The Republican Fissures and Potential Third-Party Movements. Guest: Thaddeus McCotter. The discussion centers on Tucker Carlson's potential departure from the Republican Party over foreign policy disagreements. McCotter suggests this reflects deeper fault lines within the MAGA base, where isolationist tendencies and dissatisfaction with the administration's relationship with allies like Israel could lead to future political discord. 161936

So much good stuff this time around. Hasbro Fanstreams continue to be amazing, including never-before-seen product for once. How about those Classified Fatal Fluffies? Star Wars didn't disappoint either, at least for me, with those Remnant Snowtroopers. While I might already have them, the Deluxe Insecticon 3-Pack is simply beautiful. MOTU absolutely kills it with their latest Origins 200x wave. Including not only my favorite Evil Warrior, Trap Jaw, but also focus characters from my childhood, Sy-Klone and Man-E-Faces.

Jim Griffin went on national television after the Supreme Court ruling and said the defense has evidence nobody's seen — including an unknown male DNA profile found under Maggie Murdaugh's fingernails. He said it wasn't properly investigated. He said it changes the case. And now the defense walks into retrial with subpoena power and the ability to build a full third-party culprit strategy around it.Eric Bland has seen more of this case's financial discovery than almost anyone outside the AG's office. He's been watching the defense signal its strategy for weeks — the DNA claim, Harpootlian's argument that SLED had tunnel vision from night one, the push for a venue change and attorney-led jury selection. He knows what the prosecution has to work with now that the Supreme Court has limited the financial crimes presentation. And he's making a prediction that splits the difference: reconviction is likely, but a hung jury is possible. In this interview, Bland explains what makes the hung jury scenario real, whether the unknown DNA has the forensic weight to support an alternative suspect theory, and why Creighton Waters may be walking into a fundamentally harder case than the one he won. He also answers a question nobody else has put to him — whether anything in the financial records he's reviewed could be reframed by the defense in their favor. The lawyer who built the state's motive case gives his blueprint for trial two.Join Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/Want to comment and watch this podcast as a video? Third-party IVF is getting bigger, but are clinics actually getting better at it?Or are some efforts to streamline the process creating new risks for patients?Dr. Allison Bloom of Main Line Fertility and Dr. Daniel Shapiro of Reproductive Biology Associates (RBA) discuss what separates a clinic that offers third-party reproduction from one that truly excels at it.We dive into:The push to streamline third-party IVF (and where corners may be getting cut)The technology stack donor & surrogacy programs needThe gaps in today's EMRs and what needs to changeEmerging trends around known donorsNew thinking on anonymous vs. de-identified donationOne thing each physician believes clinics should start (or stop) doing to become a third-party IVF powerhouseAs third-party reproduction becomes more common, the operational, ethical, and technological challenges become harder to ignore.

"Third-party content drives 85% of brand discovery in LLMs." It's the GEO stat making the rounds on LinkedIn right now, and a lot of marketers are using it to argue that your own site content doesn't matter anymore- that GEO is really about getting mentioned everywhere else.We disagree. And we have client data that contradicts it.In this episode, Devesh and Benji break down where this narrative came from (an Air Ops post citing a Graphite study), where the methodology breaks down, and what we're actually seeing across our clients in Traqer.ai. The short version: big brands like Salesforce and Peloton skew studies like this because they already have category-level brand awareness. For smaller players like Toro TMS and Climb Hire, clients we've worked with where their own content is essentially all we've done, they're pulling strong brand mentions across ChatGPT, Perplexity, AI Overviews, AI Mode, and Gemini. That's not third-party publications doing the work.We also get into:– Why Perplexity, AI Overviews, and AI Mode behave differently than ChatGPT and Gemini (and what visibility numbers look like across each)– The growing evidence that LLMs may decide what to recommend from training data and a loose SERP read first, then find sources to cite after the fact– Why competitive categories (CRM, exercise bikes, content marketing agencies) need a different playbook than less-saturated ones– Why your own site is the only place with enough canvas to spell out the specific use cases, pain points, and customer types that LLMs match against real user conversationsReferenced posts: Invisible Prompts and Topic-Based GEOhttps://www.growandconvert.com/ai/invisible-prompts/https://www.growandconvert.com/ai/topic-based-geo/This is the companion to last week's episode on self-promotional listicles for SEO. Maryland Primary Day is June 23. Only Democrats and Republicans can participate in the primary elections, leaving out the fastest growing group, independent voters. The state-funded and state-organized primary ballot leaves out third parties while officials are elected only by 20-25 percent of voters. But three third parties are expected to be on the ballot in the November general elections. How do they see the state's politics? Sunil Dasgupta finds out from Andy Ellis, the Green Party's candidate for Maryland Governor. Music from Seth Kibel's brand new album, Clarinet Without A Net.

Click Here for the Review Guide: Performance, Conditions, Breach, Excuse, and Third-Party RightsIn this episode, we explore the high-stakes, real-world implications of contractual obligations—focusing on how performance is measured, when breaches occur, and how legal doctrines of excuse operate to handle impossible or unfair situations. Whether you're a law student, a legal professional, or simply interested in the mechanics of contract law, this breakdown delivers clarity on the nuanced ways law allocates risk amidst human unpredictability. Most construction projects, like pipelines, run into delays that threaten entire businesses—and many fail to grasp why performance timing is everything. This episode uncovers the real-world importance of performance, conditions, and breach, going beyond the theory to show how legal concepts translate into practice when stakes are high and delays costly.Imagine you're 58 days into a multimillion-dollar pipeline build, only 15 miles laid despite tight schedules and market volatility. Your contractor's progress seems impossible, and crucial deadlines are slipping away. This scenario highlights why understanding whether performance is due, excused, or breached can make or break you. We break down how to diagnose if a failure originates from broken promises or failed conditions—name-dropping the crucial distinction between promises and conditions, and how this impacts legal obligations in practice. You'll discover:The difference between express conditions—triggered by words like "if" or "provided that"—and constructive conditions, implied by law to facilitate fairness and order. How the "perfect tender" rule under the UCC demands absolute conformity for goods, and the exceptions that prevent economic sabotage. The multi-factor test for "substantial performance" and how courts evaluate whether project imperfections justify partial payment or total breach. The stark contrast between material breaches that justify cancellation, and minor deviations that require damages. When anticipatory repudiation allows the non-breaching party to act immediately, and the delicate timing around retraction and adequate assurances. How doctrines like impossibility, impracticability, and frustration of purpose serve as legal escapes when external forces make performance impossible or pointless. Why does this matter? Because ignoring these nuances can lead to catastrophic mistakes—either by hasty breach or unknowing acceptance of defective performance. The path to mastery lies in understanding the precise seismic shifts that turn promises into enforceable obligations, and breaches into strategic decisions.Whether you're a law student facing exams or a professional navigating high-stakes contracts, this episode arms you with clarity on performance and breach, ensuring you're prepared for real-world and test scenarios alike. Perfect for anyone who needs to decode contractual failure and navigate the fine line between compliance and breach, this is essential listening to see performance in a new light.Get ready to see through the chaos, master the performance grid, and approach breach law with confidence—and perhaps even a little daring.Key Topics:The distinction between promises and conditions and their impact on performance timingSubstantial performance doctrine in common law and perfect tender rule under the UCCClassifying breaches: material versus minor, and their remediesAnticipatory repudiation: how clear refusals to perform can be addressed earlyThe doctrines of impossibility, impracticability, and frustration of purpose as excusesHow third-party beneficiaries, assignments, and delegations influence contractual rights and obligationsCritical analysis of contractual modification standards under common law versus UCCThe importance of specificity in drafting, especially related to express vs constructive conditionsPractical exam tips: decoding contractual language, applying multi-factor analyses, and

Our biggest local con starts today, Fan Expo Denver. Over the past 10+ years, it has become a juggernaut. Some highlights this year, for me at least, include a pretty comprehensive Scream and Goonies reunion, most of the cast of The Boys, all the Hobbits, and a huge amount of voice actors, including Michael Bell, Peter Cullen, Frank Welker, and Matthew Wood. It has ballooned to a 4-day event. We'll do our shopping early today, then we do panels most of the time, and we'll squeeze in the exhibit floor as we have time. One of our favorite things to do is hit up celebrity row. Or I should say rows, nowadays. Since we're not big autograph people, we're too cheap, we love just walking that area and seeing our favorite celebs interacting with fans, hanging out, or even just being on their phones.
Guests: Gal Ordo, Co-founder & CPO @ Native Topics: In Episode 186, we debated 'Native vs. Third-Party' as a binary choice. Native seems to be a third-party vendor whose entire existence depends on the belief that cloud-native controls are superior. Does your platform validate the 'Cloud Provider' side of the debate (that their controls are enough), or does the fact that you exist prove the 'Third-Party' side (that native interfaces aren't enough)? A key argument against native controls is an AWS WAF and a Google Cloud Armor don't behave the same way. If your tool manages native controls across multi-cloud, how do you handle the 'lowest common denominator' problem? Do you dumb down the policy to fit all clouds, or do you expose the unique complexity of each one? GuardDuty and SCC produce similar but meaningfully different results. How do you abstract across that so an analyst or IR team isn't having to dig into the exact meaning of the different JSON fields in their output? We often say native tools are 'good enough' for 80% of use cases but lack the depth of specialized third-party vendors (like a dedicated CNAPP or DLP). By betting your company on orchestrating native controls, are you effectively betting that 'good enough' is the future of the market? What happens when a customer needs a feature that the CSP hasn't built yet? What fraction of your users are taking this from a "I'm 80% this one cloud, I need great coverage there and good enough elsewhere" vs "I'm truly multi-cloud" or even scarier "I have a workload that is active spanning clouds"? Do your customers push you towards helping with the kinds of SaaS platforms that SSPM vendors cover? If AWS and Google Cloud suddenly decided to make their native security UIs perfect and unified tomorrow, would your company cease to exist? Or is the complexity of the cloud strictly increasing, guaranteeing you job security forever? Related: Video version EP186 Cloud Security Tools: Trust the Cloud Provider or Go Third-Party? The defense attorneys went on the Today show and dropped a phrase designed to land exactly the way it landed: “third parties and potential motives.” They said people have been bringing them information. They said the Supreme Court reversal gives them subpoena power they didn't have before. Then they stopped talking.Tony Brueski and Robin Dreeke work through the listener question this raises: Why go public with this before filing a single motion? If you have evidence of another suspect, the courtroom is where that evidence belongs—not a morning show couch. So what's the strategy?Robin breaks it down through two lenses. First: is this genuine? The evidence pattern supports the question—two weapons, no recovery, a defendant who used Curtis Eddie Smith for the roadside scheme. Alex's operational history is one of delegation. Second: is this theater? Floating a third-party theory in media before trial shapes the narrative before a jury is even selected. The conversation pushes into what the prosecution would need to prepare for if the defense walks into trial two with a completely different version of what happened that night. Tony and Robin follow the thread wherever the listener questions take it.Join Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/Want to comment and watch this podcast as a video? Luckily, I'm out of the reselling mindset and just get to care about things I love. Star Wars showed me a lot of love in their latest Fanstream, but nothing like their SDCC TVC Clone Wars homage. The Masters movie is showing off a ton of characters, but I absolutely love that they are featuring a focus character of mine. To see the movie Roboto in the Origins line so soon makes me very happy. The Transformers line I love the most is making Dinobots, and my boy Snarl is on the way. No Joe news this time around, but I'm still loving this TRU Acid Raid collab.
In this Medtech Matters podcast episode of Mike on Medtech with Mike Drues, president of Vascular Sciences, we're discussing the FDA's third-party review program. This option is available for certain 510k reviews. It is performed through an independent organization that is not part of the agency. As such, there are additional costs involved but the time savings could potential make up for that added expense. Other factors and considerations are also reviewed. During this conversation, the following questions are addressed:If I need to get a 510k clearance on my new medical device, is going through the FDA my only option?Under what circumstances should a sponsor consider using the third-party review program?Under what circumstances should a sponsor not consider using the third-party review program? How popular is the third-party review program, i.e., why are many people not familiar with it?Can you provide some examples of devices that have gone through the third-party review program. What advice would you provide in choosing which third-party review organization to work with? What are the key steps when considering using the third-party review program? When evaluating potential third-party review organizations, do you have recommendations on what questions to ask?Is there anything like the third-party review program outside the US, i.e. is there any regulatory precedent? What else is important, and what are today's takeaways?Listen to this discussion and see if you may have interest in the third-party review program. Review Guide: The OutsidersIn this episode, we break down how outsiders—people who never signed the original deal—can still acquire enforceable rights or obligations through various legal mechanisms. Whether you're a law student preparing for exams or a legal practitioner navigating modern contractual landscapes, understanding these core principles is essential. Most legal principles in contracts have a simple core—until the modern economy throws a wrench into the works. What happens when someone who never signed a deal ends up with the right to sue or the obligation to perform? In this episode, we demolish the outdated wall of privity and dive into the three pillars that shape outsiders' rights: third party beneficiaries, assignments, and delegations. You'll discover how the law now recognizes third parties as part of the original contract if they're present at formation, emphasizing the crucial difference between intended and incidental beneficiaries. We'll break down the key concepts like vesting—when rights lock in—and the subtle, highly-tested distinction between creditor and donee beneficiaries, illustrated through landmark cases like Lawrence v. Fox and Siever v. Ransom. Learn how courts determine whether outsiders can enforce promises, and why even a straightforward gift—like a life insurance policy—gives a third party direct legal standing. Then, we shift gears to post-formation transfers: how rights are assigned (transferring the prize) and duties delegated (passing the homework). You'll get clear frameworks for identifying valid assignments—highlighting the UCC's special rules that override typical contract limits for commercial transactions—and how notice affects obligation. Delegation mechanics are also demystified: why delegating a duty doesn't mean escaping liability, and how novations—an explicit, three-party agreement—can set a delegation aside altogether. This episode explores the tightrope walk between facilitating free commerce and safeguarding original contractual expectations. Whether it's a novice law student or a seasoned practitioner grappling with AI and smart contracts, these insights will sharpen your understanding of how outsiders gain enforceable rights in our complex legal ecosystem. Finish with a mental checklist to decode multi-party contract puzzles — because in the real world, relationships are messier than any textbook.Perfect for anyone preparing for exams or navigating the modern legal landscape, this episode unlocks the core principles that turn chaos into clarity and legal theory into practical mastery. The future of contracts hinges on mastering how outsiders fit into the picture—and this is your essential guide.Key topics:The fundamental difference between intended and incidental beneficiariesHow rights vest and the significance of timing and relianceThe three pillars: third-party beneficiaries, assignments, and delegationsHow contracts can be transferred after formation—practical rules and exceptionsThe liability implications of delegation, including novationThe crucial role of notice in assignment of rightsThe UCC's impact on the enforceability of contractual prohibitionsThe distinction between assignment of the prize and delegation of dutiesCommon exam traps involving ambiguous language and how courts interpret vague assignmentsA comprehensive diagnostic workflow for analyzing complex multi-party contract scenarios
I completely Star Warsed myself out yesterday. If you're in the group or follow me, you probably got a lot of spam about what I was watching all day. However, as I write this, I'm watching the third Family Guy Star Wars special, It's a Trap. Why? I have mild OCD and must finish a 3-part series after watching the first two parts. It truly is a sickness. With that being the case, I really don't want to write a whole post because I do truly love these.

Third-party lead generation has a reputation—and most of it comes from firms doing it wrong. Anthony Bux has spent two decades inside the system, from building lead gen companies to managing massive intake operations. Now, he helps PI firms avoid the expensive mistakes: testing vendors, validating compliance, and making sure firms don't burn cash on leads they can't convert. This episode shows where the real breakdown happens, and how to fix it. If you're ready to build that foundational brand equity, dominate search, and own your market, head to Rankings.io. On this episode, you'll learn: The real math behind lead costs, conversion rates, and case value. Why cold leads require a completely different intake process than a warm referral. How to spot (and avoid) aggregators selling the same lead multiple times. The minimum budget and timeline required to actually test lead gen. If you like what you hear, hit Subscribe. Rob shares how his firm grew to nearly $1 billion in Texas multifamily assets, why vertical integration gives operators more control, and where many investors misunderstand underwriting. He also explains why AI may improve operational efficiency more than underwriting itself, how strong investor relationships are built over time, and why tax strategy remains one of real estate's biggest advantages. Millions of people take a multivitamin every single day believing it's protecting their health. It's marketed as the ultimate safety net, one capsule that covers all your nutritional bases. But almost nobody is asking the most important question: What's actually inside the finished product? Multivitamins are concentrated compounds that directly affect your physiology. And if those capsules are contaminated, mislabeled, degraded, or poorly sourced, you could be exposing yourself to harmful substances every single day. Heavy metals like lead, arsenic, cadmium, and mercury can accumulate in the body over time, especially with daily supplementation. Yet in the supplement industry, there is no universal requirement for brands to show independent third-party testing of their finished products. So instead of trusting marketing claims, labels, or influencer recommendations, Dr. Christian Gonzalez went directly to the source. He contacted 45 multivitamin companies with one simple request: Provide third-party batch testing and a Certificate of Analysis (CoA) showing what's actually in the final product. The results were alarming. Most companies either refused to provide documentation or never responded at all. In this episode, Dr. G breaks down: • Why finished-product testing matters more than raw ingredient testing • The hidden risks of heavy metals and contaminants in supplements • Why many multivitamins fail basic transparency standards • The difference between label claims and verified potency • How heavy metals can accumulate in the body with daily exposure • The four brands (out of 45) that passed strict transparency and testing criteria This episode isn't about attacking companies; it's about accountability and transparency. If you take a multivitamin every day, understanding how supplements are tested (or not tested) could have a major impact on your long-term health.
