less on diagnoses or surgeries and more on how insurers interpret daily activities, medical records, and how “stable” a condition appears on paper. Routine moments of normal life can be reframed as evidence of employability, while peer reviews, surveillance, and insurer-friendly standards of review are used to justify terminating benefits. In this episode, we explore how everyday activities are weaponized against claimants, how medical stability is reinterpreted to argue work capacity, and why courts sometimes uphold these denials despite serious medical conditions. If you're navigating - or trying to protect - an ERISA disability claim, this episode explains why careful documentation, precision, and strategy can make all the difference. In this episode, we'll cover the following topics:One - Can Taking an African Safari, Attending College Classes, and Playing Pickleball Destroy Your ERISA Long-Term Disability Claim? Two - How a Hartford ERISA Disability Claim for Rheumatoid Arthritis and Spine Surgery Played Out at the Any Occupation Stage of the ClaimThree - Is Discovery Allowed in an ERISA Disability Claim When the Carrier or Plan Has Created Reasons to Deny Your Claim?Whether you're a claimant, or simply seeking valuable insights into the disability claims landscape, this episode provides essential guidance to help you succeed in your journey. One bad day can rewrite your body, your plans, and your identity. Zach Delmonico lived that reality when a severe spinal curvature and a major surgery took him from being an active athlete to waking up in a hospital bed unsure if he could even move. What hits hardest is not the medical details, but the decision point: do you turn it into a lifetime excuse, or do you turn it into fuel for resilience, mindset, and real performance? We get into what most “motivation” content skips. Zach breaks down how he rebuilt himself with a simple framework he lives by: desire (the decision that ignites action), discipline (stacking small wins until momentum is real), and determination (pushing through pain, doubt, and the urge to quit). We also go deep on confidence and communication, how he reverse engineered his own social anxiety through studying psychology and tracking patterns, and why action beats inspiration every time. Then we call out the culture of rented success: flashy cars, staged lifestyles, and the trap of measuring your worth by what you can show. Zach shares how faith and gratitude keep him grounded, how he coaches people who feel stuck by shifting focus fast, and why his real definition of success is becoming “the original you.” If you care about authentic personal development, mental toughness, discipline, and building a life that holds up offline, this conversation is for you.If it resonates, subscribe, share it with a friend who needs a reset, and leave a review. Low back pain is the number one cause for disability in America. And for many of those people, spinal surgery feels like their only option. However, only a very small number of people with spinal problems should ever get surgery. This goes for disc issues, or stenosis, or most other causes of back pain. So, if you're considering spinal surgery, please do your due diligence and ask all of these questions at a minimum before considering any surgery whatsoever. In general spinal surgery does NOT come with a high success rate, and you MUST exhaust all conservative options before giving it a shot!

Do you have a negative view of spinal surgery? Dr. Ardavan Aslie is a Board Certified, Harvard University Fellow Spine Surgeon. During his first three years of practice, Dr. Aslie became aware of a significant challenge confronting patients who underwent spinal surgery. Solving this problem became Dr. Aslie's main priority and finally, after years of research and study, Dr. Aslie developed the laminar plating system. It was a pleasure to talk with Dr. Aslie, and I learned a ton about the evolution of spinal surgery and the challenges he faces in his field.
We often have no other choice than to trust the advice of our medical professionals – but what if there's a financial incentive? In this episode, we chat with Dr. Ardavan Aslie about this issue in the context of spinal surgery – and what he is doing to change it. Dr. Aslie is a Board-Certified Orthopedic Spine Surgery Specialist in Sacramento, CA with over 28 years of experience in his field. Freedom International Livestream May 17, 2022 Guest: Dr. Lee Merritt Topic: Your DNA, NATO and The Biolabs of United States www.themedicalrebel.com BIO: Dr. Lee Merritt began her medical career at the age of four, carrying her father's “black bag” on housecalls, along the back roads of Iowa. In 1980 she graduated from the University of Rochester School of Medicine and Dentistry in New York, where she was elected to life membership in the Alpha Omega Alpha Honor Medical Society. Dr. Merritt completed an Orthopaedic Surgery Residency in the United States Navy and served 9 years as a Navy physician and surgeon before returning to Rochester, where she was the only woman to be appointed as the Louis A. Goldstein Fellow of Spinal Surgery. Dr. Merritt has been in the private practice of Orthopaedic and Spinal Surgery since 1995, has served on the Board of the Arizona Medical Association, and is past president of the Association of American Physicians and Surgeons. She has had a long interest in wellness and fitness, and has been Fellowship Certified by the American Academy of Anti-Aging Medicine. At age 63 she won a female bodybuilding championship in Physique class—with a lot of help from her friends and patience of her family. As a lifelong advocate of free market, patient-centered medicine Dr. Merritt had the opportunity to appear on the John Stossel show to speak against Obamacare. More recently she has appeared on numerous radio programs discussing Covid-19, the futility of mask mandates, and other lies and omissions from the medical “technocrats”. Her recent speech at Doctors for Disaster Preparedness on “Sars-CoV2 and the Rise of Medical Technocracy” has been widely viewed on YouTube, and forwarded on by Dr. Mercola—one of her medical heroes. She is married and the proud mother of two sons, one of whom carries on the four generation medical tradition as a General Surgeon, and the other with a real job as an Electrical Engineer. In her spare time, Dr. Merritt raises chickens, gardens and enjoys a rural Midwest lifestyle.
